Abstract

In discussions of children's rights, the economic exploitation of children in orphanages is often overlooked. This exploitation can take various forms, such as exploiting children for financially disadvantageous work that they cannot afford, or exploiting them for work that is harmful to their physical or mental health. The purpose of this study is to determine the types of economic exploitation occurring in orphanages and analyze how it impacts children's rights from the perspective of Indonesian child protection law. This study uses normative juridical approaches, namely prescriptive and comparative legal analysis. This study finds that economic exploitation in orphanages often violates basic principles of child protection, such as the right to education, the right to adequate care, and the right to adequate care. This is demonstrated by related regulations, such as Minister of Social Affairs Regulation No. 30 of 2011 concerning National Standards for Child Care. In addition, this study examines the provisions of the Convention on the Rights of the Child (CRC), adopted by Indonesia through Presidential Decree No. 36 of 1990, with other international regulations. Studies show that, although Indonesian law has established clear regulations on child protection, weak supervision and enforcement result in many orphanages not complying with these regulations. This study recommends increased oversight of orphanages and tougher penalties for child economic exploitation. It is hoped that this research will help develop better and more sustainable child protection policies in Indonesia.

Abstract

Kekerasan seksual terhadap perempuan di tempat umum merupakan persoalan serius yang mengancam hak asasi manusia dan kebebasan bergerak perempuan di ruang publik. Penelitian ini mengkaji bagaimana perlindungan hukum diberikan kepada perempuan korban kekerasan seksual di tempat umum berdasarkan Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual serta mengidentifikasi berbagai kendala dalam penegakan hukumnya. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan studi kasus. Hasil penelitian menunjukkan bahwa UU TPKS telah memberikan kerangka perlindungan hukum yang komprehensif melalui pengaturan sembilan bentuk tindak pidana kekerasan seksual, jaminan hak korban atas penanganan sensitif gender, pemulihan, restitusi, dan perlindungan dari reviktimisasi. Namun implementasinya menghadapi hambatan signifikan berupa rendahnya pemahaman aparat penegak hukum, budaya patriarki yang kuat, minimnya sarana prasarana, kesulitan pembuktian, lambatnya penyusunan peraturan pelaksanaan, lemahnya koordinasi antar lembaga, stigma sosial, keterbatasan anggaran, serta rendahnya partisipasi masyarakat. Penelitian ini menyimpulkan bahwa meskipun UU TPKS menawarkan perlindungan progresif bagi korban, diperlukan upaya sistematis untuk mengatasi berbagai hambatan agar perlindungan hukum dapat terwujud secara nyata dalam praktik penegakan hukum.

Abstract

Perundungan merupakan perilaku agresif yang semakin sering terjadi, terutama di lingkungan pendidikan, dan dapat menimbulkan dampak fisik maupun psikologis bagi korban. Dalam perspektif hukum pidana, perundungan berkaitan dengan perlindungan hak atas rasa aman, kehormatan, dan martabat manusia. Meskipun tidak diatur secara eksplisit dalam Kitab Undang-Undang Hukum Pidana (KUHP), berbagai bentuk perundungan dapat dikualifikasikan sebagai tindak pidana melalui ketentuan mengenai kekerasan, penganiayaan, penghinaan, dan pengancaman. Penelitian ini bertujuan untuk menganalisis pengaturan perundungan dalam hukum pidana Indonesia serta penerapan penegakan hukumnya di lingkungan pendidikan. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa secara normatif telah tersedia instrumen hukum untuk menjerat pelaku perundungan, seperti KUHP dan Undang-Undang Perlindungan Anak. Namun, penegakan hukum masih menghadapi hambatan, antara lain minimnya pelaporan, kesulitan pembuktian, budaya permisif di lingkungan pendidikan, serta kurangnya koordinasi antar lembaga. Oleh karena itu, diperlukan penguatan penegakan hukum yang berorientasi pada perlindungan korban serta peningkatan peran institusi pendidikan dalam upaya pencegahan.

Abstract

Kekerasan dalam Rumah Tangga (KDRT) merupakan salah satu bentuk pelanggaran hak asasi manusia yang memerlukan perlindungan hukum serta mekanisme pemulihan yang komprehensif bagi korban. Penelitian ini bertujuan untuk menganalisis pengaturan regulasi mengenai hak korban KDRT dalam proses pemulihan dan rehabilitasi berdasarkan peraturan perundang-undangan di Indonesia serta mengkaji peran lembaga terkait dalam pelaksanaannya. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach). Data yang digunakan berupa data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan, kemudian dianalisis secara kualitatif normatif. Hasil penelitian menunjukkan bahwa secara normatif negara telah menyediakan kerangka hukum yang cukup memadai dalam menjamin hak korban KDRT melalui berbagai regulasi, seperti Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga, Undang-Undang Nomor 31 Tahun 2014 tentang Perlindungan Saksi dan Korban, serta regulasi terkait lainnya yang menekankan pentingnya pemulihan korban secara komprehensif. Pelaksanaan pemulihan korban melibatkan berbagai lembaga melalui pendekatan lintas sektor, seperti LPSK, UPTD PPA, kepolisian, layanan kesehatan, dan dinas sosial. Namun demikian, implementasi pemulihan korban masih menghadapi berbagai hambatan, antara lain keterbatasan sumber daya, ketimpangan kapasitas layanan antar daerah, serta faktor budaya yang memengaruhi keberanian korban dalam melaporkan kekerasan. Oleh karena itu, diperlukan harmonisasi regulasi, penguatan koordinasi antar lembaga, serta peningkatan kapasitas layanan untuk mewujudkan sistem pemulihan korban KDRT yang lebih efektif dan berkeadilan.

Abstract

The prevention of violations in general and regional elections carried out by Bawaslu (the Election Supervisory Body) constitutes an integral component of electoral law enforcement, complementing the imposition of sanctions against violations committed by election participants. Such preventive efforts are crucial to ensuring electoral integrity, safeguarding the constitutional rights of citizens, and realizing electoral justice. Law No. 7 of 2017 on General Elections grants Bawaslu both the mandate and the authority to undertake preventive measures in electoral law enforcement, particularly through proactive interventions at every stage of the electoral process. Meanwhile, Law No. 1 of 2016 on Regional Head Elections sets forth the mechanisms governing the conduct of local elections. Bawaslu’s preventive measures are diverse in scope, encompassing the mitigation of electoral vulnerabilities, the issuance of early warnings through advisory letters, the implementation of close supervision across all electoral stages, and, importantly, the mobilization of public participation in monitoring the electoral process. This study seeks to examine the legal framework regulating the prevention of electoral violations as well as its practical implementation during the 2024 Regional Head Election (Pilkada) in Cirebon Regency. The research employs a normative juridical method, supported by empirical data, to analyze both the regulatory provisions and their application in practice.

Abstract

This study aims to analyze the juridical considerations of the panel of judges in imposing criminal sanctions on a child perpetrator of aggravated assault that resulted in death, as reflected in Decision Number 12/Pid.Sus-Anak/2020/PN Jkt.Pst. This research uses a normative juridical method with a statutory and case study approach. The findings indicate that the judges applied the principle of lex specialis derogat legi generali, prioritizing the Child Protection Act and the Juvenile Criminal Justice System Act (UU SPPA) over the general provisions of the Indonesian Penal Code (KUHP). Under the old Penal Code, aggravated assault resulting in death is regulated in Article 351 paragraph (3) with a maximum sentence of 7 years, while the new Penal Code, stipulated in Law Number 1 of 2023, regulates the same offense in Article 354 paragraph (3), with a maximum sentence of 12 years. In contrast, the Child Protection Act (Article 80 paragraph (3)) prescribes up to 15 years imprisonment. However, since the perpetrator is a child, Article 81 of the Juvenile Criminal Justice System Act limits the maximum sentence to half, which is 7.5 years. The judge also rejected the application of diversion due to the threat of imprisonment exceeding 7 years, in accordance with Article 7 paragraph (2) of the SPPA Law. Based on considerations of the perpetrator’s age (14 years), psychological condition, family background, and rehabilitative recommendations from BRSAMPK Handayani, the court imposed a two-year educational sanction at a Social Welfare Institution (LPKS). Although the verdict received criticism for being too lenient, the judge took into account child protection principles, the ultimum remedium principle, and the best interests of the child. This decision reflects a juvenile justice paradigm that emphasizes educational and restorative approaches rather than mere punishment.

Abstract

The issue of impartiality among village government officials in elections remains a persistent legal problem that threatens the fairness and legitimacy of democratic processes. A concrete example occurred during the 2024 General Election in Bandung Regency, where the Head of Majasetra Village was alleged to have engaged in politically biased actions. This study aims to analyze the legal framework and the implementation of the authority of the General Election Supervisory Agency (Bawaslu) in addressing violations of neutrality by village officials during elections. The research questions focus on: (1) how the law regulates Bawaslu’s authority and procedures in handling electoral crimes, and (2) how Bawaslu Bandung Regency implements that authority in the specific case. This research employs a normative juridical method with statutory, conceptual, and historical approaches, supported by empirical data from the field. The findings indicate that Bawaslu has a solid legal foundation through the Election Law Enforcement Center (Sentra Gakkumdu) for handling electoral violations. However, implementation at the regional level still encounters obstacles, such as limited human resources and weak inter-institutional coordination. Therefore, this study recommends strengthening the regulation of neutrality for village officials, enhancing Bawaslu’s institutional capacity, and ensuring consistent and firm law enforcement.

Abstract

Early marriage is a serious problem that impacts the social, economic, and psychological aspects of children. The Indonesian government, through Law No. 16 of 2019, has revised the minimum age for marriage for women to 19 years, as a strategic effort to protect children's rights. This study aims to analyze the role of the Office of Religious Affairs (KUA) in preventing early marriage practices as mandated by the law. The research method used is a normative and empirical juridical approach, with data collection techniques through literature studies and interviews with KUA officers and the community. The results show that the KUA has an important role in the legal education process, administrative verification of the age of prospective brides and grooms, and providing recommendations for marriage dispensations. However, structural obstacles are still found such as weak coordination between institutions and limited public access to information on new regulations. Therefore, strengthening the institutional capacity of the KUA and integrating legal education programs comprehensively need to be optimized to achieve maximum legal protection for children.

Abstract

This study examines public financial accountability and distributive justice in international space exploration from a normative legal perspective. Despite the rapid expansion of space activities and the increasing allocation of public funds, international space law remains primarily focused on technical responsibility and liability, while lacking binding norms on fiscal transparency, public financial reporting, and accountability. This normative gap raises concerns regarding the equitable governance of outer space as a global common. Employing normative legal research, this study analyzes key international space law instruments, particularly the Outer Space Treaty (1967) and related conventions, together with Indonesia’s national legal framework under Law No. 21 of 2013 on Space Activities. Statutory, conceptual, and comparative approaches are used to assess the adequacy of existing legal norms. The findings reveal an international fiscal accountability gap that undermines the operationalization of the principle of the province of all mankind and contributes to structural inequality in space exploration. At the national level, Indonesia’s space law framework is largely declarative and insufficiently integrated with public finance regulation. This study concludes that normative reform is required to strengthen fiscal transparency, accountability, and distributive justice in space governance.

Abstract

Artificial Intelligence (AI) has significantly transformed creative industries by enabling machines to generate aristic works such as images, designs, and logos used in commercial activities. The increasing use of AI-generated content raise important legal questions concerning authorship, ownership, and legal protection under intellectual property law. This study aims to analyze the legal status of AI-generated logos within the Indonesian intellectual property framework and to identify the most appropiate legal mechanism for protecting such works. This research applies a normative legal research method using statutory, conceptual, and comparative approach. The study examines Indonesian copyright law under Law No. 28 Of 2014 Concerning Copyright and Trademark Protection under Law No. 20 Of 2016 Concerning Trademarks and Geographical Indications. The results indicate that Indonesia copyright law remain human-centered, meaning that works generated autonomously by artificial intelligence do not fully meet the legal requierements for copyright law. However, AI-generated logos may still obtain legal protection through trademark registration under the first-to-file principle. This study concludes that trademark law currently provides the most effective legal mechanism for protecting AI-generated logos in Indonesia. The research also highlights the need for future legal reform to address the growing role of artificial intelligence in creative industries.
