Abstract

This article analyzes the prohibition of money duplication as stipulated in Article 378 of the Indonesian Criminal Code (Kitab Undang-Undang Hukum Pidana) and the perspective of a hadith narrated by Muslim. The research aims to gain insights into the conception of this prohibition in the context of criminal law and the Islamic religious view. A normative research method is employed, which involves examining available legal sources. The legal sources used include primary legal sources based on Article 378 of the Criminal Code and Islamic legal sources, namely the hadith narrated by Muslim. Secondary legal sources obtained from journals, books, and supporting documents are also utilized. The analysis indicates that Article 378 of the Criminal Code prohibits actions of money duplication involving manipulation or fraud to obtain unlawful profits. This article provides a more comprehensive understanding of the prohibition of money duplication from the perspectives of criminal law and Islam.

Abstract

The existence of the sanad in a hadith occupies a crucial position. This is because a hadith is said to be authentic if the line of transmission and the transmitter (narrator) are free from defects. The narrators here become one of the the influential ones in bringing the hadith to a high degree by looking based on intellectual andbehavioral credibility. Intellectuality is a measurable aspects, but every hadith scholar has varied criteria and methods in determining the credibility of a narrator. Imam Ahmad, as one of the leading scholars in the tradition of hadith, has a structured approach in assessing narrators who narrate traditions that are the basis of religious teachings. This article discusses and reviews in detail how Imam Ahmad ibn Hanbal assesses the intellectual credibility of hadith narrators. This research uses a qualitative method with an analytical descriptive approach and data collection techniques in the form of library research. The results of this study found that the methodology used by Imam Ahmad bin Hanbal reflects wisdom, justice and balance in assessing the credibility of narrators. The method used by Imam Ahmad covers various aspects including the testimony of scholars, the compatibility of the narration with the narration of other reliable narrators, and the assessment based on the frequency of the narrator’s mistakes as well as the emphasis on written records and strong memorization also characterize Imam Ahmad’s methodology. This article provides an in-depth insight into Imam Ahmad’s approach in assessing the intellectual credibility of hadith narrators and serves as areference in the future development of evaluation in the study of hadith narration.

Abstract

Employee assessment is an important aspect of human resource management that requires a comprehensive approach to measuring their performance and contribution to the company. This article aims to explain the concept of jarh wa ta'dil in the science of hadith and how this concept can be applied in the context of employee assessment in modern management. By integrating the ethical values and justice of jarh wa ta'dil, companies can develop a more holistic and value-based approach to judgment. This research uses qualitative methods with a literature study approach by applying descriptive-analytical methods. The results of the research show that there is a correlation between the principles of jahr wa ta'dil with those of the ideal employee judgment. Principles such as justice, equity, and accuracy jhr wa'dil aligned with the ideals of the employee’s judgement such as objectivity, transparency, and accountability.

Abstract

This study examines the influence of the science of jarh wa ta'dil in determining the validity of qunut hadith for every subuh prayer in the Shafi'i school of thought. This study investigates how Shafi'i scholars apply the science of jarh wa ta'dil to assess the validity and authenticity of hadith and provide recommendations for Muslims in responding to qunut subuh hadith. This study uses a qualitative method with a descriptive-analytic approach. Data is collected from relevant books, scientific journals, and online articles. Data analysis is carried out using content analysis methods. The results of the author's research find that the science of Jarh wa ta'dil plays a very important role for Shafi'i scholars in particular and generally for all scholars of madhhab in assessing the credibility of a sanad matan, such as analyzing the behavior of hadith narrators, piety, honesty, even more specifically such as from the quality of the narrator's memorization, and the author found that the hadiths that were used as arguments for qunut subuh by the Shafi'i madhhab could be used as hujjah, Based on the results of the study, it is concluded that a hadith nash can be used as the basis for a religious law when it is at the level of maqbul hadith, at least hasan ligoiri, and for qunut hadith in the Shafi'i school of thought it is classified as maqbul hadith so it can be used as evidence for its implementation.

Abstract

This research aims to understand the relationship (correlation) of the hadith science Riwayah wa al-Diroyah with the branch of hadith science, Al-Jarhu wa al-Ta'dil globally, as well as how these two sciences are reflected in sociolinguistic aspects. This study analyzes the hadith science of al-Riwayah wa al-Diroyah and its relationship with the branch of hadith science Al-Jarhu wa al-Ta'dil, by paying attention to linguistic and sociological aspects from a sociolinguistic perspective. This research methodology uses qualitative methods with data collection techniques and literature study. The data used is primary data sourced from discussions about Riwayah wa Diroyah and Al-Jarhu wa Ta'dil which are exemplified in the field of ulumul hadith, and secondary data uses books, research reports, journal articles and other scientific papers. In fact, the hadith sciences Riwayah wa Diroyah and Al-Jarhu wa at-ta'dil are Islamic sciences that have existed since the time the Prophet Muhammad was still alive and are the core of Islamic scientific heritage to this day, while Al-Jarhu wa Ta'dil is a branch of science. hadith relating to the validity of the hadith narrator.

Abstract

Al-Jarh wat Ta’dil is an important field in hadith studies that provides information about the conditions of hadith narrators based on critiques by critical scholars. These critiques follow a hierarchical structure, with shaduq being a level two endorsement after tsiqat. Despite being an endorsement, a narration from a shaduq narrator is not accepted outright and requires further scrutiny. This research analyzes the acceptance status of narrations from shaduq narrators according to critical scholars. It critically examines the case of the shaduq narrator named ar-Rabi bin Anas and investigates the reception status of his narrations. The methodology employed is qualitative with a descriptive-analytical approach, using references such as al-Jarh wat-Ta’dil literature, mustalah hadith, hadith collections, relevant books, and journals. The study demonstrates that among shaduq narrators, some receive negative critiques leading to partial rejection of their narrations. Furthermore, it shows that narrations from shaduq like ar-Rabi bin Anas are rejected if: First, they have negative critiques from scholars supported by indications after comparison with parallel narrations. Second, their hadiths are transmitted by problematic disciples; in ar-Rabi's case, his problematic disciple is Abu Ja’far ar-Razi, and the narration by this disciple occurs in isolation.

Abstract

Rijal books play an essential role in hadith studies by providing detailed information on the biographies and evaluations of hadith narrators. Through this literature, hadith scholars can assess the reliability and credibility of narrators, which helps determine the authenticity of the hadiths they transmit. This article explores the methodology in rijal books, their relevance in contemporary hadith studies, and the challenges they face in the modern context. The methodologies used include sanad criticism, compiling the biographies of narrators, and evaluating reputations based on scholars' testimonies. Sanad criticism ensures the continuity and trustworthiness of the transmission chain, while narrator biographies provide a comprehensive view of the narrators' lives, education, and activities. Reputation evaluation gathers opinions from scholars who know the narrators. The use of rijal books remains relevant in hadith verification, sanad criticism, hadith education, and academic research. They also offer insights into the social, political, and cultural contexts of the narrators, which are crucial for interpreting hadiths in the modern context. However, there are several challenges in their use, including limited information, the influence of historical context, and the need to integrate modern methodologies. Digital technology offers broader access but also raises challenges of validity and reliability of information. Major rijal books such as Al-Tarikh al-Kabir by Imam al-Bukhari and Al-Jam'u Bayna Rijal al-Shahihayn by Ibn Qirani, as well as other works like Ushul al-Ghabah Fi Ma’rifatil Asma’is Shahabah and Al-Thabaqat al-Kubra, make significant contributions to hadith studies. By understanding the methodologies and challenges in using rijal books, we can better appreciate the complexity and importance of hadith studies in the Islamic tradition. These books remain an important reference for anyone wishing to delve into hadith science and ensure the authenticity and validity of hadith chains.

Abstract

This paper investigates the comparison between Jarh wa Ta'dil and modern Islamic studies in understanding the history of the Prophet Muhammad (PBUH). Utilizing the theory of Islamization of knowledge proposed by Raj Ismail al-Faruqi, the researcher seeks to find a middle ground between these two disciplines. The Islamization of knowledge aims to enrich Islamic scholarship by incorporating not only pure Islamic sciences but also modern knowledge. This involves strengthening modern sciences, problem-solving methods, understanding issues, and providing solutions. Jarh wa Ta'dil, which primarily focuses on the chain of narration (sanad), and modern Islamic studies, which dominate the study of the text (matan), can be synergized and made complementary. This would create a harmonious relationship between the two scholarly approaches. In essence, the historical study of Islam will be stronger through the discipline of Jarh wa Ta'dil, ensuring the credibility of transmission validity, while interpretation will be supported by modern Islamic studies. The conclusion is that there is no need to contradict the two approaches, but rather they can mutually reinforce each other. For example, in the case of Isra' Mi'raj, Jarh wa Ta'dil is necessary to obtain the complete narrative data, which can then be analyzed with modern scientific approaches to further develop and sharpen the understanding of this spectacular miracle.

Abstract

The development of Islamic Financial Institutions (LKS), particularly Islamic banks, in Indonesia has seen significant growth, especially following the enactment of Law No. 21 of 2008 on Islamic Banking and Supreme Court Regulation (PERMA) No. 2 of 2008 on Shariah Economic Dispute Resolution. With the increasing number of institutions operating based on Shariah principles, various new issues related to Shariah compliance have arisen.Fatwas issued by the DSN-MUI hold legal authority in determining Shariah aspects in the economy, including banking. On the other hand, Shariah Economic Dispute Resolution (KHES) plays a role as a social control tool to manage practices not compliant with Islamic commercial law, especially in economics. This research, a descriptive qualitative study with a normative sociological approach, utilizes codified legal sources like KHES and DSN-MUI fatwas. The results suggest that, from a sociological perspective, KHES was developed as a response to the evolving landscape of Shariah economic practices requiring a legal framework. Stakeholders in Shariah economics and finance are expected to actively contribute to its improvement. DSN-MUI fatwas, in a social context, provide a solution for addressing non-compliant financial institutions, reconciling differences among scholars, and promoting Islamic principles in economics and finance.
