Abstract

This writing is titled “Enforcement Of Environmental Law Through Civil Law Aspects” that aims to know and understand how the environment through the law enforcement aspects of civil law. In this paper the authors use the method of normative research. The results of the analysis are obtained, is that the law enforcement aspects of the environment through civil law can be done through the courts and the line outside the court.

Abstract

In its development, the Bankruptcy Law in theory and practice did not progress significantly and it was until 1998 and replaced by a new one, which on October 18, 2004 legalized bankruptcy law and postponement of debt obligations have a wider scope, this is necessary because of the development and legal needs in the community while the provisions that have been applied is not sufficient as a legal means to solve the problem of accounts receivable in a fair, fast, open, and effective. One of them concerning the requirement to declare a bankrupt debtor as stipulated in the provisions of Article 2 paragraph 1 that there is no provision that requires the debtor to be insolvency, this is certainly contrary to the universal philosophy of the Bankruptcy Act that provides a way out for debtors and creditors when the debtor is in a state unable to pay its debts. The absence of this insolvency test shows that the Bankruptcy Act is dominant in protecting the interests of creditors. In order to have a clear philosophical foundation, the concept of business continuity principles should be included in the future Article of Bankruptcy Regulation so as to enable debtor and creditors to pursue debt settlement fairly, quickly, openly and effectively. The type of research in the writing of this journal is prescriptive normative legal research.

Abstract

The Covid-19 pandemic was taking place in almost all countries around the world. Along with the increasingly vigorous government strategy in tackling the spread of the corona virus that was still endemic until now, the government had started to enforce the Large-Scale Social Restrictions (PSBB) with the signing of Government Regulation (PP) No. 21 of 2020 about PSBB which was considered able to accelerate countermeasures while preventing the spread of corona that was increasingly widespread in Indonesia. The research method used was normative prescriptive. The government put forward the principle of the state as a problem solver. The government minimized the use of region errors as legitimacy to decentralization. The government should facilitated regional best practices in handling the pandemic. Thus, the pandemic can be handled more effectively. The consideration, the region had special needs which were not always accommodated in national policies. The government policy should be able to encourage the birth of regional innovations in handling the pandemic as a form of fulfilling human rights in the field of health. Innovation was useful in getting around the limitations and differences in the context of each region. In principle, decentralization required positive incentives, not penalties. Therefore, incentive-based central policies were more awaited in handling and minimizing the impact of the pandemic.

Abstract

Law enforcement is the process of enforcing or trying to implement legal norms as guides for traffic or legal relations in social and state life. In the environmental law enforcement system in Indonesia, there are three legal aspects described in the Environmental Protection and Management Act (UUPPLH), namely administrative law, civil law, and criminal law aspects. Where each aspect's law enforcement and law enforcement processes are distinct. The research method used was normative legal research. One component of environmental law enforcement is the use of civil law in environmental management. In the Environmental Protection and Management Act (UUPPLH) the process of enforcing environmental law through civil procedures is regulated in Chapter XIII Articles 84 to 93. In order to provide legal clarity in law enforcement, efforts are being made to solve environmental problems that emerge in Indonesia. Environmental law enforcement is an endeavor to ensure that regulations and requirements in general and specific legal provisions are followed and implemented through administrative, civil, and criminal supervision and enforcement. With the adoption of the first environmental rules, namely Law Number 4 of 1982 Concerning Basic Provisions for Environmental Management (UUKPPLH), government policy frameworks in implementing environmental law were actualized. Then, it was later replaced by Law Number 23 of 1997 concerning Environmental Management (UUPLH), which was subsequently replaced by Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH) (Tude Trisnajaya, 2013: 2). The research method used in this study was normative juridical research, which means it was done with an eye on the laws, rules, and court decisions that were relevant to the topic. Abstract

This research discusses the role of environmental law in preventing environmental damage and pollution with a case study of illegal shrimp farmers in the Karimunjawa National Park Area. The Karimun Jawa National Park area is an ecosystem that is rich in biodiversity and has vital ecological functions. However, illegal shrimp farming activities in this area have caused significant environmental damage, including decreased water quality and damage to mangrove habitats.This research uses a normative juridical approach to analyze applicable environmental legal regulations and policies as well as the effectiveness of law enforcement in preventing and dealing with the activities of illegal shrimp farmers. The research results show that although there are clear regulations regarding environmental protection, implementation and enforcement of the law are still weak. Lack of coordination between institutions, minimal human resources, and technical obstacles in the field are the main inhibiting factors in enforcing environmental law. This research recommends increasing law enforcement capacity, increasing coordination between institutions, and strengthening local community participation in environmental protection efforts in the Karimunjawa National Park Area. With these steps, it is hoped that environmental damage and pollution due to illegal activities can be minimized.

Abstract

Hak atas lingkungan hidup yang layak dan sehat dijamin bagi seluruh rakyat Indonesia. Oleh karena itu, merupakan tanggung jawab negara untuk melindungi hak-hak tersebut. masyarakat juga dapat berpartisipasi untuk mengefektifkan peran pemerintah agar hak tersebut dapat terpenuhi dan tidak terjadi permasalahan lingkungan. Untuk meningkatkan partisipasi masyarakat dalam mencegah permasalahan lingkungan, Selanjutnya dalam rangka mitigasi bahaya lingkungan, Kabupaten Tanjung Raja Timur melakukan sosialisasi tentang pelibatan masyarakat dan UU No. 32 Tahun 2009. Tujuan publikasi ini adalah untuk menilai seberapa baik UU Nomor 32 Tahun 2009 dalam memitigasi permasalahan lingkungan hidup dan menjunjung tinggi hak masyarakat untuk mengambil tindakan. bagian dalam pengelolaan dan konservasi lingkungan hidup. Penelitian ini menggunakan peraturan perundang-undangan dan metode konseptual, dengan fokus yuridis normatif. Undang-undang Nomor 32 Tahun 2009 sangat penting untuk mencegah permasalahan lingkungan hidup, menurut temuan penelitian. Sebagai kerangka atau pedoman pengelolaan dan pemanfaatan sumber daya alam dan lingkungan hidup sesuai dengan daya dukung lingkungan hidup dan kemampuan lingkungan hidup, UUPPLH berfungsi sebagai instrumen hukum lingkungan hidup. UU PPLH juga memberikan perlindungan hak atas keterlibatan masyarakat. Berdasarkan pada Pasal 70 ayat 2, maka dapat diketahui bahwa masyarakat dapat berperan dengan: melakukan pengawasan sosial, memberikan pendapat, saran, usul, pengaduan, dan keberatan. Tidak hanya itu, masyarakat juga dapat menyampaikan informasi atau laporan kepada pemerintah.

Abstract

Corruption is one of the social diseases that is the same as other types of crimes such as theft. The problem is that corruption is increasing along with the progress of prosperity and technology. As happened in the case of the tin corruption crime committed by Harvey Mois, where the nominal state loss was also not small, estimated at IDR 271 trillion. This research method uses a normative legal research type, a legal research method carried out by examining library materials or secondary data. This case is suspected to have occurred in the period 2015-2020. Harvey Mois has an important role in this case, namely as an intermediary for other perpetrators. In this case, he became a representative of PT Refined Bangka Tin (RBT) in a case with PT Timah regarding illegal mining activities in the IUP Persero area. The articles charged to the suspect are Article 2 paragraph (1) and Article 3 in conjunction with Article 18 of Law of the Republic of Indonesia Number 31 of 1999 as amended and supplemented by Law Number 20 of 2001 in conjunction with Law of the Republic of Indonesia Number 31 of 1999 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) ke-1 of the Criminal Code. The 'mass' corruption case resulted in environmental losses of up to Rp 271,069,688,018,700 or Rp 271 trillion, and a total of 16 suspects have been detained by the Attorney General's Office.

Abstract

The widespread circulation of fake news can have a bad impact on the development of the Indonesian state. Fake news can cause arguments and even end friendships. Moreover, fake news contains ethnicity, religion, race and inter-group (SARA) which are very vulnerable to inviting friction between communities, disrupting state stability and diversity. Apart from having a crime aspect (perpetrator of crime), fake news also has a crime victim aspect. Victims in various fake news cases in Indonesia have not received more attention, even though this is an important matter in Indonesian law enforcement. The aim of this research is to find out and explain legal protection for victims of spreading fake news on social media (Facebook), and also the legal efforts that can be taken by victims of spreading fake news on social media (Facebook). The type of legal research that is carried out normatively is where law is conceptualized as what is written in statutory regulations (law in the books) or law is conceptualized as rules or norms which are benchmarks for human behavior that is considered appropriate. Based on the research results, it is understood that legal protection for victims of spreading fake news on social media (Facebook) means that victims receive legal protection from the Witness and Victim Protection Agency (LPSK) in the form of medical assistance, psychological rehabilitation, psychosocial rehabilitation, post-traumatic psychological recovery, compensation/ compensation, restitution. Legal remedies that can be taken by victims of spreading fake news on social media (Facebook) are reporting the incident to the authorities, asking for protection from the Witness and Victim Protection Agency (LPSK), retaliation through criminal or civil law.

Abstract

Abstract The implementation of electronic tickets can have a positive influence in the midst of the low legal awareness of the people of Lubuk Linggau City in traffic. E-ticketing speeds up the process of taking action against traffic violations. With technology, violations can be detected automatically through CCTV cameras. The National Police of the Republic of Indonesia implements a traffic order enforcement strategy known as E-TLE, which is an electronic system to monitor and implement traffic regulations in electronic form that utilizes supporting resources such as CCTV. CCTV footage is used as evidence, this system uses video cameras to display and record images at a specific time and location where the device is located, which implies a closed signal. Abstract

The victim and the offender are frequently in separate nations, a crime known as cybercrime transcends all borders and periods. Cybercrime can be committed using the computer itself as the method of committing the crime and the computer network system as the target. Laws governing information technology must take into account its rapid growth. Information and communication technology laws must anticipate and lessen these negative consequences. For information, media, and communication technology to progress as much as possible, legal products about cyberspace, or mayantara, must offer security and legal certainty. In response to the increasing number of cybercrimes, the government adopted a policy on April 21, 2008, with the adoption of Law No. 11 of 2008 regarding Information and Electronic Transactions (UU ITE). The ITE Law is Indonesia's first legislation focusing on online regulation. Based on the research findings, it can be concluded that Indonesian law enforcement has been unable to combat cybercrime to the best of its abilities. Indonesian law enforcement is facing difficulties due to the growth in cybercrime. The reasons for this are a lack of public legal awareness in efforts to combat information technology crimes, limited facilities and infrastructure, and the fact that there are still relatively few law enforcement officials who are familiar with the ins and outs of information technology (internet).
