Abstract

This study's primary objective is to examine how Article 1337 of the Civil Code governs the boundaries of freedom of contract in Indonesian corporate contracts. This article aims to safeguard the parties' freedom to enter into agreements by preventing abuse that harms other parties or violates legal and moral standards. This research combines a normative technique with a legislative approach, closely examining primary, secondary, and tertiary legal texts to comprehend the application of Article 1337 in business practice. According to the findings, Article 1337 is crucial since it establishes explicit boundaries on contract freedom; yet, the efficacy of this provision is greatly reliant on the thoroughness of law enforcement and judicial interpretation. We identified subjectivity in determining public decency and order, along with an informational and power imbalance between the parties, as the primary obstacles to putting this article into practice. Therefore, consistent enforcement of the legislation and clearer standards are necessary for the fair and efficient enforcement of Article 1337.

Abstract

Transaksi jual beli melalui platform e-commerce seperti Shopee semakin diminati karena kemudahan dan efisiensi yang ditawarkan. Namun, kemajuan ini juga menimbulkan risiko bagi konsumen, seperti produk yang tidak sesuai deskripsi, penundaan pengiriman, hingga potensi penipuan. Seperti kasus penipuan yang terjadi di platform Shopee, yaitu kasus Via yang ditipu saat membeli merchandise K-pop, kasus Rona Afdilla yang juga ditipu saat membeli token Listrik melalui platform Shopee, dan juga kasus Putri yang juga ditipu saat membeli produk skincare yang tidak sesuai pesanan. Artikel ini bertujuan untuk mengkaji konsumen yang dirugikan dalam transaksi di Shopee, dengan fokus pada landasan hukum perlindungan konsumen di Indonesia, hak dan kewajiban konsumen serta penjual, serta prosedur penyelesaian sengketa. Penelitian ini menggunakan metode yuridis normatif, dengan pendekatan perundang-undangan dan analisis dokumen hukum terkait, seperti Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Peraturan Menteri Perdagangan Nomor 31 Tahun 2023 terkait e-commerce, serta ketentuan dan kebijakan platform Shopee. Data dianalisis secara kualitatif untuk memahami regulasi yang mengatur hak-hak konsumen dan kewajiban penjual, serta prosedur penyelesaian sengketa. Melalui studi kasus, dijelaskan bahwa mekanisme penyelesaian sengketa di Shopee belum sepenuhnya efektif, dengan beberapa konsumen merasa dirugikan. Rekomendasi yang dihasilkan antara lain perlunya perbaikan sistem penyelesaian sengketa, peningkatan tanggung jawab penjual, serta edukasi konsumen mengenai hak-hak mereka. Diperlukan revisi regulasi dan pengawasan yang lebih ketat untuk melindungi konsumen dari potensi penipuan di era digital ini.

Abstract

The aim of this program is to empower the community to make tuna pindang products, provide motivation to produce tuna pindang to help increase people's income and contribute to the development of tuna tuna business in Gampong Aceh. The methods to be used in Community Service activities are the observation method, practice method and lecture method. Community participation is very important in the success of this PKM program. It is hoped that the community will be able to take part in this activity starting with the desire to empower active and sustainable working groups of housewives, the community taking part in product manufacturing and packaging counseling, the community jointly making pindang cob products which will become their trademark from Gampong Aceh, Kabupaten Aceh Timur, and the community can market their products which extend to other areas. Problems in empowering the Gampong Aceh community to become a productive community in processing the available natural resources into superior products and are the hallmark of Gampong Aceh. The abundance of tuna has not yet been produced by doing pemindangan, by assisting the people of Gampong Aceh to make tuna processing into a savory variation of processed tuna fish, hopefully it will be in great demand by the community. After the cob fish processing is done, it will be packaged in attractive and hygienic packaging so that it becomes an attraction for the market share.

Abstract

Gampong Alue Dua Muka O, Idi Rayeuk District, East Aceh Regency is a coastal area, where the people work as fishermen who produce a lot of marine products, one of which is shellfish. Shellfish are sold raw directly to local markets, innovation has not yet been made into a processed food product, namely shellfish serundeng, which can be marketed widely. This is due to limited public knowledge of the processed food product shellfish serundeng (Sukera). The partner group comes from a group of PKK mothers who want to become new entrepreneurs. Community service to introduce shell serundeng (Sukera) as a product that can be developed and marketed and has the potential to increase community income. This community service has supported partner groups in Alue Dua Muka O Village to produce shell serundeng products, and understand product licensing, packaging design, copyright, business governance and marketing.

Abstract

Abstract This study aims to analyze the application of competition law principles in protecting traditional markets from the domination practices carried out by supermarkets, based on Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. The research method employed is a normative juridical approach by examining the protection of traditional markets from the dominance of supermarkets through the principles of competition law. The findings indicate that the presence of supermarkets located near traditional markets creates structural imbalances in terms of prices, product quality, services, and facilities. This condition drives changes in consumer behavior and weakens the competitiveness of traditional traders, thereby showing indications of unfair business practices, particularly in the form of predatory pricing and abuse of dominant position. Therefore, the Langsa City Government needs to strengthen the implementation of zoning policies, revitalize traditional markets, and provide empowerment support to small traders. Through these measures, a balance between modern retail investment and the protection of the people’s economy is expected to be achieved, thus realizing the principles of fair, equitable, and healthy business competition.

Abstract

Background: Caesarean section (CS) is a surgical procedure performed when vaginal delivery is not possible due to medical or non-medical indications. The increasing prevalence of CS worldwide has raised concerns regarding maternal and neonatal health. Objectives: This study aims to identify maternal factors contributing to the increased incidence of CS at Sitti Khadijah 1 Maternity Hospital, Makassar, for the period of January 1 – December 31, 2023. This research provides a unique contribution by analyzing CS prevalence and risk factors in a private Islamic maternity hospital, a setting underrepresented in national data. Furthermore, quantitative evaluation using multivariate analysis was conducted to determine the most dominant risk factors, supporting evidence-based prioritization in clinical decision-making and antenatal care planning in similar urban Indonesian contexts.Methods: A cross-sectional study was conducted using secondary data from medical records of mothers who delivered at Sitti Khadijah 1 Maternity Hospital in 2023. Maternal age, history of CS, premature rupture of membranes (PROM), gestational age, and preeclampsia were analyzed. Statistical tests included Chi-Square and multivariate analysis.Results: Of 341 deliveries, 300 (88.0%) were CS cases. Significant associations were found between CS and history of CS (p=0.004), preeclampsia (p=0.000), and PROM (p=0.000), while maternal age (p=0.751) and gestational age (p=0.183) were not significant. Mothers with a previous CS had a 99.0% likelihood of undergoing repeat CS. Preeclampsia strongly predicted CS, with 94.8% of cases delivered surgically. PROM was also a determinant, with 96.3% undergoing CS. Multivariate analysis confirmed history of CS as the strongest predictor (OR=19.689; 95% CI 2.589–149.737; p=0.004).Conclusion: History of CS, preeclampsia, and PROM are significant factors associated with CS. The risk of CS is significantly associated highest with history of CS. These findings highlight the need for improved maternal healthcare strategies to manage high-risk pregnancies and reduce unnecessary CS procedures.

Abstract

One effective method of controlling and eradicating infectious diseases that can cause death is through immunization. The level of immunization coverage and success is determined not only by the availability of vaccines, but also by community behavior. One factor is parents' knowledge and understanding of immunization. The method consisted of a pre-test, interactive counseling, a question and answer session, and a post-test. The results of the activity, which was attended by 14 people, showed that the level of knowledge of the target group about basic immunization before the counseling was only 5 people in the good category (35.7%), increasing to 12 people (85.7%). The Wilcoxon test results showed a significant effect on the increase in participants' knowledge after health promotion (p-value = 0.003). In conclusion, there was an increase in participants' understanding of basic immunization after the counseling, which indicates the success of health promotion through counseling.

Abstract

This study aims to analyze the competency development strategy of J&T Express employees in West Koya and identify the factors that influence the development of these competencies. The focus of this research is an effort to improve the quality of human resources in facing operational challenges and increasingly fierce competition in the logistics industry. This study uses a descriptive qualitative approach with purposive sampling techniques on three informants consisting of operational supervisors and storage department employees. The data collection technique was carried out through data interviews using data reduction methods and SWOT analysis with IFAS and EFAS matrices visualized in a cartesian diagram. The results of the study show that J&T Express Koya Barat indicates an aggressive strategy by maximizing internal strength to take advantage of external opportunities. Internal strength to take advantage of external opportunities. The right strategy includes increasing technology-based training, coaching and mentoring, and strengthening operational supervision. Influential internal factors include strength in the form of a wide distribution network and energetic human resources, but constrained by limited training and facilities. External factors include e-commerce growth opportunities and the threat of fierce competition and limited quality human resources.

Abstract

Abstrak: Kenakalan terhadap anak menjadi hal yang perlu diperhatikan di Desa Kota Lintang Kecamatan Kualasimpang Kabupaten Aceh Tamiang, karena banyaknya kasus kenakalan yang terjadi di desa tersebut, seperti narkoba, eksploitasi, KDRT, dan pemerkosaan. Tujuan PKM ini untuk memberikan edukasi dan simulasi pemahaman kepada masyarakat tentang undang-undang perlindungan anak dan pentingnya pencegahan kenakalan pada anak beserta hukum Sistem Peradilan Pidana Anak. PKM ini menggunakan metode sosialisasi dan workshop. Pengabdian ini diikuti oleh 31 orang terdiri dari 20 orang masyarakat Desa Kota Lintang, 6 orang perangkat desa, 2 orang dosen, dan 3 orang mahasiswa. Evaluasi pengabdian dilakukan melalui sebaran kuesioner. Hasil pengabdian menunjukkan bahwa: (1) 84% Mitra mengalami peningkatan pemahaman tentang undang-undang perlindungan anak; (2) 85% Mitra mengalami peningkatan tentang pentingnya pencegahan kenakalan pada anak; (3) 87% Mitra mengalami peningkatan pemahaman tentang undang-undang Sistem Peradilan Pidana Anak; (4) 86% Mitra mengalami peningkatan kesadaran akan konsekuensi hukum dari perilaku kenakalan; dan (5) 85% Mitra mengalami peningkatan pemahaman cara mengatasi kenakalan anak melalui simulasi pencegahan kenakalan anak.Abstract: Child delinquency is a matter that needs to be considered in Kota Lintang Village, Kualasimpang District, Aceh Tamiang Regency, because of the many cases of delinquency that occur in the village, such as drugs, exploitation, domestic violence, and rape. The purpose of this PKM is to provide education and simulation of understanding to the community about child protection laws and the importance of preventing delinquency in children along with the law on the Juvenile Criminal Justice System. This PKM uses socialization and workshop methods. This community service was attended by 20 people from Kota Lintang Village, 6 village officials, 2 lecturers, 3 students. The evaluation of the community service was carried out through the distribution of questionnaires. The results of the community service showed that: (1) 84% of Partners experienced an increase in understanding of child protection laws; (2) 85% of Partners experienced an increase in the importance of preventing delinquency in children; (3) 87% of Partners experienced an increase in understanding of the Juvenile Criminal Justice System law; (4) 86% of Partners experienced an increase in awareness of the legal consequences of delinquent behavior; and (5) 85% of partners experienced an increase in understanding of how to deal with juvenile delinquency through juvenile delinquency prevention simulations.

Abstract

Introduction Sectio Caesarea (SC) is a method of delivering a fetus by making an incision in the uterine wall through the anterior abdominal wall. Like surgical procedures in general, SC is not free from various potential risks, one of which is surgical wound infection. Surgical wound infection is one of the major problems in obstetric practice, as it can delay wound healing and thereby increase morbidity rates. Method Sample in this study was selected using a purposive sampling method, based on specific criteria determined by the researchers by considering the characteristics or attributes of the population.  Result The statistical analysis showed that age had a p-value of 0.000 (p < 0.05), nutritional status p-value of 0.000 (p < 0.05), anemia p-value of 0.000 (p < 0.05), parity p-value of 0.010 (p < 0.05), diabetes mellitus p-value of 0.047 (p < 0.05), immunosuppression p-value of 0.047 (p < 0.05), and hypothermia p-value of 1.000 (p>0.05).Conclusion: Based on the statistical test results, it can be concluded that there is a significant association between age, nutritional status, anemia, parity, immunosuppression, and diabetes mellitus with post–cesarean section (SC) surgical wound infection. Meanwhile, no significant association was found between hypothermia and post-SC surgical wound infection. Based on the p-values, age, nutritional status, and anemia were the most influential risk factors for surgical wound infection after cesarean section. By understanding the main risk factors, healthcare providers can implement earlier interventions in high-risk patients to reduce the incidence of post-SC surgical wound infections.
