Abstract

This study discusses Covid-19 Vaccination from the Perspective of Maqashid Syariah with the aim of showing where the position of vaccination for the community is based on the principle of benefit, as this is one of the substances of maqashid syariah. The main problem of this research is whether Covid-19 vaccination is a right or obligation for every community and how this vaccination is given from the perspective of maqashid sharia. This research uses a qualitative descriptive method or also known as library research. This research resulted in a conclusion, namely at the beginning of carrying out the Covid-19 vaccination is a right for the community and based on this right, it is only carried out for those who want and need it, however, gradually the spread of the corona virus has increased, causing many people to die and be exposed, so the government, in this case, requires people to vaccinate so that people have good immune system. Apart from that, Indonesia has also become an emergency zone where all people are required to vaccinate, and if viewed from the maqasid sharia viewpoint, it is mandatory from a sharia viewpoint, the implementation of the Covid-19 vaccination is to reduce the spread and expansion of the corona virus outbreak and for the benefit of society and protect the lives and souls of fellow human beings by inhibiting and reducing the death rate from the virus.

Abstract

This study explores the reconciliation of Human Rights, positive law, and siyasah syar‘iyyah as an innovative approach to addressing contemporary human rights challenges. The tension between the universal norms of human rights and Islamic law often becomes a focal point in global discourse, particularly in countries with Muslim-majority populations. Using a qualitative-descriptive approach and normative analysis, this research examines the convergence and potential integration points among these three pillars. The goal is to develop a legal framework that is more holistic, just, and contextually grounded. The findings reveal that through epistemological dialogue and the contextual reinterpretation of religious texts, siyasah syar‘iyyah can bridge the principles of Sharia and modern human rights values. Meanwhile, positive law—as a state instrument—can accommodate transcendent values of justice, provided it is formulated with sensitivity to society's social, cultural, and religious dynamics. This study recommends an inclusive legislative model and a humanistic approach to interpreting religious texts to strengthen legal legitimacy and the protection of human rights. The academic contribution of this research lies in developing an integrative approach that systematically unites three bodies of knowledge: human rights theory, modern legal theory, and the thought of siyasah syar‘iyyah. The conceptual framework is a normative and practical model for inclusive and just legal policymaking.

Abstract

This study aims to investigate Indonesian senior high school teachers’ perceptions of using the first language (L1) when teaching English because Indonesian teachers tend to have negative perceptions toward the application of the L1, while the L1 is needed in a situation where Indonesian students have limited skills in English. The semi-structured interview was applied to collect data, while thematic analysis was used to analyse it. The result showed that the teachers have three different positions in perceiving the use of the L1: the virtual position, maximal, and optimal positions. Although they have different perceptions toward the application of the L1, a major insight can be concluded about the limited use of the L1 for specific reasons, such as considering teachers’ and students’ English abilities, learners’ needs, and the type and the difficulty of the given task or assignment. The L1 can be functioned as scaffolding in three aspects: when teaching grammar, vocabulary, and when giving instructions. Teachers may consider this study’s results as the information to use the L1 in classrooms. This may also be beneficial for Indonesian educational stakeholders and the government to specifically define what type of scaffolding that teachers can use the L1 to teach English.

Abstract

Pancasila consists of two words, namely, "Panca" which means five and, "Sila", which means a principle or principle. From these two words, Pancasila can be interpreted as the five principles, which of course act as the fundamental foundation of the Unitary State of the Republic of Indonesia (NKRI). Remaining the basis of the state, Pancasila is of course the foundation of all values, ethics and standards that support life in the eyes of society, nation and state. Pancasila will absolutely regulate and become the direction of the nation's personality, national characteristics and the ideals of this sovereign state. In carrying out its role, Pancasila will contribute to the formation of the character and morals of every individual who is an Indonesian citizen. For this reason, Pancasila has an important role as a belief system or foundation of the state, as well as a philosophy of honor for a sovereign state, namely the Unitary State of the Republic of Indonesia. This research will discuss the functions, roles and challenges in maintaining Pancasila as the basis of state thought and ideology as well as maintaining the trustworthiness of state ideology within the framework of a sovereign state.
