Abstract

This research is based on the fact that defamation is an important issue that affects the honor of individuals in various legal systems. This issue has far-reaching implications, both personally and socially, requiring a comprehensive approach to protecting individual rights. This research aims to analyze defamation from two legal perspectives, namely Islamic Law and Article 12 of the Universal Declaration of Human Rights (UDHR). This study uses a normative juridical approach with a descriptive analysis method. Data were collected through a literature review of relevant primary and secondary sources. Furthermore, the data was analyzed using qualitative data analysis techniques to explore the essence of legal protection in both perspectives. The results of the study show that both Islamic Law and Article 12 of the UDHR emphasize the importance of protecting the honor of individuals. However, Islamic law highlights more social and spiritual dimensions, such as the concept of maintaining honor as part of religious obligations. Meanwhile, the UDHR focuses on the protection of individual legal rights in the context of human rights. These findings indicate the need to integrate both approaches in the Indonesian legal system to provide more comprehensive and balanced protection against defamation cases. The implication of this research is to encourage legal policies that not only protect the rights of individuals but also pay attention to the typical moral and social aspects of Indonesian society.

Abstract

Abstract This study aims to discuss the spread of the issue of religious freedom in the context of Indonesian national law, especially through Article 28E of the 1945 Constitution, as well as the values of tolerance in Islam as reflected in the Hadith Narrated by Bukhori No. 39. The main purpose of this discussion is to evaluate the extent to which the state constitution and Islamic teachings provide support for the principles of freedom and tolerance between religions in a diverse society. Through normative juridical approaches and literature study methods, the results of the study show that religious freedom is part of human rights that are not only guaranteed by the constitution, but also supported by Islamic teachings that emphasize the importance of tolerance. Despite this, in practice, there are still several challenges, such as discriminatory treatment of minority groups and restrictions on the exercise of religious rights. Therefore, synergy is needed between the state's role and public awareness in creating a harmonious religious life, mutual respect, and respect for differences.

Abstract

This research is motivated by the fact that, in many cases, the assessment of a narrator is not always based on objective evidence, but also involves subjective interpretations by scholars. This raises questions about the standards of objectivity in the science of Rijal al-Hadith and to what extent subjectivity plays a role in evaluating narrators. The aim of this study is to explore and critically analyze the methodology used in Rijal al-Hadith. The research applies a descriptive-analytical approach, with data collected through literature study techniques. The data is then analyzed using qualitative data analysis techniques. The results of this study indicate the presence of subjectivity and complexity, especially related to differences in scholarly views on the credibility of narrators such as Al-Waqidi, which highlights the need for contextual understanding and variation in interpretation. Furthermore, Rijal al-Hadith also faces challenges in the context of modernity and social complexity, requiring an evaluation and updating of methodologies to make them more inclusive. The findings of this research imply the necessity of a holistic approach that considers social, cultural, and intellectual aspects, as well as the use of digital technology and interdisciplinary approaches to enhance the accuracy of narrator assessments.

Abstract

This study is motivated by the fact that numerous phenomena of living hadith exist within the context of Indonesian society, focusing on religious practices based on the hadith of Prophet Muhammad (peace be upon him). The study identifies various forms of living hadith, such as traditions, written and oral forms, as well as practices, and analyzes their impact on the socio-religious fabric of the community. Using phenomenology and the sociology of knowledge, this research reveals the significant role of living hadith in enriching social and cultural religious practices while also highlighting its potential to cause social tensions. The findings indicate the need for a comprehensive and multidisciplinary approach to understanding the dynamics of Islam in Indonesia, as well as the importance of interdisciplinary dialogue in the development of living hadith using qualitative and ethnographic approaches.

Abstract

This research is motivated by the importance of the historical approach in hadis studies to understand the context, background, and development of hadis transmission over time. This study aims to analyze the role of the historical approach in exploring the origins, authenticity, and validity of hadis through a chronological study. The research applies a historical approach, using literature review techniques and analysis of relevant hadis sources. Data is collected through the study of both classical and modern texts that discuss the process of hadis narration. Data is then analyzed using qualitative data analysis techniques with a narrative approach. The results of this study indicate that the historical approach allows for a deeper understanding of the political, social, and cultural factors influencing hadis transmission over time. The findings of this research imply the necessity of a more systematic method for assessing the authenticity and validity of hadis based on its historical and social context.

Abstract

The use of modern technology has brought significant transformations in various fields of science, including hadith research. Hadith as one of the main sources of Islamic teachings requires in-depth analyses to ensure its authenticity, validity and understanding. Modern technologies, such as big data, artificial intelligence (AI) and specialised software, allow researchers to access, organise and analyse hadith datasets more efficiently. This article discusses the application of technology in hadith research, ranging from manuscript digitisation, sanad and matan analysis, to the development of interactive hadith databases. By utilising these technologies, researchers can speed up the sanad verification process and detect patterns or anomalies in hadith texts. However, the application of modern technology also presents challenges, such as the interpretation of data that relies on specific algorithms and the need for adjustments to the traditional principles of musthalah hadith science. This study aims to explore the benefits, challenges, and future potential of the use of technology in hadith studies.

Abstract

Debt is one form of muamalah permitted in Islam. It serves as an economic activity conducted by individuals to fulfill their needs. Islam provides clear guidelines and laws regarding debt, including the obligation to repay debts on time. This study aims to discuss hadiths on debt, focusing on the legal ruling concerning delaying debt repayment by those capable of paying, with reference to Hadith Bukhari No. 2400. The study employs a descriptive-analytical approach by collecting data from hadith compilations, commentaries (syarh), classical and contemporary fiqh books, as well as scholarly journals. The analysis involves stages of takhrij, sanad criticism, matan criticism, and commentary (syarh) discussion. The findings reveal that the hadith is authentic (sahih) in terms of both sanad and matan, emphasizing the legal implication that delaying debt repayment without a valid reason constitutes an act of injustice. This research highlights the importance of timely debt repayment as a trust in Islam, contributing to the development of fiqh muamalah literature and supporting a fair and responsible Islamic legal system.

Abstract

Corruption constitutes a form of abuse of power that causes harm to the state and society. In Islam, trust (amanah) is a fundamental principle of leadership, as emphasized in the hadith of Abu Dzar (HR. Muslim No. 1825), which underscores that leadership is a great trust that can lead to disgrace for those who fail to fulfill it properly. In Indonesia, efforts to eradicate corruption are regulated by Law Number 31 of 1999 on the Eradication of Corruption Crimes, which imposes strict sanctions on perpetrators. This study aims to analyze the relevance of the concept of trust (amanah) as taught in the hadith to Indonesia’s positive law regulations in the context of combating corruption.

Abstract

This study aims to analyze the dynamics of syirkah and mudharabah from a sociological and anthropological perspective in the context of modern society. As two forms of business cooperation in Islamic economics, syirkah and mudharabah face challenges and changes due to social, economic, and cultural developments. This research employs a descriptive method by analyzing secondary data from relevant literature and documents to reveal how social structures and cultural norms influence the practice of syirkah and mudharabah. The findings suggest that changes in social relationships, cultural norms, and the global economic system significantly shape the adaptation of these concepts in the modern era. These insights are expected to contribute to the development of Sharia-based economic collaborations that are more responsive to modern social and cultural dynamics.

Abstract

Sukuk Sukuk has become an important Islamic financial instrument in Indonesia, in line with the government's commitment to strengthening the sharia economy and meeting massive development financing needs. It is crucial to examine how the public responds to sharia financial products like Sukuk, particularly from sociological and anthropological perspectives, to understand how social, cultural, and religious factors influence investment decisions. This study uses a literature review method, combining the findings of similar studies from various scientific sources. Descriptive analysis through this literature review is used to verify previous studies and identify new contributions. The sales of Retail Sukuk SR020 reached Rp21.359 trillion from 63,009 investors. This widespread interest demonstrates society's adaptation, including that of the millennial generation, to sharia investment principles. Sociological data shows cross-gender and cross-generational participation, with millennials dominating the number of investors, while Generation X dominates the order volume7. Anthropologically, this interest illustrates how religious and social norms influence financial decisions. The trading of Sukuk SR020 reflects the social and cultural dynamics of society, as well as a mindset shift from merely saving to investing. This instrument not only serves as an investment tool but also as a reflection of religious and cultural values.
