Abstract

Since Religious Court Law was amended by Law No. 3 of 2006, every sharia economic case is stipulated as the competency of the Religious Court. Conversely, Bankruptcy Law No. 37 of 2004 has never been synchronized with the amended Religious Courts Law. Therefore, the competent court does not handle sharia economic bankruptcy (al-taflis) cases. This study aims to ensure that al-taflis can be examined based on sharia economic principles by the most appropriate judicial forum. It is normative legal research using primary and secondary legal materials such as court decisions, statutory, books, journals, reports, and internet sources, then analyzing and synchronizing to get an ideal formula regarding how al-taflis cases are settled in court. The result shows that al-taflis is appropriately stipulated as the absolute competence of Religious Courts. Case studies of al-taflis court decisions settled by the Commercial Court so far, also indicate that sharia principles are not sufficiently considered in the decisions, even ignored. Therefore, it is urgent to make synchronization efforts by amending the Bankruptcy Law until it can accommodate the settlement of al-taflis case through Religious Courts. Otherwise, it will be only a utopian sharia economic bankruptcy law

Abstract

Agrarian law reform in Indonesia is a strategic effort to achieve social justice, reduce land ownership disparities, and optimize the sustainable use of agrarian resources. This article examines the implementation of legal theory as a conceptual foundation in agrarian law reform, integrating normative,sociological,and critical approaches. The study identifies various challenges, including overlapping regulations, conflicts of interest, weak law enforcement, and limited community participation in legislative processes. Through qualitative analysis, this research explores how critical legal theory can drive policies that are more equitable and responsive to social dynamics. The findings reveal that the success of agrarian law reform heavily depends on synergy between regulatory updates, strengthening legal institutions, and community engagement. This article recommends consistent regulatory reforms, improved governance of agrarian resources, and the integration of social justice principles in decision-making processes. These findings provide a significant contribution to the development of an inclusive, equitable, and sustainable agrarian legal framework in Indonesia.

Abstract

As a guide for judges in the Religious Court, the Supreme Court has issued Perma No.2 of 2008 concerning the Compilation of Sharia Economic Law (KHES). It contained Gashb and Itlaf, in Book II about the Covenant, whereas Gashb and Itlaf have interpreted as deprivation and destruction. Briefly, Gashb and Itlaf seem to be an offence because of the phrase taking or destroying someone else's property. Offence in the field of Islamic economics is the absolute authority of the State Court. For this reason, it is necessary to examine whether Gashb and Itlaf included in the context of Islamic economics. It also needs to be examined whether Gashb and Itlaf are the absolute authority of the Religious Court. Normative juridical research carried out by discussing Book II of KHES, specifically Chapter XV. It then analysed with the absolute competence of the Religious court, the provisions of Article 49 of the Law of Religious Court. The analysis complemented by a study of legal principles in Islamic economics. Comparisons also made with the concepts of legal relations in the Civil Code, especially regarding the binding and offence in the Criminal Code.The research results of Gashb and Itlaf do not originate from the contract and do not include business activities with Islamic economic principles. Thus Gashb and Itlaf are not included in the absolute authority of the Religious Court. Gashb and Itlaf are not intended as offences because the sanctions are compensation claims. Claims are filed based on lawsuits that violate the law and become the absolute authority of the State Court. Placement of Gashb and Itlaf in KHES is wrong because it does not include Islamic economic activities, so it must have removed from KHES.

Abstract

Upah sebagai hak pekerja yang telah disepakati dan harus sesuai dengan perhitungan upah minimum yang diatur dalam PP Nomor 51 Tahun 2023 Tentang Perubahan atas Peraturan Pemerintah Nomor 36 Tahun 2021 Tentang Pengupahan, namun dalam praktiknya masih banyak pekerja yang haknya tidak dipenuhi meskipun telah melakukan kewajibannya. Metode yang digunakan adalah penelitian yuridis normatif yang dilengkapi dengan penelitian yuridis empiris, pendekatan penelitian perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa pemberian upah minimum berlaku bagi pekerja/buruh dengan masa kerja kurang dari 1 (satu) tahun. Adapun juga apabila pemberi kerja memberikan upah di bawah upah minimum, maka akibat hukumnya adalah dapat dikenakan sanksi pidana sesuai Pasal 185 Ayat (1) Undang-Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja, yaitu “Barang siapa melanggar ketentuan sebagaimana dimaksud dalam Pasal 42 ayat (2), Pasal 68, Pasal 69 ayat (2), Pasal 80, Pasal 82, Pasal 88A ayat (3), Pasal 88E ayat (2), Pasal 143, Pasal 156 ayat (1), atau Pasal 160 ayat (4) dikenai sanksi pidana penjara paling singkat 1 (satu) tahun dan paling lama 4 (empat) tahun dan/atau pidana denda paling sedikit Rp. 100.000.000,00 (seratus juta rupiah) dan paling banyak Rp. 400.000.000,00 (empat ratus juta rupiah).” Serta dapat menimbulkan potensi perselisihan hak antara pekerja dan pemberi kerja.

Abstract

Law enforcement serves as a fundamental mechanism for establishing order, security, and peace within society. It encompasses efforts to prevent or eliminate violations of the law, addressing issues both preventively and repressively. However, challenges arise when actions taken do not align with established procedures. The appropriate course of action within a legal framework is essential, and when discussing legal protection in the context of procedural law, it is important to clarify that such protection should not be interpreted as a means to shield offenders from accountability. This study seeks to evaluate law enforcement in Indonesia through the lenses of legal certainty, justice, and societal benefit. Employing a literature review methodology, which relies on expert opinions, the findings indicate notable deficiencies in the law enforcement system in Indonesia. For an extended period, those seeking justice within society have yearned for equitable law enforcement. Nevertheless, current practices in law enforcement tend to prioritize legal certainty over the community's sense of justice. Various court decisions, for example in the case of grandmother Minah and Aal, the sandal thief, seem to illustrate that law enforcement tends towards the view that law is law and has given rise to public disappointment with law enforcement in Indonesia.

Abstract

Article 1131 of the Indonesian Civil Code stipulates a general guarantee on the property rights of all debtors. Meanwhile, Article 1132 refers to a specific guarantee directed only at certain properties. For instance, suppose a debtor provides collateral for debt repayment by designating a specific piece of land in a notarial deed. In this case, it is essential to examine the legal status of the creditor who accepts the guarantee, as well as the legal protections available to the creditor if the debtor fails to repay the debt as agreed. This research aims to examine the legal standing of creditors who accept land guarantees in the form of a notarial deed as well as to comprehend the legal protections available to creditors when the debtor fails to repay the debt as agreed and the protective measures or actions creditors can initiate. To achieve this objective, a normative juridical research methodology was adopted with a legislative approach, focusing on the rules regarding property guarantees and the regulation of land mortgage rights as collateral. The obtained results shows that the designation of specific land in a notarial deed as collateral for debt repayment did not provide preferential rights to the creditor. Following the findings of this investigation, it is recommended that the guarantee of land rights be formalized through a deed of encumbrance on land rights executed by the Land Deeds Official (PPAT). However, in the absence of a voluntary resolution, the creditor can only protect claimed rights by filing a breach-of-contract lawsuit.

Abstract

Restorative justice telah menjadi pendekatan inovatif dalam sistem peradilan pidana anak, menawarkan solusi berbasis pemulihan bagi anak sebagai pelaku tindak pidana. Penelitian ini bertujuan untuk mengeksplorasi efektivitas penerapan restorative justice di Indonesia, khususnya dalam mendukung tujuan perlindungan anak sebagaimana diatur dalam Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA). Pendekatan penelitian yang digunakan adalah yuridis normatif dan empiris, dengan analisis terhadap regulasi, studi kasus, dan wawancara mendalam. Temuan menunjukkan bahwa restorative justice dapat menurunkan residivisme, meminimalkan stigma sosial, serta memfasilitasi reintegrasi anak dalam masyarakat. Namun, hambatan utama meliputi keterbatasan pemahaman aparat penegak hukum, kurangnya mediator terlatih, dan minimnya fasilitas rehabilitasi. Penelitian ini merekomendasikan penguatan kapasitas aparat, pengembangan infrastruktur pendukung, dan peningkatan kesadaran publik melalui sosialisasi. Dengan memperkuat kerangka implementasi, restorative justice berpotensi menjadi pendekatan unggul dalam menciptakan sistem peradilan pidana anak yang inklusif dan berorientasi pada keadilan sosial.

Abstract

This study examines judges' interpretations in deciding divorce cases based on the grounds of “continuous disputes” and “no hope of living harmoniously anymore.” These reasons are often used as legal bases by plaintiffs or defendants in divorce proceedings in Indonesia, as stipulated in Article 39 paragraph (2) of Law Number 1 of 1974 on Marriage and Article 19 letter (f) of Government Regulation Number 9 of 1975. The study aims to analyze how judges interpret these terms within the context of law and facts presented during trials. The research specifications used in this study are descriptive analysis, namely describing the facts in detail about the object of research so that problems are found in the form of inconsistencies between applicable regulations and practices that occur in the field, then trying to analyze and find a way out of a problem. This research is a normative legal research supported by empirical, namely research that continues to emphasize secondary data accompanied by taking samples of empirical data as implementation practices in the field. Secondary data consists of primary legal materials and secondary legal materials. The way to obtain data in this study is by conducting a study of library materials in the form of legal literature and legislation. After the data is collected, it is then analyzed using a qualitative legal method, which is closely related to the type of research categorized as normative legal research whose approach is more abstract-theoretical. The research findings indicate that judges' interpretations are based on evidence submitted by the parties, such as witness statements, documentary evidence, and facts about marital life revealed during the proceedings. “Continuous disputes” are defined as recurring conflicts that remain unresolved despite efforts for mediation or peaceful resolution. Meanwhile, “no hope of living harmoniously anymore” refers to a marital relationship that has become disharmonious and irreparable based on solid evidence. In making decisions, judges also consider principles of justice, the welfare of children (if any), and the impact of divorce on the parties involved. The study concludes that judges’ interpretations are dynamic and highly case-specific, requiring a comprehensive approach to ensure that rulings address legal, social, and moral aspects appropriately.

Abstract

The agreement begins with the agreement of the parties who made it, and fulfills the legal requirements of Article 1320 of the Civil Code agreement. The agreement made will give rise to rights and obligations for the parties who made it, but what if the agreement made is canceled unilaterally, this will certainly cause losses for the other party. According to Article 1338 paragraph 1 the agreement made must be based on good faith, meaning that the agreement is not enough only to fulfill the elements of the legal requirements of the agreement but to become the most important unit in implementing the contents of the agreement by upholding the principle of good faith of the parties making it, From some of the data presented, several legal cases and considerations of the panel of judges will be analyzed. The theory of legal certainty and the theory of justice are used to analyze the normative legal research method with a case approach is used in this study. To find out what the legal consequences are for the unilateral cancellation of agreements that have been agreed upon by the parties and the discussion in this case it is important to know legal certainty and justice for the parties in order to create a sense of security in society when making agreements.

Abstract

: This research examines the weaknesses of carbon trading regulations in Indonesia, particularly within the framework of Law Number 32 of 2009 on Environmental Protection and Management (UUPPLH) in the context of climate change mitigation. Indonesia, as a country that has ratified the Paris Agreement, faces challenges in regulating carbon trading mechanisms to reduce greenhouse gas emissions. Although UUPPLH provides a legal basis for environmental management, it does not explicitly address carbon trading aspects, such as verification, monitoring, and transaction transparency. The study also recommends strengthening the legal system based on the principles of precaution, justice, and transparency, which would enhance the integrity of Indonesia's carbon market. The precautionary principle emphasizes the need for stricter environmental impact assessments to avoid unforeseen damage, while the principles of justice and transparency ensure equitable benefit distribution and open access for all stakeholders. By introducing clearer and more inclusive regulations, Indonesia is expected to manage carbon trading sustainably, reduce the potential for misuse, and effectively achieve emission reduction targets. This research also proposes improvements to policies to prevent carbon crimes and enhance oversight mechanisms. The research method used is normative juridical with legislative and conceptual approaches to analyze legal gaps and provide recommendations for strengthening regulations aligned with international legal principles and Indonesia's domestic needs.
