Abstract

This study aims to analyze and explore legal protection for adopted children in the perspective of Law Number 23 of 2002 concerning Child Protection, by linking it to the hifdz al-nasl thinking according to Imam Al-Ghazali. Adoption in Indonesia is regulated by law to ensure the protection of the rights of adopted children, including the right to education, health, and inheritance. However, there are still various challenges in the implementation of adoption, such as the lack of public understanding of legitimate procedures and the existence of illegal adoption. In the context of Islamic family law, Imam Al-Ghazali's thinking on the protection of adopted children emphasizes the importance of maintaining the honor and welfare of children, although it does not change the status of their descendants. Protection of adopted children according to Al-Ghazali includes physical, social, and emotional aspects, and prioritizes the principle of hifdz al-nasl or protection of descendants. This study suggests the need for increased legal counseling and wider access to justice to improve the practice of adoption in Indonesia, as well as optimizing protection for adopted children so that they can grow up with their rights guaranteed. This study integrates the positive law approach and Islamic thought to provide a comprehensive picture of the protection of adopted children in Indonesia.

Abstract

The numerous cases of household violence in Indonesia suggest that the state still has significant work to do in addressing it. Despite having its claim laws, it appears that their execution still has deficiencies. The purpose of this paper is to examine how Islamic Law and Positive Law in Indonesia compare to Domestic Violence. A qualitative method with a normative approach is employed in this research. The research results show that the sanctions prescribed in Islamic law are based on the application of takzir, qishash, and diat. Meanwhile, positive law provides criminal sanctions and fines. The primary objective in criminal acts of physical violence within the family is to deter or punish the perpetrator so that peace and the progression of community life are maintained. The state plays a role in enforcing amar ma'ruf nahi munkar, including in household matters. The state is obliged to provide protection, services, and recovery for victims.

Abstract

Kegiatan edukasi pasar modal bagi penyandang disabilitas di Kabupaten Jember bertujuan untuk meningkatkan literasi finansial dan inklusi ekonomi di kalangan penyandang disabilitas, memberikan mereka pengetahuan dan keterampilan yang diperlukan untuk berinvestasi secara bijak di pasar modal. Program ini dilaksanakan melalui tiga tahap yaitu perencanaan, pelaksanaan, dan evaluasi. Program ini berhasil meningkatkan literasi finansial dan kepercayaan diri peserta dalam berinvestasi di pasar modal. Materi edukasi yang disampaikan mudah dipahami dan relevan dengan kebutuhan peserta, sementara alat bantu yang disediakan efektif dalam memfasilitasi pembelajaran. Meskipun program ini berhasil, ada beberapa keterbatasan, seperti durasi dan frekuensi sesi yang mungkin belum mencukupi, serta perlunya penyesuaian lebih lanjut pada materi edukasi. Kolaborasi dengan berbagai stakeholder berperan penting dalam kesuksesan program. Edukasi pasar modal bagi penyandang disabilitas di Kabupaten Jember berhasil mencapai tujuan utamanya. Untuk perbaikan di masa mendatang, peningkatan durasi sesi, pengembangan materi yang lebih variatif, dan perluasan jangkauan program disarankan untuk memastikan inklusi dan efektivitas yang lebih baik.

Abstract

Introduction: The kinship system in the Dayak Indramayu community plays an important role in determining the pattern of inheritance distribution. Unlike the patrilineal or matrilineal systems, which emphasize a single line of descent, the Dayak Indramayu community adheres to a bilateral kinship system that allows inheritance rights to be obtained from both the father and mother.Purposes of the Research: This study aims to analyze how the bilateral kinship system influences the pattern of inheritance distribution in the Dayak Indramayu community, emphasizing aspects of gender equality, recognition of adopted children, and its implications for social justice within the framework of customary law and national law.Methods of the Research: This study uses a qualitative-descriptive method with a socio-cultural legal approach. Data was collected through field observations, semi-structured interviews with traditional leaders and community members, and documentation studies. Data analysis was conducted using Miles and Huberman's interactive model, supplemented with normative-legal interpretations to understand the relationship between traditional norms, social values, and positive law.Results of the Research: The study found that the bilateral kinship system of the Dayak Indramayu produces a relatively egalitarian inheritance pattern by granting equal rights to both sons and daughters. However, there are still weaknesses in guaranteeing the rights of adopted children and the potential for conflict due to differences in interpretation between subgroups. The originality of this research lies in its recommendation to reformulate customary law to be more adaptive to contemporary principles of social justice and in line with the national legal framework.

Abstract

This study aims to examine the persial and simultaneous influence of firm size, sales growth, and profitability of capital structure. Where independent variables in this study is the size of the company, sales growth, and profitability while the dependent variable is the capital structure. The sample used is secondary data derived from the financial statements of textile and garment companies listed on the Indonesia Stock Exchange (IDX) period 2009 to 2014. This study uses secondary data from the company's financial statements. Samples and sampling using purposive sampling technique. The classical assumption test in this research includes normality test, multicollinearity test, heterokedastisity test and autocorrelation test. Data analysis using multiple linear regression analysis, t test, F test, and test of coefficient of determination. Data analysis using multiple linear regression analysis with SPSS 20. The results of this study indicate that firm size variables persial (t test) affect the capital structure, while the variable sales growth and profitability does not affect the capital structure of textile and garment companies listed on the Indonesia Stock Exchange. The simultaneous test results (f) show the significant effect of firm size variable, sales growth, and profitability on capital structure in textile and garment companies listed in Indonesia Stock Exchange. Abstract

This research is motivated by the urgency of legal protection for Muslim consumers in Indonesia through halal certification, in line with the enactment of Law Number 33 of 2014 on Halal Product Assurance (UU JPH). The main objective of this study is to analyze the implementation of the UU JPH in halal certification practices and evaluate its effectiveness from the perspective of maqashid syariah. This research employs a normative juridical method using statute, conceptual, and maqashid-based approaches, and utilizes primary, secondary, and tertiary legal data, analyzed descriptively and analytically using content analysis techniques. The findings show that the implementation of the UU JPH is a strategic step in providing legal certainty regarding the halal status of products circulating in Indonesia. However, its execution still faces challenges, such as the low preparedness of small business actors and the limited number of halal auditors. Institutional strengthening and public education are needed to ensure more effective and equitable halal certification. Furthermore, this study affirms that the obligation of halal certification serves as a form of protection for the constitutional rights of Muslim consumers, guaranteed by national law and reinforced by administrative and criminal sanctions for violators. From the perspective of maqashid syariah, halal certification not only functions as a formal legal mechanism but also serves as an instrument to safeguard the fundamental values of human life. It ensures product compliance with sharia principles, preserves faith, health, and community welfare, and prevents moral and economic harm.
