Abstract

Penelitian ini menganalisis  permasalahan pengimplementasian Surat Edaran Direktorat Jenderal Bimbingan Masyarakat Islam Nomor: P-005/DJ.III/Hk.00.7/10/2021 Tentang Pernikahan Dalam Masa Iddah Istri Di Kantor Urusan Agama Kecamatan Seputih Mataram. Pada praktiknya, terdapat pernikahan mantan suami sebelum habisnya masa iddah istri. Fokus penelitian ini adalah bagaimanakah tinjauan maslahah mursalah terhadap Implementasi Surat Edaran Direktorat Jenderal Bimbingan Masyarakat Islam Nomor: P-005/DJ.III/Hk.00.7/10/2021 Tentang Pernikahan Dalam Masa Iddah Istri Di Kantor Urusan Agama Kecamatan Seputih Mataram. Kesimpulan penelitian ini bahwa Surat Edaran dari Direktorat Jenderal Bimbingan Masyarakat Islam Nomor: P-005/DJ.III/Hk.00.7/10/2021 tidak dilaksanakan dengan baik di KUA Kecamatan Seputih Mataram sehingga dikhawatirkan akan mendatangkan kemudaratan pada pernikahan mantan suami tersebut. Hal ini  disebabkan menikah secara tergesa-gesa pada masa iddah mantan istri mengabaikan kesempatan berfikir secara jernih untuk membangun kembali rumah tangga yang baru pasca perceraian dari pernikahan sebelumnya.

Abstract

This study examines the implementation of halal certification for Micro and Small Enterprises based on Article 79 of Government Regulation Number 39 of 2021 on the Administration of Halal Product Assurance (PP No. 39/2021). The implementation of this regulation in Labuhan Dalam Subdistrict, Tanjung Senang District, and Bandar Lampung City has not been carried out effectively because there are still Micro and Small Enterprise products that have not been halal certified. The focus of this study is: What is the maslahah review on the implementation of Article 79 of PP No. 39/2021 regarding halal certification for Micro and Small Enterprises in Labuhan Dalam Subdistrict, Tanjung Senang District, Bandar Lampung City? The method used is field research with qualitative descriptive analysis. The primary data sources are interview results and observations with micro and small business actors who are required to have halal certification in Labuhan Dalam Subdistrict, Tanjung Senang District, Bandar Lampung City, and BPJPH employees of the Lampung Provincial Office of the Ministry of Religion in the Halal Task Force. The conclusion of the study is that, from the maslahah perspective, Article 79 of PP No. 39/2021 has not been well implemented in Labuhan Dalam. This is because the government, BPJPH, has not fully carried out its duties to execute its tasks and authorities to provide information, education, and socialization related to the obligation to have halal certification to micro and small business actors, as well as the lack of awareness of micro and small business actors regarding the obligation to have a halal certificate. This naturally brings harm to micro- and small-scale businesses and the community.

Abstract

The Indonesian legal system comprises three main components: customary law, Islamic law, and European law. These three systems serve as foundational elements in the construction of a holistic and comprehensive national legal framework through national legal politics. This study aims to examine the position and role of Islamic law in Indonesia, focusing on Ijtihad in the context of social change and the positivization of Islamic law. Employing a normative juridical method, this research relies on secondary data sources, including primary and secondary legal materials. The findings reveal that the adaptive and dynamic character of Islamic law allows it to grow and develop in the Indonesian legal system, which is transforming codification and official and binding legal enforcement. This development cannot be separated from the direction and policy of legal politics that influence the process of Islamic legal legislation. Although its application is not yet comprehensive and is still limited to certain fields, Islamic law has gained recognition in the form of independence, legitimacy, and authority as part of national law

Abstract

Indonesian society has traditions rooted in religious values, customs and habits that are still characteristic of each ethnicity and region.  One of the traditions that is still carried out today is cutting hair before the wedding process takes place.   This study aims to analyze how the law of the tradition of cutting hair before the wedding process in a group of Minangkabau ethnic communities based on `urf, as well as the values contained in the procession. This research uses a qualitative method with the type of phenomenology, data sources are taken from ten informants through in-depth interviews individually selected by purposive sampling technique. In addition, researchers also made direct observations at all stages of the tradition process which is the focus of this study. All data were analyzed interactive Miles & Huberman technique. The research findings show that the tradition of cutting hair before the wedding process in terms of `urf is permissible and does not contradict the provisions of the Quran and hadith. Furthermore, there are two values contained in the tradition of the hair cutting procession i) purifying the bride and groom before the wedding, ii) strengthening the relationship between all family members. These findings have successfully established how the tradition of hair cutting before marriage in `urf is declared valid because it does not contradict Islam, then this tradition needs to be passed down from generation to generation because it contains noble values that benefit both bride and groom and family.

Abstract

This article aims to reveal the regulation of marriage dispensation in Indonesia, which is regulated in Law No. 16 of 2019 concerning amendments to Law No.1 of 1974. Article 7 paragraph (2) states that if there is a deviation from the age provision, the parents of the man or woman can apply for marriage dispensation to the Court, for the sake of al-mashlahat. The focus of this research is how Islamic law analyzes the regulation of marriage dispensation in Law Number 16 of 2019. In this study, a normative legal research method is used, which is also called dogmatic legal research. The results show that Law No. 16/2019 brings the spirit of change regarding the regulation of marriage dispensation and the minimum age of marriage. In addition, Supreme Court Regulation No. 5 of 2019 is a special rule as a form of explanation of procedural law relating to marriage dispensation applications. In the perspective of Islamic Law, it brings al-mashlahat, with the regulation of marriage dispensation in certain circumstances. However, the minimum age of marriage in Islamic law is determined by ihtilam, rusyd, menstruation as physical signs and a certain age, which indicates maturity.

Abstract

This article aims to discuss the patterns of science integration in Islamic universities in Indonesia and the development models. This study used qualitative method, the data source consists of informants and documentation, as well as data collection techniques carried out through in-depth interviews, participant observation, focus group discussions and documentation review. As results, the application of science integration patterns in several Islamic universities turns out to be different, based on different understanding of the concept of science integration and local socio-cultural settings, according to the their respective established backgrounds. The State Islamic University (UIN) generally applies integration, not Islamization, by combining Islamic science and general science. This is stated in the vision and mission of higher education. As for practice, the implementation of science integration is applied to the faculty through direct policy from the university. In general, Islamic universities in Indonesia have already had a philosophical paradigm, by carrying out a distinctive concept of science integration. In the elaboration aspect of the integration paradigm, it is reflected in the applied curriculum. However, from the explanation, science integration actually aims at integrating religious disciplines with modern technology and science, which is implemented in Islamic higher education in Indonesia. In developing the concept of science integration in each UIN in Indonesia, it has editorial diversity and contextual elaboration with the environment and culture of respective regions. Artikel ini bertujuan membahas pola integrasi keilmuan pada perguruan tinggi Islam di Indonesia dan model pengembangannya. Penelitian ini menggunakan metode kualitatif, sumber datanya terdiri dari informan dan dokumentasi, serta teknik pengumpulan datanya dilakukan melalui wawancara mendalam, observasi partisipasi, focus group discussion dan telaah dokumentasi. Hasilnya, penerapan pola integrasi keilmuan pada beberapa lembaga perguruan tinggi Islam tersebut ternyata berbeda-beda, berdasarkan perbedaan pemahaman tentang konsep integrasi keilmuan dan setting sosial-budaya yang bersifat lokal, sesuai latar belakang perguruan tinggi itu didirikan. Universitas Islam Negeri (UIN) umumnya menerapkan integrasi, bukan islamisasi, yaitu dengan memadukan antara Islamic science dan sains umum. Ini tertuang dalam visi dan misi perguruan tinggi. Adapun prakteknya, pelaksanaan integrasi keilmuan diterapkan pada fakultas melalui kebijakan langsung dari universitas. Secara umum, Perguruan Tinggi Islam di Indonesia telah memiliki paradigma filosofis, dengan mengusung konsep integrasi keilmuan yang khas. Dalam aspek penjabaran paradigma integrasi tersebut, tercermin dalam kurikulum yang diterapkan. Namun, dari penjabarannya integrasi keilmuan sesungguhnya ingin memadukan disiplin ilmu keagamaan dengan teknologi dan sains modern, yang diimplementasikan dalam pendidikan tinggi Islam di Indonesia. Dalam pengembangan konsep integrasi keilmuan di masing-masing UIN di Indonesia memiliki keragaman redaksional dan elaborasi yang sangat kontekstual dengan lingkungan dan kultur daerah masing-masing.

Abstract

Divorces is often lead to multiple violations of children's rights due to parental conflicts. Therefore, this research reviewed maqāsid al-syarī'ah on the fulfillment of children's rights after divorce in Budi Aji Village, Simpang Pematang District, Mesuji Regency. It was field research and employed a descriptive qualitative method. Data were gathered by observation, in-depth interviews, and documentation, and accompanied by inductive analysis. Subsequently, this research found that the fulfillment of children's rights following parental divorce in the village has been sub-optimal. The majority of fathers are unemployed and unable to fulfill their obligations of providing a living, attention, and affection for children. The contributing factor is the fathers’ irresponsibility, which impedes the achievement of maintenance benefits to the children’s life (hifz an-nafs). These findings may have implications for the need to increase the understanding of divorced parents regarding the fulfillment of children's rights and the importance of the role of the extended family in ensuring offspring are not neglected.

Abstract

This study explores the legal dynamics between financial responsibility and marital property in the context of marriage in Indonesia, with a specific focus on reconciling the normative gap between Islamic law and Indonesia’s national legal system. While Islamic law places full financial responsibility (nafaqah) on the husband, Indonesian civil law applies a gender-neutral approach by recognizing joint marital property acquired during marriage, regardless of who earned it. This normative legal research employs a qualitative approach using statutory, conceptual, and comparative analyses of both Islamic legal texts (Qur’an, Hadith, and classical fiqh) and national legal instruments such as the Marriage Law No. 1 of 1974 and the Compilation of Islamic Law (KHI). The findings reveal a fundamental inconsistency: Islamic jurisprudence emphasizes the husband's economic duty, whereas civil law presumes equal ownership, potentially leading to legal ambiguity in divorce and inheritance cases. The study concludes that this dualism requires a contextual reinterpretation of the joint property regime that respects Islamic ethical values while adapting to modern socio-economic realities, including the increasing financial contributions of women. It is recommended that legal reforms recognize differentiated spousal roles without undermining gender justice. This research contributes academically by proposing an integrative legal framework that bridges the gap between normative Islamic obligations and the state’s egalitarian legal principles. Such a framework offers a more just, ethical, and socially relevant model for regulating financial responsibility and property rights in Muslim marriages within Indonesia’s plural legal system.

Abstract

This study aims to reveal and analyze the practice of marriage dowry in the form of gold in the people of Tanjung Senang District, Bandar Lampung in the perspective of 'urf. The method used in this research is a descriptive analytical field research. Primary data in the form of interviews with the community in Tanjung Senang District, Bandar Lampung, then supplemented with secondary data. The results of this study indicate that: the tradition of the people of Tanjung Senang District, Bandar Lampung, it appears that the dowry in a marriage must be in the form of gold, whereas in Islamic law the form of the dowry is not determined in marriage, everything that has value can be used as a dowry. For the people here, dowry other than gold is considered unusual, the tradition of dowry in the form of gold is inherent, this tradition is considered good, it does not conflict with Islamic law, and brings benefit to society in general. This tradition is a form of love and affection, sincerity, and responsibility for the prospective husband to his prospective wife. The nominal is related to the level of education, social status, ethnicity, and profession based on the agreement of the parties. The conclusions of this study are: in the perspective of Islamic law, by referring to the rules of urf, that is to see the traditions/customs that have been attached to the community, and to see the philosophy of the practice of giving dowry as a form of appreciation for the social status of a woman, with the practice of giving this dowry is to achieve a benefit between the two prospective brides and even between large families, then it is not against Islamic law.

Abstract

This research aims to reveal the enforcement of the mbasuh dusun tradition in cases of pregnancy outside marriage in Bengkulu City, Indonesia. This type of research is field research. The nature of this research is descriptive analytic. Data collection techniques in this study used observation, interviews, and documentation. The data obtained was analyzed using descriptive qualitative methods to obtain conclusions and research findings. The result of this study is that: the implementation of the mbasuh dusun tradition is a customary sanction for pregnant women outside of marriage in Bengkulu City, as al-'urf al-shahih and has an effective impact. This mbasuh dusun tradition is carried out by slaughtering a goat, and the perpetrator must be present to be aware and must apologize. Then give charity  (and ask for prayers) at the place where the goat was slaughtered or outside the house. Unlike customary sanctions in other regions, the implementation of the mbasuh dusun tradition has a goal and purpose, so that the perpetrator is ashamed and does not repeat the act again, so that it can effectively reduce and even deter the perpetrator. The application of this customary sanction in the context of developing marriage law in Indonesia, it is necessary to review the legalization of marriage of pregnant women outside of marriage in the Compilation of Islamic Law (KHI), and it turns out that the provision of sanctions for pregnant women outside of marriage has a significant impact on creating a deterrent effect and bringing benefits to the community.Â
