Abstract

Poverty remains a pressing issue in many regions of Indonesia, including North Lombok Regency, where poor families face limited access to health, education, and social welfare services. To address this, the government introduced the Family Hope Program (PKH), a conditional cash transfer aimed at reducing social vulnerability and improving the quality of life of poor households. This study aims to describe the implementation of the Family Hope Program (PKH) policy and its impact on family welfare in Dusun Karang, Pemenang Barat Village, Pemenang Subdistrict, North Lombok Regency. This research employs a qualitative descriptive approach. Data were collected through interviews, observations, and documentation. Research informants consisted of 10 Beneficiary Families (KPM), 1 PKH facilitator, and 1 village government official, selected using purposive sampling. Data analysis followed the Miles and Huberman model, including data reduction, data presentation, and conclusion drawing. Data validity was tested through technique triangulation, source triangulation, and time triangulation. The findings show that the implementation of the PKH policy in Dusun Karang has been carried out properly in accordance with Minister of Social Affairs Regulation (Permensos) No. 1 of 2018 and other supporting regulations. Seven policy components have been effectively implemented: routine health checks for pregnant women and toddlers (Article 7 letter a), minimum 85% school attendance for children (Article 7 letter b), nutrition counseling, immunization, and healthy living education through Family Development Sessions (FDS/P2K2 Module), education on the importance of schooling, elderly participation in social activities (Article 7 letter c), utilization of the Indonesian Health Card (KIS) through JKN-PBI integration (Presidential Regulation No. 82 of 2018), and home visits for the elderly (Permensos No. 5 of 2019 on ATENSI). However, integration with the Indonesia Smart Program (PIP) has not been optimally implemented. The program has had several positive impacts, including increased access to health and education services, strengthened social roles of the elderly, behavioral changes within families, and reduced household economic burdens. Thus, PKH functions not only as financial aid but also as a social development instrument that supports the transformation of family welfare at the village level.

Abstract

There have been many previous studies that discussed the theme of early marriage, but the difference from this study is that the people studied are in the majority of isolated communities in Jambi Province (Suku Anak Dalam). The Suku Anak Dalam community has its own rules regarding the practice of marriage and overrides the provisions in the law that have been positive. One of these rules is related to how to measure the maturity of the bride and groom (marriage age limit). For them, girls who have reached puberty are considered capable of getting married, while boys who are mature are marked by a test of dexterity to hunt animals. If the boy passes / passes the test, then he is considered an adult and is able to get married. Because according to the women of the Anak Tribe, the concept of a man's valor lies in his ability to earn a living and hunt. This coincides with the lack of fulfillment of the rules set by the State as stated in Law no. 1 of 1974. This study wants to see what factors cause early marriage and this perspective.

Abstract

Judges experience various dilemmas when adjudicating marriage dispensation cases in Religious Courts. In particular, there are difficulties associated with applying the principles laid out in the provisions of Article 2 PERMA no. 5 of 2019, which guide such decisions. This study analyzes how judges consider various legal theories when making decisions regarding marriage dispensations using the normative judicial method. The results showed that the judges of Religious Courts primarily rely on the maslahah theory when making decisions on marriage dispensation cases, in spite of the existence of PERMA no. 5 of 2019 as a potential reference for maximizing aspects of justice and legal certainty.

Abstract

Polygamy is allowed in Indonesia, providing the act is justified by religion and the rules of marriage law. A husband who wants to have more than one wife must fulfil various requirements of the Court. Based on the principle of “audi alteram partem,” the Supreme Court panel assesses the consideration of the Jambi Provincial Religious High Court against the answers, evidence, and witnesses presented by the defendant. This is to ensure the right decision is made, though the case was submitted late and no trial was filed. This research found that the Supreme Court deems a polygamy permit compulsory and aims to protect the welfare of the parties bound in the marriage. The word “can” in The Compilation of Islamic Law (KHI) article 71A showed that a marriage annulled due to polygamy without court permission is tentative or facultative. This indicated an annulment application must be submitted to the Court and the final decision is dependent on the assessment of the benefit of the wife and/or children. The legal consequence, based on the decision of the Religious Court to accept the marriage itsbat and the refusal to cancel the marriage bond, is that the children of the second wife will receive inheritance rights from the father, including property obtained with the first wife.

Abstract

The tradition of arranged marriage is a social phenomenon that has become part of the culture of many communities, including Koto Petai Village, Tanah Cogok Sub-district, Kerinci Regency, which combines local culture with the principles of Islamic law. In the context of Islamic law, arranged marriages are permissible as long as they fulfill the principle of maslahah and do not violate individual rights, but this practice often conflicts with the freedom to choose a life partner. Previous studies have highlighted the negative impacts of arranged marriage, but few have provided an in-depth analysis of the application of wali mujbir and maqashid al-syariah in the local context. This research uses a qualitative method with a case study approach through in-depth interviews, observation, and analysis of Islamic legal documents. The results showed that arranged marriage can have a positive impact in the form of creating a harmonious family and strengthening relationships between families, but it can also have negative impacts such as psychological pressure, loss of the right to choose a partner, and divorce if done without considering the wishes of the child. This study also found that the principles of maslahah and wali mujbir remain relevant in the practice of matchmaking, but must be implemented with due regard to consent and justice for both parties. The findings provide theoretical contributions in the development of Islamic family law studies as well as practical guidance for managing matchmaking traditions by respecting individual rights, thus creating harmony between traditions and Islamic values.

Abstract

In 2021, the Indonesian Council of Ulama (MUI) of Jambi Province issued a fatwa permitting the transfer, exchange, or alteration of waqf assets to enhance their value and utility. This stands in contrast to the Shafi’i school of thought, which is predominantly followed by Muslims in Indonesia, where such actions are generally discouraged. This study aims to explore the legal methodology employed by the MUI of Jambi Province and to elucidate the principles of religious moderation inherent in their decision. The research utilizes a case study design, relying on interview data from MUI officials and document analysis of the issued fatwa and other relevant materials. The findings indicate that, although this fatwa initially appears to contradict the Shafi’i doctrine, it is procedurally sound, employing the methodologies of bayani, ta’lili, and istishlahi. Substantively, it aligns with the Quran, Hadith, and the views of both classical and contemporary scholars, strongly supporting the principle of public interest (maslahah). Moreover, the fatwa reflects significant aspects of religious moderation, particularly inclusivity, respect for tradition, and adaptability to social change.
