Abstract

As one of the pillars supporting the economy in Indonesia, Micro and Small Enterprises (MSEs) are an instrument of economic development and equitable distribution of community welfare. MSEs have a very important role in moving the wheels of the national economy. Currently, MSEs in running their business cannot be separated from information technology facilities, one of which is through the marketplace. However, in the implementation of transactions through the marketplace, there are problems in terms of making agreements between the marketplace and MSEs where there is a dominant position of one of the parties. The research method used in this research is normative juridical by focusing on library law research. The results show that in electronic transactions there is an imbalance in the position between the marketplace and the seller, including MSEs, which causes the position of MSEs to be vulnerable and the position is not balanced. In the cooperation agreement, there are terms and conditions that force MSEs to agree to all agreements determined unilaterally by the marketplace. Therefore, the role of the government is needed to assist and protect MSEs so that they are not disadvantaged by certain parties and can play an optimal role in the national economy.

Abstract

The development of internet technology in Indonesia is on the rise. This aligns with the increasing level of crime due to the lack of boundaries in the digital world. One of these crimes is in the area of trade, where bad-faith business actors often engage in brand affiliation deception. Brand affiliation deception refers to a situation where certain parties piggyback on a genuine brand to create a misleading perception, causing consumers to believe that the two brands are affiliated in business with each other. However, regulations regarding brand affiliation deception are not fully and rigidly outlined in Indonesian legislation. The aim of this study is to examine and determine which legal actions constitute brand affiliation deception in the digital world according to Law Number 20 of 2016 concerning Trademarks and Geographical Indications, and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions. Additionally, the study seeks to identify which legal actions can be taken in cases of brand affiliation deception as per Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The research methodology employed is a normative juridical approach, utilizing document studies or literature materials with secondary data comprising primary legal materials, secondary legal materials, and tertiary legal materials. The research results indicate that legal acts of brand affiliation deception in the digital world are classified as trademark violations in the form of passing off and cybersquatting, because brand affiliation deception can create the false assumption that the genuine brand and the piggybacking brand have business relations with each other due to bad faith. Legal actions that can be taken in the event of violations involving brand affiliation deception include filing for damages and/or brand cessation, as well as filing criminal charges as stipulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications and Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions.

Abstract

The development of information and communication technology has caused world relations to become borderless. This can be seen on the creation of a song that can easily be transformed into a new song and uploaded on a digital platform without the permission of the Copyright Holder of the changed song, as well as the legal acts committed by foreign nationals outside the territory of Indonesia, such as one of the cases that the author researched, involving the national song Halo-Halo Bandung, which allegedly was transformed into a song titled Hello Kuala Lumpur without permission and uploaded on a Malaysian YouTube account named Lagu Kanak TV. The purpose of this research is to determine and analyze the legal provisions that can be imposed on the Hello Kuala Lumpur song maker or the owner of the Lagu Kanak TV YouTube account and also to find out the legal actions that can be taken by the Heirs of the Creator and the Copyright Holder of the song Halo-Halo Bandung and the Indonesian Government. The research method used in this research is normative juridical, which is legal research that bases its study on legal regulations. There is an examination of legal documents related to this research topic. The data collection technique used is a literature study by reviewing the relevant literature and legal regulations. Based on the results of the research, it is known that the act of changing the song Halo-Halo Bandung into Hello Kuala Lumpur by Lagu Kanak TV and its broadcast through YouTube without permission is a form of Copyright infringement on moral rights and economic rights. Dispute resolution through negotiation is recommended for both parties because negotiation is an effective way of resolving disputes and has several advantages.

Abstract

Merek merupakan tanda dan ciri-ciri yang melekat kepada barang dan jasa. Sebagai suatu bagian dari kekayaan intelektual, pemilik dari merek dagang mendapatkan hak eksklusif untuk melindungi merek dagangnya. Pelindungan yang diberikan terhadap merek dagang perlu dan layak untuk diimbangi dengan penggunaan asas itikad yang baik didalamnya. Pemerintah telah melindungi merek sebagai bagian dari kekayaan intelektual berdasarkan Undang-Undang Nomor 20 Tahun 2016, meskipun tantangan tetap ada seperti adanya tindak perundungan merek dagang. Perundungan merek dagang sudah cukup umum terjadi di Indonesia, namun belum ada pengaturan yang jelas untuk memberikan pelindungan kepada pegiat usaha dalam menghindari terjadinya tindak perundungan merek dagang. Metode penelitian yang digunakan adalah menggunakan pendekatan secara yuridis normatif dengan penggunaan studi dokumen atau bahan pustaka yang menggunakan data sekunder yang berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa berlakunya Undang-Undang Merek di Indonesia belum cukup melindungi pemilik merek dagang dari adanya praktik perundungan merek dagang, baik untuk pengusaha besar maupun terutama UMKM. Selain itu, hukum positif yang berlaku di Indonesia masih perlu mengatur secara lebih jelas terkait tindak perundungan merek dagang, dimulai dari kriteria dan indikator yang rasional serta implementasi asas itikad baik dalam pelindungan merek dagang.

Abstract

This research highlights the problem of copyright infringement through illegal websites, especially in the context of free movie streaming. The purpose of this research is to explain the formulation of creating a blacklist of blocked domain names as a preventive measure in protecting copyright in digital media based on Indonesian positive law, as well as identifying the liability of electronic system organizers related to copyright infringement in ICT media. The method used is normative and comparative juridical with data from various sources. The Safe Harbor concept protects PSEs from liability for copyright infringement on their platforms, but proactive measures are still required. Recommendations include improving monitoring of user content, cooperation with copyright owners, updating internal policies, and disseminating copyright education to users.

Abstract

Perkembangan teknologi yang pesat telah mempengaruhi dan mengubah berbagai pola kehidupan manusia hal ini disebut dengan disrupsi. Perubahan ini memberikan kemudahan salah satunya dalam mengakses berita secara elektronik. Berita merupakan objek dari hak cipta yang harus dilindungi (press publisher right). Walaupun saat ini sudah ada regulasi yang mengatur, tetapi masih terdapat pelanggaran terhadap suatu berita. Hal ini dikarenakan pasal yang mengatur mengenai berita belum memadai dan merugikan pemilik hak cipta sehingga perlu diketahui mengenai teori dan asas hukum apa yang sesuai. Teori hukum yang sesuai adalah teori yang dikemukakan oleh R.C Sherwood, bahwa berita yang diterbitkan harus diberikan penghargaan yaitu hak eksklusif mengingat dalam pembuatannya memerlukan waktu, biaya, serta kreativitas sehingga perusahaan pers berhak mendapatkan hak eksklusif sepenuhnya. Selain itu didukung denngan teori code version. 2.0 serta lex digitalis. Asas hukum yang sesuai adalah prinsip keseimbangan hak dan kewajiban bahwa perlu adanya keseimbangan   yang adil sehingga tidak ada yang merasa dirugikan kepentingannya, prinsip pelindungan ekonomi dan moral bahwa dalam pembuatan suatu berita tidaklah mudah sehingga perlu diperolehnya hak ekslusif secara utuh didapatkan oleh perusahaan pers. Agar kedepannya press publisher right dilindungi secara penuh maka diharapkan adanya aturan turunan berupa Peraturan Pemerintah yang mengatur secara jelas kepastian hukum press publisher right.

Abstract

Copyright as one of the IP regimes can be utilized in the franchise business. Currently, the franchise business can also be applied to the entertainment industry, namely the existence of a movie franchise, which contains copyright. Although, the movie franchise is widely known by the public, but in practice there are still many who unaware the legal protection of movie copyright holders (franchisor) who give permission to the copyright recipient (franchisee) to franchise the movie. Therefore, the authors are interested in conduct research and further discuss the legal protection of copyright holders of movies whose creation is developed in the form of movie franchises. This research uses a normative juridical approach method with analytical descriptive research specifications and data analysis methods in this study were carried out using qualitative juridical methods. Based on the results of the discussion it is known that one of the implementation or embodiment of copyright protection for the copyright holders of the movie (franchisor) is the existence of a license agreement. The license agreement becomes the basis of the relationship between the franchisor and franchisee, which then from this agreement also arise the rights and obligations of the parties, one of which is royalty. The granting of royalty to the copyright holder of the movie becomes a form of appreciation and appreciation for the work created from the results of the mind of the copyright holder of the movie.

Abstract

In the practice the maritime boundary delimitations can cause the overlap of claims between states with opposite or adjacent coasts. Regarding the maritime boundary between Indonesia and Timor-Leste, there was never a maritime boundary between both States, so it needs a settlement of disputes of maritime boundary delimitation between both parties. Therefore, these research aims to explain the methods and principles that could be used in resolving maritime boundary delimitation dispute between state with opposite or adjacent coasts based on international law and analyze how obstacles and solution to solve maritime boundary delimitation dispute between Indonesia and Timor-Leste (East Timor). This research uses normative legal research and Empirical Research Methods. The results of the research show that: (1) the maritime boundary delimitation between Indonesia and Timor-Leste uses enclaving, equidistant, and three-step approach method. (2), Indonesia and Timor Leste have the potential to determine maritime boundaries in the three areas, namely the area to the north of the Oecusse (Ombai Strait), to the north of Timor Island (Wetar Strait) and to the south of Timor Island (Timor Sea). Timor-Leste will still get a maritime territory in District Oecusse but the extent would be negotiated with Indonesia first, while in the Wetar Strait, the territorial sea division of the two countries would consider the outer islands of both countries.

Abstract

Trade secret is one of the Intellectual Property Rights (IPR) protected by the Law No. 30 Year 2000 on Trade Secrets. However, the Trade Secret Law has not regulated in detail the act of prohibiting the sale of products resulting from trade secret infringement. Therefore, the purpose of this research is to analyse the reasons for the urgency of regulating the act of prohibiting the sale of products resulting from violations of Trade Secrets based on the Trade Secrets Act, and to explore the regulation of temporary determination of the sale of products resulting from violations of Trade Secrets based on the Trade Secrets Act and Directive (EU) 2016/943. This research uses normative law and comparative law methods with descriptive analytical research specifications. The research was conducted by comparing the laws. The data collection technique used is literature review. Based on the results of the research, it is concluded that the provisions of the Trade Secrets Law regarding injunction in Article 11 are still not detailed enough to provide legal certainty. This is different from the case of Directive (EU) 2016/943, which has regulated the provisions of interim injunction quite comprehensively. In this case, Indonesia can use Directive (EU) 2016/943 as one of the references to complete the provisions of the Indonesian Trade Secrets Law.

Abstract

The development of human civilization has given birth to a creative economy that is developing simultaneously. Copyright is one type of Intellectual Property that is given to creators and other parties who have rights to their creations to utilize exclusivity both economically and morally. Indonesian laws and regulations have been able to adjust to economic developments. However, in its implementation there are still gaps in terms of the withdrawal of copyright royalties as objects of fiduciary guarantees. This study aims to determine and identify the optimization of regulations for the implementation of copyright royalties as fiduciary guarantees based on positive law in Indonesia. This study was conducted using a normative juridical approach method, by conducting research through literature as the main research material. Based on the research conducted, it was found that although regulations have regulated copyright to be used as objects of fiduciary guarantees, there needs to be optimization of regulations and collaboration between the government and related institutions along with the development of the creative industry era.
