Abstract

The increase in the number of vehicles in Indonesia shows that there is a dynamic growth of public transportation in line with economic development. This growth requires more efficient fuel distribution management so that people's energy needs can be met according to standardization. The problem arose when Pertalite fuel allegedly caused damage to the engine of the consumer's vehicle, so the consumer demanded compensation. The purpose of this study is to analyze the form of consumer losses and legal remedies in the perspective of justice. This research uses normative research methods based on primary and secondary legal sources, as well as legislative, factual, and conceptual approaches. The results of this study confirm that losses experienced by consumers include technical, economic, and social aspects, as well as weak business actors' accountability. ha katas Compensation, the realization of compensation by business actors has not run optimally. Legal remedies can be pursued through litigation and non-litigation through BPSK which is faster and more efficient, but the challenge of proving it is an obstacle. The principle of corrective justice according to Aristotle emphasizes the importance of reparation for losses in proportion. To ensure substantive justice, the state needs to strengthen oversight and improve access to information for consumers.

Abstract

Perkembangan teknologi blockchain melahirkan Non-Fungible Token (NFT) sebagai aset digital bernilai ekonomis yang berpotensi digunakan dalam transaksi pembiayaan. Namun, belum adanya pengaturan khusus dalam hukum Indonesia menimbulkan ketidakpastian mengenai kedudukan NFT sebagai objek hukum dan objek jaminan. Penelitian ini menganalisis kualifikasi NFT sebagai benda menurut Kitab Undang-Undang Hukum Perdata serta kedudukannya sebagai objek jaminan ditinjau dari perspektif kepastian hukum Gustav Radbruch. Metode penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa NFT memenuhi kriteria sebagai benda bergerak tidak berwujud, namun belum dapat diakui secara optimal sebagai objek jaminan karena ketiadaan pengaturan eksplisit, sistem pendaftaran, dan mekanisme penegakan hukum yang memadai.

Abstract

This study discusses the legal framework and the obligations of tourism operators in implementing the principles of sustainable tourism in Indonesia. The main focus of this research is to analyze the implementation of sustainability principles within Law No. 10 of 2009 on Tourism and related international regulations such as ISO 21401 and the International Tourism Ethics Code. The methodology used is normative legal research with legislative and conceptual approaches, aiming to critique ambiguities in existing regulations and propose solutions regarding the obligations of tourism operators. The findings show that there is a lack of clarity in the legal provisions regulating sustainability, which may negatively impact social and environmental aspects. Therefore, this study suggests the need for revisions to clarify the obligations of tourism operators to conduct environmental and social impact assessments. In conclusion, the study advocates for a stronger integration of national regulations with international standards to ensure the development of tourism that is sustainable, equitable, and environmentally friendly.

Abstract

The digitalization of land administration through electronic land certificates, as regulated under the ATR/BPN Ministerial Regulation No. 3 of 2023, introduces efficiency and transparency but simultaneously raises concerns regarding the protection of personal data. A critical issue lies in the lack of detailed regulatory provisions governing data breach handling and legal accountability. This study aims to examine the forms of legal protection for personal data within the electronic land certificate system and to analyze the legal responsibilities arising from potential data breaches. The research employs a normative juridical method using statutory and conceptual approaches, supported by primary and secondary legal materials. The findings indicate that legal protection is implemented through preventive mechanisms, including information system security and restricted access, as well as repressive measures based on the Personal Data Protection Law and Electronic Information and Transactions Law. However, the current regulation does not comprehensively address technical safeguards, sanctions, or specific procedures for data breach mitigation. This gap highlights the need for strengthening regulatory frameworks and improving cybersecurity measures to ensure more effective legal protection for electronic land certificate holders.

Abstract

Intellectual property is creativity that results from human thought in order to meet the needs and welfare of human life. Currently, IPR issues are widely discussed in the context of international issues. IPR includes two parts, namely Copyrights and Industrial Property Rights. Industrial property rights include patents, industrial designs, integrated circuits layout designs, trade secrets, geographic indications, trademarks and plant variety protection (PVP). Interior design is part of industrial design. Interior design has experienced significant developments in recent years, including in Indonesia. Problems that arises is plagiarisms done by imitating or using the "similarity" of an interior design that already has an industrial design certificate without any permission from the design owner. This study aims to find out the legal protection of interior design in the intellectual property rights of industrial design and the legal basis used by judges in deciding industrial design rights disputes. The result of this study showed that the legal protection of interior design in the intellectual property rights of industrial design involved two legal protections; they are preventive legal protections and repressive legal protections. Furthermore, Gustav Radbruch's theory of legal ideals is used as a legal basis in deciding cases of disputes over industrial design rights based on justice, benefits, and legal certainty in the case of industrial design disputes Ecosfera Room.

Abstract

Since then, the government has taken a number of steps to mitigate the impact of the Covid-19 epidemic in a number of industries. Restrictions on community activities affect business activities which in turn have an impact on the economy in the employment sector. To overcome the impact of the Covid-19 pandemic, assistance was held for the Gelgel Indigenous Village community in order to help the community's economy in order to meet the needs of their family life. The assistance provided in this activity is to obtain cheap credit bailouts from the Gelgel Village Traditional Village Financial Institution (LPD) in the Klungkung Regency and District by providing loan capital for workers who have been dismissed due to the closure of the company where they work. work. This activity aims to help the Gelgel Traditional Village community in their economic sustainability. The method used is the method of analyzing the community situation. The results show that of the three indicators, namely interpersonal roles, information-related roles, decision-making roles, it can run well.

Abstract

Perkembangan teknologi informasi telah mendorong perubahan dalam sistem transaksi perdagangan di Indonesia, khususnya melalui e-commerce. Di samping memberikan kemudahan dan efisiensi, transaksi online juga menimbulkan berbagai permasalahan, seperti penipuan, ketidaksesuaian barang, dan pelanggaran data pribadi. Kondisi ini menunjukkan pentingnya perlindungan hukum bagi konsumen. Penelitian ini bertujuan untuk menganalisis peran Badan Penyelesaian Sengketa Konsumen (BPSK) Denpasar dalam memberikan perlindungan hukum pada transaksi e-commerce serta mengidentifikasi kendala yang dihadapi. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan deskriptif kualitatif. Data diperoleh melalui wawancara dan studi dokumentasi. Hasil penelitian menunjukkan bahwa BPSK Denpasar berperan aktif dalam menyelesaikan sengketa melalui mediasi, konsultasi, dan pemberian edukasi kepada konsumen. Dalam praktiknya, sebagian besar sengketa diselesaikan melalui mediasi tanpa melalui proses peradilan. Namun, terdapat kendala berupa keterbatasan sumber daya manusia dan belum optimalnya kerja sama dengan platform e-commerce. Oleh karena itu, diperlukan penguatan kelembagaan BPSK dan peningkatan kesadaran hukum masyarakat guna mendukung terciptanya transaksi e-commerce yang adil dan aman.

Abstract

ABSTRAKPenelitian ini menganalisis implikasi penentuan batas eksploitasi air tanah terhadap tanggung jawab perdata dalam hukum lingkungan Indonesia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa penetapan batas eksploitasi air tanah berfungsi sebagai instrumen pengendalian pemanfaatan sumber daya air berdasarkan daya dukung lingkungan serta menjadi dasar penilaian terjadinya perbuatan melawan hukum sebagaimana diatur dalam Pasal 1365 KUHPerdata. Pelanggaran terhadap batas tersebut dapat menimbulkan tanggung jawab perdata berupa ganti rugi dan pemulihan lingkungan. Selain itu, penerapan prinsip strict liability dalam Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup memperkuat mekanisme pertanggungjawaban tanpa pembuktian unsur kesalahan. Kendala utama dalam implementasi adalah kesulitan pembuktian kausalitas serta lemahnya pengawasan. Oleh karena itu, diperlukan penguatan penegakan hukum dan kesadaran hukum masyarakat untuk menjamin efektivitas perlindungan air tanah secara berkelanjutan serta mendukung pembangunan berkelanjutan dalam rangka menjaga keseimbangan ekosistem dan kepentingan masyarakat luas secara adil dan berkelanjutan optimal.Kata Kunci: Air Tanah, Batas Eksploitasi, Tanggung Jawab Perdata, Perbuatan Melawan Hukum, Strict Liability

Abstract

The development of digital transportation services such as Gojek is highly dependent on personal data, but various cases of data leaks highlight the weakness of legal protection in Indonesia. This has prompted the need for comparison with Japan, which has stronger regulations through the APPI. This study aims to identify and examine the regulation of personal data of users of digital transportation services in Indonesia and compare it with the law in Japan. This study applies a normative legal research method using a legislative approach and legal concept analysis. The findings show that data protection in Indonesia is regulated in the 1945 Constitution and the PDP Law, which require data controllers such as Gojek to ensure lawful, secure, and accountable data management. However, its implementation still faces institutional challenges. In comparison, Japan, through its independent supervisory agency PPC, shows progress in supervision and a high culture of compliance. While Indonesia's PDP Law is normatively comprehensive, its effectiveness still awaits the establishment of a supervisory agency and complete implementing regulations.
