Abstract

The purpose of this study was to determine the urgency of the nationalization of foreign investment by the Government of the Republic of Indonesia. The legal research method used is normative legal research. The Government of the Republic of Indonesia is currently in a position to nationalize foreign capital companies by prioritizing the potential of the nation and state and not closing themselves on the entry of foreign capital for the sake of realizing economic growth. Foreign investment in the perspective of Law Number 25 of 2007 concerning Investment must prioritize the welfare of the Indonesian people by prioritizing the potential possessed by the nation and state without neglecting Indonesia's economic and political sovereignty. the nationalization carried out by Bolivia, Venezuela and Mexico can be used as a comparison and lesson for the Government of the Republic of Indonesia in nationalizing that the President, he uses his power to realize the will of the people in the aim of restoring economic and political sovereignty over its natural resources.

Abstract

Domestic violence (KDRT) occurs in a gendered household and causes sorrow and suffering for its victims, who are mostly women, and perpetrators, who are mostly men. The Law on the Elimination of Domestic Abuse protects human dignity, husband and wife's rights in the home, and violence or discrimination against women (KDRT). In addition to raising community understanding and knowledge of gender equality and justice to promote women's welfare and protection from violence, women's participation in all disciplines, especially development, must be boosted. The government should protect women from assault and demeaning treatment. Domestic violence may happen anywhere. Domestic violence prevents victims and perpetrators from knowing one other's social, economic, or educational status. This endeavor educates the public about domestic abuse and its psychological repercussions on children.

Abstract

The discussion that emerged from the moratorium on the Bankruptcy Law and the PKPU, all forms of changes to regulations are the absolute right of the Government which of course, before issuing the policy, the Government has considered and reviewed all inputs from stakeholders. As the main purpose of the decision is in the public interest. the concept of PKPU and bankruptcy only by considering the indications of “Moral Hazard” that may arise in the process. The spirit of business continuity adopted by the Bankruptcy Law and PKPU must be taken into consideration because it has been proven to have saved several debtors from business destruction. The imposition of a moratorium is not the only way out to avoid the threat of "Moral Hazard" which can actually be handled by other mechanisms. The solution or input that can be considered by the Government is to encourage changes, improvements, and improvements in the Bankruptcy Law and PKPU, either through the Perppu mechanism or other mechanisms. Changes or improvements will be good if they go into a more substantial or basic real.

Abstract

In the application of laws and regulations in Indonesia, there are many weaknesses, one of which does not meet the concept of fair efficiency as regulated in Law Number 12 of 2011 concerning the Establishment of Legislations, both at the level of formation, application or law enforcement. Today, technology is experiencing an increasingly rapid development along with the times. The development of technology is something that cannot be touched. The role of law as a tool of social control involves the state to run it, therefore the role of the executive and legislature in making the rule of law is very important and dominant because the state has the obligation to protect all its citizens.

Abstract

Kurator mempunyai prinsip independensi dan tidak memihak yang merupakan salah satu prinsip utama yang dikenal dalam berbagai ketentuan hukum internasional yang juga dikehendaki oleh Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang. Selain itu, kurator bertanggung jawab terhadap kesalahan atau kelalaiannya dalam melaksanakan tugas pengurusan dan/atau pemberesan terhadap harta pailit. Rumitnya penyelesaian pemberesan harta pailit semakin bertambah dengan pencantuman pasal sanksi pidana dalam UU Kepailitan yang menyatakan apabila terbukti kurator tidak independen dapat dikenakan sanksi hukum baik pidana maupun perdata sesuai perundang-undangan. Metode penelitian yang digunakan adalah penelitian hukum normatif preskriptif. Adanya ancaman untuk menjatuhkan sanksi pidana terhadap kurator dihubungkan dengan sikap tidak independennya kurator pada akhirnya menjadi persoalan baru, khususnya terkait dengan pertanggungjawaban pidana yaitu dalam hal menentukan tolok ukur kurator dikatakan tidak independen sehingga dapat dijatuhi sanksi pidana akibat melakukan perbuatan melawan hukum sebagaimana diamanatkan oleh UU Kepailitan. Pertanggungjawaban pidana kurator yang tidak independen mengacu kepada terpenuhinya 3 (tiga) pilar dalam hukum pidana yaitu ada perbuatan pidana, adanya kesalahan yang berakibat pertanggung jawaban pidana dan berkaitan pidana atau pemidanaan dengan berdasarkan pada prinsip independensi, yaitu kurator dalam situasi yang sulit dapat mengambil tindakan tegas demi kepentingan harta pailit. Adapun ratio decindendi hakim dalam menjatuhkan putusan terhadap kurator tidak langsung mengacu kepada independensi kurator dalam Pasal 234 ayat (2) UU Kepailitan melainkan mengacu kepada KUHPidana.

Abstract

The Covid-19 outbreak has had an impact on various sectors of life, including the environment. Medical waste in the community has increased in the new normal era of the Covid-19 pandemic, this can be seen from the existence of new adaptations in society, but in its application, household medical waste management is still an obstacle to this day. The approach method used is juridical-normative, with the type of dogmatic research, a form of perscriptive research on legal relations. The specification of this research is descriptive-analytical, the government continues to make various efforts in handling household medical waste. State responsibility as the basis for the implementation of environmental protection and management is carried out through the enforcement of environmental laws, namely administrative, civil and criminal law enforcement. Formulation of a new policy on the management of Infectious and Household Waste from Handling Covid 19.

Abstract

Dalam menjalankan usahanya para pelaku usaha sering mengadakan perjanjian utang piutang.Perjanjian utang piutang merupakan suatu hal yang umum dilakukan antara kreditor dan debitor.Namun tidak jarang menimbulkan sengketa antara debitor yang lalai dan tidak sanggup membayar atas utang-utangnya kepada kreditor.Salah satu upaya untuk mengatasi utang yang tidak terbayarkan adalah melalui Kepailitan dan Penundaan Kewajiban PembayaranUtang (PKPU) yang dimohonkan oleh debitor atau kreditor. Kepailitan adalah sita umum atas semua kekayaan debitor pailit yangpengurusan dan pemberesannya dilakukan oleh Kurator di bawah pengawasan Hakim Pengawas.Sedangkan PKPU adalah penyelesaian utang piutang dengan tujuan untuk mengadakan rencana perdamaian yang meliputi tawaran pembayaran sebagian atau seluruh utang kepada kreditor. Kapailitan dan PKPU dalam penerapannya telah diatur dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang, Herziene Indonesisch Reglement (HIR), Reglement of de Rechtsvordering (Rv), Rechtsreglement Buitengewesten(RBg), dan diatur lebih lanjut dalam Rancangan Undang-Undang Hukum Acara Perdata. Didalam pengaturan hukum acara kepailitan dan PKPU yang terdapat dalam berbagai peraturan dan Rancangan Undang-Undang Hukum Acara Perdata, masih terdapat kekurangan yang perlu dianalisis untuk memberikan dasar hukum terhadap pengaturan hukum acara kepailitan dan PKPU. Mengingat akan diundangkannya Rancangan Undang-Undang Hukum Acara Perdata maka dalam penelitian ini akan menganalisis beberapa poin penting yang dapat digunakan sebagai bahan masukan dalam Rancangan Undang-Undang Hukum Acara Perdata.

Abstract

Bankruptcy personal guarantee that is bankrupt without first bankrupting the main debtor in the Supreme Court Decision Number 141/PK/Pdt.Sus/Pailit/2016 whether it is in accordance with the provisions of the applicable legislation and to find out the application and consideration of the judge in deciding the case in this case. This study aims to make everyone who wants to be a guarantor of the debtor understand the applicable rules regarding individual guarantees. This research method uses a normative juridical approach. Normative juridical is where the researcher refers to the legal norms that exist in laws and regulations, literature, expert opinions, and papers. The results of this study indicate that the Judge in Decision Number 141/PK/Pdt.Sus/Pailit/2016 bankrupt the personal guarantee without first insolventing the main debtor because the personal guarantee has relinquished all its privileges, although according to the researcher there are still problems related to the list. BI Checking in showing the existence of other creditors.

Abstract

The positive law in force in Indonesia that regulates corruption is the Law of the Republic of Indonesia Number 31 of 1999 in conjunction with the Law of the Republic of Indonesia Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption. In overcoming the problem of corruption, in fact there are many difficulties faced by law enforcers which have become a routine part of law enforcement constraints in Indonesia. In addition, the problem is even more difficult if when the perpetrators of corruption are not in Indonesia, where trials are conducted in absentia, then the assets resulting from corruption have been hidden abroad, so this creates serious problems for prosecutors in carrying out executions. However, today the functionalization of criminal law in the context of enforcing the law on corruption, both from the point of view of material criminal law, formal criminal law (criminal procedure law), as well as criminal implementation, still faces obstacles, especially regarding the policy of recovering assets of perpetrators of corruption has implications for the implementation of the execution of replacement money payments in order to optimize the recovery of state financial losses. Thus, obstacles in eradicating criminal acts of corruption must be addressed immediately, so that they do not become an inhibiting factor in efforts to restore state financial losses, so that the national development program can run optimally. The current policy of recovering assets of perpetrators of corruption in an effort to recover state financial losses cannot be implemented optimally, because it must be recognized that current national law still has many weaknesses that create difficulties for law enforcers in recovering assets of perpetrators of corruption, especially in terms of confiscating the assets of the perpetrators of corruption, so that the return on state financial losses resulting from corruption is currently not optimal.

Abstract

This paper explains, Corruption comes from the Latin Corruption from the verb corrumpere means rotten, damaged, shaken, overthrown, bribed. According to Transparency International, it is the behavior of public servants, both politicians/politicians and civil servants, who illegally and illegally enrich themselves or their families by abusing the public power entrusted to them. The research method used is empirical legal research or sociological research that prioritizes field data (field research) which is evaluative in nature with the aim of assessing the implementation of a legal regulation. The formulation of the problem is the factors that influence law enforcement against civil servants involved in corruption cases of the Complete Systematic Land Program (PTSL) in Palembang City. The conclusion is that the factors that influence the prosecution of officials involved in corruption cases of the Complete Systematic Land Program (PTSL) in Palembang City, namely the legal regulation factor itself, due to the absence of supporting instruments in the form of laws and regulations that implement the criminal act of corruption is not running properly.
