Abstract

The purpose of this study is to analyze the model of consumer dispute resolution in the financial services sector in Indonesia. The research method used in this study is a normative juridical approach supported by empirical data. Consumer disputes can be resolved through the courts or out of court based on the voluntary choice of the disputing parties. This means that consumers are given the freedom to claim their rights if they are harmed by business actors, either through litigation or non-litigation channels. Thus, consumers in the financial services sector who have been harmed can choose from the current models of consumer dispute resolution in the financial services sector, namely litigation through breach of contract suits, unlawful act suits, class actions, legal standing, and small claims courts. Meanwhile, non-litigation can be pursued through BPSK, LAPS SJK, or LAPS SK. The use of the small claims court mechanism as one of the models for resolving consumer disputes in the financial services sector through litigation in court can be empowered, and the process of resolving consumer disputes through non-litigation via BPSK can be carried out in stages.

Abstract

The rapid growth of the financial technology (fintech) industry in Indonesia as part of digital business transformation has significantly improved public access to technology-based financial services. However, this development has also increased the risks of data breaches and misuse of consumers’ personal information. This study aims to analyze the urgency of personal data protection within Indonesia’s fintech ecosystem, evaluate the effectiveness of the existing regulatory framework, and identify strategies to strengthen legal protection in the digital era. The research employs a normative juridical method using statutory and conceptual approaches through literature review of relevant regulations and scholarly works. The findings indicate that although the Personal Data Protection Law provides a solid legal foundation, its implementation still faces challenges, including low compliance among fintech providers, limited public digital literacy, and suboptimal regulatory supervision. Strengthening data governance, enhancing platform accountability, and improving consumer awareness are therefore essential to build a secure and sustainable fintech ecosystem.

Abstract

Cultural diplomacy has increasingly become an important approach to strengthening international relations through cultural exchange and artistic collaboration. This study examines the ethical dimensions of artistic cooperation in cultural diplomacy through the collaboration between the Jakarta Arts Council (Dewan Kesenian Jakarta – DKJ) and the Ukrainian Institute in 2024. The research aims to analyze how ethical principles shape artistic collaboration and how cultural initiatives function as diplomatic instruments in the context of global conflict. This study employs a qualitative research design, using document analysis and a literature review to explore cultural programs, institutional reports, and scholarly sources related to cultural diplomacy and artistic exchange. The findings indicate that artistic collaboration serves as an effective medium for promoting intercultural dialogue, strengthening international cultural relations, and expanding networks among artists and cultural institutions. Ethical principles such as respect for cultural diversity, neutrality in political contexts, and intercultural dialogue play an important role in ensuring that artistic initiatives remain constructive platforms for cultural communication. However, challenges related to political sensitivity, cultural representation, and institutional coordination may influence the implementation of cultural diplomacy initiatives. Overall, the study demonstrates that ethical artistic collaboration can contribute significantly to cultural diplomacy by fostering cultural understanding and international cooperation, even in times of geopolitical tension.
