Abstract

The purpose of this research is to find out more about land tenure without rights due to illegal acts. The research method used in this research is the empirical research method by taking a qualitative approach. The result of this research is that it is clear that both parties have agreed to exchange their land which has been outlined in the minutes. The agreement occurs when an agreement is reached between the parties making the agreement, so that the perpetrator's actions are included as unlawful acts. The elements that are fulfilled are the existence of an action that has been carried out by the perpetrator by continuing to control land that does not belong to him; the action must be against the law; and the action causes harm to the heirs. Furthermore, compensation for ownership of land rights due to unlawful acts must compensate the person whose fault caused the loss, either in the form of money or in the form of returning to the original state. The amount of compensation depends on the size of the claim filed by the injured party. The size of the compensation fee is measured by looking at the object of the dispute, the grace period, and the costs incurred in deliberation efforts. However, until now there is no good faith from the perpetrator to return or compensate for his actions

Abstract

Penelitian ini bertujuan untuk menganalisis peran Badan Penyelesaian Sengketa Konsumen (BPSK) dalam menyelesaikan sengketa perjanjian kredit nasabah Bank Mandiri Taspen di Kota Gorontalo serta mengidentifikasi faktor-faktor yang mempengaruhi pelaksanaan tugas BPSK dalam konteks perlindungan konsumen. Penelitian ini menggunakan pendekatan hukum empiris dengan metode kualitatif. Data primer diperoleh melalui wawancara dan observasi langsung di lapangan, sementara data sekunder dikumpulkan dari berbagai literatur, peraturan perundang-undangan, dan dokumen pendukung. Hasil penelitian menunjukkan bahwa BPSK telah melaksanakan fungsinya dengan menawarkan mekanisme penyelesaian sengketa melalui mediasi dan arbitrase. Namun, proses mediasi gagal karena ketidakhadiran pihak bank dalam beberapa kali panggilan sidang. Kasus ini kemudian diselesaikan melalui arbitrase, di mana kedua belah pihak mencapai kesepakatan damai yang dituangkan dalam perjanjian tertulis. Faktor utama yang memengaruhi kinerja BPSK dalam kasus ini adalah kurangnya itikad baik dari pihak bersengketa untuk menghadiri proses mediasi. Penelitian ini menekankan perlunya regulasi yang mempertegas eksistensi BPSK sebagai lembaga peradilan alternatif dengan putusan yang bersifat final dan mengikat tanpa memerlukan penetapan eksekusi oleh pengadilan negeri. Dengan demikian, BPSK dapat menjadi lembaga yang lebih kredibel dan efektif dalam memberikan perlindungan hukum kepada konsumen.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai hibah wasiat kepada anak angkat serta akibat hukum yang timbul jika hibah wasiat tersebut diberikan tanpa persetujuan ahli waris sah. Dalam konteks hukum perdata Indonesia, anak angkat tidak memiliki hak waris secara otomatis dari orang tua angkatnya, tetapi dapat memperoleh bagian harta melalui hibah atau wasiat wajibah. Ketentuan mengenai hibah diatur dalam KUH Perdata dan hukum Islam, di mana pemberian hibah harus tetap memperhatikan hak-hak ahli waris utama agar tidak menimbulkan sengketa. Penelitian ini menggunakan metode penelitian empiris dengan pendekatan kualitatif. Data diperoleh melalui observasi, wawancara, dan studi dokumen terkait kasus hibah wasiat tanah di Kota Gorontalo. Data yang dikumpulkan dianalisis secara deskriptif untuk memahami dinamika hukum yang terjadi dalam praktik pemberian hibah kepada anak angkat tanpa persetujuan ahli waris utama. Hasil penelitian menunjukkan bahwa hibah wasiat kepada anak angkat tanpa persetujuan ahli waris dapat menimbulkan sengketa hukum, terutama jika hibah tersebut mengabaikan ketentuan legitime portie yang mengatur hak mutlak ahli waris sah. Dalam beberapa kasus, ahli waris sah dapat mengajukan gugatan pembatalan hibah wasiat yang dianggap merugikan mereka. Oleh karena itu, perlu adanya regulasi yang lebih jelas mengenai status hukum anak angkat dalam pewarisan, serta mekanisme yang dapat memastikan bahwa hibah wasiat dilakukan secara adil dan tidak melanggar hak ahli waris sah.

Abstract

Kredit Usaha Rakyat (KUR) memegang peranan penting dalam mendukung pertumbuhan usaha mikro, kecil, dan menengah (UMKM) di Indonesia. Namun, sering terjadi wanprestasi sehingga menimbulkan tantangan bagi stabilitas keuangan Bank Rakyat Indonesia (BRI), khususnya di Kantor Cabang South City. Penelitian ini bertujuan untuk mengkaji proses penyelesaian wanprestasi KUR di unit ini dengan menggunakan pendekatan normatif dan empiris. Pendekatan normatif difokuskan pada evaluasi ketentuan yang mengatur penyelesaian wanprestasi, sedangkan pendekatan empiris melibatkan pengumpulan data langsung dari kasus-kasus yang terjadi di Kantor Cabang South City dalam kurun waktu tertentu. Hasil penelitian menunjukkan bahwa meskipun telah ditetapkan prosedur penyelesaian wanprestasi, masih terdapat beberapa tantangan dalam pelaksanaannya. Isu-isu utama yang dihadapi antara lain keterbatasan sumber daya manusia, penyampaian informasi yang kurang efektif kepada debitur, dan keterlambatan dalam proses penyelesaian. Lebih lanjut, penelitian ini mengungkap bahwa tingkat pendidikan debitur berpengaruh signifikan terhadap tingkat keberhasilan penyelesaian wanprestasi, dengan debitur yang berpendidikan lebih cenderung memenuhi kewajibannya dengan lebih efektif. Untuk mengatasi tantangan tersebut, penelitian ini merekomendasikan peningkatan kapasitas sumber daya manusia dan peningkatan program edukasi debitur di Kantor Cabang South City. Penguatan regulasi dan pengembangan kolaborasi antar pemangku kepentingan juga penting untuk memastikan keberlanjutan program KUR dan mendorong pertumbuhan UMKM di Indonesia.

Abstract

This research aims to analyze the legal considerations provided by the panel of judges in the reconventional claim case related to the transfer of the Certificate of Ownership (SHM) in a land sale transaction. Specifically, this study examines how the judges assess the evidence presented in the reconventional claim and how the legal procedures related to the transfer of SHM are applied in the case of Court Case Number: 8/Pdt.G/2023/PN.GTO. The method used is normative research with a statutory, case, and conceptual approach, utilizing primary legal sources such as laws, court decisions, and secondary legal materials like books and journals. The results of the study show that the judges rejected the plaintiff's lawsuit because it did not meet the formal and substantive requirements outlined in civil law, such as the absence of a valid sale agreement and the failure to include all parties involved in the sale transaction. Additionally, the plaintiff failed to prove whether the defendant had committed unlawful acts or breached the contract, which should have been the basis for the lawsuit. As a result, the judges granted the reconventional claim filed by the defendant, who argued that the plaintiff's lawsuit was legally flawed. This research highlights the importance of fulfilling both formal and substantive requirements in civil lawsuits, as well as providing valid evidence in disputes regarding the transfer of land rights. The legal considerations of the judges demonstrate the application of the principles of legal certainty and justice to ensure that the decision made aligns with the applicable legal provisions and is accountable.

Abstract

This study aims to analyze the legal implications of the implementation of unregistered marriage in the context of child marriage on the legal status of mothers and children, and how it impacts the fulfillment of their civil rights in the legal system in Indonesia. The practice of unregistered marriage carried out by underage couples is still widespread in various regions, including in Pohuwato Timur Village, Marisa District, Pohuwato Regency, Gorontalo Province. Although religiously the marriage is considered valid, according to state law, a marriage without official registration does not have binding legal force. As a result, women who are married unregistered are not officially recognized as wives, and children born from the marriage only have a civil relationship with their mothers, as regulated in Article 43 of Law No. 16 of 2019 concerning Marriage. This study uses an empirical legal research method with a qualitative approach. Data were obtained through interviews, field observations, and documentation of the community and government officials in Pohuwato Timur Village, and analyzed descriptively-qualitatively. The results of the study indicate that low legal awareness in society, economic limitations, and geographical barriers are the main factors that encourage the practice of unregistered marriage among children. The legal implications are the uncertainty of the legal status of wives and children, as well as obstructed access to civil rights such as birth certificates, inheritance rights, and other legal protections. Strategic efforts are needed through legal education, ease of marriage dispensation and marriage confirmation procedures, and the active role of village governments and judicial institutions in ensuring protection for mothers and children from unregistered marriage practices.

Abstract

This study discusses in depth the legal provisions for the provision of remuneration to Foundation administrators in Indonesia and the related dispute resolution mechanisms, based on Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations. As a non-profit legal entity, a Foundation has unique characteristics that emphasize the principle of non-profit, where the use of the Foundation's assets must be fully directed to achieving social, religious, or humanitarian goals. However, in practice, the need for professionalism and high workloads often require Foundation administrators to receive reasonable compensation. This study aims to analyze the legal provisions regarding the provision of remuneration for Foundation administrators in Indonesia and to evaluate the dispute resolution mechanisms that may arise, by referring to Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations. This study uses a normative legal approach with a prescriptive analysis method, and finds that remuneration is permitted as long as the administrator is not a founder, patron, or supervisor; carries out his duties directly and fully; and is regulated transparently in the Articles of Association. In the event of a dispute, the resolution can be reached through deliberation, mediation, arbitration, or court. This study also highlights the importance of accountability, internal supervision, and regulatory intervention from the government in maintaining the integrity of Foundation governance. Thus, the law on foundations in Indonesia needs to be continuously strengthened to remain relevant to social dynamics and the practical needs of professional management of non-profit organizations. Remuneration for Foundation administrators is permitted on the condition that the administrators are not founders, advisors, or supervisors, carry out their duties directly and fully, and are regulated transparently in the Articles of Association. Dispute resolution can be carried out through deliberation, mediation, arbitration, or court, with an emphasis on accountability, internal supervision, and the need for government regulation to strengthen Foundation governance.

Abstract

The execution process of fiduciary guarantees in bankruptcy cases in Indonesia faces significant legal challenges. Although Law No. 42 of 1999 on Fiduciary Guarantees grants priority rights to creditors holding fiduciary guarantees, its implementation is often hindered by unclear procedures and inconsistencies between fiduciary guarantee law and bankruptcy law. This study aims to analyze the obstacles creditors face in executing fiduciary guarantees in bankruptcy cases and to find legal solutions to enhance legal certainty for creditors. The research method uses a normative approach, analyzing relevant regulations and court rulings, and comparing fiduciary guarantee law with bankruptcy law. The results indicate that legal uncertainty, a 90-day execution suspension after bankruptcy, and the role of the receiver, which delays the execution of fiduciary guarantees, are the main barriers. Therefore, it is recommended to implement legal reforms that provide clearer and more efficient execution procedures and ensure better protection of creditors' rights in bankruptcy situations. Thus, this study contributes to improving the fiduciary guarantee legal system in Indonesia.

Abstract

This research aims to find out and analyze how law enforcement efforts are carried out in cases of distribution of illegal tobacco products by Gorontalo Customs and Excise officials. This research is classified as empirical research using a qualitative approach and then using data collection techniques by means of interviews, literature review, documentation, and using descriptive data analysis. The results of this research indicate that law enforcement efforts against the circulation of illegal tobacco products by Gorontalo Customs and Excise officials include preventive law enforcement (prevention) and repressive law enforcement (Action). In preventive law enforcement Customs and Excise officials carry out legal socialization activities, routine patrol activities and carry out observations, to enforce repressive laws from Customs and Excise officials when they receive information from the intelligence unit or complaints from the public, the data received is then analyzed. If the results of the analysis show that the data meets operational standards then the process of action, deterrence, inspection, sealing and confiscation is continued. . Customs and Excise officials in carrying out law enforcement have not yet reached the realm of court, only the imposition of administrative sanctions. Keywords: ; ;

Abstract

Land conflicts, particularly overlapping claims of land ownership and control, represent a structural issue that continues to recur in Indonesia due to population growth, technological advancement, and the increasing complexity of development. This study aims to analyze the role of the National Land Agency (BPN) in resolving overlapping land ownership cases in Tuloa Village, North Bulango District, Bone Bolango Regency. The research employs an empirical legal approach, collecting data through interviews, field observations, and document analysis, including land regulations and BPN archives. The findings reveal that the primary causes of overlapping land claims are the lack of physical boundary maintenance and changes in ownership status due to inheritance. BPN plays a role in document verification, mediation, and handling complaints, although it faces challenges such as staff rotation and a weak documentation system. The resolution of land disputes in Tuloa Village was achieved through a familial approach involving deliberation, facilitated by the village government and BPN, resulting in a mutual agreement on land division. The implications of this study highlight the need to strengthen BPN’s institutional capacity, enhance public legal awareness on land issues, and improve the administrative system to prevent similar conflicts in the future.
