Abstract

The digitalization of notarial services is a consequence of the development of information technology that has influenced the provision of legal services in Indonesia. This study aims to analyze the legal regulations for the digitalization of notarial services in the Indonesian legal system and its impact on notaries' responsibilities for the legal risks that arise. The research method used is normative juridical with a statutory and conceptual approach. The results show that the regulation of the digitalization of notarial services is still partial and does not provide legal certainty regarding the implementation of authentic deeds electronically. Digitalization also creates legal risks that have implications for notaries' administrative, civil and criminal responsibilities. Therefore, more comprehensive regulatory updates are needed to ensure legal certainty and protection.

Abstract

This research aims to analyze the implementation of sanctions against Correctional Inmates (WBP) who commit disciplinary violations at the Class IIB Correctional Institution in Majalengka, based on the Regulation of the Minister of Law and Human Rights Number 8 of 2024 concerning the Implementation of Security and Order in Correctional Work Units. The research method employed is normative juridical, using a statutory approach and analysis of primary and secondary legal materials, supported by empirical field data. The findings indicate that common disciplinary violations include the possession of communication devices (mobile phones), the possession of sharp weapons, acts of violence among inmates, and debt practices that potentially disrupt security and order within the correctional institution. Sanctions for these violations are imposed in the form of light, moderate, and severe disciplinary measures, including placement in isolation cells, transfer to other correctional institutions, and recording in Register F, which results in the loss of certain rights such as remission and integration programs. The imposition of sanctions is carried out through an examination mechanism by the investigation team and the Correctional Observer Team, while upholding the principles of proportionality, justice, and equality before the law. The challenges encountered include overcrowding, limited human resources, and inadequate supporting facilities and infrastructure. Therefore, enhanced supervision, additional personnel, and the optimization of facilities are required to support the effectiveness of disciplinary sanctions and to ensure security and order within correctional institutions.

Abstract

Background. Public service quality is a crucial component of good governance, and the application of General Principles of Good Government (AUPB) plays a key role in ensuring effective public services. These principles, which include transparency, accountability, fairness, and efficiency, are essential for fostering trust between government institutions and citizens. However, there is a gap in understanding how effectively AUPB are implemented within public services and their impact on service delivery. Objective. This study aims to evaluate the effectiveness of implementing the General Principles of Good Government (AUPB) in public services. The research focuses on how these principles influence the efficiency, transparency, and quality of services provided by governmental institutions. Method. A mixed-methods approach was employed, combining qualitative interviews with public sector employees and quantitative surveys with citizens receiving public services. Data were collected from various government agencies to assess the practical application of AUPB principles and their impact on service quality. Results. The findings suggest that while AUPB are widely recognized, their implementation varies across institutions. Public services that effectively apply these principles show higher satisfaction rates among citizens, with increased accountability and transparency. Conclusion. The study concludes that implementing AUPB significantly improves the quality and transparency of public services, but challenges remain in ensuring consistent application across all governmental sectors.

Abstract

The development of artificial intelligence (AI) technology has given rise to various digital innovations, one of which is deepfake technology, which can manipulate images, videos, or audio to make them appear authentic. In addition to providing benefits, this technology also has the potential to be misused to create and disseminate pornographic content without the victim’s consent. Such actions can harm the victim’s honor, privacy, reputation, and psychological well-being, thereby creating legal issues that require adequate regulation and enforcement. This study aims to analyze the legal regulation and criminal liability of perpetrators involved in the dissemination of deepfake-based pornographic content in Indonesia. The method used is normative legal research with statutory and conceptual approaches. The research data were obtained through a literature review of laws and regulations, legal literature, scientific journals, and other relevant legal sources, and were then analyzed qualitatively. The results of the study show that the dissemination of deepfake-based pornographic content essentially fulfills the elements of a criminal offense and that perpetrators may be held criminally liable. Although there is no specific regulation on deepfakes, these acts may be prosecuted under the Pornography Law, the Electronic Information and Transactions Law, the Criminal Code, and the Personal Data Protection Law. However, law enforcement still faces obstacles related to regulatory limitations, digital evidence, and the identification of perpetrators. Therefore, more adaptive legal reform and the strengthening of law enforcement capacity are needed to ensure legal certainty and effective protection for victims.

Abstract

The development of digital trade has encouraged the emergence of cross-border e-commerce that allows foreign sellers to market their products directly to consumers in Indonesia through marketplaces. This phenomenon raises the potential for predatory pricing practices, which are very low pricing strategies to get rid of competitors and dominate the market. This study aims to analyze the application of business competition law to predatory pricing practices by cross-border sellers in the marketplace and examine the juridical consequences it causes. The research method used was normative juridical with a legislative and conceptual approach, to various relevant legal sources. The results of the study show that the practice of predatory pricing is prohibited based on Article 20 of Law Number 5 of 1999. However, law enforcement against foreign business actors still faces obstacles in jurisdiction, proof, and supervision. This practice has the potential to harm MSMEs and creates unfair business competition. Therefore, it is necessary to strengthen ICC's regulations and authority to face the challenges of cross-border digital trade.
