Abstract

The era of digitalization has brought about significant transformation in Indonesia's transportation sector through the emergence of online motorcycle taxis (ojol). However, despite their significant contribution to the economy and employment, ojol drivers face two fundamental problems: the lack of legal certainty regarding their employment status and the lack of adequate social security. This study aims to analyze the extent to which the draft Law on Road Traffic and Transportation (RUU LLAJ) currently under discussion can address these two issues. Using normative legal research methods and a descriptive-analytical approach, this article analyzes primary and secondary legal materials through the lens of Gustav Radbruch's Theory of Legal Certainty and T.H. Marshall's Theory of the Welfare State. The results of the study show that the LLAJ Bill is projected to become a comprehensive legal umbrella to provide legal certainty for drivers and require platforms to provide social security. Thus, the LLAJ Bill is expected to become the foundation for the creation of a fair and sustainable digital transportation ecosystem in Indonesia.

Abstract

Penelitian ini mengkaji kedudukan hukum rekrutmen Hakim Mahkamah Konstitusi pasca berlakunya UU No. 7 Tahun 2020 sebagai perubahan atas UU No. 24 Tahun 2003. Mekanisme rekrutmen memiliki arti penting karena menentukan independensi, imparsialitas, dan legitimasi Mahkamah Konstitusi sebagai penjaga konstitusi. Penelitian ini bertujuan menganalisis kerangka normatif pengangkatan, masa jabatan, serta peran lembaga pengusul, sekaligus merumuskan arah reformulasi rekrutmen. Metode berupa yuridis normatif diterapkan menjadi metode penelitian dengan pendekatan perundang-undangan serta konseptual dengan dukungan putusan Mahkamah Konstitusi yang relevan. Hasil yang didapat memberi penjelasan perihal desain rekrutmen saat ini menekankan kepastian hukum dan stabilitas kelembagaan melalui masa jabatan hingga usia 70 tahun, namun masih problematis karena minimnya transparansi, lemahnya partisipasi publik, dan potensi ketergantungan pada lembaga pengusul. Penelitian ini merekomendasikan seleksi terbuka, panel independen, uji publik, dan standar konflik kepentingan yang ketat.

Abstract

The Supreme Court has issued Supreme Court Regulation No. 7 of 2022, which has significant impacts despite generating various societal opinions. It is important to evaluate the implementation of this regulation to ensure the presence and effectiveness of compliance in the electronic court proceedings. The conceptual framework of this research is based on the concepts of e-court services and electronic courts, with the theories employed including policy implementation theory, legal certainty, effectiveness, and legal system theory. The Normative Juridical approach is a legal research method emphasizing the study of norms or legal rules stipulated in legislation. The findings indicate that the implementation of e-court services is outlined in Supreme Court Regulation Number 7 of 2022. Courts must prepare skilled judges and provide adequate infrastructure. The implementation of e-court has successfully increased the efficiency of legal processes and reduced the administrative and financial burden on the parties involved in cases. This research concludes that the implementation of e-court services has brought about increased efficiency in the proceedings of religious civil cases. Recommendations for improvement include conducting evaluations to ensure that all case resolutions through e-court services comply with the letter from the Director General of the Religious Courts Agency dated June 7, 2024, No. 1295/DJA/HK2.6/VI/2024.

Abstract

Background: Government procurement of goods and services is a strategic instrument in state financial management that must be implemented based on the rule of law, fair competition, and integrity. However, flag-borrowing practices (manifested in bid rigging, the use of falsified documents, and contract management by parties outside the official corporate structure) reveal distortions in the legal identity of business entities within the procurement system. Objective: This article examines the alignment between the conception and practice of blacklists and the principle of the rule of law, and formulates a normative reconstruction based on responsive regulation to sustainably prevent flag-borrowing practices. Methods: This study employs a normative juridical method using statutory and conceptual approaches, enriched by a socio-legal perspective through a case study of the Ministry of Law and Human Rights. Results: The analysis shows that the absence of a limitation period, the lack of an explicit obligation for proportionality review, and issues of enforcement temporality create disharmony between the objective of regulatory guidance and the principle of legal certainty. Conclusion: The reconstruction of blacklists should be directed toward five pillars: affirmation of a system-integrity orientation, temporal limitation of sanctions, proportionality review, beneficial ownership transparency, and a compliance-based rehabilitation mechanism. Through this approach, blacklists can be repositioned as a responsive, constitutional, and effective legal guidance instrument for preventing flag-borrowing practices in Indonesian public procurement.

Abstract

This research examines and analyzes the concept and regulation of the trademark dilution doctrine, which has long developed in the United States, as a form of legal comparison, as well as the implementation of the dilution doctrine in the substantive examination of trademark registration in Indonesia. The research method used is normative juridical research employing statutory, conceptual, comparative, and case study approaches. This study uses secondary data in the form of primary, secondary, and tertiary legal materials, which are then qualitatively analyzed. Data collection techniques involve literature study by tracing widely published written information. The results of this study show that trademark violations in Indonesia are dominated by imitation marks, thereby requiring legal reform in trademark law through the adoption of the dilution doctrine similar to that of the United States. Article 21 paragraph (1)(c) of the Indonesian Trademark and Geographical Indication Law mandates the application of the dilution doctrine, although it does not explicitly regulate it. This indicates that Indonesia has the potential to implement the dilution doctrine. However, the significant differences between the United States and Indonesia make full implementation of the doctrine difficult. One of the main challenges in implementing the dilution doctrine is the communal character of Indonesian society. When analyzed using Jeremy Bentham’s Utilitarianism Theory, the result shows that implementing the dilution doctrine would produce greater pain for Indonesia. Therefore, adjustments and legal formulations are needed to accommodate the interests of all parties, including clear and detailed regulations that govern dispute resolution and evidentiary standards in court. The implementation of the dilution doctrine in substantive examination also needs to be tightened to reduce future trademark disputes.

Abstract

Rapid This study examines the effectiveness of environmental legal instruments in addressing water access inequalities in multicultural rural communities. Despite the existence of various legal frameworks, disparities in water access remain prevalent, especially in rural areas where socio economic, cultural, and governance challenges persist. Legal instruments such as the Water Framework Directive (WFD) and the Clean Water Act (CWA) have proven effective in improving water quality and access in urban settings, but their impact in rural communities is often limited. The study explores the role of legal pluralism, where both statutory and customary laws coexist, in enhancing water governance. It also evaluates the importance of integrating cultural sensitivity into legal frameworks to foster community participation and sustainable water management. Through a mixed methods approach combining legal analysis and socio economic assessments, this study provides insights into the barriers to effective water governance and proposes policy recommendations for improving water access. Key findings suggest that inclusive governance models, which respect local customs and empower communities, lead to more sustainable and equitable water management outcomes. The study highlights the need for legal reforms that recognize the diverse cultural, governance, and infrastructural contexts of rural communities, ensuring that water access policies are both culturally adaptive and legally effective. By integrating these approaches, future policies can more effectively tackle water access inequalities in multicultural rural settings.

Abstract

Fenomena aksi anarkis dalam demonstrasi di Indonesia menunjukkan adanya persoalan mendasar dalam sistem penegakan hukum, khususnya dalam relasi antara masyarakat sipil dan aparat kepolisian. Aksi demonstrasi yang secara konstitusional dijamin sebagai hak menyampaikan pendapat kerap berujung pada bentrokan akibat penanganan yang tidak proporsional serta minimnya kepercayaan publik terhadap aparat penegak hukum. Penelitian ini bertujuan untuk menganalisis penanganan aksi anarkis masyarakat sipil terhadap aparat kepolisian melalui perspektif teori sistem hukum Lawrence M. Friedman yang menekankan keterkaitan antara struktur hukum, substansi hukum dan budaya hukum. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan studi literatur dan analisis deskriptif terhadap peraturan perundang-undangan, laporan lembaga swadaya masyarakat, serta studi kasus demonstrasi di Indonesia. Hasil penelitian menunjukkan bahwa aksi anarkis dipicu oleh ketidakseimbangan sistem hukum, yang tercermin dari lemahnya mekanisme pengawasan aparat, ambiguitas regulasi terkait kebebasan berpendapat dan penggunaan kekuatan, serta rendahnya budaya hukum baik di kalangan aparat maupun masyarakat. Kesimpulan penelitian ini menegaskan perlunya reformasi hukum yang komprehensif melalui penguatan akuntabilitas aparat, penegasan regulasi yang berorientasi pada hak asasi manusia dan pembentukan budaya hukum yang mengedepankan dialog serta de-eskalasi konflik. Kontribusi penelitian ini terletak pada penguatan analisis sistemik penanganan aksi anarkis berbasis teori Friedman sebagai pendekatan preventif dalam memperkuat kepercayaan publik terhadap sistem hukum.

Abstract

Penelitian ini mengkaji implementasi kebijakan buku murah dalam pemenuhan hak literasi publik di Kota Semarang dengan menggunakan pendekatan normatif-empiris dan teori utilitarianisme John Stuart Mill sebagai landasan analisis. Melalui survei dan analisis regulasi, ditemukan bahwa keterjangkauan buku masih menjadi hambatan utama bagi mahasiswa dan pelajar, meskipun minat baca masyarakat tergolong tinggi. Kebijakan Indonesia seperti Buku Sekolah Elektronik (BSE) belum mampu menghadirkan pemerataan akses literasi secara berkelanjutan. Sebaliknya, praktik India melalui NCERT, NBT dan mekanisme Low Price Edition menunjukkan model kebijakan yang lebih sistematis dan berdampak luas, termasuk penurunan harga sekitar 20% dan distribusi hingga 150 juta eksemplar. Hasil penelitian menunjukkan bahwa tingginya harga buku menciptakan ketimpangan akses terhadap literatur berkualitas dan mendorong strategi alternatif seperti: pinjam, membeli buku bekas, atau mengakses versi ilegal. Oleh karena itu, penelitian ini menawarkan skema kebijakan "60:40" sebagai solusi, yaitu pemerintah membeli 60% hak ekonomi buku untuk dicetak dalam versi murah, sementara penerbit tetap memproduksi 40% edisi premium. Skema ini dinilai sejalan dengan prinsip utilitarianisme yang menempatkan kebahagiaan intelektual sebagai kesenangan bermutu tinggi, sekaligus mewujudkan amanat UU Sistem Perbukuan untuk menyediakan buku yang bermutu, murah dan merata.

Abstract

Tindak pidana pembunuhan tidak hanya mengakibatkan konsekuensi pidana bagi pelaku, tetapi juga membuka ruang pertanggungjawaban perdata yang memungkinkan keluarga korban untuk menuntut ganti rugi. Tujuan penelitian ini adalah untuk melihat bagaimana Pasal 1370 KUHPerdata berlaku bagi tuntutan ganti rugi keluarga korban pembunuhan. Studi ini menggunakan teori onrechtmatige daad L.C. Hoffman dan teori keadilan Aristoteles sebagai kerangka teoretis. Penelitian ini menerapkan metode kualitatif dan mengklasifikasikan jenis penelitian sebagai hukum normatif dengan melakukan kajian pustaka terhadap sumber hukum primer, sekunder dan tersier. Temuan penelitian mengindikasikan bahwa keluarga pihak yang dirugikan memiliki landasan hukum yang kokoh untuk meminta kompensasi sesuai dengan Pasal 1370 Kitab Undang-Undang Hukum Perdata. Konsep onrechtmatige daad, yang mencakup komponen tindakan melanggar hukum, kesalahan, kerugian dan hubungan kausal, membentuk struktur hukum dari pasal ini. Dalam menentukan proporsionalitas ganti rugi berdasarkan kemampuan ekonomi pelaku dan kebutuhan pemulihan korban, teori keadilan Aristoteles memberikan dimensi filosofis. Studi ini memberikan panduan menyeluruh yang mengintegrasikan aspek hukum formal, konsep tanggung jawab perdata dan prinsip keadilan untuk menawarkan perlindungan hukum yang signifikan kepada keluarga korban pembunuhan di dalam sistem hukum perdata di Indonesia.

Abstract

Artikel ini membahas penerapan keadilan substantif dalam putusan kasus korupsi Harvey Moeis dengan menggunakan teori hukum Gustav Radbruch sebagai dasar analisis. Melalui metode studi literatur, penelitian menelaah putusan pengadilan, ketentuan UU Tipikor, teori kepastian hukum Jan Michiel Otto, serta konsep keadilan substantif yang menekankan integrasi antara kepastian hukum, keadilan dan kemanfaatan. Hasil kajian menunjukkan bahwa putusan tingkat pertama yang menjatuhkan pidana 6 tahun 6 bulan belum mencerminkan proporsionalitas terhadap besarnya kerugian negara yang mencapai ratusan triliun rupiah. Ketidaksesuaian ini menimbulkan disparitas pemidanaan apabila dibandingkan dengan kasus-kasus korupsi besar lainnya, sehingga memunculkan pertanyaan mengenai konsistensi dan efektivitas pemidanaan di Indonesia. Dalam perspektif Radbruch, putusan tersebut belum sepenuhnya memenuhi tuntutan keadilan substantif dan kemanfaatan sosial, terutama karena belum memberikan efek jera yang kuat dan belum sepenuhnya memulihkan kepercayaan publik. Studi ini berkontribusi pada wacana reformasi pemidanaan dengan menegaskan perlunya pedoman pemidanaan yang lebih terukur dan konsisten dalam perkara korupsi.
