Abstract

This study aims to determine the relevance of Article 1 of The Universal Declaration of Human Rights which guarantees freedom, dignity and equal rights between human individuals from the perspective of Islamic Law which came with the vision of rahmatan lil 'alamin through the Prophet Muhammad Shallahu 'Alaihi Wasallam. The method used in this research uses a descriptive analysis method with a normative juridical approach and uses qualitative data types in the form of secondary data consisting of primary, secondary, and tertiary legal materials with data collection techniques through literature studies and content analysis techniques. This research concludes that there is a significant relevance where Islamic Law greatly strengthens and provides hujjah to the clause of gender equality position between individuals that has been formulated in Article 1 of The Universal Declaration of Human Rights. So the existence of several differences in concepts between men and women in the perspective of Islamic Law is not a discrimination against certain genders, the existence of these differences has placed each gender in a noble position based on its characteristics as conceptualized by Islamic law.

Abstract

Ideally, every individual holds a balanced responsibility toward their rights and legal freedoms, as guided by Islamic Fiqh and the Universal Declaration of Human Rights (UDHR). However, in reality, imbalances between the exercise of rights and responsibilities often occur, both in social and legal contexts. This study aims to analyze the concept of individual responsibility toward rights and legal freedoms from the perspectives of Islamic Fiqh and the UDHR, as well as to identify the common ground between these two perspectives. This article falls under normative research with a qualitative approach, utilizing analysis of relevant primary and secondary literature. The findings reveal that both Islamic Fiqh and the UDHR emphasize a balance between rights and responsibilities, although differences exist in principles and contexts of application. These findings underscore the importance of harmonizing Islamic legal principles and universal norms to achieve social justice.

Abstract

This study aims to analyze the strength of Maqashidu al-Syari'ah (MS) in mediation regulations and their application in the process of mediation for inheritance disputes in the Religious Courts. This research applies descriptive analytical method; data were collected by doing observation, indepth interview with mediators, documentation and literature study, then data analysis techniques were used to analyze it. The findings of this study show that MS's spirit in the Perma of Mediation Procedure in Court is very strong. However, However, the MS spirit contained in the Perma has not been successfully implemented in mediation in Religious Courts. The results of this research imply the necessity for mediators to master the MS and its spirit contained in the Perma on Mediation Procedures in Court well and apply it in mediation.Penelitian ini bertujuan menganalisis kekuatan semangat Maqashidu al-Syari'ah (MS) dalam Perma No. 1 Tahun 2016 tentang Mediasi dan penerapannya dalam upaya perdamaian sengketa waris di Pengadilan Agama (PA). Metode deskriptif analisis diterapkan dalam penelitian ini; data dikumpulkan dengan observasi, wawancara mendalam dengan mediator, studi dokumentasi dan studi literatur, lalu data dianalisis dengan mengaplikasikan teknik kualitatif. Penelitian menunjukkan ruh MS dalam Perma tentang Mediasi di Pengadilan sangat kuat. Namun semangat MS yang terdapat dalam Perma itu belum berhasil diterapkan dengan baik dalam mediasi di PA. Hasil penelitian ini mengimplikasikan keharusan bagi para mediator untuk menguasai MS dan semangatnya yang ada dalam Perma tentang Mediasi di Pengadilan dengan baik dan menerapkannya dalam proses mediasi.

Abstract

Ideally, Article 5 of the Universal Declaration of Human Rights (UDHR), which prohibits torture, inhuman treatment, or degrading punishment, reflects universal principles that align with the values of justice, dignity protection, and the prohibition of cruel acts in the Qur’an. However, in reality, the implementation of these values often faces challenges both in the global context and in the application of Islamic criminal law, both in classical and contemporary times. This study aims to analyze the relevance of Article 5 of the UDHR with the teachings of the Qur’an and examine the historical construction of Islamic criminal law in implementing these values. This article is classified as qualitative research based on library research, using a normative-historical approach. The methodology employed is content analysis. The study concludes two main points. First, there is significant relevance between Article 5 of the UDHR and the teachings of the Qur’an, particularly in the principles of human dignity protection, justice, and the prohibition of cruel acts. Second, the historical construction of Islamic criminal law shows that these principles have been gradually implemented in various contexts, from the time of the Prophet, the period of the Imams of the madhhab, to the modern era.

Abstract

Artikel ini bertujuan untuk menelaah relevansi Putusan Mahkamah Konstitusi No. 168/PUU-XXI/2023 dalam konteks pemenuhan hak hidup layak bagi pekerja sesuai Universal Declaration of Human Rights (UDHR). Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan analisis dokumen, yang mencakup kajian terhadap putusan MK, instrumen hukum internasional seperti UDHR, dan literatur akademik. Hasil penelitian menunjukkan bahwa meskipun putusan MK mempertegas aspek perlindungan hak pekerja, tantangan tetap muncul dalam implementasi kebijakan ketenagakerjaan. Di antara tantangan tersebut adalah fleksibilitas durasi PKWT, penghapusan batasan jenis pekerjaan outsourcing, serta ketidakjelasan dalam pengaturan upah minimum sektoral. Artikel ini merekomendasikan penguatan regulasi dan pengawasan untuk memastikan hak hidup layak pekerja sesuai prinsip UDHR dapat terpenuhi secara optimal.

Abstract

The crime of bribery and criminal acts of corruption are disgraceful acts related to abuse of position, discriminatory behavior by giving special privileges to someone based on receiving bribes or rewards, violating public trust so that democracy is damaged, damaging the mentality of officials in both the private corporate sector and the government sector, endanger the security of society at large, and cause competition in business to be flawed or unfair. Based on reports and surveys from GCB in 2020, the level of bribery practices in Indonesia was in the third highest position out of 17 Asian countries. The aim of this research is to determine bribery from the perspective of Law Number 11 of 1980 and based on the Hadith History of Ahmad. Researchers utilize a descriptive approach in qualitative research methods, using primary and secondary data as sources of information. Based on the Hadith perspective, Ahmad's history says that Allah SWT and the Prophet Muhammad SAW will curse the bribe recipients, bribe givers and intermediaries.

Abstract

Ideally, the right to associate and assemble, as guaranteed in Article 28E Paragraph 3 of the 1945 Constitution of Indonesia and Article 21 Paragraph 1 of the Universal Declaration of Human Rights (UDHR), provides freedom for individuals and groups to participate in social, political, and economic life. However, in reality, the implementation of this freedom still faces challenges, especially in the context of Islamic economics in Indonesia, where existing regulations sometimes limit the development of this sector. The aim of this research is to analyze the role of the right to associate and assemble in strengthening Islamic economic activities in Indonesia. This study uses a normative legal approach with qualitative analysis, focusing on secondary data from relevant literature and legal documents. The results of the study indicate that the right to associate and assemble plays a crucial role in strengthening Islamic economics. This freedom allows the formation of Islamic-based economic organizations that support the principles of justice and transparency. The implementation of this right, although hindered by several regulations that are less supportive, still provides a strong foundation for society to collaborate in the development of a more inclusive and just economy.

Abstract

This article analyzes the prohibition of money duplication as stipulated in Article 378 of the Indonesian Criminal Code (Kitab Undang-Undang Hukum Pidana) and the perspective of a hadith narrated by Muslim. The research aims to gain insights into the conception of this prohibition in the context of criminal law and the Islamic religious view. A normative research method is employed, which involves examining available legal sources. The legal sources used include primary legal sources based on Article 378 of the Criminal Code and Islamic legal sources, namely the hadith narrated by Muslim. Secondary legal sources obtained from journals, books, and supporting documents are also utilized. The analysis indicates that Article 378 of the Criminal Code prohibits actions of money duplication involving manipulation or fraud to obtain unlawful profits. This article provides a more comprehensive understanding of the prohibition of money duplication from the perspectives of criminal law and Islam.

Abstract

Al-Jarh wat Ta’dil is an important field in hadith studies that provides information about the conditions of hadith narrators based on critiques by critical scholars. These critiques follow a hierarchical structure, with shaduq being a level two endorsement after tsiqat. Despite being an endorsement, a narration from a shaduq narrator is not accepted outright and requires further scrutiny. This research analyzes the acceptance status of narrations from shaduq narrators according to critical scholars. It critically examines the case of the shaduq narrator named ar-Rabi bin Anas and investigates the reception status of his narrations. The methodology employed is qualitative with a descriptive-analytical approach, using references such as al-Jarh wat-Ta’dil literature, mustalah hadith, hadith collections, relevant books, and journals. The study demonstrates that among shaduq narrators, some receive negative critiques leading to partial rejection of their narrations. Furthermore, it shows that narrations from shaduq like ar-Rabi bin Anas are rejected if: First, they have negative critiques from scholars supported by indications after comparison with parallel narrations. Second, their hadiths are transmitted by problematic disciples; in ar-Rabi's case, his problematic disciple is Abu Ja’far ar-Razi, and the narration by this disciple occurs in isolation.

Abstract

The development of Islamic Financial Institutions (LKS), particularly Islamic banks, in Indonesia has seen significant growth, especially following the enactment of Law No. 21 of 2008 on Islamic Banking and Supreme Court Regulation (PERMA) No. 2 of 2008 on Shariah Economic Dispute Resolution. With the increasing number of institutions operating based on Shariah principles, various new issues related to Shariah compliance have arisen.Fatwas issued by the DSN-MUI hold legal authority in determining Shariah aspects in the economy, including banking. On the other hand, Shariah Economic Dispute Resolution (KHES) plays a role as a social control tool to manage practices not compliant with Islamic commercial law, especially in economics. This research, a descriptive qualitative study with a normative sociological approach, utilizes codified legal sources like KHES and DSN-MUI fatwas. The results suggest that, from a sociological perspective, KHES was developed as a response to the evolving landscape of Shariah economic practices requiring a legal framework. Stakeholders in Shariah economics and finance are expected to actively contribute to its improvement. DSN-MUI fatwas, in a social context, provide a solution for addressing non-compliant financial institutions, reconciling differences among scholars, and promoting Islamic principles in economics and finance.
