Abstract

This research aims to conduct a comparative analysis of the application of the death penalty in murder cases in various countries. There are significant differences in the policies and practices of the death penalty, with some countries such as the United States and Japan still retaining it, while European countries such as the United Kingdom and Germany have abolished this punishment. Cultural, political, and legal factors influence how the death penalty is applied, for example, in Middle Eastern countries guided by sharia law and in China which has broader and less transparent execution policies. Overall, global trends show a trend toward reducing and abolishing the death penalty, reflecting shifts in social norms and human rights advocacy. This research highlights the importance of considering local context in death penalty policy and supports the need for international dialogue to encourage a more humane and effective implementation of justice

Abstract

This kind of approach focuses on rehabilitation and taking responsibility for one’s action rather than severe punishment. Pretrial interventions also allow the offender to participate in rehabilitative programs aimed at skills training and preventing future offenses without the stressful effect of the traditional criminal scion. More training and resources for police are crucial in the management of petty theft cases without the loss of public trust in the system of justice. Wanting community education efforts are also important in the elimination of petty theft. The study in this research uses the literature research method. Literature research method, also known as literature study, is an approach in research that relies on secondary data through the collection, analysis, and interpretation of published materials relevant to the research topic. The rationale for alternative legal solutions for petty theft cases cases demonstrates an advancement of criminal justice systems going beyond punitive measures. With the help of the restorative methods of justice, the two parties- the offender and the victim – become participants in the process of redress, which makes it possible for the offender to accept responsibility for his/her behaviour and for the victim to be reinstated with a sense of justice.

Abstract

By late March, to anticipate the spreading of COVID-19 pandemic, the President of the Republic of Indonesia has issued several regulations. The Author has examined that the main laws that were used as the based for the issuance of those regulations are Law No.6 Year 2018 regarding Health Quarantine (the Health Quarantine Law). Therefore in order to handle COVID-19 pandemic, an understanding of the Law become a must. The aim of this research is to elaborate and explain the Health Quarantine Law to reduce the COVID-19 pandemic. This research is normative legal research. The research used secondary data, which consisted of primary legal sources and secondary legal sources. Data were collected through the "google scholar machine". Data obtained were analyzed using a qualitative approach. Findings and analysis proved that besides those newly issued regulations there were several measures and acts that should be taken to handle the COVID-19 pandemic in Indonesia. The Author suggests that the Central Government shall take the necessary steps as soon as possible.

Abstract

This research analyses the legal problems caused by the existence of multiple land titles in Indonesia, which reflect weaknesses in the country's land administration system. Multiple title cases not only create legal uncertainty and increase land disputes but also burden the judicial system with lengthy and complex legal processes. The economic impact is felt across sectors, with delays in property development and declining property values, affecting individuals, investors and financial institutions. The study emphasises the importance of legal reform and improvement of the land registration system with the adoption of modern technology and increased supervision. This will lead to a more transparent, accurate and reliable land administration system, reducing the potential for multiple land titles and providing better legal protection to landowners.

Abstract

Freedom of opinion in Indonesia, constitutionally guaranteed as a human right, faces challenges in the digital era due to the ambiguous enforcement of the ITE Law, which initially targeted cybercrimes but expanded to regulate online speech, risking democratic expression. This study analyzes the ITE Law’s evolution (2008–2024) to assess its impact on freedom of expression in digital democracy, focusing on legal shifts and enforcement practices. Using normative juridical research, the study examines secondary legal materials through qualitative analysis, including legislation, court decisions, and scholarly works. The 2024 revisions reduce penalties and limit complaints to directly affected individuals, aiming to curb repression. However, ambiguities persist in defamation provisions, and enforcement biases threaten free speech. The study underscores the need for clearer legal standards, digital literacy programs, and alternative dispute mechanisms to align the ITE Law with democratic principles. Future research should explore comparative models and the law’s societal impact post-revision.

Abstract

The legal political system greatly influences the Indonesian state to become a state based on law, thus requiring the involvement of community components in the process of formulating laws. This is so, because the legal political system will have a vital role in making the law. This is because the direction of the Indonesian state in the application as a state of law uses the concept of Continental European Civil Law, where written law is a very important part of the formation process, and is used as the basis for the implementation of governance. In order to ensure the implementation of legal protection for all people, as well as justice in treatment, and guarantee protection of citizens' rights, it is necessary to establish concrete guidelines in planning and drafting laws. This is intended to be the basis for regulating the process of law-making, starting from the beginning until the time when the law is enacted or applied in regulating the life of the state society. Thus, by creating concrete guidelines and guidelines, each law-making process can be carried out in a definite, consistent, and standardised manner.

Abstract

This study explores the evolution of the mudarabah contract from a historical perspective to its prospects for application in the modern banking system. Using a literature review method, with a research focus on the evolution of the mudarabah contract over time and its prospects for application in the modern banking system. Historical analysis shows how mudarabah has adapted to the changing socioeconomic and financial regulatory challenges over time, as well as the evolution of its practice based on the principle of profit sharing and Islamic commercial ethics. The results of the study show that innovation and adaptation in Islamic financial products, including mudarabah contracts, have strengthened their relevance in the modern era, indicating significant growth in global Islamic banking. This article closes by discussing the prospects of mudarabah contracts as ethical and sustainable financial instruments in the modern banking ecosystem, given the increasing demand for responsible and fair financial alternatives, as well as the important role of financial technology in expanding the reach and efficiency of sharia financial transactions.

Abstract

This study analyzes the Highest Retail Price (HET) policy for palm cooking oil. of palm cooking oil implemented by the Indonesian government through MOT Regulation of the Minister of Trade (Permendag) Number 1 of 2022 as revoked based on Permendag Number 6 of 2022 concerning the Determination of HET of Palm Cooking Oil, and its implications for business competition based on Law No. 5 of 1999 on the Prohibition of Monopolistic Practices. based on Law No.5/1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition. and Unfair Business Competition. The price ceiling policy aims to protect consumers from uncontrolled price increases, especially for low-income households. low-income communities. Producers filed an objection, and the Central Jakarta Commercial Court ruled that the scarcity of cooking oil was the impact of the single price ceiling policy, and therefore the KPPU's decision was canceled. This research uses normative legal methods by analyzing legal principles in court decisions and related regulations. Abstract

Taxation contributes to national development, and Indonesia has responded to global dynamics by introducing Indonesia Core Tax, a digital system designed to improve tax transparency and compliance. Although Indonesia has adopted various digital systems such as e-Faktur and e-Invoicing, it still faces implementation challenges, while Malaysia is more advanced with its integrated and phased API-based e-Invois system. This study examines taxation policy within the framework of Indonesia Core Tax, focusing on the legal aspects of e-Invoicing implementation as part of the digital transformation of tax administration. The analysis covers the hierarchy and functions of legislation, from laws and regulations to Minister of Finance regulations (PMK) and technical regulations of the Directorate General of Taxes (DJP). This study uses a normative legal research method with a legislative approach and a comparative approach to compare Indonesia's digital taxation system with Malaysia's, covering legal structure, legal substance, and legal culture. The results of the study show that although Indonesia has a fairly complete digital legal framework, the implementation of the e-Invoicing system still faces challenges in terms of regulatory consistency and technological readiness. In contrast, Malaysia has already implemented a mandatory and centralized API-based e-Invoice system through a clearance model approach. This study recommends harmonizing digitalization policies in taxation and strengthening the legal system as strategic steps toward more effective and adaptive tax administration.

Abstract

Restorative approaches in public health conflict offer solutions that focus on restoring social relations and peacefully resolving conflict through inclusive dialogue. This method provides space for all parties involved to actively participate, identify root causes, and seek solutions together to minimise the negative impact of conflict on the public health system. Compared to traditional retributive approaches, restorative approaches emphasise social justice, open communication and collective healing, making them more effective in building trust and improving responsiveness to community health needs. The implementation of this approach not only resolves the conflict, but also helps to create a more resilient and sustainable public health system.
