Abstract

The practice of temporary marriage (nikah mut'ah) in Iran has a long and complex history, closely related to the interpretation of Islamic law and social dynamics within Iranian society. This is marked by the complex unfolding of the Islamic revolution in Iran. Therefore, this study aims to understand the journey of family law in Iran and its development related to the phenomenon of nikah mut'ah practice before and after the Islamic revolution. This research is a literature study. The results of this study show that before the Islamic Revolution in 1979, this practice was less common and often viewed with diverse perspectives by society. However, after the Islamic Revolution, with the new government based on Sharia, the practice of nikah mut'ah gained legal legitimacy and broader support as part of the interpretation of Shia law. Nevertheless, this practice remains controversial and sparks debate among scholars and the wider community regarding its ethical and social aspects.

Abstract

Tradisi merupakan sesuatu fenomena kebudayaan, karena tradisi adalah praktek kebudayaan dari suatu komunitas. Praktek kebudayaan memperlihatkan makna dari nilai-nilai sesuatu kebudayaan, dimana nilai-nilai kebudayaan merupakan tujuan dari manusia untuk memenuhi kebutuhan dasarnya. Tradisi yang masih melekat secara turun-temurun dari nenek moyang dan masih populer di minangkabau hingga masa sekarang. Tujuan penelitian fokus untuk mengatahui bagaimana pandangan Hukum Islam dari segi Urf terhadap larangan pernikahan sasuku yang ada diminangkabau terkhusus di Nagari Batu Bajanjang Kabupaten Solok. Kajian ini menggunakan metode penelitian lapangan (field research). Sumber data yang digunakan adalah sumber data primer berupa wawancara dengan pemuka adat istiadat sedangkan data sekunder dari buku-buku dan artikel yang relevan dengan penelitian ini. Hasil penelitian ini menunjukkan bahwa Pelaksanaan mamangkeh dan maasok gombak yang sudah menjadi adat di Nagari Batu Bajanjang Kabupaten Solok, tidak bertentangan atau berlawanan dengan hukum Islam, karena memotong rambut tidak ada terdapat larangannya dalam hukum Islam sebelum melaksanakan akad pernikahan. Jadi dapat disimpulkan bahwa pelaksanaan tradisi mamangkeh dan maasok gombak hukumnya mubah (boleh). Selain itu, tradisi ini mengandung maslahah atau kebaikan bagi calon yang akan melaksanakan suatu pernikahan, seperti memberikan atau mengumpulkan berupa penggalangan dana (uang) pada saat pelaksanaan acara mamangkeh dan maasok gombak, yang dapat membantu secara ekonomi untuk melangsungkan acara resepsi perkawinan, disamping itu, kedua mempelai mendapatkan nasehat dan siraman rohani yang berkenaan dengan perkawinan, tanggung jawab serta hak dan kewajiban satu sama lain agar lebih siap untuk menempuh hidup berumah tangga.

Abstract

This article examines the background behind couples from various ethnic groups in Indonesia opting for unregistered marriages and their efforts to obtain legal recognition of their marital status from the state. The research aims to understand the motivations of couples from different cultural backgrounds when deciding to marry in secrecy and how they then seek to legalize their unions through court decisions on marital status confirmation. The method used in this study is field research with a descriptive qualitative approach. Primary data was obtained through in-depth interviews with 14 interethnic couples such as Minang, Batak and Javanese in Padang City who filed petitions for marital status confirmation to the local Class 1A Religious Court. The findings reveal that preferences over unregistered marriages are influenced by the social, cultural and religious backgrounds of each ethnic group. This condition necessitates contextual adjustments in providing legal solutions to the issue of unregistered marriages so that they can be accepted by all parties from the existing cultural diversity. In conclusion, marital status confirmation in Religious Courts can be an effective legal solution for interethnic couples with unregistered marriages in Indonesia to obtain formal recognition of their marital status. However, a profound understanding of the prevailing socio-cultural values in each community is needed so that decisions on marital status confirmation do not contradict and can be well accepted by all parties.

Abstract

This study examines the topic of women’s leadership, which has been a subject of discussion among classical and contemporary scholars, intellectuals, and the general public. The relevance of this discourse grows when viewed in the context of Generation Z, a generation shaped by rapid technological advancements. The study seeks to analyze the characteristics of Generation Z, the concept of women’s leadership, and perspectives on this issue through the lenses of gender equality and Islamic thought. Using a library research method and secondary data sources, this study adopts a descriptive qualitative analysis approach. The findings highlight diverse scholarly views on women’s leadership. While many classical scholars express reservations, some contemporary scholars adopt a more accepting stance. From a gender equality perspective, Islam emphasizes that men and women possess rights and responsibilities and upholds principles of justice for all individuals, irrespective of gender. While differing opinions persist, women today contribute actively in various fields, often based on competence rather than gender. For Generation Z, their distinctive characteristics provide potential for leadership. Leadership often starts with self-leadership, evolving gradually to encompass broader responsibilities. Effective leadership is portrayed as a developmental process rather than an immediate attainment of high-ranking roles.

Abstract

Islamic Local Regulations in the Perspective of Islamic Politics and Religious Society in Indonesia. Afterreformation, the spectrum of political view in Indonesia has rapidly increased. One of the political progressessigned by local regulations that regulate some aspects of Islamic teaching is regarded as Islamic regulation.There are many regions and cities in Indonesia that applied the regulation, while other regions and cities havebeen managing the same draft through the government and legislative assembly. To improve religiosity forall, the coming Islamic-nuanced regulation is something needed significantly. In addition, implementation ofIslamic regulation in any places can encourage awareness to do the best things among communities. Islamiclegalization through Islamic regulation in public area, however, has indicated that Islam performs expressively.In some regions, for instance, there is a regulation that forces Muslim people to wear Islamic clothing and toread the Qur’an every day. The Motivation of undertaking this regulation is influenced by the theory of receptiea contrario. Looking at that theory, all Muslims should apply and do Islamic teachings because they are obligatedto do that totally. Besides, there is no force for non-Muslim people compulsively to apply such Islamic teachings

Abstract

This study aims to examine the historical and legal transformation of polygamy regulation in Turkiye, from its initial permissibility to its eventual prohibition under the influence of Kemalist secular reforms. With information acquired from documentation and library research, this study employs a juridical-normative approach and a qualitative-descriptive method.  The findings indicate that the abolition of the 1917 Ottoman Family Law resulted in the unequivocal prohibition of polygamy, which had been permitted under certain situations, with the enactment of the Turkish Civil Code by Mustafa Kemal Atatürk. The study highlights the significant role of Kemalism in shaping the legal landscape of Turkiye, particularly in transitioning from religious to secular legal frameworks. While the research offers important insights into the intersection of law, secularism, and social reform, it is limited by its reliance on secondary sources and the absence of field-based empirical data. Nevertheless, it contributes to the broader discourse on legal modernization and the socio-political implications of secularism in Muslim-majority societies.

Abstract

The problem of joint property disputes after divorce in the jurisdiction of the Bengkulu Religious high courts, in the period 2010 to 2015 all decisions are always made up of half of the property of the ex-wife and the other half of the property of the ex-husband, regardless of who is more dominant in working to produce the property. This is based on article 97 of the Islamic Law Compilation. According to the authors the decisions did not fulfill a sense of justice, with regard to wives who participated in working for a living. The judges of the first level Religion Court in Bengkulu did not consider the role of the wife working for a living; which incidentally is the husband's obligation. How does the Maqāsid asy-Syarī'ah review the Bengkulu judges' consideration of joint property in the case of a wife participating in earning a living in the jurisdiction of the Bengkulu’s Religious high courts? and What are the implications of the judge's decision in the jurisdiction of the Bengkulu’s Religious high courts regarding joint property in the case of the wife participating in earning a living in the context of Islamic family law reform in Indonesia? The conclusions of this research are: Judges' considerations on decisions regarding joint assets in the case of wives participating in earning a living in the jurisdiction of the Bengkulu Religious high courts were not in accordance with Maqāsid asy-Syarī'ah, because the judge did not consider the position of his ex-wife who continued to work for a living besides running obligation to take care of the household. The judge's decision regarding joint property in the case of his wife helped earn a living in the jurisdiction of the Bengkulu Religious high courts in the context of reforming the Islamic Family Law in Indonesia, the judge must be progressive. The ex-wife who helped make a living should get a share of the joint property that is greater than the ex-husband. The ex-wife's portion was formulated peacefully and deliberately between the parties.

Abstract

Law Number 16 of 2019 Amendments to Law Number 1 of 1974 concerning Marriage raise the minimum age for marriage for both men and women to be 19 years old. This was not just an equalization of the minimum age for men and women, but there were government legal politics to improve the quality of Indonesian marriages. The focus of this research was a review of the problems of the legal politics of the minimum age limit for marriage in Law Number 16 of 2019? This study concludes that the legal politics of determining the minimum age for marriage in Indonesia in the Law of the Republic of Indonesia Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage with the principles of equality and justice; non-discrimination; the state's obligation to actively protect and ensure the fulfillment of human rights and freedoms; the best interests of the child; the right to life which guarantees that every child has the right to live, develop and carry on their lives and the state was obliged to guarantee it and fulfill the rights of the child, respect for the opinion of the child; orderly and legally certainty; in line with maslahah which was the goal of Islamic law related to maintaining offspring (hifz an-nasl).

Abstract

The research discusses the considerations of judges at the Sungguminasa Religious Court regarding fulfilling the rights of wives after divorce, decision Number: 143 /Pdt.G/2014/PA.Sgm. It is generally accepted that in contested divorce cases, there are no rights to the wife after the divorce. The judge's decision that was accepted usually only granted the divorce petition. Judges usually did not grant it if there were claims for their rights and the rights of children post-divorce in the lawsuit. This research question is: What is the progressive legal analysis of the judge's considerations in case Number: 143 /Pdt.G/2014/PA.Sgm? This research was a literature study related to the considerations of judges' decisions in case number: 143/Pdt.G/2014/PA.Sgm. The primary data of this research was the decision of case number: 143/Pdt.G/2014/PA.Sgm. The judge's considerations in the decision were analyzed using Progressive Law theory to conclude. After collecting data through interviews, the findings of this research are that the Judge's considerations in Decision Number: 143 /Pdt.G/2014/PA.Sgm in fulfilling the wife's rights after a divorce from her husband, is progressive. The panel of judges granted the wife's civil rights after the divorce based on the defendant's capabilities. This decision benefits and provides financial protection for the ex-wife in continuing her life.

Abstract

Kompilasi Hukum Islam pasal 97 menegaskan bahwa  mantan istri atau mantan suami yang bercerai, masing-masing berhak mendapatkan seperdua dari harta bersama sepanjang tidak ditentukan lain dalam perjanjian perkawinan. Keduanya mendapatkan bagian yang sama dengan logika mereka telah menjalankan fungsi dan tugas yang setara; suami bertugas mencari nafkah dan istri mengurus rumah tangga. Hukum positif di Indonesia tidak membahas tentang pembagian harta bersama terkait istri turut sebagai pencari nafkah dalam keluarga. Sehingga ia dalam kondisi menanggung double bardon.  Fokus penelitian ini adalah: pembagian harta bersama istri turut mencari nafkah menurut hukum Islam dan hukum positif di Indonesia? Kesimpulan penelitian ini bahwa permasalahan  tentang harta bersama tidak diatur dalam perspektif  Hukum Islam Tradisional tidak mengatur hal ini. Namun dalam Hukum Islam Kontemporer mengqiyaskannya dengan masalah Syirkah sedangkan yang lain menjustifikasinya berdasarkan urf dan maslahah. Adapun pembagiannya secara kesepakatan damai antara para pihak. Sedangkan dalam Hukum Positif diatur  dan pembahagiannya masing-masing pihak mendapatkan setengah dari harta bersama.
