Abstract

The cultural diversity of Indonesia is well-known. Each region in Indonesia has its own folklore, which is derived from the local community. This folklore is known as folklore because it is primarily transmitted orally or through speech. The concept of individualistic and capitalistic western society does not allow (precludes) the protection of local communities' intellectual property rights, particularly their folklore, which is generally not owned individually by the members of the community in question (collectively). As a result, many incidents of misappropriation of Indonesian folklore works and their economic potential benefit foreigners more than indigenous peoples, as in the case of misappropriation of Sunan Kalijaga's folklore. The purpose of this study is to investigate the concept of protecting IPR against Sunan Kalijaga folklore in the context of optimal utilization of economic potential for the benefit of the local/customary community of Demak, as well as the obstacles encountered during the protection process. This study employs a normative juridical research method conducted through interviews, as well as a statutory approach to examine cases of rights abuse and commodification. The findings revealed that writing books and commodifying folklore into an electronic cinema based on folklore with the inclusion of the creator's name is not appropriate because folklore copyright is included as one of folklore and is owned by the state, in this case managed and represented by the government. The people who live in the area where the folklore originated have a moral and economic right to use the folklore. The Copyright Act does not adequately represent the related rights owned by the Demak local/customary community as a community of original stakeholders of Sunan Kalijaga folklore. This is due to the Copyright Act's still abstract arrangement of folklore, the characteristics of the community itself, which are communalistic and religious and do not understand IPR, and the ease with which foreigners can obtain Copyright protection for folklore works they publish. However, there are several protective mechanisms that can be used, including criminal law efforts, civil law, and documentation as a defensive measure. As a result, the government must educate the public about the significance of legal protection for folklore and revise the folklore regulation in the Copyright Act. Keywords: Folklore, indigenous peoples, Intellectual Property Rights AbstrakIndonesia dikenal dengan keanekaragaman budayanya. Setiap wilayah di Indonesia mempunyai cerita rakyat masing-masing yang berasal dari masyarakat daerahnya. Cerita rakyat ini pada dasarnya disebarkan melalui tutur kata atau lisan serta dikenal sebagai folkore. Konsep masyarakat barat yang individualistik dan kapitalistik tidak memungkinkan (preclude) untuk melindungi hak-hak dari masyarakat lokal atas kekayaan intelektual khususnya folklore mereka yang pada umumnya tidak dimiliki secara individual oleh anggota masyarakat yang bersangkutan (kolektif). Akibatnya, banyak terjadi peristiwa penyalahgunaan hak (misappropriation) atas karya-karya folklore Indonesia dan potensi ekonominya lebih banyak dinikmati oleh orang asing daripada masyarakat adat itu sendiri, seperti pada kasus misappropriation cerita rakyat Sunan Kalijaga. Bertujuan untuk mengkaji konsep perlindungan HKI terhadap folklore cerita rakyat Sunan Kalijaga dalam rangka pemanfaatan potensi ekonomi yang optimal bagi keuntungan masyarakat lokal/adat Demak serta kendala yang dihadapi dalam proses perindungan yang dilakukan. Penelitian ini menggunakan metode penelitian yuridis normatif, yang dilakukan dengan cara wawancara, dan menggunakan pendekatan perundang-undangan (statute approach) melihat kasus penyalahgunaan hak dan komodifikasi. Hasil penelitian menunjukkan bahwa Penulisan buku maupun komodifikasi cerita rakyat menjadi sinema elektronik yang berdasarkan cerita rakyat dengan pencantuman nama pencipta tidaklah tepat karena hak cipta atas cerita rakyat termasuk sebagai salah satu folklore serta dimiliki oleh negara, dalam hal ini dikelola dan diwakili oleh pemerintah. Masyarakat daerah asal cerita rakyat tersebut berada juga berhak atas pemanfaatan atas cerita rakyat tersebut, baik dari sisi hak moral dan hak ekonomi. Undang-Undang Hak Cipta belum cukup merepresentasi hak terkait yang dimiliki oleh masyarakat lokal/adat Demak sebagai komunitas pemangku asli folklore cerita rakyat Sunan Kalijaga. Hal ini disebabkan pengaturan folklore yang masih abstrak dalam Undang-Undang Hak Cipta, ciri masyarakatnya sendiri yang komunalistik dan religius serta tidak paham HKI dan mudahnya orang asing memperoleh perlindungan hak cipta atas karya folklore yang dipublikasikannya. Walaupun demikian ada beberapa mekanisme perlindungan yang dapat diterapkan, yakni upaya hukum pidana, hukum perdata, tindakan dokumentasi sebagai sarana defensive protection. Oleh karena itu, Pemerintah perlu melakukan sosialisasi mengenai pentingnya perlindungan hukum atas folklore serta mengkaji ulang pengaturan folklore di dalam Undang-Undang Hak Cipta. Kata Kunci: Folklore, masyarakat adat, Kekayaan Intelektual

Abstract

Kemajuan teknologi informasi dan komunikasi telah membawa banyak perubahan dalam kehidupan. Sosial media tidak hanya digunakan sebagai alat komunikasi, tetapi juga memiliki berbagai fungsi lain, termasuk sebagai platform untuk menyajikan konten pembelajaran digital. Penggunaan sosial media untuk menyajikan konten edukasi atau pembelajaran digital dapat membantu mengidentifikasi materi tambahan, memperluas materi pembelajaran, dan berbagi pengetahuan dengan pengguna lainnya. Tujuan pada penelitian ini adalah menganalisis Pemanfaatan Sosial Media Sebagai Media Penyajian Konten Pembelajaran Digital. Penelitian ini menggunakan metode Systematic Literature Review (SLR). Tujuan penelitian metode Systematic Literature Review (SLR) untuk mengevaluasi, meninjau dan mengenali penelitian yang relevan sehingga mampu menjawab pertanyaan pada penelitian yang ditentukan. Hasi penelitian menunjukkan bahwa platform sosial media seperti Instagram, Facebook, YouTube, dan TikTok dapat dimanfaatkan sebagai media penyajian untuk konten edukasi atau pembelajaran digital, yang membantu pengguna menambah pengetahuan dan wawasan baru.

Abstract

Pengembangan media pembelajaran interaktif yang mengintegrasikan short video learning dengan aplikasi Articulate Storyline merupakan upaya peneliti untuk meningkatkan hasil belajar siswa di SMPN 32 Banjarmasin. Penelitian ini menggunakan metode R&D dengan model 4D, yang terdiri dari empat tahap: define, design, develop, dan disseminate. Populasi dalam penelitian ini sebanyak 38 siswa yang terbagi dalam dua kelas yaitu kelas kontrol (kelas VII A) dan kelas eksperimen (kelas VII B), sampel dalam penelitian ini adalah kelas eksperimen sebanyak 19 siswa. Instrumen penelitian yang digunakan meliputi wawancara, observasi, angket, dan tes. Hasil data dikumpulkan dan diolah dengan metode kualitatif dan kuantitatif. Temuan dalam riset memperlihatkan media pembelajaran interaktif yang dibuat mendapat kategori "sangat layak" dari validasi ahli media dengan skor 94% dan kategori "layak" dari validasi ahli materi dengan skor 75%. Selain itu, penggunaan media ini berhasil meningkatkan hasil belajar siswa, ditunjukkan oleh skor N-gain di kelas eksperimen sebanyak 0,72 dengan kategori “tinggi”. Temuan ini menegaskan bahwa penggunaan short video learning dalam media pembelajaran interaktif berdampak positif terhadap hasil belajar siswa, sehingga dapat menjadi sarana efektif dalam pembelajaran Ilmu Pengetahuan Alam di SMPN 32 Banjarmasin.

Abstract

The “merdeka belajar” curriculum was socialized more than one year ago. Every school is obliged to implement the curriculum to adapt to change, especially for driving schools that are pioneers, as well as pilot projects for new paradigm changes in the learning process. For this reason, school principals must prepare teachers as early as possible to be competent in following the existing rhythm of change. This study aims to analyze the influence of teacher readiness in implementing the independent learning curriculum in driving schools. This study used a quantitative approach, with 53 teachers selected as respondents using a saturated sampling technique. The research instrument used a questionnaire, and the data analysis technique used was multiple linear regression. The study's results found that intrinsic and extrinsic motivation significantly affected individual readiness to change, in this case, the teacher implementing the independent learning curriculum in driving schools. The results of this study are expected to provide input to school principals regarding motivating all teachers according to the characteristics and stages needed because every teacher has a different background.

Abstract

Managerial is an adjective related to leadership and management. In many literatures, the word managerial is often referred to as the origin of the word management which means to train horses or is literally interpreted as to handle which means to take care of, handle or control. Meanwhile, management is a noun which can mean management, leadership or administration. In principle, the definition of management has several characteristics as follows: (1) there is a goal to be achieved; (2) as a combination of science and art; (3) is a systematic, coordinated, cooperative and integrated process in utilizing its elements; (4) there are two people ormore who work together in an organization; (5) based on the division of work, duties and responsibilities; (6) includes multiple functions; (7) is a tool to achieve goals. The techniques used in this research on improving teacher quality are participatory observation techniques, in-depth interviews, and documentation. To obtain the data needed in this research, the researcher used several methods in the data collection process. The methods used to collect data in the field are the observation method, interview method and documentation method.

Abstract

This study seeks to determine the strategy of library management as a means of literacy culture in elementary schools. This study aimed to determine the involvement of school libraries and librarians in enhancing literacy culture in elementary schools. This study uses a qualitative method with a case study approach. Data collection techniques using in-depth interviews, observation, and documentation. Informants in this study were school librarians at MIN 1 Tulungagung. Data analysis techniques include data collection, reduction, presentation, and conclusion. The study results show that the role of the school library in implementing literacy culture includes preparing facilities and infrastructure, facilitating school literacy movement activities, as a facilitator and preparing all the needs for the continuation of the school literacy movement.

Abstract

Media short video learning merupakan inovasi pembelajaran digital yang menawarkan konten singkat, mudah dipahami dan menarik. Short video efektif karena fokus pada pada satu topik secara ringkas sehingga memudahkan pemahaman, meningkatkan daya ingat, serta pengembangan keterampilan siswa. Tujuan dari penulisan ini adalah menjelaskan potensi dan manfaat media short video learning dalam mendukung pembelajaran, khususnya dalam konteks self-paced learning, di mana siswa mengendalikan waktu dan kecepatan belajar. Metode yang digunakan adalah studi literatur, yang datanya berasal dari artikel ilmiah, dan penelitian relevan. Hasil penulisan ini menunjukkan bahwa media short video learning meningkatkan efektivitas dan efisiensi pembelajaran, serta memungkinkan siswa untuk mengulang materi sesuai kebutuhan meraka, dalam pengembangan keterampilan metode Metode Self-Paced Learning. Kesimpulanya, media short video learning sangat signifikan dalam mendukung pembelajaran berbasis teknologi, memungkinkan siswa belajar secara mandiri, fleksibel, dan personal, sesuai kebutuhan. Potensinya menjadikan short video learning sebagai salah satu media yang relevan dan strategis dalam pembelajaran modern.

Abstract

This study uses the material object of poetry Risa>lah Ila> Jama>l ‘Abd Al-Na>s}ir by Niza>r Qabba>ni using the formal object of Riffaterre's semiotics. The results of this study reveal that poetry Risa>lah Ila> Jama>l ‘Abd Al-Na>s}ir terms of heuristic reading, it is still scattered, fragmented, and not yet centralized. The retroactive or hermeneutical reading, in its actual hipogram, expresses a salutary homage to the first stanza indicated byDoves, ships and ferries the Nile with symbols accompanying them. as well as in the second stanza which reveals several questions, namely:In what era do you live?, In what era of inspirers?, And in what era of wizards? Which disassembled on this reading. The model in this poem is found in the sentences in each stanza. First pertama Kursiyyuka al-mahju>ru fī (minsyiyyatu al-bakri>) yabki> fa>risu al-ahla>m and the second Nuji>buhum: fi> as}rin ‘abd al-nas}hir the first sentence that reflects a power and leadership, namely "your seat left behind at Mansheya El-Bakry weeps for the dream knight". the second sentence which is the answer to the question, namely Nuji>buhum: fi> as}rin ‘Abd Al-Na>s}ir. The poetry matrix obtained is "Patriotism" in a leadership perspective. As well as linking the actual Hipogram with the holy verses of the Qur'an about leadership, Q.S Sad ayat 26.

Abstract

Dokumentasi keperawatan merupakan poin penting untuk menilai kualitas pemberian layanan keperawatan kepada pasien. Namun, saat ini masih sering terabaikan karena faktor beban kerja perawat yang dianggap masih tinggi. Salah satu indikator untuk melihat beban kerja perawat adalah dengan melihat nilai bed turnover (BTO) dan bed occupancy rate (BOR) ruangan. Penelitian ini bertujuan untuk mengindentifikasi hubungan antara BTO dan BOR terhadap kualitas dokumentasi keperawatan di ruang rawat inap. Penelitian ini menggunakan survei analitik cross sectional study. Dokumen asuhan keperawatan yang digunakan sebanyak 420 dokumen yang dilakukan secara cluster sampling dan diukur dengan menggunakan instrumen Modified Q-Dio serta nilai BTO dan BOR ruangan rawat inap yang dihitung dari data sensus pasien. Analisa data dengan meggunakan uji spearman rank correlation. Hasil penelitian menunjukkan bahwa ada hubungan positif antara BTO dan BOR terhadap kualitas dokumentasi keperawatan. Temuan ini mengindikasikan bahwa faktor beban kerja bukan menjadi halangan bagi perawat dalam membuat asuhan keperawatan yang berkualitas.

Abstract

Soybean cultivation in tropical regions, such as Indonesia, is often constrained by photoperiod sensitivity, resulting in low yield. Using long juvenile traits in short photoperiod tropical areas resulted in lines with late flowering time and high yield. Genetic diversity analysis of soybean lines using molecular markers is a critical step for breeding high-yielding soybean lines. This study aimed to analyze genetic diversity and construct DNA barcodes for 44 tropical soybean superior lines based on 17 SSR markers. Genetic materials used were the high-yielding F5 soybean lines developed for their adaptation to short day-length of low latitude tropical regions. SSR markers used were those that distributed well across the soybean genome and proven their usefulness for soybean genetic diversity analyses. Results showed that the SSR demonstrated distinctive polymorphism among the 44 lines. A total of 377 alleles were detected with an average of 22.8 alleles per SSR locus. Polymorphism information content (PIC) values varied from 0.77 to 0.96 with an average of 0.90. Phylogenetic analysis showed that the 44 soybean genotypes were divided into 2 main clusters. Five markers, i.e., satt009, satt646, satt147, satt431, and satt191, with a polymorphism information content value of ≥0.94, were found to be informative and suitable for DNA barcode construction. Each of the 44 lines was assigned with specific barcodes. The barcodes constructed from this study should be useful for DNA fingerprinting as well as protection purposes of the specific superior soybean lines analyzed in this study.
