Abstract

Community service (PkM) in the form of educational assistance and legal consultation in Bulili Village, Duhiadaa Subdistrict, was carried out with the aim of improving legal understanding and assisting the community in resolving legal issues they face. This educational support and legal consultation activity was based on two crucial issues: the community's lack of understanding of marriage and inheritance laws, and their low participation in the village regulation formation process. These two issues were chosen because they significantly affect the realization of a safe, orderly, and prosperous village. The methods used in this community service program include interactive outreach and participatory-based direct consultation, combining educational and legal empowerment approaches for village residents. The results of the program indicate an increase in community legal awareness regarding rights and obligations within the family context, as well as the importance of active community involvement in the formulation of village regulations. It is hoped that this activity can strengthen the legal culture at the local level and serve as a foundation for the development of a just, inclusive, and sustainable village.

Abstract

The e-sports industry in Indonesia is fostering professional relationships between athletes and team management through work agreements. However, the lack of specific legal frameworks has led to concerning contractual clauses, notably the freeze contract clause, which allows team management to indefinitely suspend an athlete's contract while preventing them from pursuing professional opportunities. This study examines the implications of such clauses on athletes' rights and welfare, utilizing normative legal research with legislative and conceptual methodologies. The findings indicate that while the freeze contract is rooted in the freedom of contract principle, it often lacks good faith and balance, resulting in potential bargaining inequalities, loss of wages, and career sustainability issues for athletes. Consequently, there is a pressing need for more precise regulations and contractual guidelines from e-sports institutions to enhance legal protection and equitable welfare for athletes.

Abstract

Unilateral cancellations of music concerts by promoters significantly harm consumers, particularly with the rise of digital ticket sales. This article examines the legal implications of such cancellations and the liability of promoters for consumer losses. It utilizes normative legal research methods focusing on legislation and concepts. Findings indicate that unilateral cancellations may constitute a default on ticket sales contracts and could breach consumer protection rules if transparent information and proper compensation are not provided. A promoter’s liability may only be dismissed under force majeure if it can be proportionately proven. Consumers can seek remedies including ticket price refunds and compensation for tangible and intangible losses. The enforcement of consumer rights through non-litigation and litigation avenues is also discussed, alongside a recommendation for stricter consumer protection standards in concert organization to avert future issues.

Abstract

Inheritance land grant disputes often arise in the Indonesian judiciary, especially regarding the validity of grants that do not use notarial deeds. This study aims to analyze the validity of the grant certificate (SKH) in the transfer of rights to undivided land inheritance and its impacts. The research method used is normative law with a legislation approach and case approach, specifically analyzing Manado High Court Decision Number 32/PDT/2024/PT MND. Results show that land grants not made by notarial deeds violate Article 1682 of the Civil Code, making them legally invalid and unusable as a basis for land registration. Registration of the transfer of rights to undivided inherited land is also not possible because the land remains an inheritance boedel owned collectively by all heirs. Registering the transfer of rights to undivided inherited land requires valid legal documents and must comply with applicable laws to ensure legal certainty for concerned parties.

Abstract

This study analyzes the position of agreements made by minors in game top-up transactions, as reviewed by Law Number 1 of 2024 concerning Electronic Information and Transactions (ITE Law) and the Civil Code (KUHPerdata), amidst the rise of digital transactions involving legally incompetent parties, such as the UniPin case worth IDR 800,000. The problem formulation focuses on the formal validity of electronic contracts based on Article 18 paragraph (1) of the ITE Law versus the substantive requirements of legal competence (Article 1320 in conjunction with Article 330 of the Civil Code), with the aim of examining the implications of the vernietigbaar agreement. This research is normative juridical in nature, using a legislative and conceptual approach, with primary data sources in the form of the ITE Law, the Civil Code, and the Child Protection Law No. 35 of 2014; secondary data includes civil law literature, journals, and platform documents. Data collection was conducted through a literature study of the BPHN and JDIH databases, analyzed qualitatively and descriptively using the legal weight method to assess the hierarchy of norms. The results of the study show that digital agreements by minors are formally valid but subjectively flawed, so they can be canceled by guardians through the courts for restitutio in integrum. The conclusion recommends age verification and parental consent regulations on PSEs to synchronize cyber-civil law.

Abstract

This research examines copyright infringement on TikTok, addressing the paradox between creative freedom and intellectual property protection. Digital technology expansion enables artistic expression while simultaneously creating enforcement gaps due to low legal awareness and inadequate public literacy regarding Law No. 28 of 2014 on Copyright. The study analyzes how TikTok's policies including takedown mechanisms, safe harbor principles, and fair use doctrine function as legal instruments balancing innovation and legal certainty. Employing normative legal methodology, this research investigates the synergy between national regulations and platform policies in protecting creators' moral and economic rights. Analysis reveals the urgent need for contextual legal education and collaboration among government, platforms, and society to establish a just digital ecosystem respecting originality while cultivating ethical, globally competitive creative culture. Furthermore, the research emphasizes the state's role as a primary actor in establishing legal frameworks protecting copyright in digital spaces. Article 28C (1) of the 1945 Indonesian Constitution provides constitutional foundation that the state must provide effective regulatory mechanisms and law enforcement protecting citizens' works. Through administrative instruments including Ministerial Regulations on Information and Communications (Permenkominfo) and governmental agency authorities (DJKI, Kominfo) this study evaluates how public policy creates accountable and constitutionally compliant digital governance, ensuring equitable copyright protection in contemporary information ecosystems.

Abstract

This study aims to reconstruct the implementation of Article 33 of the 1945 Constitution through the framework of Ordnungspolitik developed by Franz Böhm and Walter Eucken. The study is grounded in the existence of imbalances in the normative, institutional, and functional dimensions of Indonesia’s economic system, which hinder the realization of the principles of solidarity and social justice. This study uses a normative legal methodology with a conceptual and comparative approach to legal thought. The analysis examines the comprehensive text of the amendments to the 1945 Constitution, sectoral regulations (such as the Job Creation Law and the Mining and Energy Law), as well as Constitutional Court rulings related to the economy. Data is analyzed qualitatively to align the principles of the German economic order (Ordoliberalism) with the values of the Indonesian Constitution. The novelty of this study lies in offering a new interpretive model for Article 33 of the 1945 Constitution by positioning the state as the architect of the market order (rather than merely a passive actor or regulator). Its innovation lies in integrating the substantive rule of law of Ordnungspolitik to limit the concentration of private economic power, which often distorts the constitutional mandate. The results show that Ordnungspolitik provides operational instruments for Indonesia to achieve distributive justice through two main channels: (1) strengthening the independence of competition oversight agencies to the level of constitutional institutions, and (2) codifying economic laws that guarantee market access rights for small businesses. This interpretation shifts the paradigm of Article 33 from mere symbolism regarding “cooperatives” to a binding norm that obligates the state to undertake structural interventions to maintain market integrity. The conclusion is that integrating the principles of Ordnungspolitik into the national legal system can serve as a solution to Indonesia’s economic institutional failures. This study recommends restructuring economic public policy to prioritize healthy competition and the protection of social rights as an inseparable legal order.

Abstract

Penguatan demokrasi lokal berbasis kearifan lokal dan perlindungan inklusif terhadap hak-hak kelompok rentan merupakan fondasi penting untuk mewujudkan tata kelola pemerintahan desa yang partisipatif, responsif, dan berkeadilan. Kegiatan pengabdian kepada masyarakat di Desa Talulobutu dilaksanakan untuk menjawab tantangan dan hambatan rendahnya partisipasi kelompok rentan dalam musyawarah desa serta belum adanya instrumen hukum yang menjamin keterlibatan mereka. Metode yang digunakan dalam pengabdian kepada masyarakat ini meliputi observasi lapangan, pelaksanaan pendidikan hukum dan hak asasi manusia, pendampingan advokasi hukum dalam penyusunan dan perancangan peraturan desa berbasis konsep Desa Inklusif, serta pelaksanaan monitoring dan evaluasi. Hasil pengabdian kepada masyarakat ini berhasil memberikan pemahaman baru dan peningkatan kesadaran akan demokrasi lokal. Selain itu, hasil lainnya adalah integrasi nilai-nilai kearifan lokal Huyula (gotong royong) dan Dulohupa (musyawarah mufakat) telah memperkuat legitimasi sosial dalam pembentukan kebijakan desa yang inklusif. Dengan demikian, pengabdian kepada masyarakat ini telah memberikan kontribusi nyata bagi pengembangan hukum daerah yang demokratis dan inklusif, serta menjadi model pemberdayaan desa yang menekankan kesetaraan, partisipasi, dan penghormatan terhadap hak asasi manusia.

Abstract

The development of digital technology has encouraged the increasing use of electronic transactions in various walks of life, including in rural areas. However, the rapid utilization of digital transactions has not been balanced with an adequate level of public understanding of the law, causing various legal risks such as online fraud, misuse of personal data, and legal uncertainty in electronic agreements. This community service activity aims to improve the legal literacy of the community through educational assistance and legal consultation related to legal protection in digital transactions. The method used is in the form of legal counseling and direct consultation held in Mekar Jaya village, Duhiadaa District, Pohuwato Regency, involving village officials and the general public. The results of the activities show that the public has been actively using digital transaction services, but still has a limited understanding of the legal rights and obligations as digital consumers. Through practical and contextual education, people are beginning to understand the importance of personal data protection, the validity of electronic agreements, and dispute resolution mechanisms in digital transactions. This legal assistance and consultation proved to be effective in increasing the legal awareness of the public and strengthening their position in facing the risks of digital transactions. This activity is expected to contribute to creating a secure, fair, and equitable digital transaction ecosystem, as well as being a model for sustainable legal service in the era of digital transformation.

Abstract

Land conflicts in Indonesia frequently arise due to overlapping land use between local communities and holders of Right to Cultivate (Hak Guna Usaha/HGU), particularly in mining activities conducted on plantation land. This issue creates legal uncertainty and the potential for prolonged disputes. This study aims to analyze the legal status of community mining activities carried out on land under HGU and its regulation under the Basic Agrarian Law and related legislation. The research employs a normative legal method using statutory and conceptual approaches, relying on primary, secondary, and tertiary legal materials analyzed qualitatively. The findings indicate that mining activities on HGU land may only be conducted upon obtaining permits from the competent authorities and the consent of the land rights holder. However, in practice, overlapping land use frequently occurs due to weak coordination in licensing, unclear land status, and lack of transparency in land administration. This condition may lead to unlawful acts and cause losses to the parties involved. Therefore, it is necessary to strengthen an integrated, transparent, and accountable licensing system to ensure legal certainty and justice in the management of agrarian resources.
