Abstract

In the modern era, mental health problems are in the spotlight in addition to the physical problems experienced by humans. There are many cases from a social and legal perspective that involve mental health issues. The purpose of this study is to describe legal and health issues from mental health issues. This research is a descriptive-analytical-explorative research with an approach in the form of a study of legislation (secondary data and primary – tertiary legal materials). The results of this study reveal that the 2014 Mental Health Law is the legal umbrella for mental health services in Indonesia, with continued implementation in the form of Minister of Health Regulation No. 75 of 2019 concerning Health Crisis Handling. In the Minister of Health Regulation there are regulations on mental health services in health facilities, especially Puskesmas, as well as integration with the formation of a national drug formulary that includes mental drugs in the list of mandatory drugs. On the other hand, the issue of mental health also mentions the existence of human rights of people with mental health, such as the issue of shackles, criminal acts of shackles, and the existence of special standards in handling cases where the defendant is a person with a mental disorder. The conclusion in this study is that the legal umbrella for mental health in Indonesia already exists, but its implementation in the field still requires further socialization so that its application can be evenly distributed throughout Indonesia.

Abstract

Medical service is a relationship between health care providers and patients. The health care professional or physician must operate ethically and circumspectly in order to avoid malpractice. Medical malpractice is defined as any professional error made by a physician, including an act that a physician should not perform. An action indicating suspected malpractice does not necessarily result in a court judgment, and some instances remain unresolved. The Res Ipsa Loquitur doctrine or the thing speaks for itself, which is consistent with existing regulations in favor of the victim, does not require the victim to show the doctor's negligence process. This doctrine provides justice for patients who are victims by proving that the malpractice case is real or indirect evidence. The evidence is conducted in accordance with civil law, and proof of the element of negligence suffices to establish the facts.

Abstract

In today's modern era, hospitals as part of health services require an internal regulation based on law, otherwise known as hospital by laws. One form of implementation of hospital by laws is the implementation of clinical pathways, which become a reference or standard for medical services from the time the patient arrives until the patient leaves the hospital. This research is descriptive-analytical-explorative research with a statutory approach. The data used in this study is secondary data, which consists of primary, secondary, and tertiary legal materials. The results of this study discuss a clinical pathway that describes a method or instrument used in providing care to patients by all health and medical personnel at the hospital. Clinical pathways have been shown to reduce unnecessary variation in patient care, reduce discharge delays through more efficient discharge planning, and increase the cost-effectiveness of clinical services. The approach and goals of the clinical pathway are consistent with total quality management and continuous quality improvement and are essentially the application of these principles at the patient's bedside. This article investigates the increasing use of clinical pathways, their benefits to healthcare organizations, their use as a tool for continuous quality improvement activities directly related to patient care, and the medico-legal implications involved.

Abstract

We carried out this study to analyze several scientific pieces of evidence on the sustainability of the use of technology in the context of post-pandemic higher education learning. We got several kinds of literature in the form of scientific evidence from several publications released between 2010 and 2020, which we obtained electronically with keyword-based searches such as “technology uses," "sustainability Education," higher education" post-Covid-19," and technology in learning." To get answers to the questions of this study, we analyzed the data under another phenomenon approach which involved data coding techniques, data evaluation, data interpretation, and valid and reliable conclusions. Based on existing data and discussion of the results, we can conclude that the analysis of scientific evidence shows that the continued use of technology in teaching in higher education is an effort made to harmonize learning in the 21st century, which prioritizes technology adoption to accelerate learning outcomes in tertiary institutions. This result will be a helpful insight into the following studies.

Penelitian ini bertujuan untuk melakukan kajian mengenai banding dan kasasi dalam hukum acara perdata dari perspektif logika hukum, dengan menggunakan proses berpikir deduktif. Kajian dilakukan dengan menerapkan prinsip silogisme yang menggunakan premis minor dan premis mayor. Penelitian ini merupakan penelitian hukum dan logika dengan pendekatan deskriptif analitis. Data yang dipergunakan adalah data sekunder, yaitu data yang sudah tersedia untuk dipergunakan.

This retrospective study delved into the legal complexities and ethical considerations inherent in the digital age. Employing a meticulous research design, the investigation encompassed a thorough literature review, a detailed legal analysis, and compelling case studies. Data collection involved an exhaustive review of legal documents, insightful interviews with legal experts, and a comprehensive analysis of pertinent court cases. The aim was to comprehensively dissect the legal landscape surrounding electronic transactions and social media. The study hinged on qualitative and quantitative data analysis, allowing for a multifaceted exploration of the subject matter. Ethical guidelines were rigorously followed throughout this scholarly endeavor, with an unwavering commitment to safeguarding privacy and data. The research aspired to provide valuable insights into the profound implications of Law No. 9/2019 on Electronic Transactions, not only in terms of its legal provisions but also its practical applications in the digital age. Ultimately, this retrospective analysis underscores the critical importance of legal literacy in navigating the intricate terrain of electronic transactions and social media. Abstract

This study aims to discuss the understanding of the phenomenon or trend of electronic banking in the country in terms of what the experts said through their studies from various perspectives and perspectives of banking and finance experts. This study relies on secondary data from book publications, scientific articles, and other data sources. We studied it under the phenomenological approach, which we started by mingling the question and then identifying the relevant literature. We continued by evaluating the suitability of the findings and the findings with the research problem, and finally, we tried to create a summary that could answer the problem validly and convincingly, and finally, we interpreted the funding obtained. We get, and we discuss. Finally, based on the data we got and the discussion we carried out in this study, we can conclude that the trend in Indonesian society to accept being a customer of electronic banking is due to the ability and innovation and effectiveness, and practicality of the services provided by banks, especially when a pandemic hits customers or the public, banking is electronics is one alternative solution that is very effective. Hopefully, this finding will be an addition to the complement of financial and banking studies in the future.

Abstract

Having a deep understanding of entrepreneurial success is essential for anyone who wants to run a profitable business in an increasingly changing world. This study discusses the knowledge of successful entrepreneurs from the point of view of the experts we examine in the study of phenomenological approaches. We have conducted an electronic search for data on several literature sources, both books, scientific applications in the form of articles and websites and magazines that discuss issues of successful entrepreneurs viewed from various fire points of view. Meanwhile, the study that we run is under a phenomenological approach, namely the process of getting something phenomenal from several collected data. These processes include data coding, in-depth interpretation, and concluding by reasoning that the findings are close and relevant. In other words, the data findings are valid and convincing. Based on the explanation and discussion, we can say that understanding a successful entrepreneur is essential for individuals who want to run a business. That understanding must be supported by experts in entrepreneurship and related issues. Thus the presentation of this data to be useful for similar studies in the future.

Abstract

Guiding the younger generation in understanding Islam from the family informing the piety of the millennial generation is essential even though the government and society have established Islamic religious schools. To ascertain the extent to which Muslim families have carried out such guidance, we have obtained supporting data from various literature sources, including findings published in international journals that we have searched electronically on the Google Scholar application from the 2010 issue to the most recent 2021. Furthermore, our analysis process involves evaluating, coding, and critical interpretation under a phenomenological approach. During the reporting, we choose a descriptive analysis system. All of our data depend on secondary, considering that this study was carried out when Indonesia was implementing PPKM, namely the period of the national public movement restriction policy. After the process of discussing the results, we can summarize that the task of guidance and family responsibilities in children's education lies with parents in the family, including things such as the motivation or encouragement of love that animates the relationship between parents and children and the provision of motivation for moral obligations as the consequences of the position of parents to their offspring so that the hope that someday the children will become pious and pious children. Thus, these findings should be part of efforts to educate children in the millennial era.

Abstract

In this era of digital technology, learning is very foreign if it still uses single method methods, namely face-to-face. We firmly believe that combining traditional methods with technology must be applied to achieve outcomes, especially in postgraduate studies. For that reason, we have carried out many publications in journals, books and procedures, and other information. Then the effort has involved several steps such as understanding the data through coding evaluation and drawing conclusions that essentially want to get the answer data on this royal question as valid and accurate as possible. Based on the available evidence and the depth of the discussion of the findings, we can finally say that the learning strategy in universities, especially in the undergraduate market, is a strategy that combines the old and new ways, namely face-to-face in the classroom and is guided by collaborative learning or learning-based learning. Thus, it is hoped that the findings of this study will make the development and progress of learning and learning studies related to blended learning increase in the future.
