Abstract

Indonesia is the world’s largest coconut producer. As a result, coconuts play an important role in sustaining millions of Indonesians' livelihoods. In 2021, a fear of cooking oil emerged, leading to a decline in production levels, reduced income for individuals, and an increase in commodity pricing both domestically and internationally. The scarcity of cooking oil, notwithstanding Indonesia's position as the leading global producer, indicates an imbalance between supply and demand. This research aims to investigate production problems as the root cause of coconut industry shortages, identify productivity-related issues through a literature review, and assess the urgency of the criteria presented in five Linkert scales. Listing problems is critical for determining the root of the problem, as well as the potential for increasing revenue and ensuring long-term sustainability through value-added initiatives in the green supply chain management (GSCM) scope. This study uses TOPSIS and MOORA analysis, a way of making decisions based on levels of importance and enabler barriers in the coconut industry, focusing on production and productivity.

Abstract

This study aims to analyze the urgency of specific regulations for genomic data protection in Indonesia using a normative juridical approach and a comparative legal method with the European Union's General Data Protection Regulation (GDPR) and the Australian Privacy Act. Genomic data has unique characteristics that distinguish it from other personal data, requiring stricter legal protection. The analysis examines Indonesia’s Personal Data Protection Law (Law No. 27 of 2022) to identify regulatory weaknesses in ownership rights, informed consent mechanisms, data security, and cross-border data transfers. The findings reveal that Indonesia lacks explicit provisions recognizing genomic data as a special category requiring higher protection standards. Referring to best practices from the GDPR and the Australian Privacy Act, this study recommends establishing specific regulations covering data ownership protection, strengthening consent mechanisms, and enhancing oversight of genomic data security and transfers. Implementing stricter regulations is expected to safeguard individual privacy while supporting research and innovation in healthcare and biotechnology.

Abstract

Korupsi merupakan tantangan serius dalam sistem ketatanegaraan Indonesia yang menghambat terwujudnya keadilan dan tata kelola pemerintahan yang bersih. Mekanisme checks and balances yang diadopsi dari tradisi demokrasi modern telah dijalankan melalui lembaga-lembaga negara, tetapi efektivitasnya kerap melemah akibat intervensi politik dan lemahnya integritas pejabat publik. Penelitian ini bertujuan menganalisis sinergi antara fiqh siyasah dan konsep checks and balances dalam memperkuat strategi pemberantasan korupsi di Indonesia. Metode yang digunakan adalah kualitatif dengan pendekatan normatif-yuridis melalui studi literatur terhadap fiqh siyasah klasik, regulasi hukum tata negara, serta penelitian terdahulu. Hasil penelitian menunjukkan bahwa integrasi kedua perspektif ini mampu menghadirkan model pengawasan yang lebih komprehensif, karena menggabungkan kerangka etis keagamaan dengan instrumen hukum konstitusional. Implikasinya, pemberantasan korupsi tidak hanya berorientasi pada aspek legal formal, tetapi juga menumbuhkan kesadaran moral dan spiritual, sehingga memperkuat legitimasi sosial dan keberlanjutan gerakan antikorupsi.

Abstract

This research discusses the position of biological fathers in the Constitutional Court decision Number 46/PUU-VIII/2010, then will also look at the views of the Penghulu in the KUA of Sipirok District. This is field research at the location of the Sipirok District KUA, and the primary data is the decision of the Constitutional Court Number 46/PUU-VIII/2010 and the understanding of the head of the Sipirok District KUA, and secondary data in the form of books, journal articles, and other parts. Next, the data was obtained using interview and documentation techniques and then analyzed using descriptive analysis techniques. The results of this research are as follows: First, in the decision of the Constitutional Court Number 46/PUU-VIII/2010, there was a reduction in the provisions in Article 100 KHI and Article 43 of Law No. 1 of 1974 concerning marriage. This change states that children born out of wedlock have a family relationship with their mother and their mother's family and with a man recognized as their father based on scientific and technological evidence or other legally valid evidence. The child was also recognized as having a civil relationship with his father's family. So, with this decision, the biological father can become the guardian of the marriage with DNA test evidence. Second: The Penghulu references Sipirok District KUA, Constitutional Court decision Number 46/PUU-VIII/2010. It has yet to be implemented directly, and they prefer to use guardian judges according to the rules of fiqh and customs in the area.

Abstract

In the Islamic law there is a marriage prohibition related to time, which is a prohibition on getting married when a person performs ihram, both the ihram of hajj and ihram of umrah and in the iddah period. The people of Sibiruang Village, Koto Kampar Hulu District, Kampar Regency, Riau Province, besides adhering to Islamic law, are still firmly adhered to the customs that have been passed hereditary to the prohibition of marriage between two praying sermons of Eid al-Fitr and Eid al-Adha or from the 1st Shawwal after the Eid al-Fitr to 10 Zulhijjah before the Eid al-Adha. Sibiruang people believe if someone violates, he will get a negative impact on the life of his family someday. This articlewants to examine the marriage prohibition between two praying sermons of Eid al-Fitr and Eid al-Adha and the traditional custom sanctions for those who break the perspective of Islamic law.[Dalam hukum Islam terdapat larangan perkawinan yang berkaitan dengan waktu, yaitu larangan untuk melakukan perkawinan ketika seseorang melakukan ihram, baik ihram haji maupun ihram umrah, dan pada masa iddah. Masyarakat Desa Sibiruang Kecamatan Koto Kampar Hulu Kabupaten Kampar Propinsi Riau, selain berpegang teguh pada hukum Islam, juga masih perpegang teguh pada adat kebiasaan yang sudah turun-temurun terhadap larangan melakukan perkawinan di antara dua Khotbah Idul Fitri dan Khotbah Idul Adha atau dari mulai tanggal 1 Syawal setelah Khotbah Idul Fitri sampai dengan 10 Zulhijjah sebelum Khotbah Idul Adha. Masyarakat Sibiruang meyakini apabila ada yang melanggar akan mendapatkan dampak negatif terhadap kehidupan keluarganya kelak. Abstract

This research is motivated by the phenomenon of childcare by fathers after divorce in Padang Lawas County. This phenomenon raises the interest of researchers to further examine child custody by fathers after divorce. The research method used is field research with a qualitative approach. Researchers collected primary data through interviews with traditional leaders and fathers caring for their children after divorce. The data obtained was then analyzed using descriptive analysis techniques, which involved collecting data through interviews and documentation and systematic data processing to describe and interpret existing phenomena. The results show that although customs in Padang Lawas County give custody to the father, it is essential to consider the provisions of the compilation of Islamic law and the broader principles of Islamic law. Child custody should focus on the best interests of the child, ensuring their physical, emotional, and mental development. Both parents have equal rights unless there are compelling reasons to the contrary, and they must work together to maintain the child's stability. Children have the right to adequate education and healthcare, as well as to maintain a good relationship with both parents, even if only one has primary custody.

Abstract

This study examines government ethics based on fiqih siyasah in the digital era. The type of research is library research with a qualitative approach, primary data sources from fiqh siyasah, and secondary data from books, journal articles, and so on. Data collection techniques used the documentation method, then analyzed using descriptive qualitative techniques. The result of this research is that technological developments are so rapid and impact social and political life that it is necessary to apply the principles of siyasa fiqh to create an Islamic government ethic. To get there, it is necessary to have an ethical government based on fiqih siyasah in the digital era, namely by implementing: Islamic principles, using technology by Islamic values, data security and privacy, transparency and public participation, public services, collaboration and consultation with Islamic scholars. It will impact government, namely being able to create governance that is more just, fair, and by Islamic religious values, and can improve the quality of public services and community involvement in the decision-making process.

Abstract

Tulisan ini dilatarbelakangi oleh adanya aturan dalam Peraturan Pemerintah Nomor 45 Tahun 1990 yang menyatakan wajibnya PNS memberikan sebagian gajinya kepada mantan istrinya sampai mantan istri tersebut menikah lagi. Adapun pertanyaan pada tulisan ini ialah pertama, apa landasan filosofis dibentuknya Peraturan Pemerintah Nomor 45 Tahun 1990? Kedua, bagaimana tinjauan hukum Islam terhadap kewajiban menafkahi mantan istri oleh PNS dalam Pasal 8 PP Nomor 45 Tahun 1990? Jenis penelitian ini adalah penelitian kepustakaan (library research) dengan menggunakan bahan hukum primer, sekunder dan testier. Temuan dari penelitian ini adalah (1) Landasan filosofis yang mendasari dibentuknya Peraturan Pemerintah Nomor 45 Tahun 1990 adalah karena Pegawai Negeri Sipil wajib memberikan contoh yang baik kepada bawahannya dan menjadi teladan sebagai warga negara yang baik dalam masyarakat, termasuk dalam menyelenggarakan kehidupan berkeluarga, maka perceraian sejauh mungkin harus dihindarkan. Dan untuk dapat melaksanakan kewajiban yang demikian itu, maka kehidupan Pegawai Negeri Sipil harus ditunjang oleh kehidupan yang serasi, sejahtera dan bahagia, sehingga setiap Pegawai Negeri Sipil dalam melaksanakan tugasnya tidak akan banyak terganggu oleh masalah-masalah dalam keluarganya. Oleh karena itu, untuk usaha meningkatkan disiplin Pegawai Negeri Sipil perlu dibentuk Peraturan Pemerintah tentang Izin Perkawinan dan Perceraian bagi Pegawai Negeri Sipil tersebut. (2) Tinjauan hukum Islam terhadap isi Pasal 8 Peraturan Pemerintah Nomor 45 Tahun 1990 yang menyatakan wajibnya seorang PNS memberikan sepertiga atau setengah gajinya kepada mantan istrinya sampai mantan istri itu menikah lagi adalah hal yang wajib dilaksanakan oleh PNS dengan dalil menaati Pemimpin yakni dalam hal ini Pemerintah sebagai eksekutif dan legislatif yang telah membentuk Peraturan Pemerintah tersebut, karena tujuan Peraturan Pemerintah itu adalah sesuatu yang sesuai dengan syariat yaitu untuk menghindarkan terjadinya perceraian yang merupakan perbuatan yang paling dibenci oleh Allah SWT.

Abstract

Cryptocurrency price fluctuations are increasingly interesting and are of concern to researchers around the world. Many ways have been proposed to predict the next price, whether it will go up or down. This research shows how to create a patterned dataset from an API connection shared by Indonesia's leading digital currency market, Indodax. From the data on the movement of all cryptocurrencies, the lowest price variable is taken for 24 hours, the latest price, the highest price for 24 hours, and the time of price movement, which is then programmed into a pattern dataset. This patterned dataset is then mined and stored continuously on the MySQL Server DBMS on the hosting service. The patterned dataset is then separated per month, and the data per day is calculated. The minimum, maximum, and average functions are then applied to form a graph that displays paired lines of the movement of the patterned dataset in Crash and Moon conditions. From the observations, the Patterned Graphical Pair dataset using the Average function provides the best potential for predicting future cryptocurrency price fluctuations with the Bitcoin case study. The novelty of this research is the development of patterned datasets for predicting cryptocurrency fluctuations based on the influence of bitcoin price movements on all currencies in the cryptocurrency trading market. This research also proved the truth of hypotheses a and b related to the start and end of fluctuations.

Abstract

The formation of laws in Indonesia requires a holistic approach to ensure that the resulting legal products are not only legally valid but also in line with the values ​​of Pancasila as the foundation of the state. This study aims to analyze the application of inclusive legal theory in the Pancasilaist legislative process. Inclusive legal theory recognizes the diversity of legal sources, including positive law, customs, religion, and other social norms, which are relevant in pluralistic Indonesia. This study uses a qualitative method with a normative and descriptive-analytical approach that aims to describe how inclusive legal theory is implemented in forming laws in Indonesia and analyze the suitability of applying the theory to the values ​​of Pancasila. Data were collected through document studies, literature studies, and in-depth interviews with legal experts and practitioners. Data analysis was conducted using qualitative techniques. This analysis will focus on how Pancasila values ​​are integrated into laws by applying Inclusive Legal Theory. The results of the study indicate that the application of inclusive legal theory in the formation of laws can increase public acceptance and compliance with the law because this approach takes into account and integrates various sources of law that exist in society, such as social norms, customs, religious values, and morality. The values ​​of Pancasila are reflected in the legislative process, which creates legal products that are fairer, more humane, and meet the needs of society. This study provides concrete recommendations for policymakers to improve the quality of legislation in Indonesia through a more inclusive approach based on Pancasila values. Thus, this study contributes to the development of inclusive legal theory and provides practical guidance for forming laws that are more effective for the identity of the Indonesian nation.
