Abstract

This research study conducts a comprehensive bibliometric analysis of the literature on sustainability and corporate social responsibility (CSR) within the context of digital platform companies. The analysis aims to uncover trends, gaps, and key contributors in this evolving intersection. By employing VOSviewer, a specialized bibliometric analysis tool, the study examines co-authorship networks, keyword co-occurrence, citation patterns, and publication trends. The findings shed light on the collaborative landscape, prevalent themes, influential works, and evolving research activity. The study's implications extend to academia, industry, and policy, guiding further research, informing business strategies, and fostering responsible practices in the digital economy.

Abstract

Trade secret is one of the intellectual property that must be protected. This relates to the existence of a company whose economic activities are based on trade secrets. Problems related to trade secrets are trade secret violations which are only formulated as violations of positive law provisions. In fact, in the era of modern business development there is a potential for violations of trade secrets that have not been accommodated by positive law. This study aims to analyze as well as construct aspects of a violation of decency as a form of violation of trade secrets. This research is a normative legal research that uses a concept, case, and statutory approach. The results of the study confirm that the orientation of a violation of decency as a form of trade secret violation can be carried out through extensive interpretation related to expanding the meaning of "laws and regulations" which has a broader meaning, namely "in accordance with legal provisions". There are two orientations of legal construction, namely short term and long term. The orientation of short-term legal construction is carried out by expanding the meaning of violating trade secrets not only contrary to positive law, but also including violations of decency that develop in society. The long-term orientation is that it is necessary to revise the provisions of trade secret law in order to keep abreast of developments in the growing business world.

Abstract

This research delves into the multifaceted landscape of intellectual property protection within the Indonesian creative industries. Through qualitative analysis, interviews with 10 key informants elucidated the challenges faced by businesses, including rampant piracy, inadequacies in legal frameworks, and enforcement issues. Businesses responded with diverse legal strategies, encompassing copyright protection, trademark registration, industry collaboration, and technological solutions. Case studies provided tangible examples, showcasing the effectiveness and challenges of these strategies. Recommendations for legislative reforms, strengthened enforcement mechanisms, industry collaboration, and technological innovation are proposed. This research contributes valuable insights into the dynamic interplay between legal challenges and strategic responses in safeguarding intellectual property within the vibrant Indonesian creative industries.

It emphasizes the significance of global strategies, government policies, and private sector involvement in promoting sustainability. However, challenges such as economic hurdles, social barriers, and environmental constraints hinder progress. Future research should focus on addressing these challenges and embracing comprehensive frameworks to ensure a sustainable and prosperous future.

The concept of economic resilience is multidimensional, encompassing factors like resistance, recovery, and adaptability to mitigate the impact of economic shocks. Drawing from various disciplines, theoretical frameworks highlight its interdisciplinary nature. Economic resilience plays a crucial role in responding to crises, with entrepreneurship emerging as a key component. Despite challenges such as resource constraints and regulatory barriers, proactive policies can foster resilient entrepreneurship. By promoting innovation, supporting access to capital, and enhancing entrepreneurial education, policymakers can build a resilient ecosystem that drives economic prosperity and sustainability. Collaboration among stakeholders is vital for realizing this vision.

Abstract

Collaboration between fintech companies and traditional banks is important for the evolution of the financial industry. Factors influencing fintech adoption by conventional banks include organizational culture, management attitudes and leadership. Understanding these factors is important for banks to remain competitive. Challenges to adoption include regulatory uncertainty, resource limitations, and data security issues, while opportunities include increased operational efficiency and greater consumer engagement. Factors influencing adoption also include technology sustainability, IT infrastructure, financial capabilities, human resources, government regulations, market changes, consumer behavior, industry competition, and strategic partnerships. Overcoming challenges such as cyber security risks and regulatory barriers, as well as capitalizing on opportunities through strategic partnerships and understanding consumer behavior, can drive successful fintech adoption for traditional banks.

Abstract

In the era of digital transformation, one prominent model of Fintech is Peer-to-Peer (P2P) lending, which offers alternative financing access through digital platforms. The protection of personal data in P2P lending becomes crucial as sensitive information such as financial and credit history is collected and processed by these platforms. Data protection regulations, like GDPR, play a vital role in maintaining the balance between Fintech innovation and individual privacy rights. This research aims to discuss the legal protection of personal data within the context of Peer-to-Peer (P2P) Lending in the realm of Financial Technology (Fintech) in Indonesia. The research methodology employed is normative law, using descriptive legal analysis. Data is gathered from various sources, including legal statutes, court decisions, legal literature, and government guidelines related to Fintech and personal data protection. Qualitative analysis is conducted to identify relevant legal provisions, explain their legal implications, and formulate improvement recommendations. The research findings reveal that personal data protection within Indonesian Fintech P2P Lending is governed by a range of regulations, including the Electronic Information and Transactions Law (UU ITE), the amended UU ITE, OJK regulations, and the Ministry of Communication and Informatics regulations. Moreover, the Omnibus Law on Job Creation provides a strong foundation for the protection of consumer personal data. Abstract

The study employs descriptive-analytical methods to examine the relevant laws and enforcement practices. It views the RESD as an emerging norm through a constructivist lens, influencing both the host countries and the global normative framework. The research finds a growing momentum to revise BIT clauses to better reflect dynamic RESD principles and social responsibility. This involves moving away from focusing solely on unilateral power. The study proposes a new model for RESD, aimed at promoting good governance and fairness in administrative processes. This model will be vital for renegotiating or redesigning BIT provisions, particularly for countries like Indonesia. By explaining the acronyms and simplifying the sentences, the key points become clearer: the need for a balanced approach in BIT negotiations, the role of RESD in this balance, and the potential for revised treaty clauses to better align with principles of social justice and fairness.

Abstract

The application of the principles of dignified justice and Human Rights (HAM) in business contract law in Indonesia has a very important role in creating economic growth that brings prosperity to all parties. Dignified justice must be carried out by the parties to the agreement so that the objectives of the agreed agreement can be achieved properly. The increasingly complex business contracts often reveal an imbalance in the fulfillment of rights between the parties involved. This situation can result in violations of the principles of justice and human rights, especially for parties whose position is weaker in an agreement, resulting in quite a few business disputes resulting from business agreements that have been made. Therefore, business law has a very important role in safeguarding and protecting the interests of the parties in business agreements. This journal aims to explain the importance of the principle of dignified justice in creating balance between the parties to an agreement, explain the role of human rights as a basis for protecting the fundamental rights of the parties to an agreement, and to identify challenges in implementing the principles of dignified justice and human rights in improving the quality of business agreements in Indonesia

Abstract

Abstract There are several things that can affect employee job satisfaction in a company such as motivation given by colleagues and superiors, compensation for completing work and certain targets, and strengthened by the commitment that exists in the employees themselves. This study aims to examine the effect of motivation and compensation on job satisfaction with commitment as a moderating variable. This research is a quantitative research with an explanatory approach that uses primary data on Bank BCA employees with a minimum criteria of having worked for more than one year spread throughout the islands of Indonesia as many as 250 people. Data is distributed through questionnaires and analyzed using smart PLS 3.0. The research results show that motivation and compensation have a positive and significant effect on job satisfaction. Interestingly, after being moderated by the commitment variable, the effect of compensation and motivation on job satisfaction is increasingly significant.
