Abstract

This study critically examines legal regulations related to the protection of medical personnel and patients in Indonesia, focusing on landmark cases that reflect legal challenges in the healthcare sector. The study found that although legal protections for medical personnel and patients are set out in legislation, implementation is often hampered, particularly in the context of medical decision-making, malpractice risks and lawsuits. Lack of legal certainty for medical personnel can hamper their professionalism, while for patients, unclear rights to quality services can reduce trust in the health system. Through the analysis of various cases in the literature review, this study identifies the need for legal reforms that focus on balancing the rights and obligations of both parties, namely medical personnel and patients, along with applicable legal education. With regulatory reform and more transparent law enforcement, the results are expected to improve the quality of health services, protect medical personnel in carrying out their duties, and strengthen public confidence in the legal system in the health sector. This research contributes to thinking about the importance of coordination between legal institutions, medical practitioners, and the community in building a fairer system in the health care sector.

Abstract

The influence of health policies on legal protection for medical personnel and patients is an important issue in efforts to improve the quality of health services. Clear and comprehensive policies are needed to regulate the rights and obligations of medical personnel and patients, as well as to reduce the risk of legal disputes. With good regulations, medical personnel can carry out their duties professionally and patients are protected from malpractice or medical negligence. In addition, specific policies regarding medical procedures, drug management, and health service standards provide clear guidance for medical personnel, thereby minimizing the potential for legal violations. Health policies must also ensure equitable access to health services for all levels of society, including vulnerable groups. Thus, effective health policies can guarantee adequate legal protection for medical personnel and patients and increase public trust in the health system.

Abstract

This article discusses the legal liability of hospitals in cases of medical malpractice based on Law No. 17 of 2023 concerning Health. This law provides a clear legal framework regarding the obligation of hospitals to ensure that all medical procedures performed are in accordance with applicable professional standards. In the event of malpractice, the hospital may be subject to civil liability to provide compensation to the victim as well as criminal liability if there is evidence of negligence or gross violations. In addition, Law No. 17 of 2023 emphasizes the patient's right to obtain safe and quality medical services, with a structured complaint and dispute resolution mechanism, as well as supervision and sanctions for violations. Thus, this law is designed to improve the quality of health services and strengthen patient protection from the risk of medical malpractice.

Abstract

The use of cloud services has become increasingly common in recent years, but this brings significant challenges related to data privacy and security. This paper examines the legal and regulatory perspectives on data privacy and security in cloud services. With regulations such as the General Data Protection Regulation (GDPR) in the European Union, strict standards have been set to protect personal data. The responsibility for ensuring data privacy and security must be shared between cloud service providers and users, with clear policies and contracts defining their respective responsibilities. Furthermore, as technology advances rapidly, regulations must continue to evolve to address new challenges and ensure adequate data protection. International collaboration and increased technological awareness among policymakers are also key factors in this effort.

Abstract

Advances in digital technology have driven the transformation of the taxation system to be more efficient and timely, but they have also created new challenges in terms of cybersecurity and data protection. Digital taxation systems manage large amounts of sensitive data, including taxpayers' personal and financial information, which is a potential target for cyberattacks. This study discusses important measures that need to be implemented to ensure the security and integrity of data in digital taxation systems. These measures include the implementation of encryption technology, strict access control, routine security audits, and security awareness training for staff. A holistic approach and collaboration with technology experts are the main keys to maintaining a secure and reliable taxation system, while maximising the benefits of digitalisation. With these steps, the risk of cyber threats can be minimised, so that the integrity and public trust in the digital taxation system is maintained.

Abstract

Professional associations play a crucial role in providing legal protection for medical personnel in Indonesia. Through various initiatives, including legal support, advocacy, and education on legal rights and obligations, professional associations help medical personnel face legal challenges and the risk of malpractice. In addition, professional associations play a role in maintaining standards of professionalism and quality of medical services by encouraging continuing education and implementing strict codes of ethics and standards of practice. Therefore, the existence of professional associations provides a sense of security and confidence for medical personnel, enabling them to focus on providing optimal health services to the community.

Abstract

The influence of international trade agreements on personal data protection policies is a topic that examines how international standards and frameworks influence domestic regulations related to data privacy. International trade agreements, such as GATT and various free trade agreements, require member countries to implement regulations that support the security and transfer of cross-border data. Challenges arise when countries have to adjust their personal data protection policies to international obligations, which can lead to potential conflicts between national interests and international compliance. Nevertheless, this agreement has a positive impact by encouraging the harmonisation of global data protection standards, reducing trade barriers, and improving the security of personal data. The successful implementation of this policy depends heavily on the commitment and cooperation between countries in implementing effective regulations that are in line with global needs.

Abstract

This study aims to analyse the social and economic impacts of multiple land title disputes on communities. Multiple land title disputes often occur due to discrepancies in the land administration system, leading to overlapping land ownership. This study reveals that the social impacts of multiple land title disputes are significant, including increased conflict between residents, deterioration of social relations, and decreased trust in government institutions. The economic impacts are also significant, with communities facing high legal costs and lost economic potential due to land that cannot be utilised productively. The research suggests the need for reforms in the land administration and agrarian justice systems, as well as increased legal awareness among communities to prevent and reduce multiple land disputes in the future. With these measures, it is hoped that social stability and economic recovery can be achieved, so that people can live more prosperously and harmoniously.

Abstract

This study compares the political participation of people with disabilities in various countries, highlighting the factors that influence their level of involvement in the political process. Although the political rights of people with disabilities have been legally recognised, their implementation in many countries still face various obstacles, such as limited accessibility, lack of awareness, discrimination, and lack of environmental support. This study employs a qualitative method with a comparative approach through literature analysis. The findings reveal that countries with strong affirmative policies, close collaboration between the government and disability organizations, and accessible technological innovations tend to have higher levels of political participation among people with disabilities. Conversely, in countries still grappling with structural and cultural barriers, participation among this group remains low. This study recommends the need to strengthen regulations, improve accessibility, and provide inclusive political education to achieve equal and meaningful political participation of people with disabilities worldwide.

Abstract

This study examines the relationship between inter-agency coordination and the effectiveness of welfare policies through a literature review. Inter-agency coordination is a crucial factor in enhancing synergy, efficiency, and accountability in the implementation of social welfare programmes, thereby minimising duplication and waste of resources. This study examines various literature discussing coordination mechanisms, challenges faced, and their impact on aid distribution and the achievement of social welfare objectives. The results of the study indicate that effective coordination is supported by intensive communication, data integration, visionary leadership, and harmonious regulations. However, obstacles such as differences in interests among institutions, limited resources, and inaccuracy in targeting remain major challenges. This study recommends strengthening the coordination system, improving human resource capacity, and utilising information technology as key strategies to enhance the effectiveness of welfare policies. Thus, solid inter-agency coordination is an important foundation for achieving inclusive, sustainable, and widely impactful welfare policies for society.
