Abstract

This research investigates the transfer of collateral objects by debtors to third parties without the creditor's knowledge, examining legal implications under the Civil Code. The study finds that the transfer of land rights requires a valid Sale and Purchase Deed prepared by a Land Deed Making Officer. If the transfer is based on a flawed deed without meeting legal requirements, it is deemed null and void. Settlement efforts for such transfers can follow either the litigation or non-litigation paths. Non-litigation options involve deliberations and mediation, demonstrating an attempt to resolve legal issues outside the judicial process. In the examined cases, both parties opted for non-litigation approaches, engaging in deliberations and mediation instead of pursuing legal action.

Abstract

This study examines the factors causing the cancellation of land rights due to administrative defects and the mechanism for cancellation. Using normative and empirical juridical approaches, this study examines Agrarian law regulation and practice in the field. As a result, cancellations often occur due to falsification of data and misuse of identity, affecting the real landowner. The settlement of the case at the Pinrang Regency Land Agency Office refers to Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional RI No. 21 Tahun 2020.

Abstract

This study examines the management of Group C minerals, focusing on challenges such as illegal mining, inaccurate valuation of sale value, weak supervision, and the lack of integration of environmental and social aspects in mining regulations. Through the analysis of Law No. 4 of 2009 on Mineral and Coal Mining and case studies in several regions, this study suggests the revision of regulations, improvement of supervision, application of information technology, and cooperation between governments for more effective management. These recommendations aim to assist policymakers in reforming the mining sector, especially for Group C minerals, to ensure its management is more equitable, efficient, and sustainable, while emphasizing the importance of adaptive and flexible policies to face global dynamics.

Abstract

This study examines the implementation of the cyber notary concept within the notarial profession in Indonesia, focusing on the associated challenges and opportunities. The research employs a normative legal method with statutory, conceptual, and empirical approaches. The analysis reveals that while the Indonesian legal framework, including the Law on Notary Position (UUJN) and the Electronic Information and Transactions Law (UU ITE), provides a foundational basis for cyber notary practices, significant regulatory gaps and uncertainties remain. Key challenges include the lack of detailed regulations, data security and privacy concerns, and the readiness of technological infrastructure and human resources. Despite these challenges, the potential benefits of cyber notary, such as increased efficiency and business facilitation, are substantial, particularly in the context of the COVID-19 pandemic. The study concludes that comprehensive regulatory development, enhanced training for notaries, and robust data security measures are essential for the effective implementation of cyber notary in Indonesia. This research contributes to the discourse on digital transformation in legal services and offers policy recommendations to support the adoption of cyber notary practices

Abstract

This study examines the potential dangers of Artificial Intelligence (AI) to human rights in Indonesia using a socio-legal approach that combines normative legal analysis and social perspectives. Existing regulations such as the ITE Law and related regulations are inadequate because they do not specifically address human rights protection, accountability, and transparency in the use of AI. Meanwhile, from the social side, AI carries the risk of bias, discrimination, privacy violations, and threats to freedom of expression. Comprehensive regulations and effective law enforcement are needed to ensure the responsible use of AI and respect for human rights in Indonesia.

Abstract

Decent work and livelihoods for humanity are part of human rights for everyone, including people with disabilities, so the 1945 Constitution provides guarantees and legal protection for their implementation. The problem is the discriminatory attitude towards persons with disabilities and the low level of education of persons with disabilities as a gap between people with disabilities and non-disabled workers. The absence of exact data related to the number of workers with disabilities both in the private sector and non-private sectors (PNS, BUMN and BUMD) raises its own problems in the protection of persons with disabilities. The quota of minimum requirement is 2 percent as a mandatory for the government, local government, BUMN, and BUMD and 1 percent for private companies from the number of employees or workers in the Disability Act is apparently not enough to provide protection for people with disabilities. This research is a normative legal research to examine the laws and regulations in order to obtain justice for persons with disabilities. This becomes very important as a form of government commitment through supervision and improvement of policies becomes very important so that persons with disabilities get decent work and livelihoods.

Abstract

Penelitian ini membahas problematika affirmative action mengenai keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statue approach), pendekatan analitis (analytical approach), dan pendekatan konseptual (conceptual approach). Hasil penelitian ini menunjukkan bahwa affirmative action dalam keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif tidak relevan lagi diterapkan di Indonesia, karena sistem hukum Indonesia telah mengakomodasi hak politik Perempuan dalam pencalonan anggota legislatif. Pada pelaksanaannya, keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif justru menimbulkan kompleksitas permasalahan seperti: (1) adanya disparitas dan diskriminasi berbasis gender karena Perempuan diberikan special treatment dalam pencalonan anggota legislatif; (2) melanggar prinsip keadilan, kesetaraan, dan persamaan yang diamanatkan Pancasila dan UUD NRI 1945; serta (3) Partai Politik peserta pemilu hanya mencalonkan perempuan untuk memenuhi syarat prosedural keterwakilan perempuan paling sedikit 30% dalam pencalonan anggota legislatif. Sehingga pengaturan keterwakilan perempuan paling sedikit 30% dalam pencalonan anggota lagislatif idealnya dihapuskan, karena tanpa adanya ketentuan affirmative action tersebut Perempuan tetap memperoleh kesempatan yang sama dengan laki-laki dalam pencalonan anggota legislatif.

Abstract

This study aims to determine and analyze the implementation of prisoner coaching. This research uses normative and empirical research. Normative and empirical variety research is used in this study. Normative research examines laws, ideas, and conceptions related to the problem being investigated. The field as the primary data source includes findings from interviews and observations. Which is supported by a statutory approach and an analytical approach. The results of the study indicate that the implementation of coaching has not been effective, when viewed from the understanding of the existing guidance in the detention center, there are still obstacles in the implementation of coaching, the number of inmates who are not following the capacity (over-capacity), lack of facilities and infrastructure for coaching and health services.

Abstract

This research was carried out with the aim of knowing the legal status of a gifted child according to civil law and finding out the inheritance rights of a gifted child according to civil law. The type of method used is normative research. The research results show that the dissenting child cannot be recognized, thus the dissenting child does not have a civil relationship with his mother or father. As well as the inheritance rights of discordant children between Islamic law and the Civil Code have similarities and differences. The similarity is that both of them state that this child is an illegitimate child, so he does not have a family relationship with his father, which results in no mutual inheritance relationship between the two. An incestuous child cannot be assigned to his mother and father which causes the two of them to have no right to inherit each other, while in Islamic law a discordant child, even though this child may not be assigned to his father, this child is still assigned to his mother and the implication is that he can inherit and pass it on to his mother and father. his mother's family.

Abstract

This study aims to examine the form of agreement between songwriters and music aggregators in Sidenreng Rappang Regency. Using normative and empirical legal research methods, this study found that agreements are generally in the form of standard contracts prepared by aggregators. The main challenges in the implementation of the agreement include the collection and distribution of royalties. Although registration is not mandatory for copyright validity, it makes it easier to prove in the event of a dispute.
