Abstract

This study examines marriage law related to the implementation of child support rights after divorce, as well as legal remedies that can be taken by the child or his mother when the father does not fulfil his obligations by Law Number 1 of 1974 concerning Marriage. The type of research used is normative legal research, which analyzes case studies of decision number 134/Pdt.G/2023/PA. Bitter melon is qualitatively descriptive. The results of the study indicate the fulfilment of children's rights to support due to parental divorce at the Parepare Religious Court, based on a case study of decision number 134/Pdt.G/2023/PA. Pare, has not gone well because the ex-husband did not fulfil his obligations due to economic factors. On the other hand, the mother in this case felt that seeking justice through the courts would take too long and cost too much money, so she chose to finance her child's needs herself.

Abstract

Elections have been considered a measure of democracy because people can participate in determining their attitudes towards their government and country. Elections are important in the life of a state. Elections are part of a democratic system through which the people determine their representatives. In general elections, political campaigns are one way for candidates to introduce themselves and their programs to the public. However, in the implementation of political campaigns, some rules must be followed by the candidates so that the campaign runs in an orderly manner and does not violate the law. One of the things that is so synonymous with the campaign period is the increasingly crowded and large number of campaign props used by candidates/election participants and their success teams. This is one of the methods for candidates to conduct campaigns so that the public can know their entire vision, mission, program, and identity.

Abstract

This study examines the influence of data protection regulations in the UU ITE on the collection and use of tax data in Indonesia. The provisions for personal data protection regulated in the IUU ITE, such as the obligation to obtain taxpayer approval and ensure data security, have a significant impact on the process of collecting and managing tax data. Despite the challenges of implementation, strong data protection can increase taxpayer trust and compliance, thereby optimizing state revenue. The study suggests steps that tax authorities can take to collect data effectively while still protecting individual privacy

Abstract

The handling of corruption cases within the Indonesian National Army (TNI) faces significant challenges related to the overlap of authority between the Corruption Eradication Commission (KPK) and the military judiciary. Based on Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer and Undang-Undang Nomor 30 Tahun 2002 tentang KPK, there are differences in jurisdiction that often cause conflicts in the handling of corruption cases involving members of the TNI. This study analyzes relevant regulations and underlying legal theories, and identifies the need for harmonization of laws and regulations, capacity building of law enforcement officials, and better coordination between law enforcement agencies. With a comprehensive and sustainable approach, it is hoped that the criminal justice system in Indonesia can function more effectively and provide fairer justice for all parties involved.

Abstract

This research examines the urgency of reform and harmonization Undang-Undang Narkotika (UU No. 35 Tahun 2009) dan Undang-Undang Informasi dan Transaksi Elektronik (UU No. 19 Tahun 2016) in facing the challenges of drug crime in the digital era. Through a normative juridical analysis of current cases and weaknesses in existing regulations, this study identifies an urgent need to expand the definition and scope of technology-based narcotics crimes, strengthen digital evidentiary aspects, regulate digital platform responsibilities, enhance international cooperation, integrate digital rehabilitation approaches, and provide special protection for children and adolescents in cyberspace. The study also emphasizes the importance of harmonization of the two laws accompanied by increasing the capacity of law enforcement in digital forensics and the use of advanced technologies such as artificial intelligence (AI) and big data analysis, while still paying attention to ethical aspects and human rights protection. The results of the study show that a comprehensive approach to legal reform is needed to create a more responsive and effective regulatory framework in tackling drug crime in the digital era, as well as anticipating technological developments and adaptations carried out by drug offenders in the future.

Abstract

This study aims to analyze the effectiveness of personal data protection in Indonesia, especially ahead of the 2024 General Election, with a focus on Undang-Undang Perlindungan Data Pribadi. Although the Undang-Undang PDP has provided a comprehensive legal framework, the results of the study show that challenges in its implementation are still significant, such as data leak incidents and weak law enforcement. The recommendations produced include increasing socialization and education, strengthening supervisory institutions, and collaboration between the government, institutions, and the community. With joint efforts, it is hoped that personal data protection can be improved so that the community feels safe in participating in the democratic process

Abstract

This research aims to determine the consequences of illegal logging laws that result in environmental damage in the Enrekang Regency and identify the obstacles officers face in handling illegal logging cases that result in ecological damage in the Enrekang Regency. The type of research used is normative and empirical research. This research is supported by a Legislative Approach (statue approach) and a Social Approach (Social Approach). Illegal logging in Enrekang Regency is regulated in Law Number 18 of 2013, namely a maximum prison sentence of 5 years and a maximum fine of IDR 2.5 billion. Handling cases of illegal logging in Enrekang Regency faces several obstacles, namely, limited human resources for forestry police, difficulty in patrolling the forest, the size of the forest area, lack of budget, and lack of patrol vehicles

Abstract

This study examines law enforcement against the crime of plagiarism of scientific papers on online academic platforms from the perspective of the ITE Law and related regulations. The research method used is normative juridical with a legislative approach. The results of the study show that the crime of plagiarism in the digital era has been regulated by various laws and regulations. However, there are still challenges in its implementation. Harmonization and synchronization of laws are needed to overcome overlapping and legal gaps. Effective law enforcement efforts require a comprehensive approach involving legal, technological, and socio-cultural aspects. This study concludes that regulatory harmonization, increased coordination between institutions, the development of plagiarism detection technology, and the strengthening of anti-plagiarism culture are needed to realize academic integrity in the digital era.

Abstract

This research investigates the effectiveness of progressive and proportional tax systems in promoting social justice from the perspectives of tax law and accounting. Each system presents its own advantages and disadvantages. While progressive taxation is considered more vertically equitable, it may induce economic distortions—inefficiencies that disrupt market dynamics and prevent economic agents from maximizing social welfare. In contrast, proportional taxes are simpler and more efficient but are less equitable in their distribution of the tax burden. This study identifies critical challenges, including weak law enforcement characterized by inconsistent application of laws and a tendency for those in power to evade accountability, as well as low taxpayer compliance and discrepancies between tax law and accounting standards. To achieve optimal social justice, this research advocates for a hybrid approach that integrates elements from both tax systems, harmonizes regulations, and enhances taxpayer compliance through improved law enforcement and public education initiatives.

Abstract

This study examines the influence of education level and social status on determining the Dui Pappenre value and its implications for family finances in Bugis traditional marriages. Using a qualitative method with a case study approach, this study analyzes the financial impact of high Dui Pappenre values on the economic stability of men's families and the financial management strategies of young couples after marriage. The results show that high Dui Pappenre values impose a significant financial burden, causing decreased liquidity, increased debt, and reduced family investment capacity. Young couples implement financial management strategies, including detailed budgeting, spending priorities, systematic debt repayment efforts, and improving financial literacy. This study emphasizes the importance of a balance between preserving cultural traditions and family economic well-being and recommends constructive dialogue to adjust Dui Pappenre values to be more realistic with current economic conditions
