Abstract

Penelitian ini membahas problematika affirmative action mengenai keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statue approach), pendekatan analitis (analytical approach), dan pendekatan konseptual (conceptual approach). Hasil penelitian ini menunjukkan bahwa affirmative action dalam keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif tidak relevan lagi diterapkan di Indonesia, karena sistem hukum Indonesia telah mengakomodasi hak politik Perempuan dalam pencalonan anggota legislatif. Pada pelaksanaannya, keterwakilan Perempuan paling sedikit 30% dalam pencalonan anggota legislatif justru menimbulkan kompleksitas permasalahan seperti: (1) adanya disparitas dan diskriminasi berbasis gender karena Perempuan diberikan special treatment dalam pencalonan anggota legislatif; (2) melanggar prinsip keadilan, kesetaraan, dan persamaan yang diamanatkan Pancasila dan UUD NRI 1945; serta (3) Partai Politik peserta pemilu hanya mencalonkan perempuan untuk memenuhi syarat prosedural keterwakilan perempuan paling sedikit 30% dalam pencalonan anggota legislatif. Sehingga pengaturan keterwakilan perempuan paling sedikit 30% dalam pencalonan anggota lagislatif idealnya dihapuskan, karena tanpa adanya ketentuan affirmative action tersebut Perempuan tetap memperoleh kesempatan yang sama dengan laki-laki dalam pencalonan anggota legislatif.

Abstract

This article examines the complex legal and practical challenges arising from the implementation of dormant account blocking policies by financial institutions in Indonesia, an increasingly urgent issue amid the acceleration of digital banking and the intensification of cybercrimes. Using a normative juridical approach supported by statutory and case analysis, the research scrutinises the intersection between the need to combat financial crimes and the imperative to protect customers' privacy rights under Indonesian cyber law. The findings reveal that while dormant account blocking is effective in mitigating illegal acts, such as money laundering and misuse of digital financial accounts, it often raises procedural and ethical issues, including a lack of notification, inconsistent legal implementation, and potential infringement on consumers' rights to privacy and access. These gaps lead to eroded public trust in digital banking due to uncertainty and the risk of arbitrary administrative action. The study recommends harmonisation of regulations and standard operating procedures among banks, enhanced dispute resolution mechanisms, and strengthened protection of customers' legal and privacy rights, particularly through improved transparency and digital literacy initiatives. The article contributes an integrative conceptual model balancing risk-based financial legislation and rights-based legal protection, offering a new legal framework better suited to Indonesia's evolving financial digital landscape

Abstract

The development of information and communication technology has changed various aspects of human life significantly. In Indonesia, Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) has been promulgated to regulate the use of information technology and electronic transactions. However, along with the rapid development of technology, UU ITE has undergone two changes, the last one being through Undang-Undang Nomor 1 Tahun 2024. This study aims to explore the application of ITE law in the use of computer technology for geological exploration and digital accounting systems, using a qualitative approach with a case study design. The results of the study show that the implementation of ITE law still faces challenges related to data protection and information security. Many companies find it difficult to ensure compliance with ITE legal regulations, while sensitive geological and accounting data is vulnerable to unauthorized access and data leakage. The implications of the research are the need to increase socialization and training of ITE law, update information security policies, and adopt advanced security technologies to protect sensitive data more effectively.

Abstract

This assimilation program is a right obtained by all prisoners and children who meet the requirements. The purpose of this study is to answer 2 (two) main problems, namely the extent to which the implementation of the rules of assimilation and the right of integration at home for prisoners in Class II A Prison in Parepare City, and can the implementation of the rules of assimilation and the right of integration at home for prisoners have an effect in suppressing the spread of Covid-19 at Class II A Prison in Parepare City. This research is an experimental research that uses empirical or non-doctrinal legal research with a quantitative approach to prisoners and their warden staff Rules; Assimilation; Covid-19 at Class II A Prison in Parepare City. This assimilation aims to measure the level of citizen protection as an influencing variable (X1), equal rights for prisoners as a variable (X2), and the provision of health insurance for all citizens (X3) in suppressing the spread of the covid outbreak as the dependent variable (Y). in the Class IIA Prison in Parepare.

Abstract

This study aims to find civil law arrangements regarding the juridical analysis of breaking a promise to marry or what is commonly referred to as Broken Marriage Promises as an unlawful act. What are the legal consequences of breaking a marriage promise as unlawful? This study uses a normative legal research type with a statutory approach. The types and sources of legal materials use primary, secondary, and tertiary legal materials. Analysis of legal materials uses deductive logical reasoning, which is studied from a qualitative perspective. The results of the study show that breaking a promise to marry or commonly called promises of marriage as an unlawful act, is regulated in Article 58 of the Civil Code and several judges' decisions such as Supreme Court Decision Number 3191 K/Pdt/1984, Supreme Court Decision Number 3277 K/Pdt/2000, Decision of the Supreme Court Number 1644 K/Pdt/2020. The legal consequences of breaking a marriage promise as an unlawful act, namely if a person suffers a loss due to breaking of the marriage promise, both material and immaterial losses, then he can be sued for compensation following the loss suffered if the element of the unlawful act is fulfilled according to Article 1365 of the Civil Code.

Abstract

The development of AI usage raises legal challenges in the protection of intellectual property rights (IPR). One crucial issue is copyright over AI-created works, reflected in various lawsuits in United States and viral case in Indonesia regarding AI altering personal photos in the style of Ghibli anime. This study analyzes: (1)The position of AI as a creator; (2)The position of AI users as creators; and (3)The legal status of AI-produced works. Normative methods used with legislative, analytical, and conceptual approaches. The results show that AI cannot be considered a creator because it does not meet the requirements for a legal subject (intellectuality and legal responsibility), instead AI only seen as a legal object in Indonesia. Additionally, AI users are also not recognized as creators because they do not meet the criteria for originality, fixation, and IPR protection. Therefore, AI works are categorized as being in the public domain.

Abstract

Penelitian ini bertujuan untuk menyoroti pentingnya sinergi antara manajemen pemasaran, manajemen sumber daya manusia (SDM), dan kepatuhan terhadap hukum Informasi dan Transaksi Elektronik (ITE) dalam pengelolaan perguruan tinggi di era digital. Melalui analisis kualitatif, penelitian ini menemukan bahwa integrasi ketiga aspek tersebut sangat penting untuk meningkatkan kinerja dan daya saing perguruan tinggi. Manajemen pemasaran yang efektif dapat menarik dan mempertahankan mahasiswa, sementara manajemen SDM yang baik memastikan tenaga kerja yang kompeten dan berkomitmen. Kepatuhan terhadap hukum ITE menjaga keamanan dan privasi data, meningkatkan reputasi dan kepercayaan publik terhadap institusi. Kesimpulan dari penelitian ini menunjukkan bahwa perguruan tinggi yang mampu mengintegrasikan manajemen pemasaran, SDM, dan kepatuhan hukum akan lebih siap menghadapi tantangan dan memanfaatkan peluang di pasar pendidikan yang kompetitif dan digital.

Abstract

This study examines the practice of Mowea Sarapu within the Tolaki Muslim community in Indonesia, focusing on the husband as the primary unit of analysis. In this context, the husband symbolically "hands over" the cheating wife to his lover through the ritual of splitting the sarong and the payment of customary fines, often without formal divorce. The purpose of this study is to examine the conformity of these practices with Islamic norms (marriage, talaq, ishlah, and maqasid al-shari'ah) and to evaluate the normative position of women at the intersection of customs, religion, and state law. Utilizing normative legal research methods with conceptual and comparative approaches, this study draws on a literature review that focuses on the Tolaki/Kalosara tradition, Islamic family law, gender discourse, and Indonesian positive law. The findings suggest that Mowea Sarapu is able to mitigate communal conflict and restore dignity, but it creates a liminal zone for women's legal status, which is vulnerable to livelihood insecurity, hereditary issues, and stigma. The novelty lies in its framing as a reconstructable "ishlah adat." The contribution of research, in the form of socio-theological frameworks (maqasid, legal pluralism, and gender justice), aims to transform it into a model that is women-centered, more equitable, and in line with substantive justice and the rule of law.

Abstract

In Indonesian law, marriage is a physical and spiritual bond between men and women who aim to form a happy family based on trust in God Almighty. The heresy drama series display inner marriage practice, namely the marriage process that emphasizes the spiritual aspect without fulfilling formal requirements in the form of a marriage guardian, witness human beings, and ijab valid acceptance. Research​ This use method study law normative with approach legislation and analysis draft law marriage in Indonesia. The study results show that inner marriage in the Bidaah series is done through unilateral declaration and claiming spiritual validity, with God as the guardian and angels as witnesses. This is contradictory to Article 1 of the Law of Marriage, which regulates marriage as a physical and spiritual bond that must fulfil the conditions of formal law. In addition, the practice of inner marriage also violates Islamic law, as stated in the Compilation of Islamic Law (KHI), which requires the existence of guardians, witnesses, and clear acceptance of consent to ensure a legitimate marriage. Thus, the practice of inner marriage, as displayed in the series No fulfil terms and conditions marriage as arranged in law positive Indonesia, renders the marriage void ab initio.

Abstract

This study examines the integration of Toraja customary law as a living law into the development of Indonesia’s national legal system in the period 2024–2025, with a focus on the regulation of indigenous peoples and ulayat (communal) land rights and their implications for the protection of the rights and living spaces of indigenous communities. Using a normative legal approach through the analysis of the Constitution, agrarian regulations, policies on the registration of ulayat land, regional regulations, and relevant literature, the research shows that such integration can strengthen legal certainty and the bargaining position of Toraja indigenous communities, particularly through the recognition of ulayat rights and the strengthening of customary institutions. However, the study also finds a risk of formalization that reduces the communal character of land and tongkonan, shifts decision-making power to the bureaucracy, and generates new conflicts when the logic of state law is not aligned with customary values and social structures. Therefore, integration will only produce substantive justice if it is designed in a participatory manner, recognizes the authority of customary decisions, and positions Toraja indigenous communities as the primary subjects in governing their own living spaces
