Abstract

This study examines the instillation of Islamic educational values by the Indonesian Dedication House Community (KRDI) among street children in Makassar City. The main focus of this study is the form of instillation, the methods used, and the obstacles faced by the community in implementing non-formal education programs for street children. This study uses a qualitative approach with descriptive and phenomenological methods. Primary data were obtained from the General Chairperson of KRDI, mentors, volunteer teachers, and street children, while secondary data consisted of documents and reports related to KRDI activities. Data collection techniques were carried out through observation, interviews, and documentation, then analyzed through the stages of data reduction, data presentation, and drawing conclusions with validity tests using data triangulation. The results of the study indicate that KRDI plays a strategic role in fostering street children through religious education, character education, and the development of interests and talents. Obstacles that arise include limited teaching staff, the diverse character backgrounds of street children, and lack of support from parents. The implications of this study highlight that Islamic value-based education models can serve as alternative solutions for non-formal education among marginalized urban groups.

Abstract

Low student motivation in Fiqh subjects is often caused by rigid learning processes that overlook psychological aspects and individual needs. This study aims to describe the application of Abraham Maslow’s humanistic learning theory in increasing student motivation in Fiqh learning at MA Syekh Yusuf Sungguminasa. The research utilizes a descriptive qualitative method, with data collected through observation and in-depth interviews. The results indicate that the humanistic approach significantly impacts the improvement of student motivation through the systematic fulfillment of the hierarchy of needs. By meeting basic needs up to esteem, students are able to reach the stage of self-actualization within the learning process. The implications of this study emphasize that Fiqh educators need to integrate humanistic approaches to create a more meaningful and humane learning environment, ultimately fostering the optimal development of student potential.

Abstract

Ijtihad, taqlid, and fatwa are fundamental concepts in Islamic law that serve as essential mechanisms for addressing legal issues arising from the continuous development of society. This paper aims to explain the definitions of ijtihad, taqlid, and fatwa; the requirements and pillars of ijtihad and fatwa; their classifications; the methods of ijtihad in Islamic law; the legal status of ijtihad and taqlid; and the products of ijtihad and fatwa in contemporary society. This study employs a library research method by examining various scholarly sources related to Islamic law. The discussion reveals that ijtihad is the earnest intellectual effort of a qualified mujtahid to derive Islamic legal rulings from the Qur'an, the Sunnah, and other recognized legal sources. Taqlid refers to following the opinions of qualified Islamic scholars by those who lack the ability to perform ijtihad, while a fatwa is a legal opinion issued by a mufti in response to specific questions and is not legally binding in the same way as a court judgment. In the modern era, ijtihad and fatwa play a strategic role in addressing contemporary issues such as Islamic finance, digital transactions, healthcare, and technological advancements, ensuring that Islamic law remains relevant, dynamic, and capable of promoting the public interest (maslahah).

Abstract

Wad'i law is an essential component of Usul al-Fiqh that explains the conditions, requirements, causes, and impediments determining the applicability of taklifi rulings. Understanding Wad'i law serves as the foundation for the proper implementation of Islamic law, as it clarifies when and under what circumstances a particular legal ruling becomes applicable. This study aims to examine the concept, legal foundations, classifications, and the perspectives of the four major schools of Islamic jurisprudence regarding the application of Wad'i law. The study employs a library research method with a descriptive-analytical approach by examining the Qur'an, the Sunnah, classical and contemporary Usul al-Fiqh literature, and other relevant scholarly sources. The findings reveal that Wad'i law consists of divine rulings that establish something as a cause (sabab), condition (shart), impediment (mani'), validity (sahih), invalidity (fasid/batil), and, according to some scholars, also includes 'azimah (original ruling) and rukhsah (legal concession). The foundations of Wad'i law are derived from the Qur'an, the Sunnah, and the principles of Usul al-Fiqh, which explain the relationship between causes, conditions, and impediments in determining legal rulings. Furthermore, differences exist among the Hanafi, Maliki, Shafi'i, and Hanbali schools concerning the application of several aspects of Wad'i law, particularly regarding the conditions for the validity of acts of worship and the determination of legal causes. Therefore, Wad'i law plays a strategic role as a legal framework that explains the mechanism for implementing taklifi rulings, ensuring that Islamic law is applied correctly, proportionately, and in accordance with the provisions established by the Sharia.

Abstract

Qawa'id al-Fiqhiyyah are general legal principles formulated by Islamic scholars based on the Qur'an, Hadith, and the results of ijtihad to serve as guidelines for understanding and establishing Islamic law. This study aims to examine the five major legal maxims (Al-Qawa'id al-Fiqhiyyah al-Khams), namely Al-Umuru bi Maqasidiha, Al-Yaqinu La Yuzalu bi al-Syakk, Al-Masyaqqatu Tajlibu al-Taysir, Al-Dhararu Yuzal, and Al-'Adatu Muhakkamah, including their legal foundations, functions, applications, and the differences of opinion among scholars regarding each maxim. This research employs a library research method using a descriptive qualitative approach through the analysis of classical and contemporary literature in the fields of fiqh and ushul fiqh. The findings indicate that these five major legal maxims constitute the primary foundation for the development of other fiqh principles and play a significant role in the process of istinbath (legal reasoning) in Islamic law. Their application enables scholars to address various emerging legal issues systematically while remaining consistent with the principles of Islamic law. Although differences of opinion exist among the schools of Islamic jurisprudence concerning the scope and application of these maxims, such differences demonstrate the flexibility of Islamic law in responding to contemporary issues. Therefore, a thorough understanding of Al-Qawa'id al-Fiqhiyyah al-Khams is essential for supporting the formulation of legal rulings that are just, systematic, and aligned with the objectives of Islamic law (maqasid al-shariah).
