Abstract

This study examines Indonesia's non-ratification of the United Nations Convention on Contracts for the International Sale of Goods (CISG) from the perspective of Lawrence M. Friedman's Legal System Theory, which emphasizes three main elements: structure, substance, and legal culture. The purpose of this study is to analyze the integration of these three factors and to identify the legal, administrative, and social obstacles that hinder the ratification of the CISG. The method used is a qualitative approach with a socio-legal research type through literature studies and interviews with academics and practitioners of international trade law. The results of the study indicate that the non-ratification of the CISG is influenced by three main factors. First, structurally, coordination between government agencies involved in the ratification process is still weak and not yet integrated. Second, in terms of legal substance, there are differences in principles and norms between the CISG and national civil law that raise concerns about disharmony. Third, the legal culture of policymakers and business actors who are still conservative towards international law slows down the acceptance of this convention. In addition, administrative obstacles such as lengthy bureaucracy, lack of human resource capacity, and the perception that CISG ratification is not urgent also contribute to inhibiting factors. This study concludes that the lack of integration between the structure, substance, and legal culture is the main root of the failure to ratify the CISG in Indonesia. Therefore, legal system reform is needed through strengthening institutional coordination, harmonizing the substance of contract law, and increasing literacy and awareness of international law among policymakers and business actors.

Abstract

The abuse of authority in corruption cases in Indonesia can be more comprehensively examined through the lens of the sociology of law, particularly by applying Anomie Theory and Legal Realism. Corruption, as an extraordinary crime, persists despite the relative adequacy of the formal legal system (law in the books). This study employs a socio-legal method with a qualitative descriptive approach to explore the interplay between social structures and law enforcement practices in power-based corruption. The findings reveal that Anomie Theory explains corruption as a deviant “innovation” arising from the gap between cultural goals such as wealth and social status and the limited institutional means to achieve them lawfully. Conversely, Legal Realism emphasizes law in action, showing that judicial decisions and enforcement practices are often influenced by extra-legal factors such as political power, economic interests, and institutional pressure. This dynamic erodes the corrective function of formal law and undermines substantive justice. Although procedural justice may be achieved, public trust in the legal system continues to deteriorate, perpetuating a cycle of social anomie. The study concludes that effective anti-corruption efforts require not merely normative or positivist reforms, but also structural transformation in law enforcement and the reconstruction of social norms underpinning the moral legitimacy of law.

Abstract

The phenomenon of digital begging on the TikTok platform, the act of soliciting money or digital gifts through live streaming, has become a new socio-legal issue in Indonesia. This practice utilizes digital interactions to solicit donations by constructing emotional narratives and portraying difficult situations to garner sympathy. Although considered a form of social solidarity, this phenomenon also raises concerns regarding individual exploitation, the degradation of social values, and the misuse of technology. This study aims to analyze the perpetrators' motivations, public responses, and the social and legal impacts of this phenomenon. Using descriptive qualitative methods and a content analysis approach, this study collected data through video observation and literature review. The analysis focused on communication patterns, themes raised, and interactions between perpetrators and audiences. The results show that Digital Begging has received a variety of responses, ranging from support as a creative outlet to criticism as a form of exploitation that normalizes unproductive behavior, potential fraud, and public manipulation. From a sociological perspective, regulations related to this practice remain unclear, creating gaps in the supervision and protection of minors and the elderly. In conclusion, this phenomenon reflects changing social dynamics in the digital era.

Abstract

High-interest loan agreements are increasingly prevalent in society through formal and informal institutions, including online loans and loan sharks. While providing quick access to capital, this practice often creates economic inequality, increases debt risk, and worsens the socio-economic conditions of borrowers, particularly vulnerable groups. A sociological analysis of law is relevant to examining the relationship between law, economic practices, and social structures in the power relations between lenders and borrowers. This study uses Karl Marx's conflict theory to examine power dynamics, where lenders, as the bourgeoisie, exploit their economic position, while borrowers, as the proletariat, are subordinated due to limited access to information, capital, and financing alternatives. The study's results indicate that high-interest loans have the potential to become a means of exploitation, reinforcing bourgeois dominance and widening socio-economic inequality. Therefore, it is recommended to strengthen regulations on interest rates and oversight of illegal loans, improve financial literacy among vulnerable communities, and implement fair and transparent consumer protection to achieve more equitable and sustainable lending practices.
