Abstract

This research aims to explore the views of Islamic law on the use of castration punishment in cases of sexual crimes against children and then relate it to the theory of justice put forward by John Rawls. This type of research is library research with a normative approach. Analysis was carried out using a qualitative descriptive approach. The results of this research are that there are two conditions. First, when the victim is the same as the perpetrator, this is called Liwath Sodomy and is punishable by death. Second, when the victim is not of the same type as the perpetrator, Zina is condemned; the sanction is for those who are married to be stoned to death and for those who are not married to be bound 100 times. Islam does not recognize the punishment of castration, so the law is ta'zir, but this does not mean that castration can punish perpetrators of sexual crimes against children. Furthermore, when related to John Rawls's theory of justice, first, the principle of equal standing emphasizes the importance of providing equal opportunities to all individuals, including criminals, to improve their social position. Second, the principle of equitable differences requires that inequality in society is only acceptable if it benefits the most disadvantaged. In the context of castration, the question is whether the action benefits the victim or society. Therefore, Jonh Rawls's concept of justice indirectly does not recognize the punishment of castration for sexual crimes against children.

Abstract

The research explores the issue of child custody (hadhanah) in Indonesia after divorce, focusing on the challenges arising from the increasing divorce rates. It addresses the gap between classical Islamic jurisprudence, which traditionally prioritizes maternal rights, and the modern social realities that necessitate multidimensional considerations—legal, psychological, and social. The novelty of this study lies in its attempt to reconstruct the concept of child custody by harmonizing the principles of Islamic family law with the evolving needs of modern Indonesian society. This is achieved through the reinterpretation of classical fiqh texts using contemporary approaches, such as maslahah mursalah (public interest) and maqasid al-shariah (objectives of Islamic law), to align them with the principle of the best interest of the child. The research employs a qualitative methodology with a normative-sociological approach, supported by a literature review. Primary data is derived from classical Islamic jurisprudence literature and contemporary Islamic legal thought, while secondary data includes Indonesian legislation such as the Compilation of Islamic Law and the Marriage Law, alongside relevant scholarly articles. The findings reveal the urgent need to reinterpret the concept of hadhanah in a way that reflects current social, legal, and psychological considerations. The research emphasizes that harmonizing traditional sharia norms with modern social realities will enable the application of more humanistic Islamic law, thus contributing to the development of a contextual and equitable framework for Islamic family law in Indonesia. This approach helps address contemporary challenges and strengthens the adaptability of Islamic family law in the modern era.

Abstract

Polygamy is a sensitive issue in Islamic marriage law, which is regulated differently in each Muslim country. Indonesia and Brunei Darussalam both adhere to Islamic law, but have different legal approaches to granting permission for polygamy. This study will explore the legal provisions regarding permission for polygamy in Islamic marriage regulations, and will also discuss the similarities and differences in the procedures for granting permission for polygamy between Indonesia and Brunei Darussalam. This study is a comparative normative legal study utilizing the statute approach and comparative approach. The results of the study indicate that Indonesia and Brunei Darussalam both require permission for polygamy based on the principles of fairness and the husband's financial capability, but differ in their procedures and penalties. In Indonesia, permission must be obtained through the Religious Court with the consent of the first wife, while in Brunei, permission is granted by a judge with a penalty of a $2,000 fine for those who marry without written permission. This difference reflects Indonesia's more flexible legal system compared to Brunei, which enforces Islamic law more strictly.
