Abstract

Pada Tahun 1999 Pemerintah Republik Indonesia telah menerbitkan Undang-Undang No. 30 Tahun 1999 tentang ”Arbitrase dan Alternatif Penyelesaian Sengketa” sebagai payung hukum dalam rangka mengembangkan penggunaan Alternative Dispute Resolution (alternatif penyelesaian sengketa) untuk menyelesaikan sengketa yang timbul dalam masyarakat. Bentuk atau model Alternative Dispute Resolution ini sebenarnya telah dipraktekkan oleh setiap komunitas masyarakat di seluruh wilayah Indonesia untuk menyelesaikan segenap ragam sengketa, baik bidang keperdataan maupun kepidanaan sekalipun penamaan sengketa dan lembaga penyelesaian sengketanya menggunakan terminologi yang berbeda-beda, misalnya dalam komunitas masyarakat suku Sasak di Lombok lembaga penyelesaian sengketa secara kultural disebut dengan Majelis Adat Desa. Sedangkan musyawarah mufakatnya untuk menyelesaikan sengketa disebut dengan Begundem. Namun demikian sekalipun lembaga dan penamaan musyawarah mufakat sebagai bangunan proses penyelesaian sengketa menggunakan terminologi yang berbeda-beda untuk setiap masyarakat diberbagai wilayah Indonesia, tetapi tujuan penyelesaian sengketa sama-sama mengedepankan perdamaian melalui musyawarah mufakat untuk membangun harmonisasi pihak-pihak yang terlibat dalam sengketa.

Abstract

Early marriage in Indonesia, especially in Kabanjahe, is a complex social issue that still occurs with high frequency. This study aims to identify the factors that cause early marriage among junior high school students and evaluate the prevention efforts made by the school. The method used was qualitative with a descriptive approach, involving in-depth interviews with perpetrators of early marriage, teachers, and other related parties. The results showed that economic factors, low education, and cultural and social pressures are the main drivers of early marriage. In addition, the impact of the COVID-19 pandemic has exacerbated this situation with an increase in the number of marriage dispensations. This study recommends the need for collaboration between schools, families and communities in prevention efforts, as well as the importance of comprehensive education on the risks of early marriage. It is hoped that the results of this study can serve as a reference in developing more effective policies to protect children from early marriage practices.

Abstract

This study examines the effectiveness of sharia dispute resolution mechanisms in strengthening consumer protection in Indonesia. This issue is crucial as the rapid growth of the Islamic economy has increased the complexity of disputes between financial institutions and customers, while existing mechanisms have not fully reflected substantive justice. Although the Religious Court and the National Sharia Arbitration Board (BASYARNAS) have a strong legal foundation, their practical effectiveness remains limited due to institutional and social challenges. This research employs a qualitative descriptive-analytical approach, using in-depth interviews with 18 informants consisting of judges, arbitrators, OJK officials, representatives of Islamic financial institutions, and consumers. Data were analyzed using the interactive model of Miles and Huberman, including stages of data reduction, presentation, and conclusion drawing, with validation through source and method triangulation. The findings reveal that the effectiveness of sharia dispute resolution is still low at the implementation level. The main influencing factors include low public legal literacy, weak inter-institutional coordination, limited human resources in sharia law, and suboptimal application of maqashid al-shariah principles. A hybrid model combining litigation and sharia-based mediation is identified as a potential alternative to strengthen consumer protection and increase public trust in sharia legal institutions. This study concludes that the effectiveness of sharia dispute resolution must prioritize substantive justice and social welfare rather than mere procedural compliance, to enhance trust and fairness within Indonesia’s Islamic legal system.

Abstract

Religious conversion is not completed through the formal adoption of a new religious affiliation but develops through religious learning, social negotiation, and identity reconstruction. This study examines how women affiliated with Mualaf Center Kampung Madras in Medan interpret their religious journeys and how social interactions contribute to the formation of their identities as Muslim women. The study employed a qualitative phenomenological design involving five women converts aged 31–60 as primary participants and the head of Mualaf Center Kampung Madras as a supporting key informant. Data were collected through semi-structured interviews, nonparticipant observation, and documentation. The data were analyzed through bracketing, intuiting, analyzing, and describing, while symbolic interactionism was used to interpret the construction of religious meaning and identity. The findings identified four interrelated themes: diverse pathways to conversion, post-conversion challenges and religious adjustment, social support and the role of the Mualaf Center, and the reconstruction of the self as a Muslim woman. Conversion was shaped by marriage, spiritual attraction, and prolonged interaction with Muslim social environments. After conversion, participants encountered limited religious knowledge, negative family responses, emotional pressure, and socioeconomic difficulties. Support from spouses, neighbors, religious teachers, Muslim communities, and the Mualaf Center facilitated religious learning and reduced social isolation. The findings demonstrate that Muslim identity was constructed gradually through the interpretation of religious symbols, interaction with significant others, and negotiation between personal agency and socially internalized expectations. The study highlights the importance of sustained, non-coercive, and context-sensitive support for women converts.
