Abstract

Keberadaan merek saat ini memilik peran penting sebagai suatu identitas yang baik untuk melindungi produk serta menjadi jaminan atas kualitas produk atau layanan dalam persaingan pasar. Untuk dapat dilindungi, suatu merek harus didaftarkan terlebih dahulu dan sudah memenuhi syarat yang telah ditentukan oleh undang-undang. Merek dapat saja ditolak atau dibatalkan apabila tidak memenuhi syarat yang ditentukan. Pada kasus sengketa merek “PREDATOR”, Acer Incorporated selaku Penggugat mengajukan gugatan kepada Komisi Banding Merek yang telah mengajukan putusan untuk menolak permohonan banding atas pendaftaran merek “PREDATOR” milik Penggugat karena adanya persamaan pada pokoknya dengan merek yang telah terdaftar dengan nama dan jenis barang yang sama. Penelitian ini menggunakan metode penelitian dengan penedekatan yuridis normatif berdasarkan hukum yang berlaku. Hasil penelitian menunjukan bahwa Pertama, terdapat disparitas antara Majelis Hakim pada Pengadilan Niaga dan Hakim Agung pada Pengadilan Kasasi. Kedua, terdapat inkosistensi pada Putusan Majelis Kasasi dalam menafsirkan unsur Persamaan Pada Pokoknya dan menafsirkan tujuan dari gugatan Penggugat

Abstract

The development of technology today makes humans coexist with technology. Many human activities can be carried out through the internet network. One of them is the presence of the metaverse which is a technology that contains virtual interactions, digital objects, and decentralized humans from various platforms. Metaverse is used by many people as a medium for buying and selling transactions. Metaverse users generally sell their products in the form of NFTs. Various well-known brands have started promoting their products through the metaverse. The emergence of well-known brands in the metaverse is an opportunity for irresponsible parties to infringe brand rights. As was the case in Ryder Ripps v. Yuga Labs. Pollution, imitation, obscuration, and so forth of well-known trademarks are carried out by irresponsible parties. One of them is the doctrine of Trademark Dilution. Trademark dilution is the unauthorized use by other parties that can weaken the quality or characteristics of a trademark. This makes the question of how the protection of trademarks in the virtual space of the metaverse and what legal action can be taken when there is a violation of trademark rights. Not many countries have regulated the protection of digital trademarks specifically against trademark dilution, as well as Indonesia. This research will be conducted using a non-native juridical approach method with legal sources in the form of laws and regulations, international agreements, theories, and legal rules. The focus of this research is how metaverse with the platform in it can protect the trademark with the terms and conditions agreement of account users in the platform. The result of this research is that brands can be protected against infringement of rights to the brand as well as brand dilution by referring to the terms and conditions of account users listed in the platform. In addition, the legal action that can be taken is to file a lawsuit as determined by the platform and the removal of related content.

Abstract

Technological developments have brought changes in various sectors of life, including copyright protection. The presence of subscription-based streaming platforms has changed the way individuals enjoy digital creative works. Along with the rapid pace of technological development, a new phenomenon in digital copyright infringement activities has emerged, namely the illegal sale of subscription-based streaming platform accounts. This research aims to examine the need for revising provisions regarding digital copyright protection, especially the definition of piracy. The research method used is normative legal research through offline and online document studies, using qualitative descriptive data analysis methods to obtain explanatory conclusions. Based on the research results, it was found that the current legal framework for protecting digital copyright cannot protect creators and copyright license holders from the illegal sale of streaming accounts. The access structure in subscription-based streaming platforms has substantially changed how copyrighted content is enjoyed and how piracy can be conducted. Based on this, the author concludes that it is necessary to change the definition of piracy within the scope of copyright protection by adding the element of 'illegal access' so that copyright protection in the digital era can be carried out optimally.

Abstract

Dalam perjanjian endorsement, pihak endorser seringkali hanya menerima perjanjian dengan klausula baku yang telah dibuat oleh endorsee. Hal ini memunculkan ketidakseimbangan dan wanprestasi yang mengarah perlunya diberikan tempat yang layak bagi keberadaan asas itikad baik dalam pelaksanaan perjanjian endorsement. Penelitian ini dilakukan untuk mengkaji dan menganalisa akibat hukum dan pertanggungjawaban hukum penggunaan klausula baku yang merugikan endorser dalam perjanjian endorsement dikaitkan dengan asas itikad baik dalam KUH Perdata. Penelitian ini menggunakan metode yuridis normatif untuk menelaah kaidah-kaidah dalam hukum positif dengan spesifikasi penelitian deskriptif analitis mengenai peraturan perundang-undangan terkait seperti KUH Perdata, buku-buku, literatur terkait lainnya, serta dokumen perjanjian endorsement sebagai objek penelitian, dianalisa secara kualitatif, untuk mengungkapkan kenyataan yang ada berdasarkan hasil penelitian berupa deskripsi atau penjelasan terkait penyelesaian masalah dalam penelitian ini. Hasil dari penelitian ini, yaitu pertama, akibat hukum dari penerapan klausula baku dalam perjanjian endorsement yang merugikan endorser terkait dengan asas kepatutan, yaitu perjanjian endorsement ini dapat dibatalkan sebagian atau seluruhnya, sebab dapat dibatalkannya perjanjian yaitu adanya adanya cacat kehendak yang dilakukan oleh endorsee, yang menyalahgunakan keadaan akibat ketidakseimbangan finansial sehingga rumusan prestasi dalam perjanjian endorsement pun tidak berimbang dan tidak patut. Kedua, endorser berhak atas pemenuhan prestasi sesuai yang diperjanjikan dan/atau pembayaran ganti rugi dari pihak endorsee sebagai wujud pertanggungjawabannya, apabila endorser dapat membuktikan bahwa klausula baku tersebut telah merugikannya.

Abstract

Trademarks have a very important function, namely as a differentiator from goods or services from other trademarks as well as a reputation for the goods or services being traded. Trademarks must be protected to prevent infringement in the form of unfair competition. The aim of this research is to understand the implementation of regulations and criteria regarding violations of brand similarity in essence as well as the use of marks that are not in accordance with those registered under brand law in Indonesia. The research method used in this research is a normative juridical approach, namely by using library materials in the form of positive law as the main material and then examining its implementation into practice. The primary legal material used by the author is Law Number 20 of 2016 concerning Marks and Geographical Indications, Law Number 15 of 2001 concerning Marks, Commercial Court Decision at the Surabaya District Court Number 2/Pdt.Sus-HKI/Merek/2022/ PN.Niaga.Sby, and Supreme Court Decision Number 161 K/Pdt.Sus-HKI/2023 as well as secondary legal materials, namely related literature, to analyze the decision.

Abstract

This study analyzes the impact of Trademark Bullying in influencing business competition in Indonesia on business owners and efforts can be made in the event of legal uncertainty for business actors who own UMKM brands in the event of Trademark Bullying based on the applicable positive law. The stidy used juridical normative method. Trademark Bullying practices also involve threats of litigation or legal reporting to the authorities. Where if this happens small business brand owners will be greatly disadvantaged because of the large costs required if this takes place in the litigation process because small business brand owners do not have the financial capacity to fight legally, so in the end they give up using the brand they own. legally due to the lawsuit process filed by the perpetrator of Trademark Bullying.

Abstract

Copyright infringement on e-commerce platforms is a growing concern, especially with the unauthorized use of individuals' photos for commercial purposes. Eliska's case highlights the negative consequences of uploading product photos without permission, violating the moral and economic rights of the original owners. Indonesia's Copyright Law No. 28 of 2014 imposes serious legal sanctions on such violations, holding individuals and e-commerce platforms like Tokopedia accountable for monitoring and enforcing copyright rules. This research uses normative legal methods to analyze regulations, licensing, and copyright protection related to photography and portraits in e-commerce, focusing on Tokopedia. A descriptive-analytical approach is employed to explain legal regulations concerning copyright in product sales on the platform, with data collected through theoretical literature review, legislative analysis, and online studies. Findings indicate that copyright infringement on e-commerce platforms significantly impacts original owners and the integrity of online commerce. Eliska's case shows how unauthorized photo use can lead to financial loss and reputation damage. Law No. 28 of 2014 provides for criminal sanctions and fines for such violations, while e-commerce platforms must ensure compliance with copyright regulations. Legal certainty and collaboration between copyright owners and platforms are essential for a safe and fair online trading environment.

Abstract

As one of the pillars supporting the economy in Indonesia, Micro and Small Enterprises (MSEs) are an instrument of economic development and equitable distribution of community welfare. MSEs have a very important role in moving the wheels of the national economy. Currently, MSEs in running their business cannot be separated from information technology facilities, one of which is through the marketplace. However, in the implementation of transactions through the marketplace, there are problems in terms of making agreements between the marketplace and MSEs where there is a dominant position of one of the parties. The research method used in this research is normative juridical by focusing on library law research. The results show that in electronic transactions there is an imbalance in the position between the marketplace and the seller, including MSEs, which causes the position of MSEs to be vulnerable and the position is not balanced. In the cooperation agreement, there are terms and conditions that force MSEs to agree to all agreements determined unilaterally by the marketplace. Therefore, the role of the government is needed to assist and protect MSEs so that they are not disadvantaged by certain parties and can play an optimal role in the national economy.

Abstract

The development of internet technology in Indonesia is on the rise. This aligns with the increasing level of crime due to the lack of boundaries in the digital world. One of these crimes is in the area of trade, where bad-faith business actors often engage in brand affiliation deception. Brand affiliation deception refers to a situation where certain parties piggyback on a genuine brand to create a misleading perception, causing consumers to believe that the two brands are affiliated in business with each other. However, regulations regarding brand affiliation deception are not fully and rigidly outlined in Indonesian legislation. The aim of this study is to examine and determine which legal actions constitute brand affiliation deception in the digital world according to Law Number 20 of 2016 concerning Trademarks and Geographical Indications, and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions. Additionally, the study seeks to identify which legal actions can be taken in cases of brand affiliation deception as per Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The research methodology employed is a normative juridical approach, utilizing document studies or literature materials with secondary data comprising primary legal materials, secondary legal materials, and tertiary legal materials. The research results indicate that legal acts of brand affiliation deception in the digital world are classified as trademark violations in the form of passing off and cybersquatting, because brand affiliation deception can create the false assumption that the genuine brand and the piggybacking brand have business relations with each other due to bad faith. Legal actions that can be taken in the event of violations involving brand affiliation deception include filing for damages and/or brand cessation, as well as filing criminal charges as stipulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions.

Abstract

The development of information and communication technology has caused world relations to become borderless. This can be seen on the creation of a song that can easily be transformed into a new song and uploaded on a digital platform without the permission of the Copyright Holder of the changed song, as well as the legal acts committed by foreign nationals outside the territory of Indonesia, such as one of the cases that the author researched, involving the national song Halo-Halo Bandung, which allegedly was transformed into a song titled Hello Kuala Lumpur without permission and uploaded on a Malaysian YouTube account named Lagu Kanak TV. The purpose of this research is to determine and analyze the legal provisions that can be imposed on the Hello Kuala Lumpur song maker or the owner of the Lagu Kanak TV YouTube account and also to find out the legal actions that can be taken by the Heirs of the Creator and the Copyright Holder of the song Halo-Halo Bandung and the Indonesian Government. The research method used in this research is normative juridical, which is legal research that bases its study on legal regulations. There is an examination of legal documents related to this research topic. The data collection technique used is a literature study by reviewing the relevant literature and legal regulations. Based on the results of the research, it is known that the act of changing the song Halo-Halo Bandung into Hello Kuala Lumpur by Lagu Kanak TV and its broadcast through YouTube without permission is a form of Copyright infringement on moral rights and economic rights. Dispute resolution through negotiation is recommended for both parties because negotiation is an effective way of resolving disputes and has several advantages.
