Abstract

Perampasan aset hasil tindak pidana korupsi merupakan instrumen penting dalam upaya pemulihan kerugian negara dan pencegahan kejahatan korupsi yang berkelanjutan. Namun demikian, pengaturan perampasan aset terpidana korupsi di Indonesia masih menghadapi berbagai hambatan normatif, struktural, dan politik hukum yang menghambat efektivitasnya. Artikel ini bertujuan untuk menganalisis secara kritis hambatan pengaturan perampasan aset terpidana korupsi di Indonesia serta mengkaji urgensi pembaruan kebijakan hukum yang berorientasi pada pemulihan aset. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, melalui kajian terhadap KUHAP, Undang-Undang Pemberantasan Tindak Pidana Korupsi, KUHP Tahun 2023, serta Rancangan Undang-Undang Perampasan Aset Tindak Pidana. Data diperoleh melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier, kemudian dianalisis secara kualitatif dengan pendekatan deskriptif-analitis dan preskriptif. Hasil penelitian menunjukkan bahwa pengaturan perampasan aset masih bersifat terbatas dan terfragmentasi, ditandai oleh paradigma retributif, pembatasan penyitaan dalam KUHAP, beban pembuktian yang tinggi, serta ketidakharmonisan norma antar peraturan perundang-undangan. Selain itu, resistensi politik dan kekhawatiran terhadap isu hak asasi manusia turut memperlambat pengesahan RUU Perampasan Aset. Temuan ini menegaskan bahwa pembaruan hukum perampasan aset yang komprehensif, berkeadilan, dan sejalan dengan standar internasional merupakan kebutuhan mendesak guna memperkuat efektivitas pemberantasan korupsi dan pemulihan kerugian negara.

Abstract

Penelitian ini mengkaji konsekuensi sosial praktik incest serta ketegangan normatif antara hukum adat dan hukum perkawinan nasional pada komunitas Suku Polahi di Gorontalo. Permasalahan utama terletak pada adanya praktik perkawinan sedarah dalam komunitas terisolasi yang secara normatif bertentangan dengan larangan dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, sehingga menimbulkan konflik antara pluralisme hukum dan supremasi hukum nasional. Penelitian ini bertujuan menganalisis dampak sosial praktik tersebut serta memetakan intensitas ketegangan normatif yang muncul. Metode yang digunakan adalah penelitian hukum normatif-empiris (socio-legal) dengan pendekatan interdisipliner, melalui studi peraturan perundang-undangan, wawancara mendalam, observasi lapangan, dan analisis kualitatif interaktif. Hasil penelitian menunjukkan bahwa praktik incest dipengaruhi oleh faktor isolasi geografis, keterbatasan akses pendidikan, dan minimnya administrasi kependudukan. Dampak yang muncul meliputi risiko kesehatan reproduktif, stigma sosial, invisibilitas hukum, serta kerentanan perempuan dan anak. Ketegangan normatif antara hukum negara dan hukum adat relatif tinggi, namun dikelola melalui pendekatan persuasif dan pemberdayaan sosial. Temuan ini menegaskan bahwa pluralisme hukum memiliki batas ketika berhadapan dengan norma prohibitif yang bertujuan melindungi generasi dan hak fundamental, sehingga kebijakan intervensi harus bersifat humanis, partisipatif, dan berbasis perlindungan hak

Abstract

The purpose of the study was to analyze the legality and limits of police repressive actions against protests that resulted in riots. This type of research is normative legal research with a legislative approach, a case approach and a conceptual approach. The analysis used in this study is an analytical descriptive technique. The results of the research show that the law is always used as a guideline in limiting all citizens' behavior to stay on the right path. Protests often lead to riots, destruction of public facilities, attacks on officers, and violations of public order, so that there is a criminal threat for protesters who do not maintain order and security. The regulation of police repressive actions in protests that result in chaos still needs special refinement in the context of protests, among which the substance of repressive actions must also harmonize technological developments and digitalization in security maintenance. The rules need to be updated by adding objective indicators of threats, public accountability mechanisms, transparent documentation obligations, measurable proportionality standards, and room for recovery for victims of abuse of power.

Abstract

This study examines the legal certainty of including the status of "unregistered marriage" in the Family Card from a normative juridical perspective with a statutory, conceptual, and casuistic approach, revealing fundamental inconsistencies between the substantive formalism of Law Number 1 of 1974 concerning Marriage which requires registration as an absolute requirement for the legal force of marriage (Article 2 paragraph 2) with the administrative descriptive approach of Law Number 24 of 2013 concerning Population Administration which accommodates the social reality of unregistered marriage through a Statement of Absolute Responsibility based on the Regulation of the Minister of Home Affairs Number 109 of 2019. The results of the analysis show that this normative dualism gives rise to the ambiguity of the hierarchy of norms as stipulated in Article 7 of Law Number 12 of 2011 concerning the Establishment of Legislation, moral hazard in marriage registration practices, and permissive Dukcapil field practices with tens of thousands of families with this status every year. The legal implications for the protection of wives' civil rights include the vulnerability of the right to maintenance (Article 34 of the Marriage Law), joint property, and limited inheritance (KHI Article 171), while for children it creates weak legal filiation resulting in the status of "one mother's child", hampered education rights, and the risk of statelessness which is contrary to the Convention on the Elimination of All Forms of Discrimination Against Women, the Convention on the Rights of the Child 1989, and Articles 27-28 of the 1945 Constitution. Critical discussions through grammatical, systematic, teleological, and comparative interpretations confirm that the status of "unregistered marriage" violates the principle of rechtszekerheid, creates structural gender injustice, and institutionalizes administrative exploitation. As a novelty, the research proposes the concept of "integrated administrative itsbat" through a national digital platform that integrates the Population and Civil Registration Office-Religious Affairs Office-Religious Court with artificial intelligence-based validation of Absolute Responsibility Statements and a mandatory 90-day timeline, revolutionizing the protection of marginalized families through inclusive technology

Abstract

This study examines the legal consistency between Constitutional Court Decision No. 35/PUU-XXI/2023 and Supreme Court Decision No. 57P/HUM2022 regarding small island protection in Indonesia. It focuses on the judicial review of the Coastal Area and Small Islands Management Law following a mining dispute on Wawonii Island. The research employs a normative legal method with statutory and casebased approaches. Findings indicate that the Constitutional Court affirms the prohibition of mining on small islands as conditional, rather than absolute, contingent upon technical, ecological, and socio-cultural impacts. Simultaneously, the Supreme Court categorizes such activities as abnormally dangerous, reinforcing environmental safeguards. This judicial synchronization establishes a robust regulatory framework that prioritizes sustainability, tightens environmental permitting instruments, and ensures legal certainty for stakeholders. These rulings strengthen the constitutional rights of coastal communities against exploitative activities, mandating that natural resource utilization must strictly adhere to rigorous ecological standards to prevent irreversible damage to vulnerable island ecosystems.

Abstract

Penelitian ini bertujuan untuk menganalisis relevansi dan efektivitas dakwaan Pasal 340 dalam Kitab Undang-Undang Hukum Pidana (KUHP) terhadap pemenuhan keadilan hukum berdasarkan kesesuaian antara konstruksi peristiwa hukum dan unsur “dengan rencana terlebih dahulu”. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus, melalui analisis komparatif antara perkara yang melibatkan Ferdy Sambo dan perkara Nomor 61/Pid.B/2023/PN GTO. Hasil penelitian menunjukkan bahwa efektivitas dakwaan Pasal 340 sangat bergantung pada kemampuan pembuktian unsur perencanaan secara sah dan meyakinkan. Dalam kasus Ferdy Sambo, unsur perencanaan terbukti secara sistematis sehingga penerapan Pasal 340 dinilai relevan dan memenuhi keadilan hukum. Sebaliknya, dalam perkara Nomor 61/Pid.B/2023/PN GTO, fakta persidangan menunjukkan perbuatan yang bersifat spontan sehingga hakim lebih tepat menerapkan Pasal 338 KUHP. Penelitian ini menyimpulkan bahwa efektivitas dakwaan tidak hanya ditentukan oleh terpenuhinya syarat formil dan materil, tetapi terutama oleh kesesuaian antara norma yang didakwakan dan fakta materiil, guna menjamin proporsionalitas pidana, kepastian hukum, dan keadilan substantif.

Abstract

The aim of this research is to find out the process and implementation of land registration in Hutuo Village, as well as to find out the factors that cause problems in land registration in Hutuo Village. The type of research used is Empirical Legal research. Data collection techniques were carried out using interview techniques and literature. Then the writer will analyze the data obtained in the research process descriptively, in this case the researcher will describe the description of the research subjects and objects as the results of the research he conducted. The results of this research indicate that land registration in Hutuo Village in view of Government Regulation Number 24 of 1997 is still not optimal. This is proven by the data in Hutuo Village where there are still a large number of unregistered land cases. However, the cases of land that have not been registered have not been resolved, due to the background obstacles that influence the achievement of legal certainty in the Hutuo Village. The suggestion in this research is that the Government, especially the Regional Office of the National Land Agency in Gorontalo Regency, continues to strive to carry out more outreach to the people of Hutuo Subdistrict to carry out land registration so that they can have a certificate to obtain legal certainty.

Abstract

This research discusses Decision Number 67/Pdt.P/2024/PN Gto at the Gorontalo District Court regarding a request to change a child's name from "Nadelia Nazwa Putri Baune" to "Aurel Syahwana Putri Baune," filed by the parents for administrative convenience. The study focuses on analyzing the judges' legal considerations in granting the application, emphasizing the relationship between compliance with formal norms, the relevance of the reasons presented, and the social sensitivity inherent in the case. Data was collected thru a study of judgment documents, interviews with judges, and analysis of relevant legal literature. The research results show that judges use a combination of legal-formal considerations based on the Population Administration Law and the principle of expediency, which emphasizes the smooth administration of children. Although the applicant's reasons were considered simple, the judge still deemed the application valid because it did not contradict the law, did not harm third parties, and was supported by administrative evidence and witnesses. However, critical analysis shows that the judges' ratio decidendi tends to be more pragmatic than in-depth, potentially setting a permissive precedent in similar cases. In conclusion, this decision reflects legal practices that are responsive to societal needs, but it still requires strengthening legal argumentation standards to balance legal certainty, justice, and utility.

Abstract

Penelitian ini dilatarbelakangi oleh perkembangan Artificial Intelligence (AI) yang mempermudah pembuatan dan penyebaran meme, namun berpotensi menimbulkan penghinaan di ruang digital. Rumusan masalah penelitian ini adalah implikasi pertanggungjawaban pidana serta konsep pengaturan hukum terhadap meme bermuatan penghinaan berbasis AI. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan implikasi hukum pembuatan dan penyebaran meme yang mengandung unsur penghinaan melalui Artificial Intelligence (AI) terhadap pertanggungjawaban pidana pada dasarnya tetap mengacu pada ketentuan hukum pidana yang berlaku di Indonesia, yaitu Kitab Undang-Undang Hukum Pidana (KUHP) dan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE). Lebih lanjut, Konsep pengaturan hukum pidana terhadap penggunaan AI dalam pembuatan dan penyebaran meme yang mengandung unsur penghinaan di Indonesia masih belum memadai dan belum bersifat komprehensif. Hal ini disebabkan oleh belum adanya regulasi khusus yang secara eksplisit mengatur kecerdasan buatan, sehingga pengaturan yang ada masih bersifat umum dan menimbulkan kekosongan hukum. Oleh karena itu, diperlukan pembaruan hukum pidana yang lebih adaptif dan responsif terhadap perkembangan teknologi, khususnya dalam mengantisipasi berbagai bentuk kejahatan siber yang memanfaatkan kecerdasan buatan.
