Abstract

Perkembangan teknologi informasi dan komunikasi telah membawa dampak signifikan terhadap pola interaksi masyarakat, khususnya melalui media sosial. Di satu sisi, media sosial memberikan ruang kebebasan berekspresi, namun di sisi lain juga membuka peluang terjadinya tindak pidana ujaran kebencian (hate speech) yang berpotensi mengganggu ketertiban umum dan persatuan bangsa. Penelitian ini bertujuan untuk menganalisis penerapan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik sebagaimana telah diubah dengan Undang-Undang Nomor 19 Tahun 2016 terhadap tindak pidana ujaran kebencian di media sosial, serta mengkaji pertimbangan hakim dalam Putusan Nomor 72/Pid.Sus/2020/PT.DPS. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan terdiri atas bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa perbuatan terdakwa dalam kasus tersebut telah memenuhi unsur-unsur tindak pidana sebagaimana diatur dalam Pasal 28 ayat (2) jo. Pasal 45A ayat (2) UU ITE, khususnya unsur kesengajaan, tanpa hak, serta perbuatan menyebarkan informasi elektronik yang menimbulkan rasa kebencian terhadap kelompok tertentu. Pertimbangan hakim dalam menjatuhkan putusan didasarkan pada aspek yuridis, filosofis, dan sosiologis, dengan tetap memperhatikan keseimbangan antara kebebasan berekspresi dan perlindungan terhadap ketertiban umum. Penelitian ini menyimpulkan bahwa penerapan UU ITE dalam perkara tersebut merupakan bentuk penegakan hukum terhadap ujaran kebencian di ruang digital, sekaligus menegaskan bahwa kebebasan berpendapat memiliki batasan hukum yang harus dipatuhi.

Abstract

Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis berbagai bentuk diskriminasi yang terjadi terhadap daftar pemilih tambahan dalam konteks pemilihan umum. Fokus utama penelitian ini adalah mengungkap dinamika diskriminasi yang mungkin dialami oleh pemilih yang terdaftar dalam daftar pemilih tambahan, baik secara sistematis maupun sporadis. Selain itu, penelitian ini juga bertujuan untuk mengeksplorasi mekanisme penyelesaian hukum yang efektif dan dapat diterapkan guna mengatasi diskriminasi tersebut. Dengan menganalisis kerangka hukum yang ada serta studi kasus yang relevan, penelitian ini diharapkan dapat menawarkan solusi yang komprehensif dan praktis. Lebih jauh, penelitian ini berupaya untuk memberikan kontribusi signifikan dalam penyusunan kebijakan pemilihan umum yang lebih adil dan inklusif. Melalui rekomendasi kebijakan yang didasarkan pada temuan empiris, diharapkan sistem pemilihan umum dapat diperbaiki sehingga mampu menjamin perlindungan hak-hak pemilih tambahan secara lebih efektif. Selain itu, penelitian ini juga bertujuan untuk memperkuat kerangka perlindungan hukum bagi pemilih tambahan, sehingga setiap individu memiliki kesempatan yang setara untuk berpartisipasi dalam proses demokrasi. Hasil penelitian ini diharapkan dapat menjadi acuan bagi pembuat kebijakan dan praktisi hukum dalam upaya meningkatkan kualitas dan integritas sistem pemilihan umum.

Abstract

The Omnibus Law on Job Creation is a significant piece of regulatory reform introduced by the Indonesian government to boost investment competitiveness and stimulate economic growth by streamlining cross-sector regulations, including labour law. However, the reform has sparked debate about whether workers, particularly contract workers who are vulnerable in the labour market, are adequately protected by the law. This research aims to analyse the complexities surrounding the implementation of the Omnibus Law on Job Creation and its implications for the welfare and legal protection of contract workers in Indonesia. This research employs a qualitative legal approach, using document analysis and network content analysis of industrial relations dispute decisions issued by the Supreme Court of the Republic of Indonesia between 2020 and 2024. NVivo 12 Plus was used to support systematic coding and visualisation. The results indicate that, while regulatory changes under the Omnibus Law increase labour market flexibility, they also create legal uncertainty for contract workers, affecting income stability, employment security and access to labour rights. It is concluded that the policy creates an imbalance between investment-oriented objectives and the constitutional mandate to protect workers' welfare. Therefore, a regulatory review and a more inclusive policy formulation process are necessary to ensure fair and sustainable labour protection.

Abstract

The consolidation of democracy in post-Reform Indonesia is currently facing an "illiberal turning point" that systematically erodes the essence of people's sovereignty at the local level through manipulative legal engineering. The urgency of this research is based on the institutional paradox due to the synchronization of the 2024 Simultaneous Regional Elections which triggered mass vacancies and the strengthening of elite hegemony. This study aims to analyze the dialectic of power recentralization through the appointment of Acting Regional Heads, the construction of the doctrine of factual tenure based on the Constitutional Court Decision Number 132/PHPU. BUP-XXIII/2025, as well as the challenges of political cartelization to elite circulation and freedom of choice The main findings of this study show the existence of a "triad of democratic regression" which includes: (1) a crisis of sociological legitimacy due to the appointment of 271 acting regional heads that are centralistic and closed; (2) the establishment of the doctrine of factual tenure as an instrument of substantive justice to prevent the manipulation of tenure by incumbents; and (3) the anomaly of political party cartelization that actually consolidates giant coalitions to create a single candidate even though the nomination threshold has been lowered through the Constitutional Court Decision Number 90/PUU-XXIII/2025. These findings contribute to the understanding that current legal norms tend to be used as instruments of political exclusion to maintain the status quo of the elite. The conclusion of the study confirms that local democracy is undergoing a substantial erosion into just an administrative plebiscite. The implication is that it demands a more strict revision of the Election Law and total transparency in the mechanism for appointing officials. The suggestion for further research is to conduct an empirical evaluation of bureaucratic neutrality under the leadership of the acting and the effectiveness of civil society movements in fighting electoral monopolies.

Abstract

The politicization of social assistance ahead of elections shows an increase, with programs intended to protect vulnerable communities being transformed into instruments for mobilizing electoral support by incumbent regional heads. This study aims to analyze the formulation of criminal law regarding the politicization of social assistance as a form of abuse of power, identify regulatory weaknesses, and develop a more effective legal reform model. The research employs a juridical-empirical method with a socio-legal approach, examining legislation on elections, regional governance, and corruption, and combining it with empirical data from election monitoring reports, regional budget documents, and selected case studies. Data were collected through literature review and institutional document analysis, then processed using qualitative-descriptive techniques to compare legal norms (das sollen) with actual practices (das sein). The findings reveal that the politicization of social assistance operates through three main patterns: budget manipulation aligned with electoral cycles, personalization of public programs to build political image, and bureaucratic mobilization to influence voter behavior. These practices exploit regulatory gaps, particularly limited criminal provisions and fragmentation among administrative, electoral, and anti-corruption legal regimes. The study demonstrates that such practices constitute a deviation from the purpose of authority (detournement de pouvoir) and should be addressed as more than procedural violations. The implication of this research highlights the need for a specific criminal offense framework based on the misuse of public policy, supported by stronger sanctions, integrated oversight, and clearer legal standards to safeguard democratic integrity and the neutrality of social welfare policies.

Abstract

This study examines the criminal offense of hoarding subsidized fuel oil (BBM) in Indonesia. The background of the study is the recurring misuse of subsidized fuel distribution by irresponsible actors who stockpile fuel to obtain personal profit. Such practices create supply scarcity, trigger price increases, harm lower-middle-income communities, and disturb national economic stability. This research uses an empirical legal method that focuses on the identification of living law and the effectiveness of legal rules in society. The approach studies how legal norms are implemented in practice through objectively obtained facts, including public opinions, attitudes, and legal behavior. The findings show that sanctions for hoarding subsidized fuel are regulated mainly in Law Number 22 of 2001 concerning Oil and Gas, especially Articles 51 and 55, as amended by later regulations. Article 55 provides imprisonment of up to six years and a maximum fine of IDR 60,000,000,000 for misuse of the transportation and/or trading of government-subsidized fuel. Economic motives, weak distribution oversight, regulatory gaps, and price-increase momentum are key factors enabling this offense.
