Abstract

There have been several human rights cases in several regions in Indonesia in recent years and the ripples of conflict that have accompanied them show that there are differences in interpretation of the principles and implementation of human rights among the community. In this case, it is necessary to formulate regulations on human rights that are good and universally applicable to all groups. This research aims to offer an ideal formulation of human rights regulation in Indonesia. This research uses descriptive qualitative method or also known as literature study. This research reveals findings as one of the problem solving in human rights issues. There are three things that must be promoted as a form of struggle in maintaining human rights in Indonesia, namely strengthening the values of Pancasila as a source of human rights values, the need for a common perception of the conception of the implementation of ideal human rights in Indonesia, and the idea of a human rights education movement among the community on an ongoing basis.

Abstract

Kesadaran hukum masyarakat haruslah tetap terjaga dan menjadi titik awal dalam menjalankan dan mempersempit terjadinya tindak pidana kebakaran hutan, dengan masyarakat yang memiliki kesadaran hukum yang tinggi maka bencana dan musibah setidaknya bisa diatasi. Hal ini dikarenakan adanya kesadaran hukum yang diciptakan dan dijadikan pedoman untuk menjaga lingkungan agar tetap sehat. Dalam penulisan jurnal ini penulis menggunakan metode penelitian deskriptif, dimana hasil dari kegiatan KKN dalam hal meningkatkan kesadaran hukum kepada masyarakat desa Sungai Perak atas pentingnya memiliki kesadaran hukum terhadap tindak pidana kebakaran hutan dan lahan, dengan melakukan sosialisasi dan edukasi lewat berbagai media dan hasil wawancara yang menghasilan beberapa rumusan masalah diantaranya adalah (1) bagaimana pemahaman hukum masyarakat desa Sungai Perak tentang himbauan untuk tidak melakukan proses pembukaan lahan dengan cara membakar (2) apa saja yang menjadi faktor penyebab terjadinya kebakaran lahan dan (3) apa upaya pemerintah desa Sungai Perak dalam mengatasi masalah kebakaran hutan dan lahan ini. Dan kesimpulan dari jurnal ini adalah (1) bahwa masyarakat desa Sungai Perak masih banyak yang kurang memahami tentang hukum membakar lahan secara sengaja maupun tidak sengaja, (2) minimnya kesadaran hukum pada masyarakat desa Sungai Perak inilah yang membuat aturan tentang larangan pembakaran hutan dan lahan menjadi tidak berfungsi karena masyarakat beranggapan bahwa dengan cara membakar maka akan mengurangi biaya dan proses nya tidak berlangsung lama, (3) faktor penyebab terjadinya kebakaran hutan dan lahan antara lain adalah karena pembukaan lahan dengan cara dibakar, membuang puntung rokok sembarangan dan juga faktor alam seperti terkena sambaran petir(4) pemerintah desa Sungai Perak telah melakukan upaya guna mencegah terjadinya kebakaran hutan dan lahan dengan cara melakukan sosialisasi kepada masyarakat untuk menciptakan masyarakat yang memiliki kesadaran hukum yang tinggi dan pemerintah juga melakukan berbagai maca m usaha guna meminimalisir terjadinya kebakaran hutan dan lahan dengan cara menyediakan alat untuk pemadaman api jika terjadi kebakaran.

Abstract

This study aims to describe the concept of maintaining property in maqashid al-syariah and its relationship with property. In maqashid al-syariah property becomes one of the important topics that get attention so that people can maintain their property as well as possible. In the teachings of Islam it is also said that the use of wealth must be in the way of Allah and must always serve Allah. Islam has given more special attention to the property owned so that it can provide the value of worship in the sight of Allah SWT so that a happier life is achieved in this world and the hereafter. In this study the author uses a type of library research or also known as Library Research. This study concludes that property and ownership is one of the most important topics of discussion in Islamic law. Its position is related to one another, this is evidenced by the maqashid al-syariah method in which there are five elements, one of which discusses property (hifzh al-mal). The relationship between property and maqashid al-syariah, among others, is in the form of circulation and circulation, which aims to make the assets owned move in various circles, not only based on one group, and the next relationship lies in a condition that is far from problems so that it can avoid problems. danger and the relationship between property and maqashid al-syariah is with justice in managing assets.

Abstract

This research discusses the issue of the prohibition on the implementation of worship during the Covid-19 pandemic in places of worship by using maqashid al-shari'ah as a guide to answering the problem above. Covid-19 has brought significant changes in various lines of life, including the issue of human servitude to the Khaliq. The purpose of this research is to answer the question of governance of worship during Covid-19. The method of this research is descriptive qualitative by using secondary data as the main reference. Research shows that there are many restrictions from the MUI and the government in overcoming this virus, one of which is by suspending congregational prayers at mosques, both Friday prayers and fardhu prayers five times a day. If seen based on the review of maqasid al-shari'ah, then there is one element that exists in the maqashid, namely preserving life. So that the suspension of congregational prayers at the mosque is an alternative to maintaining the benefit of the community. MUI in each of its fatwa policies stipulates a law based on the Qur'an, as-Sunnah, and also ijtihad which is based on fiqh principles that are relevant to each condition and incorporated in the types of fiqh rules daf'u Aḍ-darurah wa raf'u al-ḥaraj in order to create benefit for all human beings.

Abstract

The issue of siri marriage is a conflict of norms, namely the norms of Islamic law, marriage law, human rights, and Maqashid al-Syariah. So that its existence that develops in society there are pros and cons. This research is a literature research using the Maqasid al-Syari'ah approach as an analytical tool. The findings of this study state that siri marriage according to the provisions of Islamic Law is valid, while positive law states that it is invalid (void) or can be canceled. As for human rights, siri marriage is not against the law, because the issue of marriage is a basic right for humans which is a gift from God and it has been regulated in the constitution (1945 Constitution) as well as in Law Number 39 of 1999 concerning human rights. While Maqashid al-Syari'ah views siri marriage as an act that can cause harm, then to prevent it from being registered with the authorities, it is based on the method of al-maslahah al-mursalah and sadd al-zari'ah considering that marriage has a fixed law as a means of realizing benefit

Abstract

This study aims to investigate Indonesian senior high school teachers’ perceptions of using the first language (L1) when teaching English because Indonesian teachers tend to have negative perceptions toward the application of the L1, while the L1 is needed in a situation where Indonesian students have limited skills in English. The semi-structured interview was applied to collect data, while thematic analysis was used to analyse it. The result showed that the teachers have three different positions in perceiving the use of the L1: the virtual position, maximal, and optimal positions. Although they have different perceptions toward the application of the L1, a major insight can be concluded about the limited use of the L1 for specific reasons, such as considering teachers’ and students’ English abilities, learners’ needs, and the type and the difficulty of the given task or assignment. The L1 can be functioned as scaffolding in three aspects: when teaching grammar, vocabulary, and when giving instructions. Teachers may consider this study’s results as the information to use the L1 in classrooms. This may also be beneficial for Indonesian educational stakeholders and the government to specifically define what type of scaffolding that teachers can use the L1 to teach English.

Abstract

This study discusses Covid-19 Vaccination from the Perspective of Maqashid Syariah with the aim of showing where the position of vaccination for the community is based on the principle of benefit, as this is one of the substances of maqashid syariah. The main problem of this research is whether Covid-19 vaccination is a right or obligation for every community and how this vaccination is given from the perspective of maqashid sharia. This research uses a qualitative descriptive method or also known as library research. This research resulted in a conclusion, namely at the beginning of carrying out the Covid-19 vaccination is a right for the community and based on this right, it is only carried out for those who want and need it, however, gradually the spread of the corona virus has increased, causing many people to die and be exposed, so the government, in this case, requires people to vaccinate so that people have good immune system. Apart from that, Indonesia has also become an emergency zone where all people are required to vaccinate, and if viewed from the maqasid sharia viewpoint, it is mandatory from a sharia viewpoint, the implementation of the Covid-19 vaccination is to reduce the spread and expansion of the corona virus outbreak and for the benefit of society and protect the lives and souls of fellow human beings by inhibiting and reducing the death rate from the virus.

Abstract

Different political choices within households create interesting dynamics as well as potential conflicts. This phenomenon reflects the diversity of views and values within families. This research utilizes primary sources such as books, journals, and websites, covering diverse perspectives. Qualitative research type and descriptive-analytic method are used to describe and analyze the conflict. Two theoretical frameworks, social conflict and conflict management, were used for a more comprehensive understanding. The results show that family harmony is considered important as it contributes to the well-being of family members. Political conflicts in the family, especially related to the presidential and vice presidential elections, are complex and influenced by social media, identity, and emotional aspects. Solutions involve understanding, open communication, information checking, the value of tolerance, and an agreement to maintain privacy in political discussions. The role of parents is crucial in modeling good behavior. Analysis based on social conflict theory highlights the role of social media, identity and emotions in conflict. Identification of differences and poor communication exacerbate tensions. Conflict management provides guidance on solutions and steps to manage differences in political views in the family. Overall, this study shows that social conflict management can be applied in a family context to maintain harmony amidst differences in political choices. The proposed solutions involve understanding, open communication, information checking, the value of tolerance, and the role of parents as positive behavior models. Thus, family harmony can be maintained, creating a healthy and loving family environment.

Abstract

This article describes the implementation of lecturer service in providing material on the importance of understanding Islamic Inheritance Law according to the Compilation of Islamic Law for Orphans and Duafa in the Muhammadiyah Tembilahan orphanage. The urgency of this activity is carried out to add insight into the right to inheritance distribution according to the Compilation of Islamic Law. The partner's problem is that there are still many orphans and poor children who do not comprehensively understand their rights in getting a share of the inheritance. Therefore, the purpose of this activity is to provide understanding to them so that later they get their rights in accordance with the applicable rules according to the compilation of Islamic law. The implementation of this activity used lecture and discussion methods. There were 35 participants who participated in this activity. This activity was welcomed enthusiastically by the partners. The indicators of the success of this service activity are evidenced by several children who feel satisfied and happy with this activity. Furthermore, it is recommended to carry out similar activities on an ongoing basis to improve and hone their ability to understand Islamic inheritance law in order to realize a harmonious and blessed life in the world and the hereafter.

Abstract

This article describes the implementation of lecturer service in providing scientific writing training material for students of Universitas Islam Indragiri, STMIK Indragiri, and STAI Auliaurrasyidin Tembilahan. This training is important to add insight into scientific writing techniques in this case writing scientific articles in scientific journals. The partner's problem is that there are still many students who find it difficult to compile or make good scientific articles. Therefore, the purpose of this activity is to make it easier for students and increase their understanding because they will not be separated from writing scientific papers. The implementation of this activity is hybrid (online and offline) and uses lecture and practice methods or accompanied independent assignments for several weeks. The participants who participated in this training were 76 students. This training was welcomed enthusiastically by partners, namely students from 3 (three) universities in Indragiri Hilir Regency. This service activity shows its success, it is proven that there are several students who have succeeded in collaborating in writing scientific papers in the form of journal articles that have been successfully published in several unaccredited and accredited national journals. This means that the proof of performance from the results of this assisted self-assignment is the achievement of the success of this activity. Furthermore, it is recommended to conduct continuous training to hone students' abilities in writing and creating scientific papers.
