Abstract

Penelitian ini bertujuan untuk meneliti bagaimana penanganan masalah yang terjadi karena kesalahan dalam melakukan transfer dana. Penelitian ini menggunakan metode penelitian hukum normatif. Data yang dipergunakan akan data sekunder, dalam hal ini Undang-Undang No.3 Tahun 2011 tentang Transfer Dana (UU No.3/2011). Hasil dan analisis penelitian ini menunjukkan bahwa hubungan hukum yang terjadi dari suatu kesalahan transfer merupakan hubungan keperdataan sehingga menimbulkan hak dan kewajiban dari pihak-pihak yang terlibat. Proses penyelesaian salah transfer dapat dilakukan melalui proses mediasi dan kordinasi antara para pihak yang terkait. Bank merupakan pihak yang diberikan kewajiban untuk menyelesaikan salah transfer, sebagaimana diamanatkan dalam ketentuan Pasal 56 ayat (1) UU No.3/2011yang menyatakan bahwa “Dalam hal penyelenggara pengirim melakukan kekeliruan dalam pelaksanaan transfer dana, penyelenggara pengirim harus segera memperbaiki kekeliruan tersebut dengan melakukan pembatalan atau perubahan

Abstract

Guiding the younger generation in understanding Islam from the family informing the piety of the millennial generation is essential even though the government and society have established Islamic religious schools. To ascertain the extent to which Muslim families have carried out such guidance, we have obtained supporting data from various literature sources, including findings published in international journals that we have searched electronically on the Google Scholar application from the 2010 issue to the most recent 2021. Furthermore, our analysis process involves evaluating, coding, and critical interpretation under a phenomenological approach. During the reporting, we choose a descriptive analysis system. All of our data depend on secondary, considering that this study was carried out when Indonesia was implementing PPKM, namely the period of the national public movement restriction policy. After the process of discussing the results, we can summarize that the task of guidance and family responsibilities in children's education lies with parents in the family, including things such as the motivation or encouragement of love that animates the relationship between parents and children and the provision of motivation for moral obligations as the consequences of the position of parents to their offspring so that the hope that someday the children will become pious and pious children. Thus, these findings should be part of efforts to educate children in the millennial era.

Abstract

In this era of digital technology, learning is very foreign if it still uses single method methods, namely face-to-face. We firmly believe that combining traditional methods with technology must be applied to achieve outcomes, especially in postgraduate studies. For that reason, we have carried out many publications in journals, books and procedures, and other information. Then the effort has involved several steps such as understanding the data through coding evaluation and drawing conclusions that essentially want to get the answer data on this royal question as valid and accurate as possible. Based on the available evidence and the depth of the discussion of the findings, we can finally say that the learning strategy in universities, especially in the undergraduate market, is a strategy that combines the old and new ways, namely face-to-face in the classroom and is guided by collaborative learning or learning-based learning. Thus, it is hoped that the findings of this study will make the development and progress of learning and learning studies related to blended learning increase in the future.

Abstract

With respect to medical malpractice, even though it is widely used and spoken, formally there is no clear neither equivocal definition ever made. Even from the point of view of law and healthcare experts, the use of malpractice term in healthcare is still unclear. This thesis conducts literatures review and experts interview in order to find out and determine the definition of medical malpractice. This thesis also tries to find the criteria, kinds, causes, evidence to be used in malpractice lawsuits, and forum selection in resolving malpractice disputes in healthcare. This thesis provides input that in principle the legal relation in providing medical service shall be seen as contractual relation.

Abstract

This review discusses the understanding of state policies on human resource management in the field of small and medium-sized businesses that are still plagued by the pandemic. For this purpose, we have conducted a series of data searches on online databases, especially scientific journal publications that publish HR issues and strengthen small businesses. Our data is obtained from secondary data from well-known publications such as Research gate, Taylor&Francis, Google Book, Sagepub, and databases published by the Indonesian Government related to policies and regulations for small and medium enterprises. At the same time, Indonesia is still plagued by pandemics. Then our data with a phenomenological approach to explore all available data so that we can find answers to this study with available and valid principles. Among other things, our studies involved evaluation, system coding, and high interpretation before we got a summary. The results include that Micro, Small, and Medium Enterprises contribute to the National Gross Domestic Product and have an essential role in economic recovery. The Government is committed to supporting MSMEs to survive, develop, and grow amid the challenges of the pandemic.

Abstract

Understanding the risks and opportunities in real estate investing is an exciting study for academic purposes and business applications in the field. The author believes that this question is very relevant to be discussed to understand the opportunities and risks if someone wants to run a property business, which is a very lucrative business opportunity. To complete the discussion of this theme, we have conducted a series of electronic data searches on several publication databases, journals, books, and websites that actively discuss the risks and opportunities of investing in real estate, both nationally and internationally. We cannot describe the data validly and adequately if we do not do an in-depth study first, involving a data coding system and a thorough evaluation to get data findings that can answer. We carried out data published in the last ten years from 2010 to 2021, considering that today's data is so fast that it continues to change and evolve. Based on the phenomenological study we saw from the extensive data exploration. We found several points which in general were understanding the opportunities of the risk of investing in property, so based on this discussion, we can conclude that the opportunity is this considering that property is a business that never runs out and cannot be as easy as others are in motion and the sale and purchase, they only need to maintain, and the risk will usually occur if mismanagement and natural disasters such as floods and fires, the rest of the property business opportunities are indeed very promising. Thus, this finding should be a complement to the same studies.

Abstract

The Governor of DKI Jakarta Regulation No.70 Year 2021 regarding the Second Amendment to the Governor of DKI Jakarta Regulation No.132 Year 2018 regarding the Coaching of the Administration of Owned Apartment, which was issued on September 1, 2021, has made changes in several provisions in the previous Governor's Regulation. One of the changes is Article 102B. This study discusses the meaning of the change, thoughts on the implementation, and its transitions. This research is normative legal research, which uses secondary data. The analysis was carried out qualitatively through a descriptive-analytical approach to find answers to the objectives of this study. As a guide, this research conducts analysis using Gustav Radbruch’s perspective.

Abstract

This paper delves into the intricate juridical framework governing environmental conservation within the dynamic context of infrastructure development and the pursuit of sustainable progress in the Republic of Indonesia. As Indonesia experiences rapid economic growth and urbanization, driven by ambitious infrastructure projects, it confronts a challenging dichotomy—simultaneously fostering development and preserving its ecological riches. This study offers an extensive examination of Indonesia's legal landscape, encompassing environmental laws, regulations, policies, and practical implementation and enforcement mechanisms. It scrutinizes the critical role of Environmental Impact Assessments (EIAs) in navigating the environmental consequences of infrastructure ventures. Additionally, it explores government policies and international commitments that underscore Indonesia's dedication to sustainability. The paper highlights the intrinsic connection between environmental conservation and sustainable progress, emphasizing the importance of responsible resource management and ecological preservation in achieving long-term development objectives. By analyzing case studies, policy implications, and future research directions, this research aims to provide a comprehensive understanding of how Indonesia can harmonize its infrastructure development ambitions with the imperative of environmental protection, ultimately guiding the nation toward a more sustainable and equitable future.

Abstract

Ketentuan mengenai Badan Usaha Milik Negara (BUMN) telah diatur dengan jelas dalam Undang-Undang No.19 Tahun 2003 tentang Badan Usaha Milik Negara (BUMN). Meskipun demikian ternyata putusan kepailitan mengenai kepailitan BUMN masih belum ada keseragaman. Penelitian ini dibuat dengan tujuan untuk melakukan analisis terhadap Putusan No. 04/Pdt.Sus-Pailit/2016 Jo. Putusan No. 447 K/Pdt-Sus-Pailit/2016 yang menolak permohonan kepailitan terhadap BUMN dalam bentuk Persero, sedangkan terdapat putusan sebelum dan sesudahnya yang memutuskan bahwa BUMN dalam bentuk Persero dapat dinyatakan pailit. Hal tersebut sejalan dengan UU BUMN. Penelitian ini adalah penelitian hukum dengan pendekatan yuridis normatif, yang menggunakan data sekunder berupa sumber hukum primer dan sumber hukum sekunder.

Abstract

Chronic diseases are becoming a global health challenge, with their increasing prevalence and impact on patients' quality of life. Traditional medicine, which has been used for thousands of years in various cultures, offers potential for integration with modern medicine in managing these conditions. This study aimed to assess the effectiveness of traditional medicine in curing chronic diseases through a comprehensive literature review. The results showed that there is positive evidence regarding the effect of traditional medicine on the healing of chronic diseases. The use of medicinal herbs can significantly reduce blood sugar levels in diabetic patients, while acupuncture is effective in reducing pain severity in diseases such as arthritis. Massage therapy and meditation techniques showed a positive impact in reducing stress, which is an important risk factor for many chronic diseases. The study also found that the integration of traditional medicine with conventional care can provide a more holistic and personalized approach to chronic disease management, improving patients' quality of life.
