Abstract

The Covid-19 pandemic has resulted in more people doing activities from home, so almost all activities are carried out online, including for educational activities. The problems on this research are how the comparison between fair use regulations in Indonesia and in the United States during the pre-Covid-19 pandemic? How the regulations of the doctrine of fair use to anticipate the occurrence of a new phenomenon regarding the use of copyright on digital platforms during and/or after the Covid-19 pandemic? The method used in writing this law is a normative juridical method. The results of the study conclude that Fair use rules in Indonesia already regulate that fair use will not harm the legitimate interests of creators but does not provide clear parameters regarding fair interests. While the Fair use Arrangements in the United States are regulated in 17 U.S. Code 107. In this regulation, there are 4 factors, namely: the purpose and character of the use, the nature of the copyrighted work, the quantity and importance of the material used, the effect of the use upon potential market or value of the copyrighted work. The Covid-19 pandemic gave rise to fair use cases that had never occurred before the outbreak of Covid-19, e.g. the case of The Internet Archive, it can be observed that there is an encouragement from the public to further relax copyright protection because of the Covid-19 pandemic resulting in the public interest having to be carried out rather than the creators and copyright holders.

Abstract

The song entitled "Masker dan Vaksin" released by Satuan Tugas Penanganan COVID-19 on YouTube is a modified song from the song "Galih dan Ratna" by Guruh Sukarno Putra. In addition, Indomusikgram creates video content on TikTok entitled "Tips Jaga Kesehatan" by modifying the song "Ampar-ampar Pisang" which was created by Hamiedan AC. The song contains a message to the public about preventing the COVID-19 virus. This research will focus on legal protection for the creators of modified song in digital platforms based on Law No. 28/2014 concerning Copyright. Furthermore, this research was also conducted to determine whether the fair use principle can be applied in modifying songwriting works on digital platforms based on Law Number 19/2016 concerning Information and Electronic Transactions. The writing method used is a normative juridical approach. This writing uses descriptive analytical writing specifications. In this writing phase is also done by writing literature by reffering to the laws and regulations, literature and other relevant documents. The results of this research shows that songwriters have the right to include their names in uploaded content on YouTube and TikTok by Indomusicgram and Satuan Tugas Penanganan COVID-19 based on Article 44 of Law No. 28/2014 concerning Copyright. Creators also have the right to refuse if they object to the modification of the song that occurs. Furthermore, the ITE Law does not regulate the principle of fair use of copyright. So it can be concluded from Article 25 of the ITE Law, the application of the principle of fair use to song copyrighted works modified on digital platforms during the COVID-19 pandemic still refers to the Copyright Law.

Abstract

Over-The-Top Services are a concrete form of technological developments whose existence makes it easier for people to carry out daily activities, for example to watch a movie and communicate. The phenomenon related to Over-The-Top Services that recently emerged due to the COVID-19 pandemic is watch party, which is an activity of watching movie together virtually with the help of Over-The-Top Services. This activity has the potential to violate Copyright because it can be categorized as the implementation of the economic rights of the creator or copyright holder of films that are watched without permission. On the other hand, watch party can also be categorized as acts that do not violate Copyright if they meet the fair use requirements based on Law Number 8 of 2014 on Copyright. This research was conducted with the aim of finding answers to these questions. This research was conducted using a normative juridical approach and a qualitative juridical analysis method, in which the author examines in depth the related primary, secondary, and tertiary legal materials. The results of the study indicate that the watch party activity is a form of announcement of creations and includes fair use because it is carried out without commercial purposes.

Abstract

The process of resolving brand criminal cases in court still refers to the principles of good justice, including the principle of contante justitie (simple, fast, and low cost). In practice, brand criminal cases were found that did not perfectly implement the principle of contante justitie for example the case of counterfeiting the Cressida and Damor brands which was decided by way of Central Jakarta District Court Decision Number 1778/Pid.B/2011/PN.JKT.Pst. The implementation of the contante justitie principle in the process of resolving trademark criminal cases is not optimal so that legal protection for brand owners who experience violations of trademark rights is difficult to obtain legal certainty. This condition occurs because there are obstacles both in terms of positive law which have not optimally regulated the settlement of criminal cases, especially brands and parties who are less cooperative in carrying out the case settlement process and trial agenda.

Abstract

Podcasts are basically digital audio content that is much loved by the public and audiobooks become one of the contents that have recently been incorporated into podcast content on a digital platform. The presence of this podcast-based audiobook raises a new problem in copyright related to its adaptation. This study aims to examine legal protection regarding podcast-based audiobooks from the perspective of copyright based on Indonesian Copyright Law and ITE Law. Furthermore, this study was also conducted to analyze the act of adapting books into podcast-based audiobooks on a digital platform carried out by content creators without the permission of the creators or copyright holders. This study uses normative juridical approach with descriptive specifications. The normative juridical approach is carried out by exploring legal theories and principles as well as applicable laws and regulations. This study describes legal problems that occur in society and is analyzed based on the applicable laws and regulations. The result of the study shows that copyright protection for podcast-based audiobook content has been regulated in several articles in the Copyright Law, including Article 40 paragraph (1) and Article 9 paragraph (1) regarding the right to adapt a creation. In addition, the act of adapting and uploading without permits made by content creators on a digital platform is considered to have violated the provisions of Article 9 of the Copyright Law and Article 25 of the ITE Law.

Abstract

The development of technology today makes humans coexist with technology. Many human activities can be carried out through the internet network. One of them is the presence of the metaverse which is a technology that contains virtual interactions, digital objects, and decentralized humans from various platforms. Metaverse is used by many people as a medium for buying and selling transactions. Metaverse users generally sell their products in the form of NFTs. Various well-known brands have started promoting their products through the metaverse. The emergence of well-known brands in the metaverse is an opportunity for irresponsible parties to infringe brand rights. As was the case in Ryder Ripps v. Yuga Labs. Pollution, imitation, obscuration, and so forth of well-known trademarks are carried out by irresponsible parties. One of them is the doctrine of Trademark Dilution. Trademark dilution is the unauthorized use by other parties that can weaken the quality or characteristics of a trademark. This makes the question of how the protection of trademarks in the virtual space of the metaverse and what legal action can be taken when there is a violation of trademark rights. Not many countries have regulated the protection of digital trademarks specifically against trademark dilution, as well as Indonesia. This research will be conducted using a non-native juridical approach method with legal sources in the form of laws and regulations, international agreements, theories, and legal rules. The focus of this research is how metaverse with the platform in it can protect the trademark with the terms and conditions agreement of account users in the platform. The result of this research is that brands can be protected against infringement of rights to the brand as well as brand dilution by referring to the terms and conditions of account users listed in the platform. In addition, the legal action that can be taken is to file a lawsuit as determined by the platform and the removal of related content.

Abstract

Saat ini dunia telah dihadapi perkembangan infrastruktur teknologi informasi, dan komunikasi (TIK) yang begitu pesat di era transformasi digital dan memasuki Revolusi Industri 5.0. Masifnya perkembangan dari platform digital Over The Top (OTT) merupakan hal yang menjadi pemicu dari hadirnya era transformasi digital dan Revolusi Industri 5.0. Dari berbagai aspek yang terdampak dari perkembangan TIK ini salah satunya yaitu aspek Kekayaan Intelektual diantaranya adalah Hak Cipta. Bahwa objek Hak Cipta yang sering dimanfaatkan salah satunya sebuah karya seni yang dapat dinikmati sebagai hiburan, yang mana pada saat ini para content creator yang dapat melakukan cover version sebuah lagu/musik yang dapat secara langsung dipublikasikan di platform digital yang mana hal ini erat kaitannya dengan batasan mengenai penggunaan wajar/fair use yang perlu diperhatikan para pengguna konten Hak Cipta Lagu/Musik di platform digital dimaksud. Penelitian ini menggunakan metode yuridis normatif yang terdiri atas bahan hukum primer berupa peraturan Perundang-undangan, bahan hukum sekunder berupa kajian literatur hukum dan bahan hukum tersier berupa kamus hukum serta literatur pendukung lainnya. Dengan tujuan, untuk memahami fenomena yang dimaksud dengan berlandaskan pada hukum yang berlaku. Hasil penelitian ini menunjukan bahwa, melihat masifnya perkembangan infrastruktur TIK dan juga Kekayaan Intelektual di era Industri 5.0 dan era transformasi digital, Pemerintah perlu membuat Peraturan Perundang-undangan yang lebih detil dan rinci tentang penggunaan wajar atau fair use dalam sistem Hak Cipta Indonesia dengan pendekatan melalui prinsip Hukum Transformatif dan tidak semata-mata melalui pendekatan hukum yang konservatif, bahwa dalam pembentukan hukum, harus diperhatikan variabel-variabel non hukum seperti, teknologi, ekonomi, ekosistem digital, dan sosial budaya.

Abstract

Perkembangan inovasi dalam transformasi digital turut mendorong kemajuan penggunaan teknologi informasi berupa Artificial Intelligence (AI) atau kecerdasan buatan. Pemanfaatan AI memiliki peran yang signifikan dalam kehidupan sehari-hari sehingga diperlukan pelindungan hukum yang baik terhadap inovasi-inovasi yang berkaitan dengan produk AI, khususnya berkaitan dengan pelindungan hak kekayaan intelektual berupa Paten. Oleh karena itu, pada penelitian ini akan mengkaji terkait pelindungan Paten atas produk AI dengan melakukan studi komparatif antara hukum Paten Jepang dengan hukum Paten Indonesia. Penelitian ini menggunakan metode yuridis normatif yang mencakup pendekatan perbandingan hukum. Hasil penelitian menunjukkan bahwa terdapat permasalahan hukum berupa kekaburan norma pelindungan Paten terhadap produk AI di Indonesia. Sementara itu, Jepang telah memiliki regulasi yang dapat menjamin kepastian hukum terkait pelindungan atas Paten produk AI. Melalui penelitian perbandingan hukum ini diharapkan dapat menjadi suatu sumbangan pemikiran serta masukan bagi pembentuk undang-undang serta pihak-pihak terkait di Indonesia dalam mengakomodir kepastian hukum terkait pelindungan Paten atas produk AI sebagai suatu invensi mutakhir.

Abstract

Dampak menyeluruh yang dialami oleh masyarakat seluruh dunia akibat dari wabah virus Covid-19 mensyaratkan adanya upaya penanggulangan yang perlu untuk ditempuh oleh pemerintah. Salah satu temuan teknologi yang memanfaatkan infrastruktur telekomunikasi, sistem, dan teknologi informasi bernama PeduliLindungi diselenggarakan oleh Pemerintah Indonesia melalui Keputusan Menteri Komunikasi dan Informatika Nomor 159 Tahun 2020 tentang Upaya Penanganan Corona Virus Disease 2019 (Covid-19) untuk melakukan tracing, tracking, warning and fencing pengguna aplikasi guna menanggulangi penyebaran virus Covid-19. Pengguna aplikasi perlu melakukan pendaftaran akun dengan mencantumkan data pribadi. Meskipun aplikasi ini secara praktis bermanfaat bagi masyarakat luas, namun penyelenggaraan aplikasi ini juga bersinggungan dengan perlindungan data pribadi. Penyelenggaraan aplikasi PeduliLindungi harus sesuai dengan prinsip dan pengaturan perlindungan data pribadi di Indonesia. Tujuan dari penelitian ini adalah agar dipahaminya penerapan perlindungan data pribadi dalam penyelenggaran aplikasi PeduliLindungi dan CovidSafe dan dianalisisnya perlindungan data pribadi di Indonesia dengan melakukan perbandingan regulasi di negara Australia. Hasil dari penelitian ini ditemukan bahwa Indonesia perlu untuk mengadopsi pengaturan di Australia tentang pemberian sanksi kepada penyalanggunaan data pribadi pada aplikasi surveilans kesehatan pasca pandemi berakhir.  Kata Kunci : Covid-19, Peduli Lindungi, Perlindungan Data Pribadi, Indonesia, Australia.

Abstract

The urgency of the fame of a marks that is currently important makes people more aware to protect well-known marks. In the case of the "Biostime" marks dispute that occurred between H&H Hong Kong Limited and PT Bogamulia Nagadi, there were legal problems regarding the cancellation of the mark which had similarities in essence with the well-known marks. The study was to determine the disparity between the judges considerations in the Supreme Court Decision No. 781/K/Pdt.Sus-HKI/2022 and the Commercial Court Decision No. 48/Pdt.Sus-Merek/2021/PN. Niaga.Jkt.Pst is in accordance with Law Number 20 of 2016 concerning MIG; and assess the accountability of the Directorate General of Intellectual Property of the Ministry of Law and Human Rights based on Law Number 20 of 2016 concerning MIG. This research uses research methods with a normative juridical. This research stage focuses on literature studies using secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. In addition, field studies were conducted by conducting interviews. Based on the results of the study, 2 (two) things can be concluded. First, the disparity between the consideration of Supreme Court Justices and Commercial Court Judges is in the criteria for famous marks. Second, DJKI's responsibility is to comply with and carry out the results of court decisions and provide legal protection for marks that have been officially registered.
