Abstract

This research discusses the impact of the use of illegal fishing gear, especially trawlers, on the welfare of small fishermen in Tanggamus Regency, Lampung Province. Through interviews with Head Fishermen and partners from Polair, this research identified that despite the ban on the use of trawls based on Law Number 45 of 2009 concerning fisheries, some small fishermen are still reluctant to switch to legal fishing gear. The formulation of the problem is what is the legal regulation of the use of trawls in fishing and how is the use of trawls in fishing by fishermen in the Tanggamus Regency area, Lampung Province in terms of Law Number 45 of 2009 concerning Amendments to Law Number 31 of 2004 concerning Fisheries? The Normative Juridical research method is descriptive analytical, then analyzed qualitatively, then conclusions are drawn using a deductive mindset. The results:several alternative fishing gear such as gill nets, hand lines, basic longline fishing, drift longline fishing, payang fishing gear, and payang nets. The social and cultural implications in small-scale fishers' decisions are also a focus for understanding the challenges faced in changing their traditional practices. Conclusion: provides an overview of the complexity of changes in behavior of small-scale fishermen.

Abstract

Introduction: The facial profile refers to the anteroposterior relationship visible from the lateral view of the face. There are three types of the facial profile: straight, convex, and concave. Photometry is a reliable, simple and accurate methods for determining the facial profile. Facial profile can be influenced by various factors, such as genetics, gender, age, and environment. This study aims to analyze the differences in facial profiles between male and female elementary school students. Methods: an observational analytic with a cross-sectional design. The subjects were elementary school students in Jember Regency, aged 6-12 years. A of 141 children participated in the study, consisting of 76 males and 65 females. Data analysis included Kolmogorov-Smirnov normality test, the Levene test for homogeneity, and an independent parametric t-Test to compare the facial profiles of males and females. Results: The average facial profile angle among elementary school students shows a straight facial profile. The average angle for females was 157.71º, which was slightly greater than that of males. However, there was no significant difference between male and female facial profiles. Similarly, no significant difference observed between the facial profiles of students aged 6-9 years old and those aged 10-12 years old. Conclusion: Elementary school students predominantly exhibit straight facial profiles, with this profile being more common among males.

Abstract

As is known, financing institutions with sharia principles have shown extraordinary growth in Indonesia. In practice, financing based on sharia principles is often understood by some people as interest-free and collateral-free financing. This opinion is not entirely correct because not applying interest is correct but not requiring collateral is incorrect, even though several financing institutions with sharia principles provide financing by providing relief regarding collateral. Financing institutions with sharia principles are the embodiment of an Islamic economy that prioritizes sharia principles, including material guarantees. Guarantee institutions for immovable objects (land and buildings) are operationalized using guarantee institutions according to positive Indonesian law, namely Law Number 4 of 1996 concerning Mortgage Rights for Land and Objects Related to Land (UUHT), where the principles of Mortgage Rights in UUHT do not conflict with the pillars and conditions for material guarantees in Islamic law (ar-rahn). This also means that the execution is also subject to the provisions of the Mortgage Rights. However, the majority of people think that when financing using sharia principles, guarantee institutions are used according to Islamic law. This is where there is a need to increase socialization regarding guarantee institutions using sharia principles and for the government to immediately formulate laws and regulations that specifically regulate the execution of mortgage rights because so far the execution through auction sales in the UUHT has been carried out according to Article 224 HIR (258 RBg) as stipulated in Article 26 UUHT and its explanation.

Abstract

Abses otak adalah nekrosis fokal dengan membran disekelilingnya berada dalam parenkim otak akibat dari proses infeksi atau proses traumatis. Penatalaksanaan abses otak dapat berupa penatalaksanaan medis maupun bedah, bergantung pada ukuran dan kedalaman abses yang terjadi. Konstipasi merupakan salah satu dari beberapa keluhan yang dirasakan oleh pasien yang telah menjalankan tindakan pembedahan tersebut. Studi kasus ini bertujuan untuk melihat perkembangan pasien pasca bedah yang mengalami konstipasi setelah diberikan intervensi masase abdomen. Klien melakukan tindakan craniotomy debridement pada tanggal 29 Maret 2023. Pasien mengatakan kurang nyaman pada bagian abdomennya dikarenakan ia belum buang air besar (BAB) sejak berada di rumah sakit. Klien mengatakan ia merasa abdomennya terasa penuh dan buang angin terus menerus. Hasil Constipation Assessment Scale (CAS), didapatkan skor 7 dalam rentang skor 0-16. Permasalahan utama yang diangkat merupakan konstipasi dengan intervensi manajemen konstipasi yang berfokus pada masase abdomen. Masase abdomen dapat menjadi intervensi untuk mengatasi permasalahan konstipasi yang seringkali terjadi pada pasien pasca pembedahan.

Abstract

Pendahuluan: Menurut Riskesdas tahun 2018, prevalensi karies gigi pada anak di Indonesia mencapai 89,6%, sedangkan karies aktif di Jawa timur sebesar 49,88%, yang menunjukkan bahwa angka kejadian karies di Jawa Timur masih sangat tinggi. Karies dapat dicegah dengan tindakan preventif berupa penilaian risiko karies. Aplikasi CARA merupakan salah satu pemanfaatan teknologi di bidang kedokteran gigi yang dapat memprediksi risiko karies pada anak. Aplikasi CARA berbasis android mudah digunakan dan hasil dapat diunduh untuk dijadikan dasar edukasi kepada orangtua. Tujuan penelitian ini adalah menganalisis penilaian risiko karies pada anak usia 6-9 tahun dengan menggunakan pengujian aplikasi model CARA berbasis android. Metode: Jenis penelitian ini observasional analitik  dengan pendekatan studi cross-sectional. Jumlah populasi penelitian sebanyak 87 siswa dengan subjek penelitian adalah anak usia 6-9 tahun SDN Candijati 1 Arjasa yang diambil dengan teknik total sampling. Pemeriksaan penilaian risiko karies formulir aplikasi CARA (Caries Risk Assessment) dan frekuensi makan-makanan manis dilakukan menggunakan kuesioner dan pemeriksaan langsung. Analisis data menggunakan uji chi square untuk menilai pengaruh jenis kelamin dan usia terhadap faktor risiko karies, uji Anova dan regresi linear untuk pengujian model.  Hasil: Penilaian risiko karies pada anak memiliki risiko karies rendah sebesar 65,5% dengan indikator penyebab karies yang dominan yaitu konsumsi makanan manis dan rata-rata kemungkinan anak terhindar karies sebesar 69,3%. Simpulan: Analisis faktor risiko karies pada anak di area agro-Industri menggunakan aplikasi “CARA” menunjukkan faktor risiko perilaku menjaga kesehatan gigi dan mulut seperti mengatur pola makan, sikat gigi dan konsumsi makanan berserat dapat menurunkan risiko seseorang terkena karies. Analysis of caries risk factors in children in the Agro-Industrial Area using the Android-based CARA model application test: cross-sectional studyIntroduction: According to the 2018 Basic Health Research, the prevalence of dental caries among children in Indonesia reached 89.6%. In East Java, the rate of active caries was 49.88%, indicating a persistently high incidence. Caries can be prevented through early intervention, including risk assessments. The CARA (Caries Risk Assessment) application is an Android-based tool designed to predict caries risk in children. It is user-friendly and provides downloadable results for parental education. This study aimed to evaluate caries risk in children aged 6-9 years using the CARA application. Methods: This type of research is observational analytic with a cross-sectional approach. The population consisted of 87 students  aged 6-9 years from Candijati 1 Elementary School, Arjasa, selected through total sampling. Caries risk assessment was conducted using the CARA application, supported by a questionnaire assessing sweet food consumption and clinical dental examination. Data were analyzed using Chi-square tests to assess the influence of gender and age on caries risk factors. ANOVA and linear regression analyses were conducted for model testing. Results: The Cronbach’s Alpha reliability and validity test yielded p = 0.525 (p > 0.5), with the sensitivity level of the CARA application showing a value of 91.1%, specificity of 100%, positive predictive value of 100% and negative predictive value of 89.4%, supporting the validity of the CARA application. Caries risk assessment in children aged 6-9 years at Candijati 1 Elementary School showed a low caries risk of 65.5%, with sweet food consumption as the dominant risk factor and an average caries prevention potential of 69.3%. Conclusion: Maintaining dental and oral health through dietary control, regular tooth brushing and consumption of fibrous foods can significantly reduce caries risk. The findings indicate that the CARA application is a valid, effective, and practical tool for caries risk assessment in children.

Abstract

The need for decent and affordable housing in Indonesia is becoming increasingly urgent alongside population growth and urbanization, but is hindered by high property prices and income inequality. This study aims to describe how Balanced Residential conversion funds contribute to achieving justice and welfare. This research uses a normative juridical method to analyze the Balanced Residential Conversion Fund policy as a solution to housing provision imbalances. The research focuses on implementation issues of Balanced Residential, including land price constraints, lack of developer incentives, and unclear fund conversion mechanisms. The results show that the Balanced Residential Conversion Fund policy, regulated through Government Regulations and managed by BP3, provides flexibility for developers while ensuring housing availability for low-income communities. However, three main challenges are identified: (1) absence of clear standards in calculating conversion fund amounts, (2) weak supervision of fund allocation, and (3) inaccurate mapping of housing needs. The research concludes that this policy has the potential to achieve social justice if improved through: (1) establishing transparent formulas for calculating conversion funds, (2) strengthening fund management and accountability systems, and (3) data-based mapping to ensure strategic locations for subsidized housing. With these improvements, Balanced Residential Conversion Funds can become an effective instrument in reducing housing backlog and creating social balance.

Abstract

This study examines overlapping land ownership based on girik documents as one of the sources of legal conflict in Indonesia. The issues to be discussed are Are the judge's considerations in Decision Number 591/PDT.BTH/2020/PN.BKS in accordance with the UUPA and what are the legal consequences of overlapping land ownership based on the girik documents. This research is normative legal research and is descriptive in nature using secondary data obtained through literature studies, the data is processed qualitatively and conclusions are drawn using deductive logic. The results and conclusions of this study are the judge's considerations in Decision Number 591/PDT.BTH/2020/PN.BKS are in accordance with the UUPA by considering that the civil case decision Number: 268/Pdt.G/2012/PN.Bks; Jo. Number 302/PK/Pdt/2015 has permanent legal force (inkracht van gewijsde) and rejecting the Plaintiff's application as the owner of the disputed land is in accordance with the UUPA, namely Article 26 paragraph 2 of the UUPA, and Article 21 of the UUPA needs to be added in the judge's considerations. However, the legal consequences of dual certificates are the lack of legal certainty for land rights owners over the certificates they own.

Abstract

The sale and purchase occur between the seller, who has the authority to transfer the rights to the land. The Grantor of the Mortgage Rights must have legal authority over the land object used as collateral. However, in practice, deviations occur in the implementation of the sale and purchase and the imposition of Mortgage Rights, as seen in Decision No. 90/PDT.G/2021/PN.JKT.SEL. The problem formulation is how to assess the validity of the imposition of mortgage rights on a piece of land acquired through sale and purchase in Decision No. 90/PDT.G/2021/PN.JKT.SEL. A normative juridical, descriptive-analytical method was used in this research. This study relies on secondary data from primary legal materials, which are analyzed qualitatively. Therefore, the results can be concluded deductively. The findings show that in Decision Number 90/PDT.G/2021/PN.JKT.SEL, the land was sold by a party who was not the legitimate owner, and the sale transaction was not carried out before an authorized Land Deed Official (PPAT), but only by a notary. As a result, the material and formal requirements for a valid land sale were not fulfilled. The conclusion is that all legal actions related to the land, including the sale and purchase and the imposition of Mortgage Rights, were declared invalid, and the land remains the property of the Plaintiff.

Abstract

Anak tunagrahita memiliki berbagai keterbatasan, baik dalam fungsi intelektual maupun fungsi adaptifnya. Keterbatasan ini membuat orang tua menjadi cemas terhadap masa depan dan tingkat kemandirian anaknya. Tujuan dari penelitian ini adalah untuk mengidentifikasi tingkat kecemasan pada orang tua yang memiliki anak tunagrahita di SLB (Sekolah Luar Biasa) BC Multahada. Jenis penelitian ini adalah deskriptif kuantitatif. Populasi pada penelitian ini adalah orang tua (ayah/ibu/wali/pengasuh utama di rumah) yang memiliki anak tunagrahita di SLB BC Multahada dengan jumlah sebanyak 63 orang. Teknik sampling yang digunakan adalah total sampling. Kuesioner yang digunakan adalah Penn State Worry Questionnaire versi Indonesia yang memiliki nilai validitas, yaitu: 0,75 sampai 0,80; dan nilai reliabilitas 0,88. Hasil penelitian dianalisis dengan menggunakan statistik deskriptif frekuensi dan persentase. Hasil penelitian ini menunjukkan bahwa hampir setengah responden mengalami kecemasan sedang diikuti kecemasan ringan. Lalu sebagian kecil mengalami kecemasan berat dan sebagian kecil lagi tidak mengalami kecemasan. Berdasarkan hasil penelitian dan pembahasan, kecemasan yang dirasakan orang tua akan berdampak terhadap dirinya maupun anaknya. Apabila kecemasan ini tidak segera ditangani nantinya akan berkembang menjadi lebih buruk. Adapun faktor yang mempengaruhi kecemasan orang tua adalah jenis kelamin, status pekerjaan, usia, pendidikan, derajat tunagrahita, dan usia anak

Abstract

The Mortgage Law and Objects Related to Land, namely Law Number 4 of 1996, (hereinafter reffered as the Mortgage Law) states that there are three ways if the debtor breaks a promise (wanprestasi) and the creditor can carry out the execution of the Mortgage object. The three methods consist of Parate Execution as stated in the Mortgage Law Article 6, Executorial Title as stated in the Mortgage Law Article 14 paragraphs (2) and (3), as well as Underhand Execution. Execution of Mortgage carried out by Islamic Banks in the Study of Decision Number 5530/Pdt.G/2017/PA.Badg remains subject to the Mortgage Law and the auction process which is carried out on the basis of Minister of Finance Regulation Number 27/PMK.06/2016 concerning The Instructions for Auction has been amended by The Minister of Finance Regulation Number 213/PMK.06/2020 concerning Instructions for Auction Implementation. The judge's considerations in adjudicating the Decision Number 5530/Pdt.G/2017/PA.Badg case are in accordance with the Mortgage Law, especially in Article 6 with the creditor still having the right to carry out execution through auction according to Minister of Finance Regulation Number 27/PMK. 06/2016 which has now been amended by Minister of Finance Regulation Number 213/PMK.06/2020.
