Abstract

Sengketa kekayaan intelektual termasuk jenis sengketa yang sering muncul pada era perkembangan yang luar biasa di era digital ini. Namun, kerap kali terdapat permasalahan atas penyelesaian sengketa kekayaan intelektual hingga saat ini, termasuk tidak terakomodirnya kepastian hukum dalam berbagai putusan mengenai sengketa KI. Penelitian ini bertujuan untuk mengetahui urgensi pembentukan Pengadilan Khusus Kekayaan Intelektual di era digital dalam menyelesaikan sengketa kekayaan intelektual sesuai dengan asas peradilan cepat, sederhana, biaya ringan serta menilik prospektif pembentukan Pengadilan Khusus kekayaan Intelektual dapat memberikan kepercayaan terkait penegakan hukum bagi pemegang hak kekayaan intelektual di tengah kompleksitas sengketa digital. Penulis dalam penelitian ini menggunakan metode pendekatan yuridis normatif. Berdasarkan penelitian ini didapatkan hasil bahwa pembentukan pengadilan khusus ini dapat menjadi solusi untuk memastikan penyelesaian sengketa kekayaan intelektual sesuai dengan asas peradilan cepat, sederhana, dan biaya ringan serta memiliki prospek yang sangat baik untuk memberikan kepercayaan terkait penegakan hukum bagi pemegang hak kekayaan intelektual di tengah kompleksitas sengketa digital.

Abstract

The Metaverse is a new form of virtual interactive and physically cyber interaction where users can experience activities in a virtual environment that feels very real. For companies that utilize the Metaverse well, such as promoting or commercializing virtual products within it, it can bring significant profits. However, commercialization through cross-border technology often faces legal issues that arise. The use of brand elements on a product marketed by others without permission is a major issue in the field of brands, which also occurs in the digital world. This study aims to prove legal action against the use of famous brands in the Metaverse, as well as the legal actions that can be taken by owners of famous brands against the use of their brands in virtual Metaverse products. This study was conducted through a normative juridical approach using literature or secondary data as the main source. Based on the research conducted, it was found that the use of famous brand elements in the Metaverse is considered a violation of the brand, similar to brand violations in the real world in general. Therefore, based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications (Trademark Law) harmonized with the ITE Law, the rights of brand owners to take legal action to protect their brands will still apply even if the brand violations occur in the digital space.

Abstract

This research originates from a legal dispute involving Keenan Nasution and Rudi Pekerti, the original composers of the song Nuansa Bening, who filed a lawsuit against singer Vidi Aldiano under Case Number 51/Pdt.Sus-HKI/Cipta/2025/PN Niaga Jakarta Pusat. The composers claimed they had not received any royalties for over 16 years, despite the song being performed publicly 31 times without their authorization, and sought compensation of IDR 24,500,000,000 (twenty-four billion five hundred million rupiah). They also requested the seizure of Vidi Aldiano’s property in Cilandak, South Jakarta. This study employs a normative juridical approach, focusing on secondary data through literature review, including primary legal materials (laws and regulations), secondary legal sources (expert opinions), and tertiary references (legal dictionaries and related materials). The research is descriptive-analytical in nature, using normative qualitative data analysis. The findings reveal that based on Law Number 28 of 2014 concerning Copyright, songwriters as copyright holders are entitled to both moral and economic rights, which are legally protected. If those rights are violated, legal protection for the creators can be pursued based on the principles of automatic protection, recognition of moral rights, and the overarching principles of justice and legal certainty.

Abstract

Collective trademarks can be an alternative for trademark protection for Micro, Small, and Medium Enterprises (MSMEs) considering the greater benefits compared to regular trademarks. In 2024, there was an increase in the number of collective trademark applications, indicating that the public, especially MSMEs, are becoming more aware of the importance of trademark protection. However, issues have been found in the legislation regarding collective trademarks. This article aims to formulate the appropriate arrangements of collective trademark legislation that align with the MSME climate in Indonesia to achieve legal certainty. The research method used is normative juridical with a statutory approach, a conceptual approach, and a comparative approach. The regulation of collective trademarks in Indonesia will be compared with Brazil based on Law No. 9.279 of May 14, 1996, as amended by Law No. 14.200 of September 2, 2021. This research found that Law Number 20 of 2016 still contains several issues, namely the ambiguity of norms and articles that lead to multiple interpretations among the public. The provisions on collective trademarks in the Regulation of the Minister of Law and Human Rights Number 67 of 2016 (MIG Law) regulate substance similar to that stated in the MIG Law, whereas it should provide a more detailed and technical explanation. On the other hand, Law Number 15 of 2001, which was the previous regulation before the enactment of the MIG Law, provides a more comprehensive regulation on collective trademarks compared to the MIG Law. Thus, the legislation regarding collective trademarks does not yet provide legal certainty. The comparison with Brazil provides recommendations for appropriate arrangements, indicating the need for revisions and improvements to the legislation on collective trademarks to meet the need for more adequate regulations.
