Abstract

This study was motivated by the prevalence of juvenile delinquency, particularly murder committed by children against other children. The objective of this study was to examine the perspectives of positive law and Islamic law on the imposition of sanctions for such acts. This study employed an empirical juridical approach using primary and secondary data, which were analysed descriptively and qualitatively and presented deductively. The results of the study indicate that, based on Article 81(2) of Law No. 11 of 2012 on the Juvenile Criminal Justice System, a child may only be sentenced to half the maximum penalty applicable to adults. In the case studied, the child was sentenced to 7 years and 6 months in prison for murder under Article 338 of the Criminal Code. From the perspective of Fiqh Jinayah, the act is classified as jarimah qishash because the perpetrator was 15 years old. However, because the judicial process uses the Indonesian legal system, the child was given a ta'zir punishment in the form of imprisonment.

Abstract

Traditional images still dominate the representation of masculinity as a product of patriarchal ideology. This research examines the representation of masculinity among Generation Z in Bangka Island, exploring whether shifts occur or traditional norms persist. Using a social representation approach, the study investigated 178 Gen Z males through open questionnaires and interviews. They are called Bujang, which anchors for social representation of masculinity. Thematic analysis found that, in Gen Z’s perspective, masculinity focuses on Jadi Urang (being true men), and requires three dimensions: prosperity, sociability, and religiosity. Some norms of masculinity have changed, while others still adopt traditional masculinities in certain social configurations. In production relations, representation shows urang bujang ya begawi (men must work). In power relations, urang bujang belajer tanggungjawab (men have responsibility). In emotional relationships, kelaki jangen nanges (men don’t cry). These themes indicate both shifting and persistent elements of traditional masculinity norms.

Abstract

Penelitian ini membahas analisis hukum terhadap pelanggaran Hak Asasi Manusia (HAM) dalam penanganan demonstrasi mahasiswa di Indonesia. Demonstrasi mahasiswa merupakan wujud kebebasan berekspresi dan berkumpul yang dilindungi oleh konstitusi dan instrumen HAM internasional. Meskipun demikian, praktik di lapangan menunjukkan adanya penggunaan kekuatan berlebihan, kriminalisasi, intimidasi, dan penyempitan ruang sipil. Metode penelitian yang digunakan adalah yuridis-normatif dengan pendekatan kualitatif melalui studi literatur, regulasi, putusan pengadilan, dan laporan lembaga HAM. Hasil analisis menunjukkan bahwa defisit pemahaman aparat mengenai HAM, celah regulasi, serta kurangnya mekanisme pengawasan berkontribusi terhadap pelanggaran. Strategi penanganan demonstrasi yang mengintegrasikan pelatihan berbasis HAM, SOP yang jelas, kolaborasi lintas lembaga, dan mekanisme akuntabilitas efektif dalam melindungi hak mahasiswa serta memperkuat kepercayaan publik terhadap institusi penegak hukum

Abstract

This study examines the innovative da’wah   strategies of Muslimat Nahdlatul Ulama in integrating Ahlussunnah Wal Jama'ah (Aswaja) values amid ongoing social transformation in East OKU Regency, Indonesia. Using a field-based qualitative approach, data were collected through in-depth interviews, non-participant observations, and document analysis involving Muslimat NU leaders, religious figures, and community members. The findings indicate that Muslimat NU adopts a culturally grounded and digitally integrated da’wah   model that combines social media engagement with community-based religious activities. This approach enhances the relevance of da’wah   in contemporary society while strengthening women’s participation in both religious and social spheres. In addition, da’wah   bil-hal (action-based preaching) is implemented through socio-economic empowerment programs, enabling women to develop economic independence and active social roles. The study further reveals that Aswaja values moderation, balance, and tolerance are systematically internalized through participatory religious forums and community activities, transforming traditional gatherings into spaces for social learning and problem-solving. These strategies contribute to strengthening social cohesion and expanding the role of women as active agents in community development. This study contributes to the literature by demonstrating how local Islamic organizations adapt da’wah   practices through the integration of cultural and digital approaches to address contemporary social challenges.
