Abstract

This research explores the constitutional review of asset confiscation conducted by law enforcement agencies on pre-office property owned by state officials in gratification cases. The issue is crucial since it relates to the protection of individual property rights and the limitation of institutional authority in combating corruption. This study aims to analyze how the seizure of assets acquired before assuming public office can be assessed from a constitutional law perspective. Using a normative juridical method complemented by case and conceptual approaches, along with interviews with legal practitioners and academic experts, this research evaluates the principles of legality, proportionality, and human rights protection in asset confiscation practices. The findings indicate that the seizure of pre-office assets without sufficient proof of connection to criminal acts violates constitutional principles, particularly the right to private ownership and legal certainty. Furthermore, such actions contradict the presumption of innocence and due process of law, potentially eroding public trust in the justice system. The study highlights the need for a clear and strict legal framework that defines the boundaries and procedures of asset confiscation to ensure that anti-corruption efforts remain effective without undermining citizens’ constitutional rights. Establishing such a framework would strengthen the legitimacy of law enforcement institutions and uphold the balance between justice enforcement and the protection of individual constitutional guarantees.

Abstract

Crime prevention and criminal law enforcement require clear arrangements so that at the same time they can form good protection for every Indonesian citizen's personal data. The purpose of this paper is to analyse the concept of using big data in crime prevention as well as criminal law enforcement and the form of boundaries and protection of personal data in the use of big data in crime prevention as well as criminal law enforcement. To achieve the results used, the research method used is a case approach and a statutory approach. From this writing, the use of big data in the context of crime prevention and criminal law enforcement has grown rapidly along with IT advances. Big data includes the collection, analysis and processing of large and diverse amounts of information. In disclosing crime cases using big data, it must also be linked to regulations on personal data protection and the data used in case disclosure must also be guaranteed validity, so that the activities carried out do not damage the sense of justice in society

Abstract

Sistem peradilan militer menempatkan Oditur militer sebagai salah satu bagian penegakan hukum dalam yurisdiksi militer dalam fungsi penuntutan. Dalam pelaksanaan tugas penuntutan tersebut dibantu oleh Perwira Seksi Penuntutan agar berjalan maksimal. Tujuan penelitian ini guna memahami peran Pasitut dalam proses penyelesaian tindak pidana terhadap anggota TNI yang melakukan tindak pidana sekaligus mengidentifikasi kendala serta upaya penanggulangannya dalam proses penuntutan. Menggunakan metode penelitian lapangan (field research) yang berlokasi di kantor Oditur Militer I-02 Medan dan menggunakan pendekatan yuridis empiris. Sumber data mencakup data primer dan sekunder yang dihimpun dari hasil wawancara, peraturan perundang-undangan, dan studi literatur. Informan dalam penelitian ini adalah Kepala Seksi Penuntuan Oditurat I-02 Medan. Hasil penelitian yang didapatkan bahwa peran Perwira Seksi Penuntutan dalam proses penyelesaian tindak pidana mencakup persiapan kegiatan terkait penuntutan, melaksanakan putusan pengadilan (eksekusi), mengawasi narapidana militer, menyelesaikan administrasi keuangan, sampai pengamanan dan pengawalan terhadap terdakwa dan barang bukti.

Abstract

Handling cases of domestic violence (KDRT) requires an approach that not only focuses on sanctions for perpetrators, but also on the comprehensive recovery of victims. One of the appropriate methods is restorative justice, which is focused on restoring social relations, psychological recovery for the victim, and the participation of all parties involved in the process of resolving the case. In this context, lawyers play a strategic role, not only as defenders of the law, but also as facilitators of a just and supportive restorative process for victims. This study aims to analyze in depth the role of lawyers in the implementation of restorative justice in domestic violence cases, as well as identify the challenges and opportunities faced in practice. The applied approach includes normative juridical and sociological with qualitative data analysis. The findings indicate that lawyers play a crucial role in ensuring victims ' rights are protected, providing trauma-sensitive legal assistance, and encouraging restorative agreements that do not harm victims. Therefore, it is necessary to increase the capacity of lawyers, the development of more comprehensive regulations, and cooperation between sectors to support the implementation of restorative justice that is efficient and in favor of victims of domestic violence.

Abstract

The enactment of Law Number 1 of 2023 reinstates the offense of insulting the President under Articles 218 and 219 of the Criminal Code. This study examines the differences in the normative construction of these provisions and their implications for legal certainty and freedom of expression. Employing normative legal research with statutory and conceptual approaches, the findings indicate that Article 218 emphasizes the substance of insult with a public interest exception, while Article 219 focuses on dissemination without clear limitations regarding intent. This ambiguity risks multiple interpretations and potential criminalization of criticism. Therefore, judicial interpretative guidelines are required to clarify intent and ensure proportional application.

Abstract

This research is motivated by a medical dispute due to alleged negligence (malpractice) that has been settled out of court, but the hospital did not implement the contents of the agreement, thus creating legal uncertainty for the patient. The research problem is focused on the validity of the medical dispute settlement agreement and the judge's legal considerations in deciding the default case in Decision Number 232/Pdt.G/2025/PN Medan, with the aim of analyzing the legal status of the settlement deed and legal protection for the injured party. The research method used is normative legal research with a case and statutory approach. The results of the study indicate that the settlement agreement between the patient and the hospital is valid and binding based on Articles 1320 and 1338 of the Civil Code, which changes the legal relationship into a purely contractual relationship. In his decision, the judge stated that the Defendant was in default because he violated the obligation to pay compensation and medical costs that had been agreed upon, so he was sentenced to pay material compensation of Rp266,000,000. It is recommended for the parties that each peace agreement be confirmed through a court decision (Van Dading) or a notarial deed to guarantee stronger executorial powers, and for the hospital to be highly committed to implementing the agreement in order to protect the patient's rights and the institution's reputation. Abstract

The “STRONG” trademark dispute between Hardwood Private Limited and PT Unilever Indonesia Tbk has led to overlapping ownership claims and divergent legal interpretations at different judicial levels. This research seeks to assess the implementation of the legal certainty principle for the initial trademark registrant and to evaluate the legal reasoning adopted by the Supreme Court in Decision Number 332 K/Pdt.Sus-HKI/2021 in light of Law Number 20 of 2016. Employing a normative legal research framework, this study applies qualitative analysis through statutory and jurisprudential approaches. The results indicate inconsistencies in applying the first-to-file doctrine, as the Supreme Court granted the trademark rights to PT Unilever by characterizing “Strong” as a descriptive common term that cannot be exclusively owned, notwithstanding Hardwood’s status as the earliest registrant. These findings underscore the importance of conducting thorough substantive examinations by the Directorate General of Intellectual Property during trademark registration to avoid overlapping rights. Additionally, there is a pressing need to reinforce regulations governing the use of common terms in trademarks to promote justice and legal certainty for prior registrants and to prevent monopolization of language in commercial practices. Abstract

Currently, women are the main victims of domestic violence throughout Indonesia. Domestic violence generally refers to acts such as verbal abuse, physical violence, coercion, and threats. Domestic violence has always been a concern in various sectors. Although considered very dangerous by the government, this crime continues to be committed in the general public. Domestic violence, especially the brutality of men against their wives, not only causes real torture, but also mental suffering. Therefore, victims of domestic violence must receive maximum legal protection. Basically, marriage is something sacred in society. Because of the bond of marriage between a man and a woman, the marriage is legally binding in the form of the rights and responsibilities of the husband towards his wife, and the obligations of the wife towards her husband. According to Law Number 1 of 1974 Article 1 concerning Marriage, marriage is a physical and spiritual union between a man and a woman as husband and wife with the aim of realizing a happy and eternal family based on faith in God Almighty. Domestic violence is any act that causes misfortune or physical, sexual, or mental suffering to a person, especially women. The regulation of domestic violence is regulated in Law Number 23 concerning the Elimination of Domestic Violence.
