Abstract

Polygamy is allowed in Indonesia, providing the act is justified by religion and the rules of marriage law. A husband who wants to have more than one wife must fulfil various requirements of the Court. Based on the principle of “audi alteram partem,” the Supreme Court panel assesses the consideration of the Jambi Provincial Religious High Court against the answers, evidence, and witnesses presented by the defendant. This is to ensure the right decision is made, though the case was submitted late and no trial was filed. This research found that the Supreme Court deems a polygamy permit compulsory and aims to protect the welfare of the parties bound in the marriage. The word “can” in The Compilation of Islamic Law (KHI) article 71A showed that a marriage annulled due to polygamy without court permission is tentative or facultative. This indicated an annulment application must be submitted to the Court and the final decision is dependent on the assessment of the benefit of the wife and/or children. The legal consequence, based on the decision of the Religious Court to accept the marriage itsbat and the refusal to cancel the marriage bond, is that the children of the second wife will receive inheritance rights from the father, including property obtained with the first wife.

Abstract

The tradition of arranged marriage is a social phenomenon that has become part of the culture of many communities, including Koto Petai Village, Tanah Cogok Sub-district, Kerinci Regency, which combines local culture with the principles of Islamic law. In the context of Islamic law, arranged marriages are permissible as long as they fulfill the principle of maslahah and do not violate individual rights, but this practice often conflicts with the freedom to choose a life partner. Previous studies have highlighted the negative impacts of arranged marriage, but few have provided an in-depth analysis of the application of wali mujbir and maqashid al-syariah in the local context. This research uses a qualitative method with a case study approach through in-depth interviews, observation, and analysis of Islamic legal documents. The results showed that arranged marriage can have a positive impact in the form of creating a harmonious family and strengthening relationships between families, but it can also have negative impacts such as psychological pressure, loss of the right to choose a partner, and divorce if done without considering the wishes of the child. This study also found that the principles of maslahah and wali mujbir remain relevant in the practice of matchmaking, but must be implemented with due regard to consent and justice for both parties. The findings provide theoretical contributions in the development of Islamic family law studies as well as practical guidance for managing matchmaking traditions by respecting individual rights, thus creating harmony between traditions and Islamic values.

Abstract

Human trafficking remains a significant human rights issue in Indonesia, despite the nation’s comprehensive legal framework aimed at preventing crime and upholding justice. This pervasive problem predominantly targets women and children, exploiting their vulnerability through forced labor, sexual exploitation, and slavery. The increasing prevalence of human trafficking highlights gaps in law enforcement, insufficient government commitment, and limited societal awareness, making it urgent to strengthen preventive measures and legal implementation. This study seeks to analyze the challenges in combating human trafficking while exploring strategies to enhance law enforcement and public participation. Employing a qualitative approach, the research utilizes library-based methods with data collected through document analysis, focusing on Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking. The findings reveal significant shortcomings in legal enforcement due to inadequate budget allocation, poor coordination among stakeholders, and the lack of robust community education. Despite the legal framework’s potential, the government’s efforts in ensuring security, developing infrastructure, and addressing societal awareness remain insufficient. The study emphasizes the need for harmonized regulations, increased resource allocation, and cultural and gender-sensitive approaches to strengthen protection and rehabilitation initiatives. By fostering public awareness, regular program evaluation, and collaborative reforms, Indonesia can address the systemic challenges and adopt a holistic strategy to combat human trafficking effectively, ensuring justice for victims and preventing further exploitation.

Abstract

The independent curriculum is a learning curriculum related to interests and talents for the improvement of the 2013 curriculum. One of the schools that implements an independent curriculum is SMA Negeri 1 Pringgabaya. This study aims to identify the implementation of independent curriculum in Civics Education and Pancasila subjects at SMA Negeri 1 Pringgabaya, what are the factors that affect the implementation of independent curriculum in Civics Education and Pancasila subjects at SMA Negeri 1 Pringgabaya. This research method uses a qualitative research approach method. The results showed that independent curriculum in Civics Education and Pancasila subjects at SMA Negeri 1 Pringgabaya has been implemented with the flow of Civics Education and Pancasila learning objectives, Civics Education and Pancasila teaching modules and Civics Education and Pancasila learning assessments, as well as supporting and inhibiting factors that influence the implementation of independent curriculum in Civics Education and Pancasila subjects at SMA Negeri 1 Pringgabaya. It can be concluded that independent curriculum in Civics Education and Pancasila subjects at SMA Negeri 1 Pringgabaya is implemented with the flow of learning objectives, teaching modules and learning assessments, as well as the factors that influence it.

Abstract

The purpose of the following study is to determine the implementation of the Mataram City Regional Regulation No. 1 of 2022 related to the implementation of risk-based business licensing, especially in the trade sector, culinary type MSMEs and obstacles in the implementation of Mataram City Regional Regulation Number 1 of 2022 concerning the implementation of risk-based business licensing. Data collection methods were carried out to collect research data, namely through interviews, observation, and documentation. The study was conducted in the city of Mataram, with research samples including the business licensing service section and the head of the UMKM of Kelurahan Rembiga. The sample selection was carried out through purposive sampling technique, namely by determining several indicators according to certain criteria. The results of research related to the implementation of regional policies related to the implementation of risk-based business licensing in the city of Mataram show that the implementation of regional regulations in terms of providing services to business actors through online risk-based with the Online Single Submissions (OSS) site has achieved good synergy. Reviewed from the service implementation mechanism, implementation results, implementation evaluation and using the theory of public policy implementation based on George C. Edward III. In addition, it will also be examined regarding a number of obstacles faced in the implementation of risk-based business licensing services by public officials, namely DPMPTSP as the policy organizer and its staff.

Abstract

@semuatentangbatam is an Instagram social media account that contains information about Batam City. This account make it easier for the public to find information about what is happening in Batam City. The author is interested in knowing the credibility of @semuatentangbatam social media account in terms of following Followers information. The research was classified as a quantitative descriptive. The sampling technique of this research was Isaac and Michael with 348 respondents of sample value. The research data were collected from questionnaire and the method that used is share link of the questionnaire to @semuatentangbatam followers.The research found that: a) The results of the data validity test, the data that has been tested on the x and y variables is declared valid. b) The results of the data reliability test using Conbrach's Alpha the value obtained is 0.844 for the credibility variable and the value is 0.874 for the results of the information fulfillment variable, it can be concluded that each variable is considered reliable. c). The results of the normality test, each variable is normally distributed. d) It is known that the credibility variable has a positive and significant effect on the information fulfillment variable. The results of several tests carried out on the x variable against the y variable show that the hypothesis in this study is that the credibility of Instagram social media has an influence on its followers to meet the information they need. Abstract

This article explores how the Suku Anak Dalam (SAD) community resists the application of Islamic law in family matters, specifically in the determination of dower (mahr), the management of joint property, and the distribution of inheritance. While most SAD members have formally converted to Islam, their legal practices remain rooted in a matrilineal customary system passed down through generations. Challenging prevailing scholarly emphasis on integrative frameworks between Islamic law and local custom, this study demonstrates that, in the SAD context, resistance emerges when elements of Islamic jurisprudence (fiqh) clash with the community’s socio-cultural structure and shared values. Using a socio-legal approach and qualitative methods, the research draws on in-depth interviews with seven key informants, including a religious leader, the tumenggung (tribal chief), customary elder, community facilitator, subdistrict head, and SAD community members. The findings reveal a persistent orientation toward collective female authority: mahr is determined by the bride’s maternal kin group; joint property, upon divorce, is granted entirely to the wife; and inheritance follows a strictly matrilineal line. Rather than rejecting Islamic law on theological grounds, this resistance reflects a form of public reasoning grounded in ancestral consensus. The study highlights the importance of interpreting Islamic law through contextual, dialogical, and adaptive lenses—particularly within societies shaped by legal pluralism. [Artikel ini mengkaji bentuk-bentuk resistensi yang muncul dalam komunitas Suku Anak Dalam (SAD) terhadap penerapan hukum Islam dalam ranah hukum keluarga, khususnya terkait penetapan mahar, pengelolaan harta bersama, dan pembagian warisan. Meski secara formal mayoritas anggota komunitas SAD telah memeluk Islam, praktik hukum yang dijalankan tetap berpijak pada sistem hukum adat matrilineal yang diwariskan lintas generasi. Berbeda dari kecenderungan literatur sebelumnya yang menekankan model integratif antara syariah dan adat, studi ini justru menunjukkan bahwa dalam konteks SAD, resistensi muncul ketika ketentuan-ketentuan fikih dianggap tidak sejalan dengan struktur sosial dan nilai-nilai kolektif komunitas. Dengan pendekatan sosio-legal dan metode kualitatif, penelitian ini mengumpulkan data melalui wawancara mendalam dengan tujuh informan kunci: tokoh agama, tumenggung (kepala suku), pemimpin adat, pendamping komunitas, pejabat lokal, dan anggota komunitas SAD. Temuan utama memperlihatkan bahwa praktik hukum keluarga di komunitas ini lebih menekankan otoritas kolektif perempuan, tercermin dari penentuan mahar oleh keluarga pihak ibu, pengalihan penuh harta bersama kepada istri setelah perceraian, serta sistem pewarisan yang mengikuti garis keturunan perempuan. Artikel ini berargumen bahwa resistensi tersebut bukan merupakan penolakan teologis terhadap hukum Islam, melainkan lahir dari penalaran publik yang bertumpu pada konsensus adat. Temuan ini menegaskan pentingnya pendekatan hukum Islam yang lebih kontekstual, dialogis, dan responsif terhadap pluralitas hukum dalam masyarakat adat.]

Abstract

Lower-to-middle-class communities in Indonesia continue to exhibit resistance to religious moderation, frequently perceiving it as a foreign concept influenced by Western ideologies. This misconception persists even though religious moderation is deeply rooted in Islamic tradition and represents neither a new religion nor a secular invention. Such resistance often manifests through overt, semi-covert, and covert strategies, reflecting varying levels of opposition ranging from open rejection to more subtle forms of disengagement. This study employed a qualitative approach, drawing on data from online media platforms to analyze patterns of resistance and their underlying causes. The findings revealed that resistance was frequently driven by misinformation, distrust of government-led initiatives, and a limited understanding of the historical and theological foundations of religious moderation. These attitudes fostered intolerance and social fragmentation, posing a serious threat to national resilience, democratic values, and social harmony. Furthermore, the study emphasized that addressing resistance required not only educational interventions but also inclusive policymaking that bridged the gap between state narratives and grassroots religious experiences. The research offers crucial insights for policymakers and educators in developing culturally sensitive and community-based strategies to promote religious moderation and counteract the growing tide of intolerance in diverse socio-religious contexts across Indonesia.

Abstract

Kecamatan Nguter di Kabupaten Sukoharjo memiliki prevalensi balita gizi kurang yang melebihi ambang batas (<7,75%) dan merupakan yang tertinggi di kabupaten, yaitu sebesar 12,9%. Salah satu faktor yang diduga berkontribusi adalah konsumsi air minum yang terkontaminasi, khususnya di Desa Plesan dan Kedungwinong, di mana keberadaan bakteri Escherichia coli dalam air minum diduga dapat menyebabkan infeksi dan penyakit diare, sehingga menurunkan berat badan balita dan memicu kejadian balita pendek. Penelitian ini bertujuan untuk mengetahui hubungan antara keberadaan bakteri E. coli dalam air minum dengan kejadian balita pendek di Kecamatan Nguter. Penelitian ini merupakan studi observasional analitik dengan desain potong lintang (cross-sectional). Sebanyak 30 orang ibu dari balita pendek menjadi responden. Variabel bebas adalah keberadaan E. coli dalam air minum, sedangkan variabel terikat adalah kejadian balita pendek. Teknik pengambilan sampel menggunakan total sampling. Data dikumpulkan melalui kuesioner dan hasil uji laboratorium bakteriologis terhadap air minum balita. Analisis data dilakukan menggunakan uji chi-square dengan tingkat kepercayaan 95%. Hasil penelitian menunjukkan bahwa tidak terdapat hubungan yang signifikan antara keberadaan E. coli dalam air minum dengan kejadian balita pendek di Kecamatan Nguter, Sukoharjo (p= 0,804).
