Abstract

The surveillance system in correctional institutions plays an important role in suppressing drug trafficking, given that around 40% of drug abuse cases in Indonesia occurred in prisons and detention centres in 2023. This study analyses the effectiveness of surveillance and law enforcement and identifies the main challenges in eradicating drug abuse. The methods used were literature review and secondary data analysis from official government reports. The findings show that manual surveillance is still prone to collusion, while the use of technology such as CCTV, electronic monitoring, and sniffer dogs can reduce smuggling by up to 25% in priority prisons. The main obstacles include budget and infrastructure limitations, especially in class II and III prisons. Inter-agency synergy has proven to increase effectiveness, with more than 150 narcotics cases uncovered throughout 2023, while a rehabilitative approach has reduced recidivism by up to 15%. This study recommends strengthening regulations, increasing human resource capacity, and integrating technology and intelligence as sustainable strategies to eradicate narcotics in prisons.

Abstract

Restorative justice is an important approach in handling cases of drug abuse by children as an alternative to the repressive judicial system. This study analyses the effectiveness of its application in rehabilitation, education, and social reintegration, as well as identifying obstacles in the field through literature review and secondary data. The results show that diversion mechanisms and community-based rehabilitation programmes can reduce recidivism and social stigma. However, their implementation is still hampered by a lack of rehabilitation facilities, insufficient training for officials, and social stigma. Restorative justice has proven to be relevant for child protection, but requires stronger regulations, increased human resource capacity, and cross-sector collaboration to achieve sustainable results.

Abstract

This study aims to analyze the legal status of interfaith marriage in the perspective of Indonesia's positive law. This research uses normative legal research methods with legislative and conceptual approaches. Data were obtained through literature studies of laws and regulations, court decisions, and legal literature relevant to the issue of interfaith marriage. The results of the study show that Indonesia's positive law in principle does not recognize interfaith marriage. Law Number 1 of 1974 concerning Marriage emphasizes that the validity of marriage is determined by the laws of each religion, so interfaith marriage cannot be carried out if it is contrary to religious provisions. Although there is a practice of registering interfaith marriages through court orders or carried out abroad, it creates legal uncertainty and differences in interpretation in its application. This study concludes that the status of interfaith marriage in Indonesia's positive law is still within the area of strict legal restrictions in order to maintain legal order and certainty of marital status. Therefore, consistency in law enforcement and clarity of regulations are needed so that there is no dualism of practice and interpretation of the law in the community.

Abstract

Pemalsuan ijazah merupakan salah satu bentuk tindak pidana yang mengancam integritas sistem pendidikan. Ijazah, yang seharusnya berfungsi sebagai bukti autentik atas capaian akademik, kerap disalahgunakan untuk memperoleh keuntungan pribadi, termasuk dalam proses rekrutmen pekerjaan maupun penerimaan anggota kepolisian. Penelitian ini menyoroti salah satu kasus pemalsuan ijazah yang dilakukan oleh seorang oknum kepala sekolah sebagaimana termuat dalam Putusan Nomor 1093/Pid.B/2023/PN Tjk. Tujuan penelitian ini adalah untuk mengkaji bentuk pertanggungjawaban pidana terhadap pelaku serta menganalisis dasar pertimbangan hakim dalam menjatuhkan putusan. Metode yang digunakan merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Data penelitian dihimpun melalui studi kepustakaan yang meliputi peraturan perundang-undangan, literatur hukum, serta putusan pengadilan yang relevan. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana terhadap terdakwa didasarkan pada asas kesalahan, di mana terdakwa dengan sadar dan tanpa adanya paksaan melakukan tindak pidana pemalsuan ijazah. Atas dasar tersebut, hakim menjatuhkan pidana penjara selama 5 (lima) bulan. Perbuatan terdakwa telah menimbulkan kerugian moral dan sistemik bagi dunia pendidikan serta merusak integritas proses seleksi anggota Polri. Oleh karena itu, pidana yang dijatuhkan dinilai masih tergolong ringan jika dibandingkan dengan dampak yang ditimbulkan.

Abstract

Fenomena pinjaman online (pinjol) ilegal menimbulkan berbagai persoalan hukum dan sosial, terutama bagi masyarakat pedesaan yang memiliki literasi hukum dan digital yang rendah. Praktik pinjol ilegal sering disertai bunga tinggi, penagihan tidak manusiawi, dan penyalahgunaan data pribadi. Meskipun perlindungan hukum telah diatur dalam Peraturan Otoritas Jasa Keuangan (POJK), Undang-Undang Perlindungan Konsumen, dan Undang-Undang Pelindungan Data Pribadi, implementasinya belum efektif karena minimnya edukasi hukum di masyarakat. Kegiatan pengabdian ini bertujuan untuk meningkatkan kesadaran hukum masyarakat Dusun Tanjung Senang, Desa Merak Batin, Kecamatan Natar, Kabupaten Lampung Selatan agar mampu mengenali dan menghindari risiko pinjol ilegal. Metode yang digunakan adalah pendekatan edukatif dan partisipatif melalui sosialisasi hukum, diskusi interaktif, dan kuesioner evaluatif yang melibatkan aparat desa dan kelompok ibu-ibu sebagai peserta utama. Hasil kegiatan menunjukkan peningkatan pemahaman hukum sebesar 85%, terutama dalam kemampuan peserta mengidentifikasi pinjol ilegal dan memahami mekanisme pengaduan ke OJK serta aparat penegak hukum. Peserta juga menunjukkan antusiasme tinggi dan komitmen untuk menyebarkan informasi kepada masyarakat sekitar. Kegiatan ini berhasil meningkatkan literasi hukum dan digital masyarakat desa serta memperkuat kesadaran kolektif dalam menghadapi praktik keuangan ilegal berbasis teknologi. Dengan demikian, kegiatan ini berkontribusi nyata terhadap upaya mitigasi risiko hukum dan sosial akibat pinjol ilegal secara berkelanjutan.

Abstract

Criminal acts may occur concurrently (concursus), as seen in cases combining the falsification of marital status and domestic neglect. This study examines the judicial considerations in sentencing perpetrators of concursus delicti between the crime of falsifying marital status and domestic neglect, as reflected in Decision No. 287/Pid.B/2023/PN.Mgl, and evaluates whether the imposed sentence fulfills the principle of justice. This research employs a normative legal method using statute and conceptual approaches, with data collected through literature studies comprising primary, secondary, and tertiary legal materials. The analysis was conducted qualitatively to interpret legal norms and judicial reasoning. The findings reveal that the judges based their decisions on juridical, philosophical, and sociological considerations, reflecting efforts to achieve fairness for both the perpetrator and the victim. The three-year imprisonment sentence was deemed proportionate, balancing deterrence and rehabilitation. However, justice for the victim remains incomplete due to the absence of explicit legal provisions on compensation for victims of domestic neglect. The study concludes that future sentencing should not only ensure legal certainty but also emphasize restorative and victim-oriented justice within Indonesia’s criminal justice system.

Abstract

Bankruptcy law is fundamentally designed as an ultimum remedium due to its severe legal and economic consequences for debtors, creditors, and broader market stability. However, Indonesian bankruptcy law continues to rely on minimal formal requirements, which may facilitate the misuse of bankruptcy petitions against solvent debtors. This article examines how the principle of ultimum remedium and proportionality has been operationalized in judicial practice through Indonesian Supreme Court Decision No. 1714 K/Pdt.Sus-Pailit/2022. Using a normative legal approach combined with jurisprudential analysis, this study evaluates the Court’s reasoning in limiting bankruptcy despite the formal statutory requirements being satisfied. The analysis is complemented by a comparative perspective with involuntary bankruptcy regimes in the United States and the rehabilitative-oriented insolvency framework in Singapore. The findings demonstrate a judicial shift from formalistic application toward substantive justice, emphasizing economic impact, proportionality, and the availability of non-bankruptcy alternatives. This development signifies an emerging judicial constraint on bankruptcy as a last resort and provides a normative foundation for future reform of Indonesian bankruptcy law.
