Abstract

This study examines the compliance and accountability of the Agus Salim digital donation campaign about Minister of Social Affairs Regulation Number 8 of 2021. Employing a normative juridical approach, the research analyzes legal provisions and evaluates the campaign's adherence to regulatory requirements, focusing on permit acquisition, transparency, and reporting obligations. The findings reveal partial compliance, highlighting challenges such as delayed permit approval, insufficient financial transparency, and gaps in reporting mechanisms. The study also identifies limitations in the regulatory framework, including enforcement difficulties and the absence of digital-specific guidelines. These results underscore the need for revised regulations and enhanced accountability measures to ensure the ethical and effective operation of digital donation campaigns in Indonesia.

Abstract

This study examines the impact of fiscal policy on economic growth in developing countries, emphasizing the role of government expenditures and tax policies in shaping economic outcomes. The findings indicate a strong positive relationship between fiscal policy and economic growth, where government spending and tax measures significantly contribute to enhancing economic performance. Specifically, the study reveals that well-structured fiscal policies can effectively promote growth, with key fiscal tools such as public investment and tax reforms playing a vital role. The results suggest that developing countries can achieve higher economic growth by implementing strategic fiscal measures, which can address structural challenges and encourage sustainable development. The research provides essential insights for policymakers to design more efficient fiscal policies that foster long-term economic stability and growth.

Abstract

This research examines the role of Dayak customary law in environmental conservation, focusing on sustainable natural resource management. It explores how practices such as land-use restrictions, sacred forest protection, and conservation rituals contribute to ecosystem preservation. The study also identifies conflicts between customary law and national policies, particularly regarding land tenure and resource exploitation by industries. Using a normative legal approach, the research analyzes Indonesia’s legal framework, including the 1945 Constitution, the Forestry Law, and the Environmental Protection Law. Through case studies in Kalimantan, the study highlights the effectiveness of these practices in conserving the environment. The findings indicate that while customary law plays a crucial role in conservation, its potential is hindered by insufficient recognition and alignment with national laws. The study recommends enhancing the formal recognition of customary law through clearer legal frameworks, improving collaboration with local governments, and providing capacity-building programs for indigenous communities to ensure sustainable resource management.

Abstract

Introduction: Unauthorized transfer of trade secrets can harm the owner, cause financial loss, damage reputation and trigger legal action. In the era of globalization and technology, the transfer of trade secrets is increasingly urgent to be legally regulated. Legislation has been implemented in various countries to protect trade secrets, but the legal consequences vary. The repercussions involve financial loss, reputation, legal action and ethical business considerations.Purposes of the Research:  The purpose of this study is to investigate and analyze the process of identifying and handling the transfer of trade secrets under the hand in Indonesian legal practice. This study also aims to understand the legal consequences that apply to the perpetrators of private transfer of trade secrets in the Indonesian legal system. Methods of the Research: This research uses normative legal research methods to analyze statutory regulations, court decisions, and legal literature related to the private transfer of trade secrets. A statutory approach helps understand the applicable legal framework. Data sources include various legal documents and legal literature, with data collection techniques focusing on document analysis and literature study. Data analysis involves identifying trends and legal implications of cases related to private transfer of trade secrets in the Indonesian legal context.Results of the Research: The process of identifying and handling illegal transfers of trade secrets in Indonesia is an important step in protecting business and industry. It covers the steps from identification to prosecution, with reference to regulations such as the Trade Secret Act. Trade secrets must be confidential and have economic value. Prevention through internal security policies and employee training is also necessary. Perpetrators of the transfer of trade secrets may face civil, criminal and administrative actions in accordance with applicable law, with consequences including criminal sanctions, demands for compensation and confiscation of goods or documents. Protection is also given to whistleblowers in good faith. Internal policies, nondisclosure agreements, and consulting legal advisors are important for protecting trade secrets. All parties must understand and comply with the law to maintain business integrity in Indonesia.

Abstract

The digital industry has witnessed rapid growth, powered by innovative start-ups that drive change and transformation. In the bustling digital landscape of Bandung City, these start-ups face a multitude of challenges ranging from market uncertainties to resource limitations. This qualitative study explores how digital start-ups in Bandung City navigate these challenges through adaptation and innovation strategies. Through in-depth interviews and thematic analysis, this research sheds light on the dynamic strategies that enable these start-ups to thrive and remain competitive in the ever-evolving digital ecosystem. The findings offer practical insights for founders and decision-makers while enriching the theoretical understanding of adaptation and innovation within a localized context.

Abstract

This study aims to uncover the secrets of strategic business planning of startups in West Java, Indonesia, and its relationship with sustainable growth and competitive advantage. Through quantitative analysis of survey data from various startups, this study investigates the relationship between strategic planning practices, resource allocation, sustainable growth, and competitive advantage. The findings show that strategic planning practices and resource allocation are significantly correlated with sustainable growth and competitive advantage. These insights contribute to a deeper understanding of the dynamics of startups in the entrepreneurial ecosystem in West Java, providing valuable guidance for startups, policymakers, investors, and academics.

Abstract

Background: As digital platforms evolve, consumer privacy concerns related to online data breaches have risen. Companies are increasingly held responsible for the protection of consumer data. The need to assess corporate responsibility in such violations is critical for consumer trust and regulatory frameworks. Objective: This study aims to explore the extent of corporate responsibility in online consumer data privacy violations and the legal and ethical implications for businesses involved. Method: A qualitative research design was adopted, utilizing a case study approach. Relevant case law and reports of data breaches were analyzed to assess how companies manage their data privacy policies and how these are reflected in their accountability for breaches. Results: Findings reveal that while corporations acknowledge the importance of consumer data privacy, there are significant gaps in their implementation of security measures. Legal frameworks often fail to hold companies accountable for breaches, relying instead on self-regulation and fines that are not always sufficient to deter negligence. Conclusion: Corporate responsibility for online data privacy violations requires stronger legal frameworks and stricter enforcement of data protection measures. It is essential for businesses to adopt comprehensive privacy policies and ensure compliance with emerging global standards.

Abstract

Background: The rise of blockchain technology has led to the development of smart contracts, which are self-executing contracts with the terms of the agreement directly written into code. While they promise enhanced efficiency, security, and automation, the legal implications of smart contracts on conventional contract law remain largely underexplored. The advent of these digital contracts challenges traditional legal frameworks and calls for a reassessment of existing contract law principles. Objective: This study aims to analyze the implications of smart contracts for conventional contract law, focusing on the legal, ethical, and practical challenges they present. The research seeks to evaluate how smart contracts align with or diverge from traditional contract principles such as offer, acceptance, and enforceability. Method: A qualitative research approach was employed, utilizing a comprehensive literature review and case law analysis to explore the intersection of smart contracts and conventional contract law. Interviews with legal experts and blockchain developers were also conducted to gather insights on real-world applications. Results: The findings reveal that while smart contracts offer substantial benefits in terms of automation and security, they also raise issues related to ambiguity, legal recognition, and the need for updated regulations. The study identifies a gap in existing legal frameworks regarding the enforceability of smart contracts. Conclusion: Smart contracts have significant potential to revolutionize contract law, but their integration into conventional legal systems requires substantial legal reform and adaptation. Further research is needed to establish clear regulatory standards.

Abstract

Background: Government policies play a significant role in shaping the investment climate and, consequently, in driving economic growth. Policies aimed at stimulating investments—such as fiscal incentives, tax policies, and infrastructure development—can significantly influence the flow of capital into various sectors, fostering economic activity and job creation. Conversely, restrictive policies or regulatory inefficiencies can stifle investment and hinder economic development. Understanding the implications of these policies is crucial for policymakers and businesses seeking to maximize economic growth potential. Objective: This study aims to evaluate the impact of government policies on investment decisions and their subsequent effect on economic growth. The research seeks to identify the key policy factors that drive or hinder investment flows and assess their broader implications for long-term economic performance. Method: A mixed-methods approach was employed, utilizing quantitative data analysis of economic indicators and investment flows from government reports, along with qualitative interviews from business leaders and policymakers. The study examines a range of countries with varying policy environments to identify common trends and impacts. Results: The findings suggest that pro-investment policies significantly boost both domestic and foreign investment, leading to higher economic growth rates. In contrast, restrictive policies and regulatory uncertainties were found to negatively impact economic performance. Conclusion: The study concludes that effective government policies are essential for fostering investment and driving sustainable economic growth. Policymakers should prioritize creating stable, investment-friendly environments to achieve long-term economic benefits.
