Abstract

This study comprehensively examines the concept, mechanism, and legal implications of syndicated loans in the Indonesian banking industry, which are defined as joint loans by a group of banks to a single debtor with uniform terms to overcome the maximum credit limit (BMPK) in accordance with regulations issued by the Financial Services Authority (OJK) and Bank Indonesia (BI), as stipulated in BI Circular Letter Number 6/33/UPK/1973, SEBI 11/26/UPK/1979, PBI 7/14/PBI/2005, and Article 1320 of the Civil Code concerning the validity of agreements. The implementation mechanism includes a sourcing stage with a feasibility study based on 5C analysis, structuring termsheets including covenants such as DSCR >1.2x, selling through syndication roadshows, and servicing by agent banks with a single facility agreement that ensures pro-rata non-joint and several risk sharing. The legal implications emphasise the rights and obligations of the parties involved, such as the debtor in relation to events of default, the lead arranger in relation to fiduciary duty, and the participants through majority voting for debt acceleration or execution of collateral rights in accordance with Law No. 4/1996, with potential disputes resolved based on pacta sunt servanda Article 1338 of the Civil Code.

Abstract

This study aims to analyze the impact of dividend policy on company value among manufacturing companies listed on the Indonesia Stock Exchange (IDX). The research method employed was a literature review, seeking references related to the research context under study. The findings indicate that the dividend payout ratio and dividend yield have a significant positive effect on company value, while dividend growth does not show a significant impact. These findings underscore the importance of dividend policy as a factor influencing investor perceptions of company value. The managerial implication of this research is that manufacturing companies on the IDX need to consider appropriate dividend strategies as part of their financial policies to enhance company value. This study also contributes to the financial literature by expanding understanding of the dynamics of dividend policy in the Indonesian capital market, particularly within the manufacturing sector.

Abstract

This comprehensive study delves into a meticulous comparative analysis, examining the metaphysical underpinnings and normative frameworks inherent in Islamic and Western philosophical paradigms. The primary focus is on their profound implications for the foundations and practical application of human rights. Through an in-depth exploration of key philosophical texts, historical contexts, and real-world applications, this research sheds light on the complex tapestry that shapes understanding human rights in these distinct traditions. The Islamic viewpoint, deeply rooted in the sacred Qur'an and Sunnah, emphasizes concepts like fitrah (innate predisposition) and stewardship. At the same time, Western traditions, evolving across classical to Enlightenment eras, prioritize individual liberties within a secular framework. By navigating these intellectual landscapes, this study contributes significantly to a nuanced and culturally sensitive discourse on human rights, surpassing simplistic dichotomies and fostering a global understanding.

Abstract

This study explores the transformative shifts in urban governance, socioeconomic dynamics, and infrastructural development during the tenure of Anies Baswedan as the Governor of Jakarta. Through a comprehensive literature review, it examines the multifaceted impacts of Baswedan's leadership on Jakarta's urban landscape. Baswedan's administration has been marked by ambitious policies addressing social inequalities, promoting economic growth, and enhancing infrastructure. Initiatives such as the Jakarta Smart City program, the One Million Trees Movement, and the Jakarta MRT expansion have sought to modernize governance, foster environmental sustainability, and improve the quality of life for residents. However, challenges persist in social welfare, economic inclusion, and sustainable development, underscoring the complexities of governing a rapidly growing megacity. This study contributes to a deeper understanding of urban governance paradigms by synthesizing insights from diverse disciplinary perspectives. It offers valuable insights into the opportunities and challenges of leadership in dynamic urban contexts.

Abstract

Brand identity development is crucial for Micro, Small and Medium Enterprises (MSMEs) engaged in the tourism industry, especially in Sederhana Beach Village, Muara Gembong District, Bekasi Regency, West Java. This beach village has great potential in tourism due to its natural beauty and charming local culture. However, MSMEs in the village are often faced with challenges in building a strong and attractive brand, hindering their business growth. The research method used in this study was sourced from the literature. The results show that a strong and attractive brand can attract more tourists, create a distinctive identity associated with natural beauty and local culture, and facilitate collaboration and promotion of the village as a complete tourist destination. Suggested business development strategies include coordinated brand management among local MSMEs, investment in training and guidelines on brand development, and support from local governments and relevant agencies in the form of technical assistance, funds, and coaching programmes. By implementing solid brand-based business development strategies, MSMEs in Pantai Sederhana Village can increase revenue, achieve sustainable business growth, and provide economic benefits to the local community. This research makes a significant contribution to the development of MSMEs in the tourism sector, particularly in maximising the potential of beach villages through effective brand management.

Abstract

Public-private partnerships (PPPs) play a crucial role in supporting education digitalisation initiatives in developing countries. By combining the private sector's financial and technical resources with government efforts, these partnerships help provide vital technological infrastructure to schools in less developed areas. In addition, PPP initiatives also focus on strengthening the transfer of knowledge and skills through training and curriculum development relevant to the needs of the job market. This collaboration also encourages innovation, which enables the development and implementation of sustainable digital solutions to improve access to and quality of education. Overall, public-private partnerships are key to creating an education system that is inclusive and responsive to global changes in developing countries.

Abstract

This research aims to examine inclusive education strategies in instilling values of justice, equality and acceptance of differences in students in Indonesia through a literature review. Inclusive education is seen as an approach that provides equal learning opportunities for all children, regardless of background, physical, mental or social conditions. Through strategies such as adaptive learning, collaboration between teachers, parents and communities, and the development of a diversity-friendly school culture, inclusive education is able to create an equitable learning environment that respects diversity. The review shows that the implementation of inclusive education strategies has a positive impact on students' social, academic and character development and reduces stigma and discrimination in the school environment. However, challenges such as limited resources, lack of teacher training and social stigma remain major obstacles. Therefore, a sustained commitment from all stakeholders is needed to strengthen training, provide adequate facilities and conduct socialisation and advocacy so that inclusive education can run optimally and sustainably.

Abstract

This research aims to examine the implementation of Merdeka Curriculum as the national curriculum based on the Minister of Education, Culture, Research, and Technology Regulation Number 12 of 2024, and analyse its implications for educational institutions in Indonesia. The method used is a literature study with a descriptive qualitative approach, collecting and analysing various secondary sources such as official government documents, scientific journals, articles, and related research reports. The study results show that Merdeka Curriculum emphasises flexibility, autonomy and relevance of learning to the needs and potential of learners. This curriculum provides more space for schools and teachers to develop innovative, contextual, and character-strengthening-centred learning through the Pancasila Student Profile strengthening project. However, its implementation faces challenges in the form of human resource readiness, limited infrastructure, and the need for continuous training and mentoring. The successful implementation of the Merdeka Curriculum is highly dependent on the collaboration and commitment of all education stakeholders. Overall, the Merdeka Curriculum has the potential to improve the quality of national education and form a generation that is adaptive, creative, and has strong character, provided that the existing challenges can be overcome systematically and sustainably.

Abstract

This study aims to analyse the legal basis and implications of Law No. 20 of 2003 on the National Education System for the implementation of education in Indonesia. The method used is a literature review with a descriptive analytical approach to various literature, legal documents, and related research results. The results of the study show that Law No. 20 of 2003 has a strong philosophical, juridical, and sociological basis, which serves as a normative foundation for building an inclusive, high-quality, and equitable national education system. The implications of this law are evident in significant changes in curriculum structure, equal access to education, financing, educator competence, and community participation in education. However, the implementation of this law faces challenges in the form of resource inequality and policy adaptation at the regional level. This study recommends synergy among stakeholders as the key to the successful implementation of the law for the development of a sustainable national education system.

Abstract

This study aims to analyse the constitutional and regulatory basis contained in Law No. 20 of 2003 on the National Education System through a literature review approach. The analysis of the constitutional basis focuses on the relationship between the Law and the principles and provisions of the 1945 Constitution, particularly regarding the right to education, the obligations of the state, and the basic values of national education. Meanwhile, the regulatory analysis examines the implementation mechanisms, government authority, national education standards, and community participation in the education system regulated by this Law. The results of the study show that Law No. 20 of 2003 is strongly aligned with the constitutional basis and provides a comprehensive regulatory framework. However, implementation challenges require continuous improvement so that national education can be effective, inclusive, and equitable. This study provides recommendations to strengthen constitutional and regulatory aspects in supporting the development of a national education system that is adaptive to social changes and future needs.
