Abstract

As a transit country, Indonesia is obliged to temporarily accommodate thousands of refugees and asylum seekers who are waiting to be processed by UNHCR for resettlement to the third countries. To facilitate refugees and asylum seekers, Joko Widodo’s government issued Presidential Regulation 125/2016. The international community appreciates the regulation because it shows Indonesia commitment to take part in addressing one of the humanitarian issues that is currently being concern to the world. This paper aims to analyze Joko Widodo’s policy that facilitate refugees and asylum seekers. By using the concept of international recognition in the constructivist paradigm, this paper argues that the government issued Presidential Regulation 125/2016 is influenced by the desire of Indonesia to be recognized as a “human rights defender” in terms of refugee handling. In this case, recognition, appreciation, and positive response from the international community has been obtained by Indonesia leading to the reduction of pressure from international community which could trigger the phenomenon of misrecognition. In this regard, Indonesia’s identity as “human rights defender” can be maintained.

Abstract

The COVID-19 pandemic has taken mankind by surprise and has caused many governments to impose various rules and strategies to contain it. This article discusses the social impact of government policies during COVID-19, the role of agencies other than the government, and the importance of human rights. Collaborative Governance regime and theory are used to complement qualitative methods and for quantitative method, data collection techniques based on literature research, institutional reports, survey results from journals, online media, and print media, as well as the input of experts in focus group discussions. We found that 1) inconsistencies in policy; 2) lack of coordination and leadership; 3) trust issues; and (4) inequalities and injustice performances increased the pressure on social compliance. Our results indicate that the government needs to be more agile to accommodate, nurture and integrate social actors as governance partners in order to ensure its efficacy, resilience and compliance during this pandemic. The government  needs to ensure that an inclusive approach is adopted in multi-dimensional channels so none is left behind and the collaborative governance framework in this pandemic war needs to be improved and implemented. In addition,the government should ensure equal treatment of human rights as specially in human safety in health and safety measures.

Abstract

The Drug-Free Village program, known as "Desa Bersinar" in the City of Semarang, aims to combat drug abuse and promote a healthy, safe environment. This study evaluates the efficiency of the program's implementation by examining its planning, execution, and outcomes in reducing drug-related activities. Utilizing a mixed-method approach, data was collected from both quantitative surveys and qualitative interviews with village leaders, local government officials, and residents. The findings reveal that although the program has raised awareness and involved community participation, certain challenges such as lack of resources, insufficient coordination between agencies, and inadequate monitoring persist. These factors have impacted the overall efficiency and sustainability of the program. Furthermore, the study highlights the need for enhanced collaboration between local authorities and national drug enforcement bodies, as well as increased funding and training for community leaders. In conclusion, while Desa Bersinar has made significant strides in addressing drug issues in Semarang, more focused efforts are needed to improve its long-term effectiveness. Recommendations include reinforcing local support structures and creating better strategies for continuous monitoring and evaluation. This research contributes to the understanding of community-driven approaches in the fight against drug abuse at the village level.

Abstract

This paper will look at the success of a local government organization with the determination of organizational resources and the right performance management system in order to improve public services in the local government. This article aimed at finding out whether the performance management system is appropriate if it is implemented in the local government work environment. The research method used a literature study by analyzing previous research and other various reference sources, both from textbooks, national journals, and reputable international journals. As an analytical material, we provided an example of an analysis of the performance management system in Banyumas Regency Government. Based on this, it can be concluded that Banyumas Regency always strives to improve organizational performance and existing resources through the implementation of performance management practices although formally the Head of the Region has not yet established a performance management system that applies in Banyumas Regency

Abstract

Effectiveness shows the success of achieving the goals that have been set. If the results of activities are closer to the target, it shows the higher the effectiveness. An organization is considered to achieve high effectiveness if the it is free from various characteristics of ineffectiveness. This research aims to analyze the effectiveness of the Indonesian police organization in tackling drug abuse that occurs in society today. In accordance with the Function, Purpose, Position, Role, and Authority of the Police, which is very large and important to prevent drug trafficking and abuse in Indonesia, it has been written in Law Number 2 of the Year concerning the Indonesian National Police. The results indicated that the effectiveness of police organizational performance in tackling and preventing drug abuse in Indonesia is currently not optimal. This is shown in the yearly prevalence rate of drug abuse, which increased by 0,15% from 1,80% in 2019 and to 1,95% in 2021. This increase is quite large when viewed from the total population, drug abuse. This is estimated at 3.662.646 people aged 15-64 years over the past year shows an increase of 243.458 people compared to 2019 (3.419.188 people). Meanwhile, the prevalence rate of ever-use drug abuse increased by 0,17% from 2,4% in 2019 to 2,57%. With an absolute number in 2021 of 4.827.616 people aged 15-64 years having used drugs, this number is 292.872 more people than in 2019 (4.534.744 people). With the increase in narcotics crimes in the Provinces, Districts/Cities throughout Indonesia, the Police, assisted by the community, needs to be more active in carrying out preventive measures that can narrow the space for perpetrators who will commit narcotics crimes.

Abstract

This paper examines the threat of the use of cryptocurrency and crowdfunding, and crowdfunding using cryptocurrency, as a newly emergent threat in terrorist financing. It uses the terrorist funding typologies created by Freeman, supplemented by Davis, to identify the threat presented using these modes of financing. It argues for two conclusions: first, that the use of cryptocurrency adds an added layer of security and reliability to funding sourced by traditional actors, such as state transfers and individual donations by rich donors. Second, the use of crowdfunding allows terrorist organizations, especially those in Southeast Asia, to tap a heretofore untapped market in potential funders, especially at the micro level. Taken together, crowdfunding and cryptocurrency present significant threats to the present Combating the Financing of Terrorism (CFT) regime.Bahasa Indonesia Abstract: Tulisan ini menjelaskan ancaman penggunaan mata uang kripto dan urun dana, serta urun dana dengan menggunakan mata uang kripto sebagai ancaman terbaru dalam dunia pendanaan terorisme. Hal ini menggunakan tipologi pendanaan terorisme yang dibuat oleh Freeman, yang dilengkapi oleh Davis, untuk mengidentifikasi ancaman yang dihadapi dengan menggunakan moda pendanaan tersebut. Tulisan ini memiliki dua kesimpulan argumen. Pertama, penggunaan mata uang kripto menambahkan lapisan keamanan dan keandalan untuk pendanaan yang bersumber dari aktor-aktor tradisional, seperti pendanaan dari negara dan donasi individual dari pendonor yang mapan, Kedua, penggunaan moda urun dana memampukan organisasi terorisme, khususnya yang berpusat di Asia Tenggara, untuk memasuki pasar yang sebelumnya sulit dimasuki oleh donator potensial, terutama di tingkat mikro. Jika digabungkan, urun dana dan mata uang kripto menyediakan ancaman yang signifikan terhadap rezim Combating the Financing of Terrorism (CFT) saat ini.

Abstract

The basic principle of the New Public Management (NPM) paradigm is to run state administration as it moves the business sector (run government like a business or market as a solution to the ills in the public sector).  This strategy needs to be implemented so that the old model of bureaucracy that is slow, rigid and bureaucratic is ready to answer the challenges of the globalization era.  The privatization of higher education in the form of PTN BH and BLU is an autonomous form of higher education institutions by adopting the values of NPM.  In practice, there appears to be a shift and misunderstanding of the value of privatization which is interpreted as the commercialization of higher education. This article concludes that this higher education privatization policy has a negative impact, namely the commercialization of higher education, which if allowed to continue will grow the capitalization of education. Education can only be accessed by the owners of capital, while the lower class people are increasingly marginalized. Evaluation of the higher education privatization policy must be carried out immediately by the government in order to make improvements even if it is necessary to revoke and change the privatization policy of higher education.

Abstract

The Drug-Free Village Program (Desa Bersinar) is a strategic initiative by the Indonesian government aimed at eradicating drug abuse at the village level. The program's urgency is heightened in large cities like Semarang, which face complex social and cultural diversity. Administrative efficiency is critical to ensuring optimal resource utilization and achieving the program’s objectives. This study aims to analyze the level of administrative efficiency in the Desa Bersinar program in Semarang City and identify influencing factors.  This research employs a quantitative descriptive approach, utilizing questionnaires distributed to village officials involved in program implementation and in-depth interviews with key informants. Quantitative data were analyzed using descriptive statistics, while qualitative data were thematically analyzed. The findings reveal that the program demonstrates good administrative efficiency, yet challenges remain, including the limited competence of village officials and bureaucratic inefficiencies. The use of information technology has shown potential in expediting administrative processes but has not been fully optimized. The novelty of this study lies in its combined use of quantitative and qualitative analyses to provide a comprehensive overview of administrative efficiency in a village-level drug prevention program. Key recommendations include enhancing human resource capacity, strengthening the integration of information technology, and increasing the frequency and quality of program evaluations. These findings offer valuable insights for improving the program's implementation and serve as a reference for similar initiatives in other regions.

Abstract

Introduction to the Problem: This article examines the U.S. strategy for countering corruption and the increasing challenges of money laundering involving cryptocurrencies in a globalized financial ecosystem. As digital assets gain legitimacy, they have simultaneously become tools for illicit finance, prompting the need for coordinated global regulatory efforts. The United States, home to the world’s largest crypto exchanges and a leading jurisdiction for asset seizures, has developed a comprehensive Five-Pillar Strategy emphasizing global coordination and institutional strengthening. Purpose/Objective Study: This study analyzes how U.S. policy frameworks, including those under the Commodity Futures Trading Commission (CFTC), Financial Crimes Enforcement Network (FinCEN), and Dodd-Frank Act, respond to transnational threats of corruption, crypto-related crime, and illicit finance. It assesses how these measures promote transparency and shape international cooperation mechanisms. Design/Methodology/Approach: Using a mixed-method legal approach grounded in methodological pluralism, this research integrates normative legal analysis, legal sociology, and neoliberal institutionalism to evaluate the adaptive capacity of global coordination in addressing crypto-related financial crimes. Findings: The study finds that effective responses to crypto-based corruption require not only domestic policy coherence but also institutionalized multilateral coordination anchored in international regimes such as the Financial Action Task Force (FATF), the UN Convention against Corruption (UNCAC), and the OECD’s Crypto-Asset Reporting Framework. The U.S. Five-Pillar Strategy strengthens transparency through beneficial ownership reporting, enhances the detection of illicit transactions via FinCEN and CFTC oversight, and reinforces cross-border collaboration through FATF and UNCAC partnerships. These frameworks collectively represent a pragmatic application of neoliberal institutionalism (where institutions mitigate the risks of an anarchic financial order) and sociological jurisprudence, which treats law as a dynamic tool of social engineering. However, gaps persist in enforcement harmonization and data-sharing, underscoring the continued need for adaptive and inclusive global coordination mechanisms. Paper Type: Research Article
