Abstract

Collective trademarks can be an alternative for trademark protection for Micro, Small, and Medium Enterprises (MSMEs) considering the greater benefits compared to regular trademarks. In 2024, there was an increase in the number of collective trademark applications, indicating that the public, especially MSMEs, are becoming more aware of the importance of trademark protection. However, issues have been found in the legislation regarding collective trademarks. This article aims to formulate the appropriate arrangements of collective trademark legislation that align with the MSME climate in Indonesia to achieve legal certainty. The research method used is normative juridical with a statutory approach, a conceptual approach, and a comparative approach. The regulation of collective trademarks in Indonesia will be compared with Brazil based on Law No. 9.279 of May 14, 1996, as amended by Law No. 14.200 of September 2, 2021. This research found that Law Number 20 of 2016 still contains several issues, namely the ambiguity of norms and articles that lead to multiple interpretations among the public. The provisions on collective trademarks in the Regulation of the Minister of Law and Human Rights Number 67 of 2016 (MIG Law) regulate substance similar to that stated in the MIG Law, whereas it should provide a more detailed and technical explanation. On the other hand, Law Number 15 of 2001, which was the previous regulation before the enactment of the MIG Law, provides a more comprehensive regulation on collective trademarks compared to the MIG Law. Thus, the legislation regarding collective trademarks does not yet provide legal certainty. The comparison with Brazil provides recommendations for appropriate arrangements, indicating the need for revisions and improvements to the legislation on collective trademarks to meet the need for more adequate regulations.

Abstract

Pasar seni rupa menempatkan lukisan sebagai komoditas bernilai tinggi, namun pelindungan hak ekonomi pelukis di pasar sekunder belum optimal karena dalam Pasal 11 ayat (1) Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UUHC) masih menganut prinsip kehabisan hak sehingga pencipta kehilangan hak ekonomi setelah penjualan pertama. Sementara Pasal 18 mengatur pengembalian hak cipta setelah jangka waktu tertentu hanya berlaku terbatas pada ciptaan buku dan musik. Berdasarkan kondisi tersebut, menimbulkan permasalahan pelindungan hak ekonomi Pencipta melalui asas droit de suite serta penerapannya dalam perjanjian jual beli putus karya seni lukis menurut UUHC. Penelitian ini menggunakan metode penelitian yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Data diperoleh dari bahan hukum melalui studi pustaka dan wawancara, serta menggunakan perbandingan hukum Amerika Serikat dan Uni Eropa. Hasil penelitian menunjukkan bahwa, pertama, pelindungan hak ekonomi pencipta karya seni lukis melalui UUHC belum mengakomodasi asas droit de suite, karena prinsip kehabisan hak dalam Pasal 11 ayat (1) serta pengaturan jual beli putus dalam Pasal 18 belum memberikan jaminan hak ekonomi berkelanjutan atas penjualan kembali karya seni lukis di pasar sekunder. Kedua, penerapan asas droit de suite dalam perjanjian jual beli putus di Indonesia belum memiliki dasar normatif yang jelas, berbeda dengan Eropa yang tegas menjamin hak royalti penjualan kembali dan Amerika Serikat yang menekankan pelindungan personal antara seniman dan karyanya melalui hak moral. Penelitian ini merekomendasikan pembaruan kebijakan UUHC melalui adopsi eksplisit asas droit de suite demi menjamin keadilan ekonomi bagi pencipta seni lukis.

Abstract

Abstrak Dewasa ini pelaku usaha berlomba-lomba membangun sebuah brand. Alasannya adalah semakin positif citra sebuah brand di masyarakat maka brand tersebut akan mempengaruhi tingkat pembelian masyarakat terhadap brand tersebut. Brand menjadi salah satu faktor pertimbangan masyarakat untuk membeli suatu produk barang atau jasa. Umumnya masyarakat cenderung membeli produk yang masuk ke dalam tingkatan teratas dalam suatu survey brand. Membangun sebuah brand bukanlah usaha yang mudah, diperlukan usaha maupun modal yang tidak sedikit demi membangun citra yang kuat dalam masyarakat. Akan menjadi sangat tidak adil bila brand yang telah dibangun dengan susah payah ditiru oleh pelaku usaha yang tidak bertanggung jawab. Pelaku usaha membutuhkan sebuah perlindungan hukum atas brand yang telah dibangunnya agar terhindar dari perbuatan curang yang mengarah ke persaingan usaha curang. Pranata hukum merek dibuat untuk memberikan perlindungan atas suatu brand yang ditempelkan pada suatu barang atau jasa yang diperdagangkan. Pranata tersebut memberikan hak eksklusif bagi pemegang merek dalam menggunakan brand tersebut. Kata Kunci : Brand, Hukum, Merek, Perlindungan, dan Usaha.

Abstract

The Covid-19 pandemic has resulted in more people doing activities from home, so almost all activities are carried out online, including for educational activities. The problems on this research are how the comparison between fair use regulations in Indonesia and in the United States during the pre-Covid-19 pandemic? How the regulations of the doctrine of fair use to anticipate the occurrence of a new phenomenon regarding the use of copyright on digital platforms during and/or after the Covid-19 pandemic? The method used in writing this law is a normative juridical method. The results of the study conclude that Fair use rules in Indonesia already regulate that fair use will not harm the legitimate interests of creators but does not provide clear parameters regarding fair interests. While the Fair use Arrangements in the United States are regulated in 17 U.S. Code 107. In this regulation, there are 4 factors, namely: the purpose and character of the use, the nature of the copyrighted work, the quantity and importance of the material used, the effect of the use upon potential market or value of the copyrighted work. The Covid-19 pandemic gave rise to fair use cases that had never occurred before the outbreak of Covid-19, e.g. the case of The Internet Archive, it can be observed that there is an encouragement from the public to further relax copyright protection because of the Covid-19 pandemic resulting in the public interest having to be carried out rather than the creators and copyright holders.

Abstract

This research aims to analyze the urgency of implementing Statement of Use, Declaration of Use, and Specimen of Use instruments as a means of supervising trademark use obligations in Indonesia. Currently, Law Number 20 of 2016 concerning Trademarks and Geographical Indications (UU MIG) only requires a written statement of use without being accompanied by concrete evidence at the time of renewal applications. This creates a loophole for trademark registrations without the intent to use (non-use), which can hinder bona fide applicants. This study employs a normative legal research method with a comparative law approach between the UU MIG and the Lanham Act (U.S. Trademark Act of 1946). The Lanham Act mandates proof of actual trademark use through a Statement of Use for intent-to-use applications, as well as a Declaration of Use for applications based on use-in-commerce, which must be submitted with a Specimen of Use as actual evidence of the trademark's use in trade. The results indicate that the adoption of these instruments into the Indonesian legal system is urgent to strengthen the supervisory function of the Directorate General of Intellectual Property (DGIP). This implementation would enable the DGIP to conduct administrative (ex-officio) trademark cancellations for non-use, thereby purging the trademark database of passive marks without having to rely on third-party lawsuits. This legal reform is in line with the legal development theory to encourage business actors to actively utilize the economic functions of trademarks.

Abstract

The advancement of information technology has driven the growth of the creative industry, which heavily relies on intellectual works, one of which is trademarks as part of the Intellectual Property Rights regime. A trademark not only serves as a product identity but also as a marketing tool and a determinant of reputation. However, in practice, legal issues often arise, particularly related to the registration of trademarks by parties acting in bad faith and having substantial similarities with previously registered trademarks. This research analyzes the Application of the Principle of Bad Faith in the trademark registration process in the trademark dispute "C+Logo" between Gunawan and PT Bagava Alam Semesta. Through descriptive analysis research with a normative juridical approach, the results of this study indicate a violation of the principle of bad faith in the trademark registration conducted by PT Bagava Alam Semesta because it meets the principle of bad faith violation as examined in accordance with the Trademark and Geographical Indications Law.

Abstract

Privacy, as a part of Human Rights, is the right of freedom of private matters. The basic concept of privacy is “the right to be let alone” which state that every individual have the right to have his own solitude without intervention. One of the most important information which also can be associated with Information Privacy is Personal Data that shall be protected as a form of protection to the privacy itself. Some of the personal data has been used as the requirements of the SIM Card Registration, thus making new problems regarding its personal data protection since the comprehensive regulation still covered only by the Ministral Regulation. Research method used in this paper is Descriptive Analytic in which the writer analyze the research object by explaining the situation and the condition of the personal data protection obtained from literatures on the facts that can be associated with the implementation of SIM Card Registration Policy according to Indonesia’s Positive Law and International Law. According to the result of the study, the Ministral Regulation already covered most of the basic data protection needed in the SIM card registration policy, however the protection provided by the Ministral Regulation still has not covered the third party involved. The Involvement of this third party is inevitable and should be protected immediatelyin order to prevent any abuse of personal data.
