Abstract

Food security investments have brought conflict between local indigenous communities and the government in South Papua. The research aims to encourage protection and recognition efforts from the state towards indigenous peoples' entities. This research uses socio-legal studies. The research found sixteen plants that function as medicine. Inventory in the form of "recording" communal intellectual property is the first step to protecting all communal intellectual property that has never been recorded before. The Yei Indigenous People or the local government should work together to register with the Ministry to obtain rights to communal intellectual property, which will impact state action in protecting and defending communal intellectual property rights.

Abstract

This study explores the implementation of the Electronic Information and Transaction Law (UU ITE) in handling online fraud cases in Indonesia, using normative-empirical legal methods. Although the UU ITE provides a comprehensive legal framework, its effectiveness is hampered by challenges in proving and tracing perpetrators, limited resources and technology in law enforcement agencies, and the complexity of cross-border cases. The data shows a significant increase in online fraud cases from 115,756 reports in 2021 to 130,000 victims in 2022. This research highlights the importance of a holistic approach that includes improving regulations, increasing the capacity of law enforcement, strengthening international cooperation, and increasing people's digital literacy. In addition, the development of artificial intelligence (AI) technology and a multi-stakeholder approach were identified as important strategies in the prevention and early detection of online fraud. Recommendations, including the revision of the UU ITE to accommodate technological developments and harmonization with the Criminal Code, are expected to improve the success of handling online fraud cases and create a safer digital environment in Indonesia.

Abstract

This service activity aims to overcome the problem of managing waste from salak bark and seeds in Pekalobean Village, Enrekang Regency, which has not been utilized optimally so far. By utilizing local potential, this activity develops coffee products from the waste as an effort to empower the community's creative economy. The methods used include the collection of qualitative and quantitative data, as well as the implementation of training for farmer groups in processing waste into coffee products. The results of the service activities show that the salak waste processing process can produce coffee that has a unique taste and is well received by the community. In addition, the training carried out increases knowledge and skills in processing waste, which has the potential to increase their income. Thus, these innovations not only add value to waste, but also contribute to the improvement of the local economy and environmental sustainability.

Abstract

Legal development is a crucial aspect of fostering a just and orderly society, particularly in Indonesia's culturally diverse context. This article examines the interaction between law and culture in legal development within multicultural communities. By integrating formal law with customary law, it highlights the role of law as a social change agent harmonized with local cultural values. Through community-based legal education and public participation, law can become a sustainable tool for social transformation. Challenges such as cultural resistance, legal pluralism, and limited legal awareness are discussed alongside strategies to address them. The conclusion emphasizes the significance of a synergistic relationship between law and culture to establish an inclusive, responsive, and sustainable legal system.

Abstract

Information and communication technology development has brought significant changes to the taxation system, including the emergence of increasingly complex cybercrimes. This study aims to analyze the evolution of cybercrimes in the digital taxation system and the strategies and challenges in dealing with them. The method used is qualitative normative with a literature study approach. The study results indicate that cybercrimes in taxation include identity fraud, fake tax refund schemes, and international tax evasion, with significant financial impacts. Law Number 1 of 2024 concerning the Second Amendment to the UU ITE provides a more substantial legal basis but still requires harmonization with existing tax regulations. The handling strategy involves applying digital forensics, artificial intelligence, and international cooperation. The main challenge lies in the complexity of cybercrime, which continues to grow, and the need for more comprehensive regulations. This study concludes that a holistic approach is needed to strengthen rules, increase technological capabilities, and educate taxpayers to overcome taxation cybercrimes in the digital era.

Abstract

This study aims to understand, explain, and address the complexities of oppression in a multicultural and multiethnic society such as ASEAN. This study uses a law-based methodological approach that integrates intersectionality, postcolonial, feminist, critical race, and queer theories concerning international legal instruments. Based on the results of the study, mapping the landscape of intersectionality in ASEAN reveals how the interaction of gender, race, class, religion, and sexual orientation creates multiple discriminations, such as those experienced by female migrant workers, the LGBTQ+ community, and religious and ethnic minorities, who are often marginalised in legal systems and public policies. While international instruments demand protection without discrimination, inconsistent implementation of laws in ASEAN exacerbates existing structural injustices. Therefore, a transformative strategy for social justice in ASEAN requires a rights-based approach that focuses on empowering vulnerable groups, their active participation in decision-making processes, and legal reforms that integrate principles of intersectionality to ensure equitable access to justice. This approach can only succeed if ASEAN countries align domestic policies with international standards, strengthen inclusive legal systems, and empower regional mechanisms such as the ASEAN Intergovernmental Commission on Human Rights (AICHR) to more effectively uphold human rights in the region.

Abstract

This study aims to determine and analyze how the effectiveness of mediation in overcoming divorce in the Palopo Religious Court and what are the factors to be successfully for the resolution of divorce cases in Palopo Religious Court. This study was conducted in Palopo Religious Court. The research method used empirical normative approach, the source of research data was field research and library research such as interviews and literature review of literature books and scientific works. The results of this study indicated that the effectiveness of mediation to overcome the divorce in the Palopo Religious Court is quite effective because it has been carried out with procedures in the mediation process. The successful factors of the divorce case in the Palopo Religious Court were good faith from both sides, the ability of a mediator to provide an explanation to the parties, and time also.

Abstract

Short messages in the form of advertisements are increasingly being accepted by the public through their cell phones. The public never specifically gave the phone number to the party sending the advertising message. This is considered to be even more annoying because the short message advertisement violates the principles of consumer protection. This study aims to determine and analyze the extent of privacy violations against the spread of spam information via short messages. This study uses the empirical normative method, namely research conducted with the approach of legal norms or substances, legal principles, legal postulates, and legal comparisons, using a conceptual approach. The results show that short messages in the form of offers that are not directly related to the services used by cellular subscribers must be a concern for customer convenience.

Abstract

This study aims to determine the practice of buying and selling, and to find out that regulations on consumer protection are still in accordance with the pattern of buying and selling online. This research uses normative legal research with a literature study approach, types and sources of legal materials using primary legal materials and secondary legal materials. Data analysis will be examined from a qualitative perspective. The results of the research show that online buying and selling practices and regulations on consumer protection have been accommodated in Law no. 8 of 1999 (consumer protection), law no. 31 of 2004 (Engagement), law no. 7 of 2014 (trade) and Law no. 19 of 2016 (ITE).

Abstract

This study aims to find out the rights of workers according to Law No. 6 of 2023 concerning Job Creation and to find out about Legal Protection for Occupational Safety and Health According to Legislation at PB Medina in Sidenreng Rappang Regency. The type of research used is the type of research used in this research is normative and empirical research or commonly known as legal research which combines the two. Based on the analysis of data and facts from research results and discussion, as follows: Some of the articles regulated in Law Number. 11 of 2020 concerning Job Creation has not sufficiently regulated the issue of labor rights. For example, those that regulate Work Agreements for a Specific Time (PKWT), wages, provincial or district/city minimum wages, serious errors in layoffs by workers/laborers, and the right to apply for labor if they feel disadvantaged. The Labor Law, which was 17 years old until the entry into force of the Job Creation Law, is currently unable to answer issues regarding labor rights and is considered very detrimental. The implementation of labor protection at Rice Milling Madina Sidenreng Rappang has been carried out by using the application of an occupational safety and health system. aims to provide security, safety, and health at work. The company protects all workers by providing work safety and security equipment and guidance regarding using PPE (Personal Protective Equipment). However, in practice, the application of OSH has not been carried out optimally, this is evidenced by the presence of workers/laborers who do not follow the SOPs applied by the company by not using personal protective equipment while working.
