Abstract

Restorative Justice is utilized as an approach to resolve criminal cases involving offenders, victims, families, and relevant parties to seek a fair resolution, prioritizing rehabilitation over retribution. The Guidelines for Narcotics Rehabilitation based on Restorative Justice guide Prosecutors in the stages of pre-prosecution, prosecution, and rehabilitation supervision. In practice, there are differences in the interpretation and application of the dominus litis principle by Prosecutors in handling narcotics cases with a restorative justice approach. The limitations in understanding and applying the dominus litis principle can affect the consistency and uniformity of rehabilitation policies provided by the Prosecutor's Office in narcotics criminal cases. Moreover, this issue can also lead to inconsistent treatment of narcotics defendants in need of rehabilitation. The issue concerning the authority of the prosecutor's office in implementing rehabilitation policies in narcotics criminal cases with a restorative justice approach and enforcing the law in narcotics criminal cases with a restorative justice approach. This research method employed a normative juridical research type using legislative and conceptual approaches as the basis for analysis in addressing the issues. The conceptual approach used includes the concept of narcotics rehabilitation by the Indonesian Prosecutor's Office based on theories of authority and law enforcement, serving as analytical tools in addressing the issue of prosecutor's authority in law enforcement rehabilitation in narcotics criminal cases. In conclusion, the Prosecutor's Office has the juridical authority to conduct rehabilitation in narcotics criminal cases with a restorative justice approach. This is regulated in the Indonesian Prosecutor's Regulation Number 18 of 2021. Prosecutors play a central role in controlling cases, from investigation to court judgment execution, based on the dominus litis principle. Public prosecutors have a significant role in ensuring that medical and social rehabilitation efforts are carried out appropriately by designated rehabilitation institutions or health services, as well as in issuing warnings and taking further action if suspects fail to comply with the prescribed rehabilitation process. Law enforcement in cases of narcotics abuse requires a thorough understanding and strict application of the requirements based on the Indonesian Prosecutor's Regulation Number 18 of 2021

Abstract

Presiden Republik Indonesia menetapkan Peraturan Presiden Nomor 38 Tahun 2015 tentang Kerjasama Pemerintah Dengan Badan Usaha Dalam Penyediaan Infrastruktur yang bertujuan untuk Mencukupi kebutuhan pendanaan secara berkelanjutan dalam Penyediaan Infrastruktur melalui pengerahan dana swasta. Namun dengan adanya Perpres tersebut menyebabkan adanya celah hukum bagi BUMN/BUMD untuk melakukan praktik persaingan usaha tidak sehat. Penelitian ini merupakan penelitian yang bersifat yuridis normatif dengan obyek yang diteliti adalah asas-asas hukum dan kaidah-kaidah hukum yang masih berlaku namun juga didukung dengan data empiris. Hasil penelitian menunjukkan bahwa pengaturan larangan monopoli persaingan usaha dalam tender proyek KPBU yaitu adanya larangan tindakan post bidding yang merupakan tindakan mengubah, menambah, mengganti dan/atau mengurangi dokumen pengadaan dan/atau dokumen penawaran setelah batas akhir yang telah ditetapkan masih terjadi. Dalam hal ini KPPU tidak mengatur tentang post bidding hanya saja KPPU dapat memutuskan tindakan post biding yang terjadi dalam kerjasama pemerintah dan badan usaha terkait pengadaan barang dan jasa apabila melakukan persekongkolan tender.

Abstract

Era digital menuntut inovasi pembelajaran Bahasa dan Sastra Indonesia untuk meningkatkan literasi kreatif siswa. Penelitian ini mengkaji integrasi sastra profetik dalam e-modul interaktif menulis cerpen sebagai strategi pembelajaran yang tidak hanya mengasah keterampilan menulis, tetapi juga menanamkan nilai-nilai profetik, yakni humanisasi, liberasi, dan transendensi. Metode penelitian yang digunakan adalah Research and Development (R&D) dengan mengadaptasi model Borg & Gall yang disederhanakan menjadi tujuh tahap: analisis kebutuhan, perencanaan, pengembangan produk awal, uji ahli dan praktisi, revisi produk, uji lapangan, dan revisi produk akhir. Subjek uji coba meliputi ahli materi, ahli media, praktisi (guru), dan siswa kelas XI SMA. Data dikumpulkan melalui wawancara, angket, dan observasi, kemudian dianalisis secara kualitatif dan kuantitatif. Hasil validasi ahli materi menunjukkan kelayakan 95,45%, ahli media 95%, uji praktisi (guru) 93,25%, dan uji lapangan (siswa) 86,44%. E-modul dirancang dengan memanfaatkan teknologi digital melalui fitur kuis, video pembelajaran, dan permainan literasi yang mendorong siswa aktif berkarya. Hasil kajian menunjukkan bahwa integrasi sastra profetik dalam e-modul mampu meningkatkan keterampilan menulis cerpen sekaligus menumbuhkan kesadaran kemanusiaan, kebebasan berpikir, dan spiritualitas siswa. E-modul interaktif berbasis sastra profetik menjadi inovasi pembelajaran yang kontekstual, menarik, serta relevan bagi generasi digital, sehingga berpotensi memperkuat pendidikan karakter dan literasi nilai pada peserta didik. Sastra profetik dapat menanamkan nilai spiritual dalam proses kreatif, menjadikan cerpen sebagai media refleksi sekaligus transformasi sosial yang relevan dengan pendidikan karakter abad ke-21.

Abstract

Purpose: The purpose of this study is to identify the factors that influence business sustainability, especially in micro and small businesses in Greater Jakarta. Methodology: The research employed a quantitative descriptive method using primary and secondary data. Primary data were collected through a 1–5 Likert scale questionnaire completed by employees of micro and small businesses in Greater Jakarta. Secondary data were sourced from relevant studies in reputable academic databases. The population size was unknown, and 131 respondents were selected using simple random sampling based on the Hair formula. Data were analyzed with SmartPLS 4.1.0.0 using outer model, inner model, and hypothesis testing. Results: The study on Micro and Small Enterprises in Jabodetabek reveals that management support and self-efficacy have positive and significant effects on employee performance and business sustainability. Employee performance also significantly influences business sustainability and plays a mediating role in strengthening the effects of management support and self-efficacy. These findings highlight the importance of managerial support and individual confidence in improving performance outcomes and ensuring sustainable business growth. Conclusions: The findings indicate that management support and self-efficacy significantly enhance employee performance and business sustainability in the land transportation sector. Employee performance serves as a key mediating factor that strengthens the impact of management support and self-efficacy on business sustainability. Limitations: This study is limited to examining the sustainability of micro and small businesses operating in the Greater Jakarta area, which may restrict the generalizability of the findings to other regions or business scales. Contribution: This study plays a role in identifying factors that influence the sustainability of micro and small businesses in Greater Jakarta, focusing on factors such as employee performance, management support, and self-efficacy.

Abstract

Building high-performance teams is essential dynamic and competitive organizational environment. Success in teams is shaped not only by the capabilities of individual members but also by effective leadership and a supportive organizational culture. This study aims to explore the interplay between leadership, competence, and organizational culture in fostering high-performance teams. Specifically, it examines how these three factors interact and collectively influence team effectiveness within organizations. Adopting a literature review approach, the study analyzes a range of relevant scholarly sources to develop a comprehensive understanding of the topic. Findings suggest that transformational leadership plays a pivotal role in inspiring and motivating team members to deliver optimal performance. In addition, individual competence encompassing both technical skills and soft skills provides a solid foundation for team success. A collaborative and innovative organizational culture further enhances synergy, enabling teams to excel in complex and changing conditions. The study concludes that the integration of leadership, competence, and organizational culture is vital for creating high-performance teams and ensuring sustainable organizational growth.

Abstract

Criminal liability for online gambling is regulated in the provisions of Article 45 paragraph (3) of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions. If a criminal act is committed by the Company, it is linked to the provisions of Article 52 paragraph 4 of Law Number 11 of 2008 concerning Electronic Information and Transactions, with a prison sentence plus two-thirds of the principal penalty. The objectives of this research are: first, to examine and provide legal solutions regarding criminal regulation of corporations in carrying out online gambling approaches from the criminal justice system in Indonesia; secondly, examining criminal responsibility for corporations in online gambling, the approach of the criminal justice system in Indonesia. The results of the research show that the prison sentence provisions in Article 45 paragraph 3 of Law Number 1 of 2024 are more severe than the criminal provisions in Article 45 paragraph 1 of Law Number 11 of 2008. There is a maximum limit of 10 (ten) years in Article 45 paragraph 3 of Law Number 1 of 2024, and 6 (six) years in Article 45 paragraph 1 of Law Number 11 of 2008. Despite this increase in prison sentences has increased, but the additional prison sentence period has not been maximized. The prison sentence should be increased further, so that it has a deterrent effect in enforcing the criminal law on online gambling. In fact, legislators should set a minimum limit for criminal perpetrators of online gambling.

Abstract

Abstract : The definition of trial in absentia is to try without the presence of the defendant in the trial. In Indonesian law, courts in absentia can be applied to cases of road traffic violations, economic crimes, subversion and corruption.In the judicial process in absentia by the military court against suspects whose members of the military are absent or fleeing, those concerned can be processed using Law Number 39 of 1947, Article 86 and Article 87 concerning Amendments to the Army Criminal Code.The purpose of this study is to analyze, explain the implementation of the decision of the military court in absentia against members of the military who deserted and to analyze, explain the arrangements for the implementation of the decision of the military court in absentia against members of the military who deserted.This research is included in normative juridical research. The normative juridical research method is a method or method used in legal research which is carried out by examining existing library materials. The data used is secondary data. While the collection of legal materials is done by reviewing and collecting library materials and the analysis method is carried out by qualitative descriptive methods.From the results of the study, it can be concluded that based on the Decision that the Researcher reviewed, namely Decision Number 125-K/PM.II-09/AD/VIII/2021 and Decision Number 87-K/PM I-03/AD/IX/2021 it can be seen that the Implementation of the Military Court Decision this cannot be implemented. Abstrak : Persidangan in absentia ialah mengadili tanpa kehadiran terdakwa dalam persidangan.Dalam hukum Indonesia peradilan in absentia dapat diberlakukan pada kasus-kasus pelanggaran lalu lintas jalan, tindak pidana ekonomi, subversi dan tindak pidana korupsi.Dalam proses peradilan in absentia oleh peradilan militer terhadap tersangka yang anggota militer tidak hadir atau melarikan diri, kepada yang bersangkutan dapat diproses dengan menggunakan Undang-Undang Nomor 39 Tahun 1947 Pasal 86 dan Pasal 87 tentang Perubahan Kitab Undang-Undang Hukum Pidana Tentara.Tujuan penelitian ini adalah untuk menganalisis, menjelaskan Pelaksanaan Putusan Pengadilan Militer In Absentia Terhadap Anggota TNI yang Desersi dan menganalisis, menjelaskan pengaturan Pelaksanaan Putusan Pengadilan Militer In Absentia Terhadap Anggota TNI yang Desersi.Metode yang digunakan dalam Penelitian ini adalah penelitian yuridis normatif. Metode penelitian yuridis normatif adalah metode atau cara yang dipergunakan di dalam penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka yang ada. Data yang digunakan adalah data sekunder.Sementara pengumpulan bahan hukum dilakukan dengan mengkaji dan mengumpulkan bahan pustaka serta metode analisa dilakukan dengan metode deskriptif kualitatif.Dari hasil penelitian, dapat ditarik kesimpulan bahwa berdasarkan Putusan yang Peneliti kaji yakni Putusan Nomor No 125-K/PM.II-09/AD/ VIII/2021 dan Putusan No. 87-K/PM I-03/AD/IX/2021dapat dilihat bahwa Pelaksanaan Putusan Pengadilan Militer ini belum dapat dilaksanakan. Abstract

Through a bibliometric analysis, this study examines the development, patterns, and key trends in implementing game-based learning (GBL) within physical education. Despite the growing interest in GBL across various educational domains, its application in physical education remains underexplored and fragmented. To address this gap, a bibliometric analysis was conducted on 29 peer-reviewed journal articles indexed in Scopus and published between 2014 and 2024. The articles were systematically selected from an initial pool of 330 records using predefined inclusion and exclusion criteria. Data were analyzed using VOSviewer and CiteSpace to examine co-authorship networks, keyword co-occurrence, citation patterns, and publication trends. The results indicate a consistent increase in GBL-related research in physical education over the past decade, with notable contributions from Indonesian scholars. Key clusters include character development, digital media integration, cooperative learning, and motor skill enhancement. Highly cited articles emphasize the relevance of combining digital platforms such as YouTube and gamified instructional strategies to improve students' engagement and fundamental movement skills. However, challenges persist, particularly in technological access and educators' digital competencies. This study contributes to the literature by offering a comprehensive map of the research landscape and highlighting emerging gaps and opportunities for future inquiry. The findings imply that when effectively designed and supported, GBL can enhance physical, cognitive, and social-emotional outcomes in physical education. These insights are relevant for curriculum developers, policymakers, and educators seeking to modernize physical education through innovative, inclusive, and engaging pedagogical approaches in the digital era.

Abstract

Acts of bullying committed by children often lead to criminal acts, if the bullying is not immediately known and controlled by other parties. The bullying that is often carried out by children against their friends is triggered by various things. Criminal acts committed by children certainly cannot be equated with criminal acts committed by adults. The role of criminology is very important to find out the cause of a person committing a crime and criminology can also find out how to overcome the problem of these crimes. Behind it all, of course, the role of family, peers, teachers and the environment is very influential.

Abstract

Narcotics are a global threat that requires comprehensive legal action, particularly in Indonesia and Thailand, as strategic areas for illicit trafficking. This study aims to analyze the comparative regulations, investigative methods, and effectiveness of law enforcement against narcotics crimes in both countries. The research method used is normative juridical with a legislative, conceptual, and analytical approach through secondary data from reports from 2024-2026. The results show that Indonesia maintains a strict policy with the threat of the death penalty but has begun to adopt restorative justice through Law No. 1 of 2023 and Prosecutor's Regulation No. 18 of 2021. In contrast, Thailand has undertaken a radical transformation through the Narcotics Code BE 2564 , which prioritizes public health and the decriminalization of certain substances. In practice, Indonesia excels in specialized investigative techniques, while Thailand is effective in border operations and asset seizures. In conclusion, both countries are transitioning from a punitive approach to a system that better balances legal and health aspects. The success of law enforcement in the future depends heavily on the integration of financial intelligence to impoverish drug lords and the effectiveness of rehabilitation in reducing recidivism rates, given the high number of suspects reaching tens of thousands each year in both regions
