Abstract

The Constitutional Court seems inconsistent when examining the same legal issue, i.e., the constitutionality of the minimum married age limit for women, but with different decisions. In the 2014 decision, the Court rejected the petition, while in the 2017 decision, the Court accepted it. This paper analyzes the considerations of constitutional judges in deciding the case to understand whether women’s constitutional rights have been protected in both decisions. Using the case and statutory approach, this article concludes that the 2014 decision rejecting the petition to increase the minimum married age limit for women does not fulfill women’s constitutional rights. Sixteen years old as the minimum age limit for women and nineteen years for men is discriminatory and deprives girls’ rights to health and education. The judges’ consideration in the 2017 decision, which granted the petition, was that determining the minimum married age limit is a legal policy. Still, if the policy contradicts the 1945 Constitution, citizens can challenge its constitutionality. The Marriage Law is a past product, so it needs to be adapted to developments and the 1945 Constitution’s norms. The difference in the Constitutional Court’s decisions on examining the same issue is due to different interpretations and efforts to protect the constitutional rights of citizens.

Abstract

This article is to discuss the impact of legal reform project between Indonesian and Australian government in assisting women, the poor and those living in remote areas to access the judiciary in Indonesia. Through the program access to the Religious Courts for divorce cases, for example, women are able to document their role as female heads of household. The document is necessary to facilitate access to the Indonesian Government pro-poor programs such as cash transfers, free health treatment, subsidized rice or enrolment of children at state schools. This article argues that the access to justice program in Religious Courts has positive impacts on gender equity development in Indonesia. This argument is based on AmartyaSen’s conception of development that must go well beyond “the accumulation of wealth and the growth of gross national product and other income-related variables.” Thus, the process of development is really all about removing “the unfreedoms” from which the members of society may suffer. Access to the Religious Courts program for women, the poor and marginalized groups, which was initially supported by the Australian Government through its agencies, has “opened” Indonesian government mind on how to address obstacles in removing “the unfreedoms” of gender discrimination caused by the family laws.

Abstract

Criminal law deals with the protection of public interests and values deemed to be crucial for a particular society. In Islam, these values are ascribed to the divine commands. Thus, there will be calls from some Muslims for the implementation of Islamic criminal law by the state for they believe that this is required by Islam. Can therefore the death penalty or corporal punishments required by the Shariah law be imposed by a state while they are in conflict with the state’s obligation to comply with international human rights instruments? This paper will analyze this uneasy situation faced by some Muslim countries implementing Islamic criminal law but party to the ICCPR and CAT. It aims at verifying that an extreme universalism or cultural relativism approach regarding the validity of international human rights norms on this matter is insufficient. This is because Islamic doctrines strongly influence Muslims on this matter and failure to seriously engage them will lead to rejection of international human rights instruments which are important for protecting individual rights. This paper argues that an approach that is able to reconcile the requirements of Shariah law regarding criminal punishments and those of international human rights norms is necessary.

Abstract

This paper aims to examine the roots, dynamics, and resolutions of land conflict between Rengas farmers and Limbang Jaya farmers with PTPN VII Cinta Manis in Ogan Ilir, South Sumatra. Authors use qualitative method through deepening data from depth interviews, observation and Focus Group Discussion (FGD). The results showed that the roots of the conflict are different foundation claims, lack of transparency in the mechanism of compensation, land grabbing by companies. The key findings of the conflict dynamics study was that conflict between farmers of Rengas with PTPN VII Cinta Manis led to reclaiming action by farmers which was regarded as a victory for the resistance of farmers in conflict. This reclaiming action attracted more regions into the conflict contestation, including farmers of Limbang Jaya. Rengas conflict and Limbang Jaya conflict was different: Rengas conflict had history of resistance since the beginning, while the conflict of Limbang Jaya was an escalation of the Rengas conflict. Conflict resolution was taken through advocating by civil society element and mediation by stakeholders. Both resolutions approaches have not been able to provide a sustainable resolution, due to advocacy efforts tend to be a massive confrontation, while mediation was only a procedural matter not a substantive matter.

Abstract

Currently, the level of digital literacy in Indonesia still needs to be improved. In the ever-growing digital era, digital literacy is a critical skill and knowledge for society. This research aims to explore the literacy policies implemented and the challenges faced by the government in supporting increased literacy in digital governance in Indonesia. This study uses a qualitative approach using Online Research Methods (ORMs) as a data collection method. The analysis tool that is maximized is Nvivo 12 Plus. The findings of this research show that digital literacy plays an essential role in ensuring the active participation of citizens in governance, efficiency of public services, growth of the digital economy, and security in the digital environment. Strong digital literacy is essential for Indonesian society because it allows better access to online services and bridges the public into an era of ever-growing digital democratization. This condition could make Indonesia ready and adaptive to the progress of the digital era. However, the implementation of digital literacy policies is also faced with several inhibiting factors, such as disparities in access and infrastructure, economic and social challenges, lack of education and training, lack of research and data, lack of involvement and coordination between parties, rapid technological changes, including the framework regulations that are not yet fully accommodating. Therefore, Indonesia needs adaptive policies to overcome these obstacles so that digital literacy can increase evenly.

Abstract

The Narrative Policy Framework (NPF) has emerged as an indispensable instrument in public policy research, influencing the design, development, and implementation of diverse policies across multiple domains. Despite its growing application and influence, a thorough analysis and comprehension of its scholarly evolution and inter-disciplinary impact remain elusive. This study addressed this deficiency by conducting a comprehensive bibliometric analysis of the NPF literature. We extracted and analyzed 178 documents from the Scopus database using the Bibliometrix R utility. The results demonstrate a substantial increase in NPF research over the years, as evidenced by the growing number of affiliations and collaborations between researchers and institutions. In addition, the co-occurrence network analysis uncovered a number of research themes and clusters, providing valuable insights into the NPF research focus. Additionally, the study traced the thematic evolution of the research domain over time, revealing significant shifts and trends in research topics. Our findings suggest that the scholarly landscape of NPF research is diverse, complex, and dynamic, spanning multiple academic disciplines and policy domains. In addition to enhancing our comprehension of the NPF research ecosystem, the results of this study provide valuable insights for future research directions and policy applications.
